Comment: Hills Bank and Trust Company has requested that the City approve a Subordination Agreement for property at 1939 Chelsea Court. Comment: Hills Bank and Trust Company has requested that the City approve a Subordination Agreement for property at 213 Huntington Drive. March 19, 2013 City of Iowa City Page 3 /3 7q ITEM 2d(3) PARTIAL RELEASE SARATOGA SPRINGS - RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE PARTIAL RELEASE OF MORTGAGE FOR THE PROPERTY LOCATED AT 2501, 2505, 2509, 2513, 2519, 2523, 2527, 2559, 2563, 2567, 2531, 2537, 2541, 2545, 2549, AND 2555 CLEARWATER COURT. Comment: On August 2, 1996, Saratoga Springs Limited Partnership executed a mortgage in favor of the City to secure a loan and an agreement for CDBG and HOME funds for the construction of affordable housing. Recently Saratoga Springs Limited Partnership paid the loan, conveyed the property to The Housing Fellowship, and assigned the agreement to The Housing Fellowship. Although the loan has been paid in full, the requirements under the agreement for CDBG and HOME funds do not expire until December 31, 2017. This resolution partially releases the mortgage to reflect that the loan has been paid. ITEM 2d(4) IOWA CITY FIRE STATION NO. 4 - RESOLUTION TO RESCIND RESOLUTION 12 -522 AND ACCEPTING WORK FOR THE IOWA CITY FIRE STATION NO. 4 PROJECT. Comment: Due to a correction of the final cost of this project, this resolution rescinds the previous acceptance on December 18, 2012 (Resolution #12 -522) and recommends acceptance of the project with this revised final cost. The project has been substantially completed in accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Clerk. ❖ Project Estimated Cost: $ 3,021,072.00 ❖ Project Bid Received: $ 2,468,468.00 ❖ Project Actual Cost: $ 2,619,490.29 ITEM 2d(5) POLICE CITIZENS REVIEW BOARD EXTENSION - MOTION GRANTING A 45 -DAY EXTENSION TO THE POLICE CITIZENS REVIEW BOARD FOR THE FILING OF THE PUBLIC REPORT WITH THE CITY COUNCIL ON COMPLAINT #12 -06. Comment: Ordinance 97 -3792 establishes the Police Citizens Review Board and sets forth mechanisms for complaints. The Ordinance also provides the City Council to grant extensions of the 45 -day reporting requirement for good cause. The Board requested a 45 -day extension at their meeting of March 6 and draft minutes included in the March 14 information packet (IP 17). Correspondence included in Council packet. March 19, 2013 City of Iowa City Page 4 ITEM 2d(6) TRANSIT FUNDING APPLICATION - MOTION SETTING A PUBLIC HEARING FOR APRIL 23, 2013 REGARDING THE IOWA DEPARTMENT OF TRANSPORTATION CONSOLIDATED TRANSIT FUNDING APPLICATION FOR IOWA CITY TRANSIT Comment: The Metropolitan Planning Organization of Johnson County will be filing a Consolidated Transit Funding Application on behalf of Iowa City Transit with the Iowa Department of Transportation. In accordance with statutory requirements, this motion will set the public hearing for the April 23, 2013 City Council meeting, and notice published. ITEM 2d(7) DISBURSEMENTS - MOTION TO APPROVE DISBURSEMENTS IN THE AMOUNT OF $13,745,473.02 FOR THE PERIOD OF FEBRUARY 1 THROUGH FEBRUARY 28, 2013, AS RECOMMENDED BY THE FINANCE DIRECTOR SUBJECT TO AUDIT. DISBURSEMENTS ARE PUBLISHED AND PERMANENTLY RETAINED IN THE CITY CLERK'S OFFICE IN ACCORDANCE WITH STATE CODE. 13 $J ITEM 2d(8) SETTING OF PLANNING & ZONING PUBLIC HEARINGS - RESOLUTION REPEALING RESOLUTION NO. 00 -102 OF THE CITY COUNCIL OF THE CITY OF IOWA CITY AND APPROVING A NEW RESOLUTION ESTABLISHING THE ORDER OF BUSINESS FOR FORMAL COUNCIL MEETINGS. Comment: The order of business for formal council meetings is established by resolution and requires all Planning and Zoning matters to be placed together. Currently, all motions setting public hearings, with the exception of those regarding planning and zoning items, are placed on the consent calendar. Staff recommends that the order of business be changed to allow the setting of public hearings on planning and zoning items to be placed on the consent calendar as well. The proposed resolution would change the order of business to allow this starting April 9, 2013. No other changes are being proposed. ITEM 2d(9) WAIVER OF OUTSIDE COUNSEL CONFLICT - RESOLUTION WAIVING A POTENTIAL CONFLICT OF INTEREST FOR SIMMONS PERRINE LAW FIRM. Comment: Simmons Perrine Law firm currently represents the City of Iowa City in a construction litigation matter. Separately, a property owner from whom the City is attempting to acquire property rights for the Westside Levee project wishes to retain their former in -house counsel, now an associate with Simmons Perrine, to represent them in the property acquisition matter. The associate is not involved in representing the City in the construction litigation matter. The City Attorney's Office recommends approval. March 19, 2013 City of Iowa City Page 5 1.3-93 ITEM 2d(10) PURCHASE AGREEMENT - RETIRED K -9 OFFICER TO CURRENT HANDLER - RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND KEVIN BERG FOR THE PURCHASE OF A RETIRED K -9 OFFICER 13-- gA ITEM 2d(11) Comment: This agreement authorizes the execution of an Agreement between Kevin Berg, the current trainer and handler of K -9 Officer Naton, and the City for the purchase of the animal. The Agreement contains an acknowledgment of the responsibility for all costs associated with Naton as well as a waiver and indemnification provision associated with any potential liabilities. CONCRETE CONTRACT APPROVAL - RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR PROVISION OF CONCRETE PRODUCTS TO THE CITY. Comment: Various divisions of the City utilize raw concrete for projects. The vast majority is used by the Streets division for street repair. The concrete was put out to bid, and the lowest unit price bid was from Iowa City Ready Mix. Based on past usage, the contract expenditures for the year will exceed the City manager's $150,000 purchase authority for commodities, so approval from City Council is required. ITEM 2e. Approval will allow the establishment of a concrete recycling and processing plant on this property. Comment: This project will include the construction of an open outdoor Park Shelter in lower City Park. APPEAL MOBILE VENDING CART - APPEAL OF D9NIAL OF APPLICATION FOR PERMIT TO OPERATE A MOBILE VENDING CART ON CITY PLAZA OR IOWA AVENUE. Comment: Mohamed Abbas along with his business partner, Alsaddig Elsemeih, submitted an application for a mobile vending permit. The City Code allows staff to issue six vending permits. The City received nine applications, and staff denied three and granted six. In a letter dated March 5, 2013 staff denied their application. In accordance with the City Code, Mr. Abbas and Mr. Elsemeih filed an appeal to the City Council. The packet includes a memorandum from staff, the application, the denial letter, the appeal, the administrative rules, and a letter to the applicant informing the applicant of the City Council hearing. a. AMPLIFIED SOUND IN CITY PARKS - ORDINANCE AMENDING TITLE 10 OF THE CITY CODE, ENTITLED "PUBLIC WAYS AND PROPERTY," CHAPTER 1, ENTITLED "PARADES AND PUBLIC ASSEMBLIES," TO ALLOW STAFF TO APPROVE AMPLIFIED SOUND IN CITY PARKS. (FIRST CONSIDERATION) Comment: The City Code presently does not allow parade and public assembly permittees to use amplified sound except if the event is a community -wide event that reasonably expects to draw more than 500 persons or occupy a substantial area within City Plaza. Although this limitation was designed to limit amplified sound in City Plaza specifically and the downtown generally, it also applies to permits issued for City parks. This ordinance allows the Director of Parks and Recreation Department to approve amplified sound in parks pursuant to administrative rules. � �c A Action: March 19, 2013 City of Iowa City Page 11 ITEM 8.
