Harvat Hall, 410 E. Washington Street, Iowa City, Iowa, or if said meeting is cancelled, at the next meeting of the City Council thereafter as posted by the City Clerk; at which hearing the Council will consider: 1) An amendment to the Comprehensive Plan - South District Plan to change the land use designation from Multifamily to General Commercial for property located at the southeast corner of the intersection of Highway 6 and Broadway Street. 2) An ordinance conditionally rezoning property from Commercial Office (CO -1) zone to Community Commercial (CC -2) zone and amending the conditional zoning agreement for approximately 2.31 -acres of property currently zoned CC -2 and CO -1 located at the southeast corner of the intersection of Broadway Street and Highway 6. 3) An ordinance conditionally rezoning approximately 7.09 acres to amend the Sensitive Areas Development Plan to allow a reduction in the previously approved wetland buffer on property located adjacent to 2845 Mormon Trek Boulevard. 4) An ordinance rezoning approximately 27.8 acres located west of Mormon Trek Boulevard and north of Hawkeye Park Road from Institutional Public (P -2) to Institutional Public /Medium - Density Multi - Family (P- 2 /RM -20). 5) An ordinance amending Title 14: Zoning to define rooming house cooperatives as a type of fraternal group living use and to specify that fraternal group living uses are allowed by special exception in the RNS- 20 zone and to modify the residential density and parking standards for said uses to be consistent with the density and parking standards for multi - family uses. 6) An ordinance amending Title 14: Zoning Code to establish parking location standards and entranceway standards that will reduce the visual impact of structured and surface parking areas along residential streets in multifamily zones. 7) A resolution for a voluntary annexation of approximately 2 acres of property located near the northeast corner of Scott Boulevard and American Legion Road. 8) An ordinance conditionally rezoning approximately 2 acres from County Residential (R) and approximately 2.83 acres from Low - Density Single - Family Residential (RS -5) to Low - Density Multi - Family Residential (RM -12) located at east of Scott Boulevard and north of Muscatine Avenue and American Legion Road. I cannot attend tonight's meeting, so I kindly request by the present email that new changes in Zoning be applied to this construction. I urge this project to go through the Special Exception process that the developer might be attempting to evade. I urge the Council to request from the developer that the changes include all proposed and future projects. I live in an area where "stabilization" is much needed and appreciated, I would hate to see all the work the city has already put into the stabilization of my neighborhood undone, even partially. If the house on the corner of Governor and Burlington Streets must be torn down let's make sure what replaces it is in the best interests of more than just the developer, no special exceptions. Governor St. Marian Karr From: Suzanne Bentler <su- bent @hotmail.com> Sent: Tuesday, April 23, 2013 1:15 PM To: Council Subject: A voice in support of Item 7g Hello City Council members: I am writing to urge you all to vote to approve Item 7g on tonight's council agenda which is a zoning amendment that reads: AMENDING TITLE 14: ZONING TO DEFINE ROOMING HOUSE COOPERATIVES AS A TYPE OF FRATERNAL GROUP LIVING USE AND TO SPECIFY THAT FRATERNAL GROUP LIVING USES ARE ALLOWED BY SPECIAL EXCEPTION IN THE RNS -20 ZONE AND TO MODIFY THE RESIDENTIAL DENSITY AND PARKING STANDARDS FOR SAID USES TO BE CONSISTENT WITH THE DENSITY AND PARKING STANDARDS FOR MULTI- FAMILY USES. By a vote of 7 -0, the Planning and Zoning Commission recommended approval of this zoning code amendment. As a homeowner and landlord in an older neighborhood near the central part of the city, I strongly encourage you to approve this amendment. As I understand it, this vote impacts rooming house cooperatives and fraternal group living which may include proposed and future projects in our neighborhood, specifically one advertised as a future fraternity at the corner of Governor Street and Burlington Street. Our neighborhood is one of the areas targeted in the Comprehensive and Strategic Plans for neighborhood stabilization. The neighborhood has worked hard over many years to promote the goal of neighborhood stabilization in this region through two successful rezoning efforts and a historic conservation designation. The community has joined this effort by including this area in the UniverCity Neighborhood Partnership Program which has helped to promote positive improvements in the neighborhood and continue the trend of stabilization. The amendment before you, if approved, will serve to fill a loophole in the current zoning that is counter to your stated goals as provided in the city's comprehensive and strategic plans. Please approve this amendment with the consideration that all currently proposed and future projects be subject to the changes. We love our home and our neighborhood school, and accept that living near downtown comes with some of the negative consequences tied to living around and among so many homes used for student housing. We don't always love dealing with those consequences, but we do accept them because of the neighborhood improvements we've seen over the time we've been there. I must say that I have been pleased with the increased stabilization of our neighborhood as a result of the historic conservation designation, changes to the zoning of the neighborhood, and the UniverCity neighborhood partnership. All of these things have brought many young families into the area, most with the energy and desire to continue to improve their homes (and ultimately the neighborhood). It has recently come to my attention that a fraternity house is being proposed for the lot on the corner of Burlington and South Governor Streets. This, without restriction, seems to counter much of the progress and stabilization of our neighborhood. Two homes on the lot are currently labeled for demolition, and that process appears to be underway. I must say that the removal of the asbestos siding on the historic home has uncovered the beautiful original details of the home underneath. In a perfect world, I would ask that the home be restored instead of demolished., However, I do understand that the process may be too far along to stop the demolition from happening. If that is the case, I would like to state my support for the proposed changes to the zoning code, as outlined in item 7g. I feel that it is the least we can do to continue to try to protect our older central neighborhoods. I would like to thank you for your time and consideration of this matter. Your support would mould mean a lot, not only to my family, but to many of the residents of the neighborhood. I'd like to urge your support for the RNS -20 zone amendments. These will strengthen and support neighborhoods -- typically fragile ones -- in which housing cooperatives and fraternal organizations might choose to locate. Specifically, requiring fraternal organizations to go through the Special Exception Process will enable the neighborhood and the City to have more input in any potential developments. The lower occupancy standards will, naturally, assist in helping impacted neighborhoods maintain the balance of long- and short-term residents. Your support would be most appreciated. An increase in the number of fraternities and sororities in this zone would seem to be in obvious contradiction to the effort to stabilize the neighborhood, through efforts of zoning code changes and the UniverCity program. I recently purchased a house through this program that is very close to multiple fraternities /sororities. The inclusion of yet another fraternity in this area (Governor /Burlington) that is already dense with these buildings is saddening, for reasons I hope are obvious. So any efforts to limit the scope of the size of this development (and any future ones) would be consistent with the City "Strategic Plan" and met with relief from coextensive home owners.
