Notice is hereby given that a public hearing wilt
be held by the City Council of Iowa City, Iowa, at
7:00 p.m. on the 23rd day of April, 2013, in Emma
J. Harvat Hall, 410 E. Washington Street, Iowa
City, Iowa, or if said meeting is cancelled, at the
next meeting of the City Council thereafter as
posted by the City Clerk; at which hearing the
Council will consider.
1) An amendment to the Comprehensive
Plan - South District Plan to change the
land use designation from Multifamily to
General Commercial for property located
at the southeast comer of the intersection
of Highway 6 and Broadway Street.
2) An ordinance conditionally rezoning
property from Commercial Office (CO -1)
zone to Community Commercial (CC -2)
zone and amending the conditional zoning
agreement for approximately 2.31 -acres of
property currently zoned CC -2 and CO -1
located at the southeast comer of the
intersection of Broadway Street and
Highway 6.
3) An ordinance conditionally rezoning
approximately 7.09 acres to amend the
Sensitive Areas Development Plan to
allow a reduction in the previously
approved wetland buffer on property
located adjacent to 2845 Mormon Trek
Boulevard.
4) An ordinance rezoning approximately
27.8 acres located west of Mormon Trek
Boulevard and north of Hawkeye Park
Road from Institutional Public (P -2) to
Institutional Public/Medium- Density Multi -
Family (P- 2/RM -20).
5) An ordinance amending Title 14: Zoning
to define rooming house cooperatives as a
type of fraternal group living use and to
specify that fraternal group living uses are
allowed by special exception in the RNS-
20 zone and to modify the residential
density and parking standards for said
uses to be consistent with the density and
parking standards for multi - family uses.
6) An ordinance amending Title 14: Zoning
Code to establish parking location
standards and entranceway standards that
will reduce the visual impact of structured
and surface parking areas along
residential streets in multifamily zones.

CONDITIONAL ZONING AGREEMENT
THIS AGREEMENT is made between the City of Iowa City, Iowa, a municipal corporation
(hereinafter "City "), Allen Homes, -,_(_hereinafter "Applicant ") and Sally Hall and Hieronymus
Family Partnership LLP (hereinaft r collectively "Owners "). ,

4. In consideration of the City's rezoning the ubjeot property, Owners and Applicant agree
that development of the subject property will; conform to all other requirements of the
zoning chapter, as well as the following co (ions:
a. Prior to receiving a building permit,fok development of dwelling units on the subject
property, Owners or Applicant :hall ay $36,653 to cover 12.5% of the cost of
improving American Legion Road fro tage adjacent to the subject properties to
City street standards, or provide a lette of credit for the same; and
b. Prior to receiving an occupancy per it for a building on the subject property,
Owners or Applicant shalt install an 8- oot wide sidewalk (the City will promptly
reimburse Owners /Applicant for 3 feet of the required 8 -foot width) along the
property's frontage with Scott Boulevard; nd

Owners or Applicant shall install a 5 -foo wide temporary sidewalk according to

terms of this Conditional Zoning Agreeient.

a covenant running with the land and with title to the land, and shav remain in full force
and effect as a covenant running with title to the land, unless or u it released of record
by the City of Iowa City.
The parties further acknowledge that t9s t ' agreement shall inure o the benefit of and bind
all successors, representatives, and ssigns of the parties.
8. The Owners and Applicant ackn wledge that nothin in this Conditional Zoning
Agreement shall be construed to reli ve the Owners or pplicant from complying with all

The subject properties, located in the flood plain, sustained significant damage in the flood of
2008. These homeowners decided to sell their properties to the City as part of the FEMA- funded
Hazard Mitigation Grant Program or CDBG- funded flood buy -out program. FEMA restricts future
use of land purchased as part of this program to public open space. The houses located at 515,
527, 539 Normandy Drive and 822, 930 Park Road have been demolished, while the house at 820
(the Ned Ashton House, listed on the National Register of Historic Places) has been purchased by
the City but will not be demolished.
ANALYSIS:
Current and proposed zoning: RS -5 zoning primarily provides housing opportunities for
V,
individual households, although allows some flexibility in dwelling types. RS -5 zoning can feature
some non - residential uses that contribute to the livability of residential neighborhoods, such as
parks. P -1 zoning serves as a notice of public ownership (County, City or Iowa City Community
School District) and use of the land (parks, schools, police station, etc.).
Compatibility with neighborhood: Given the high proportion of properties in the immediate
surrounding area that have been purchased by the City and demolished, and the proximity to
City Park, staff believes the rezoning proposal would be compatible with the neighborhood.
Most of the houses to the north and northeast of the subject properties, along Normandy Drive,
Eastmoor Drive and Manor Drive, have been purchased by the City and demolished. Properties
to the east and south of the subject properties are not located in the floodplain and have not
been purchased by the City.
Design of the park proposed for the subject properties has not yet been completed, although
the Ned Ashton House would remain as a focal point. The Ned Ashton House, known for its
architectural significance and designed to minimize flood damage, will be maintained as a
reception hall open managed by the Parks and Recreation Department. It is listed on the
National Register of Historic Places and designated as an Iowa City Historic Landmark. Any
significant changes to the property will be reviewed by the Historic Preservation Commission.
The house at 816 Park Road, at the northwest corner of Park Road and Normandy Drive, has
not been purchased by the City, but has a significant landscape buffer to separate it from the
proposed public use.
STAFF RECOMMENDATION:
Staff recommends approval of REV 3- 00013, a City- initiated proposal to rezone approximately
5.23 acres of property located at 515, 527, 539 Normandy Drive and 820, 822, 930 Park Road
from RS -5 to P -1.

Discussion of Work Program
The Commission discussed work program priorities for the coming year. The issues they agreed
on were:
1. Draft Mixed Use Zones for Riverfront Crossings/Towncrest Area
2. Parking Standards for the Downtown and Riverfront Crossings
3. Neighborhood Stabilization, Private Dorms, Open Space Setback, Backyard Paving,
RNS -20 zone
4. CB -10 Standards
5. Review 500 foot separation of bars in outlying areas
6. Amendments to CI -1 and CC -2 zones
7. Clean -up standards for the PRM Zone that have become obsolete with the recent
amendments to the MF density standards
8. Amend sign code to allow canopy roof signs in more locations and adjust standards for
projecting signs
9. Comprehensive Plan implementation
10. Consideration of protections for Downtown historic properties
It was noted that some of the less complex items, such as numbers five and six, might be
completed prior to the higher priority projects due to the amount of research needed.

The purpose of the rezoning it to create parkland including the Ned Ashton property and the surrounding
properties that were purchased as part of the flood buyout program. The plan is to convert the Ashton House
into a small special events facility to be operated by the Parks and Recreation Department. It is anticipated that
it will be used for weddings, family reunions and small conferences. There will be a parking lot for
approximately 35 cars to accommodate users of the Ashton House. Because it is on the National Register of
Historic Places and an Iowa City Landmark, any changes to the Ashton property will be reviewed by the Iowa City
Historic Preservation Commission to assure that they do not detract from its historic appearance.
