DBA IOWA CITY FIELDHOUSE CONSISTENT WITH THE AGREEMENT REACHED BETWEEN IOWA CITY FIELDHOUSE AND IOWA CITY POLICE DEPARTMENT. Comment: The Iowa City Police Department cannot recommend approval of the twelve (12) month liquor license renewal application made by Caffrey I.C., Inc. dba Iowa City Fieldhouse (hereinafter "The Fieldhouse ") at this time based on the criminal charges currently pending against one of the owners of The Fieldhouse, related to the willful injury of February 5, 2013 City of Iowa City Page 2 a bar patron, at the bar. These charges are not consistent with the statutory requirements of "good moral character" for liquor license holders. The Police Department wishes for The Fieldhouse to continue operating while they resolve this ownership issue. Police Department command staff met with the City Attorney's office and the owners of The Fieldhouse. As a result, an Agreement has been made between the Police Department and The Fieldhouse ownership for a six (6) month license while the ownership issue is resolved. Resolutions and Motions: ITEM 4d(1) APPROVING DISBURSEMENTS - MOTION TO APPROVE DISBURSEMENTS IN THE AMOUNT OF $15,349,696.12 FOR THE PERIOD OF DECEMBER 1 THROUGH DECEMBER 31, 2012, AS RECOMMENDED BY THE FINANCE DIRECTOR SUBJECT TO AUDIT. DISBURSEMENTS ARE PUBLISHED AND PERMANENTLY RETAINED IN THE CITY CLERK'S OFFICE IN ACCORDANCE WITH STATE CODE. ITEM 4d(2) CEDAR RAPIDS POLICE RANGE USAGE AGREEMENT - /3_a� RESOLUTION AUTHORIZING THE CITY OF IOWA CITY TO ENTER INTO AN AGREEMENT WITH THE CITY OF CEDAR RAPIDS TO PROVIDE FUNDING TO EXPAND AND UPGRADE THE CURRENT CRPD RANGE AND GUARANTEE CERTAIN USAGE RIGHTS WITH THAT FUNDING. Comment: The Iowa City Police Department and other area law enforcement agencies have attempted to locate property to build a local law enforcement range. After years of searching no suitable property has been located. The Iowa City Police Department has been using the CRPD range for several years without a formal agreement. With this formal agreement certain rights will be guaranteed and ICPD will have access to a state of the art facility. A breakdown of funding is as follows; 2012 Byrne JAG $16,726.00 + 2009 Byrne JAG $31,927.00 +Asset forfeiture funding $51,347.00. This item was deferred from the January 22 Council meeting. February 5, 2013 City of Iowa City Page 3 ITEM 4d(3) VOLUNTEER TRANSPORTATION COORDINATOR POSITION - RESOLUTION AUTHORIZING IOWA CITY TRANSIT TO ENTER INTO l3- a7 A MEMORANDUM OF UNDERSTANDING WITH CORALVILLE TRANSIT AND ELDER SERVICES, INC. TO PROVIDE MATCHING FUNDS FOR A NEW FREEDOM GRANT Comment: Iowa City Transit and Coralville Transit have partnered with Elder Services /RSVP in applying for a New Freedom grant through the Iowa Department of Transportation to run through December of 2014. The grant funds a Volunteer Transportation Coordinator with Elder Services for a program that targets those that cannot use the fixed route or paratransit (Johnson County SEATS) services for medical related appointments. The financial impact of authorizing the agreement will be $4,232.00 to the Transit budget for the upcoming year ITEM 4d(4) SUBORDINATION AGREEMENT 1524 SYCAMORE STREET - �3 2g RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND HILLS BANK AND TRUST COMPANY, CORALVILLE, IOWA FOR PROPERTY LOCATED AT 1524 SYCAMORE STREET, IOWA CITY, IOWA. Comment: University of Iowa Community Credit Union has requested that the City approve a Subordination Agreement for property at 1524 Sycamore Street. The owner of the property received funding from the City of Iowa City with Community Development Block Grant Funds. When the project is completed, there will be enough equity to cover the City's lien position. ITEM 4d(5) RELEASE OF LIEN ON 603 GRANT STREET - RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY 13-x9 CLERK TO ATTEST TO THE RELEASE OF LIENS REGARDING A REHABILITATION AGREEMENT AND A MORTGAGE FOR THE PROPERTY LOCATED AT 603 GRANT STREET, IOWA CITY, IOWA. Comment: The owners of the property received assistance through the City of Iowa City Housing Rehabilitation Program. The loan has been paid off; thus the liens need to be released. Setting Public Hearings: ITEM 4e(1) CDBG AMENDMENT FOR FACADE IMPROVEMENTS - MOTION SETTING A PUBLIC HEARING FOR FEBRUARY 19, 2013 REGARDING AN AMENDMENT TO IOWA CITY'S FY13 ANNUAL ACTION PLAN, THAT IS A SUB -PART OF IOWA CITY'S 2011 -2015 CONSOLIDATED PLAN (a.k.a. CITY STEPS). Comment: A public hearing regarding an amendment to the FY13 Annual Action Plan to use $67,000 of CDBG funds for fagade improvements to commercial buildings in the City- University Urban Renewal Area. A 30- day public comment period started on January 18, 2013. ITEM 4e(2) BUDGET PUBLIC HEARING - RESOLUTION SETTING A PUBLIC /3- 33 HEARING ON MARCH 5, 2013 TO DISCUSS THE PROPOSED OPERATING BUDGET FOR THE FISCAL YEAR JULY 1, 2013 THROUGH JUNE 30, 2014, THE PROPOSED THREE -YEAR FINANCIAL PLAN FOR FY2014 — 2016, AND ALSO THE MULTI -YEAR CAPITAL IMPROVEMENTS PROGRAM THROUGH FISCAL YEAR 2017. Comment: This resolution sets a public hearing on March 5, 2013 to discuss the FY2014 Proposed Operating Budget, the three -year Financial Plan for FY2014 — FY2016 and multi -year Capital Improvements Program (CIP) through Fiscal Year 2017. Detailed information on the budget will be available for public inspection on February 15, 2013. February 5,2013 City of Iowa City Page 5 ITEM 4e(3) NEW URBAN RENEWAL AREA - RESOLUTION DETERMINING THE NECESSITY AND SETTING DATES OF A CONSULTATION (February 21) AND A PUBLIC HEARING (March 5) ON A PROPOSED CAMP CARDINAL URBAN RENEWAL PLAN FOR A PROPOSED URBAN RENEWAL AREA IN THE CITY OF IOWA CITY, IOWA Comment: The proposed resolution states that the Council has reasonable cause to believe that the proposed Camp Cardinal urban renewal area satisfies the eligibility criteria for designation as an urban renewal area under Iowa law. The resolution sets the date for a consultation between the taxing entities, February 21, 2013, and notes proper notice and copies of the plan have been provided to such entities, confirms the plan has been duly submitted to the Planning and Zoning Commission for its recommendations, and sets the public hearing on the proposed urban renewal plan for March 5, 2013. The resolution also provides for publication and dissemination of the notice of the public hearing. ITEM 4E(4) HOUSING AUTHORITY'S ANNUAL PLAN PUBLIC HEARING - RESOLUTION SETTING A PUBLIC HEARING FOR APRIL 23, 2013, 13 -3+ FOR THE IOWA CITY HOUSING AUTHORITY'S ANNUAL PLAN FOR FISCAL YEAR 2013 AND DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING. Comment: The Public Housing Authority is required to submit an updated Annual Plan for 2013 under the Quality Housing and Work Responsibility Act of 1998 ( "QHWRA "). The Public Housing Reform Act requires submission of an Annual Plan. The Annual Plan provides details about the Housing Authority's current programs and the residents served, as well as the Housing Authority's strategy for addressing the housing needs currently assisted families and the larger community. The QHWRA requires that the plans be made available to the public for review not later than 45 days before the public hearing is to take place. ITEM 4f. Approval will allow the development of a 3 -lot, commercial subdivision on approximately 8.21 -acres of land located at the northeast corner of the intersection of Prairie du Chien Road and Dodge Street. MOSS RIDGE ROAD ACQUISITION - AUTHORIZING THE ACQUISITION OF PROPERTY RIGHTS FOR THE MOSS RIDGE ROAD PROJECT. Comment: The City of Iowa City must acquire right -of -way, fee title, permanent easements and /or temporary construction easement to construct the Moss Ridge Road Project. This project includes the construction of Moss Ridge Road from N. Dodge Street /Highway 1 to the proposed Moss Ridge Campus @ Rapid Creek Preserve. The project will include roadway, N. Dodge /Highway 1 improvements, sidewalk, sanitary sewer, water main, traffic signals, storm water system, and storm water detention facilities. Our entertainment venues took part in the development of the present law, but the change in law regarding the I -PACT program makes a change appropriate, and the venues have found that their businesses are being hurt by the midnight curfew for their 19 and 20 year old patrons more than they expected. Because the venues have all shown good results in preventing underage drinking in their establishments, staff has faith that management will continue to do well without the curfew.
