Resolutions and Motions: ITEM 4d(1) TRANSIT TITLE VI PLAN - EXCEPTING IOWA CITY TRANSIT FROM THE IOWA CITY TITLE VI COMPLIANCE PLAN AND APPROVING A TRANSIT - SPECIFIC TITLE VI PROGRAM PLAN Comment: Title VI of the Civil Rights Act of 1964 prohibits discrimination based on race, color or national origin by agencies in any programs and activities that receive federal funds. In 2011, City Council adopted the City of Iowa City Title VI Compliance Plan with Resolution No. 11 -301. The Federal Transit Administration (FTA) mandates that each recipient of federal funds incorporate a transit specific Title VI Program Plan to endure compliance with Title VI laws. Iowa City Transit receives annual operating funds from FTA of nearly $1.1 million. ITEM 4d(2) EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG) - AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO 39 ATTEST AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF IOWA CITY AND JOHNSON COUNTY, IOWA, FOR THE APPLICATION AND ADMINISTRATION OF ANY AWARDED EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARDS Comment: The Iowa City Police Department, in partnership with the Johnson County Sheriff's Office, is making application for the 2013 Edward Byrne Memorial Justice Assistance Grant (JAG) program administered by the U.S. Department of Justice. The Departments were notified that they were eligible for a total of $26,624.00. In accordance with past practice and the application process, the parties have agreed to split the award 52% for Iowa City ($13,844) and 48% to Johnson County ($12,780), and that the City of Iowa City will take responsibility for the application and management of this grant under the terms of the interlocal agreement. June 18, 2013 City of Iowa City Page 3 ITEM 4d(3) SENIOR CENTER JOHNSON COUNTY GRANT AGREEMENT - f ,0I AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A GRANT AGREEMENT WITH JOHNSON COUNTY FOR FUNDS TO SUPPORT THE IOWA CITY/ JOHNSON COUNTY SENIOR CENTER. Comment: This resolution approves a one - year $59,224 grant agreement from Johnson County to support the operating expenses of the Center in FY14. As in the past, funds received will be used to support operations, such as community outreach programming, Senior Center Television, and the senior nutrition and home delivered meal programs serving older adults throughout the county. The grant agreement is attached to the resolution. GILBERT STREET) - ACCEPTING THE WORK FOR THE SANITARY SEWER 3 -d� PUBLIC IMPROVEMENTS FOR AUDITOR'S PARCEL 2009032, ADDRESSED 2530 S. GILBERT STREET, AND DECLARING THE SANITARY SEWER OPEN FOR PUBLIC USE. Comment: See Engineer's Report. ITEM 4d(6) ENGINEERING DIVISION BUDGETED POSITIONS - RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE ENGINEERING DIVISION OF THE PUBLIC WORKS DEPARTMENT BY ADDING ONE 13 - J0 3 FULL -TIME SENIOR CIVIL ENGINEER POSITION AND DELETING ONE FULL -TIME CIVIL ENGINEER POSITION. Comment: This resolution changes a Civil Engineer position to Senior Civil Engineer position. The Capital Improvement Plan has increased from $113 million as shown in the 2008 Financial Plan to over $251 million in the 2014 Financial Plan and it now relies more heavily on state and federal funding sources, requiring specific administrative, tracking and reporting obligations. This increase allows the Iowa City Engineering Division to promote a Civil Engineer to Senior Engineer to better manage this workload. r ��•',. ®, CITY OF IOWA CITY MEMORANDUM* TO: Mayor, City Council, General Public FROM: City Clerk RE: June 18, Agenda, Revision /Additions CONSENT CALENDAR -- - -- - ITEM 4d(4) REVISION: ASHTON HOUSE REMODELING PROJECT - AWARDING \ CONTRACT AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR THE ASHTON HOUSE REMODELING PROJECT Comment: Bids for this project were opened on Friday, June 14, 2013 and the following bids were received: Iowa State Contractors Ottumwa $199,000 Selzer - Werderitsch Associates Iowa City $278,950 Calacci Construction Iowa City $359,145 Engineer's estimate: $225,000.00 The Parks and Recreation Department recommends award of the contract to Iowa State Contractors. The project will be funded with GO Bonds. ITEM 4f(6) NO PARKING ANY TIME signs on both sides of Waterfront Drive south of Main Street and Installation of NO PARKING 5 PM — 8 AM signs on west side of Waterfront Drive between Southgate Ave. and Main Street: ADDITIONS: Correspondence received from Matt Neely, Craig Dahlen ITEM 4f(7) (ADDITION) Nancy Adams - Cogen: Early Mornings at Trinity Episcopal Church ITEM 7a (ADDITION) PARATRANSIT SERVICE CONTRACT - REPEALING RESOLUTION NO. 13 -196 AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST REVISED 28E AGREEMENT BETWEEN THE CITY OF IOWA CITY AND JOHNSON COUNTY FOR THE CONTRACTING OF PARATRANSIT SERVICE WITHIN THE CORPORATE LIMITS OF IOWA CITY Comment: Council previously approved an earlier version of a 28E Agreement between the County and the City for provision of paratransit service. However, while issues of public interest were not in dispute, substantive changes have been made to the contract, including indemnification and renegotiation in the event of substantial changes in operation costs, such that Council approval of the revised Agreement is necessary. This resolution repeals the earlier version and approves an Agreement substantially similar in substance to the attached version. June 18, 2013 City of Iowa City Page 4 ITEM 4d(7) RELEASE OF LIEN - AUTHORIZING THE MAYOR TO SIGN AND THE ia'' a4 CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING AN AGREEMENT WITH HAWKEYE AREA COMMUNITY ACTION PROGRAM (HACAP), IOWA CITY, IOWA. Comment: The owner received assistance through the City of Iowa City's Community Development Block Grant (CDBG) funds to purchase eight (8) properties located at 1958 Broadway Street, Unit 5A; 1960 Broadway Street, Unit 8A; 912 Benton Drive, Unit 11; 812 Benton Drive, Unit 32; 810 Benton Drive, Unit 32; 904 Benton Drive, Unit 14; 1960 Broadway Street, Unit 9A; and 802 Westwinds Drive, Unit 6. The terms of the Agreement have been satisfied; thus the lien needs to be released. ITEM 4d(8) SUBORDINATION FOR 1814 LAKESIDE DRIVE - AUTHORIZING THE 13-- .20 -Is MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO A SUBORDINATION AGREEMENT BETWEEN THE CITY OF IOWA CITY AND MIDWESTONE BANK, IOWA CITY, IOWA FOR PROPERTY LOCATED AT 1814 LAKESIDE DRIVE, IOWA CITY, IOWA. Comment: MidWestOne Bank has requested that the City approve a Subordination Agreement for property at 1814 Lakeside Drive. On November 15, 2012, the owner of the property received funding from the City of Iowa City using Community Development Block Grant (CDBG) funds. The property has enough equity to cover the City's lien position. ITEM 4d(9) MAY DISBURSEMENTS - APPROVING DISBURSEMENTS IN THE AMOUNT OF $15,730,982.16 FOR THE PERIOD OF MAY 1 THROUGH MAY 31, 2013, AS RECOMMENDED BY THE FINANCE DIRECTOR SUBJECT TO AUDIT. DISBURSEMENTS ARE PUBLISHED AND PERMANENTLY RETAINED IN THE CITY CLERK'S OFFICE IN ACCORDANCE WITH STATE CODE. ITEM 4e. Setting Public Hearings: ITEM 4e(1) MOSS GREEN URBAN VILLAGE URBAN RENEWAL PLAN - /-3 - DETERMINING THE NECESSITY OF AND SETTING DATES OF A CONSULTATION (JUNE 26, 2013) AND PUBLIC HEARING (JULY 23, 2013) ON A PROPOSED AMENDMENT NO. 1 TO THE MOSS GREEN URBAN VILLAGE URBAN RENEWAL PLAN IN THE CITY OF IOWA CITY, IOWA Comment: A Resolution of Necessity is required as a preliminary step to amending an Urban Renewal Plan. Recent state code changes require that urban renewal plans must be amended to include potential urban renewal projects. Projects included in this amendment include the construction of Moss Ridge Road (for which the City received a $1.9 Million RISE grant) and potential office building developments. This Resolution of Necessity for Amendment #1 to the Moss Green Urban Village Urban Renewal Area sets the dates of a consultation to be held with other taxing jurisdictions in the county and for a Public Hearing on the proposed amendment. June 18, 2013 City of Iowa City Page 5 ITEM 4e(2) HIERONYMUS / KUM AND GO COMPREHENSIVE PLAN - SETTING A PUBLIC HEARING FOR JULY 23 ON A RESOLUTION TO AMEND THE COMPREHENSIVE PLAN - SOUTHEAST DISTRICT PLAN TO CHANGE THE LAND USE DESIGNATION FROM MULTI - FAMILY TO COMMERCIAL FOR PROPERTY LOCATED AT THE NORTHWEST CORNER OF THE INTERSECTION OF MUSCATINE AVENUE AND SCOTT BOULEVARD. (CPA13- 00002) Comment: At its June 6 meeting, by a vote of 0 -6 (Thomas absent), the Planning and Zoning Commission recommended denial of this amendment to the Comprehensive Plan. Approval will allow this property to be considered for commercial uses rather than residential development. ITEM 4e(3) HIERONYMUS / KUM AND GO REZONING - SETTING A PUBLIC HEARING FOR JULY 23 ON AN ORDNANCE TO REZONE 0.85 - ACRES FROM LOW DENSITY SINGLE - FAMILY (RS -5) ZONE AND 2.87 -ACRES FROM LOW DENSITY MULTI - FAMILY (RM -12) ZONE TO COMMUNITY COMMERCIAL (CC -2) ZONE FOR PROPERTY LOCATED NORTH OF MUSCATINE AVENUE, WEST OF SCOTT BOULEVARD. ITEM 4e(4) CHEZIK- BELL AUTO DEALERSHIP REZONING - SETTING A PUBLIC HEARING FOR JULY 23 ON AN ORDNANCE TO AMEND THE CONDITIONAL ZONING AGREEMENT REGARDING SETBACK AND LANDSCAPING FOR 2.3 -ACRES OF LAND LOCATED SOUTHEAST OF THE INTERSECTION OF HIGHWAY 1 AND SUNSET STREET IN THE INTENSIVE COMMERCIAL (CIA) ZONE. (REZ13- 00014) Comment: At its June 6 meeting, by a vote of 6 -0 (Thomas absent), the Planning and Zoning Commission recommended approval of this amendment to the Conditional Zoning Agreement, subject to there being three varieties of trees and larger landscaping beds in the two corners adjacent to Highway 1. Approval will allow the setback to be reduced from 30 feet to 11 feet, but with enhanced landscaping along the frontage of the property. ITEM 4e(5) AMENDMENT TO ALLOW SCHOOLS IN THE CC -2 ZONE - SETTING A PUBLIC HEARING FOR JULY 23 ON AN ORDNANCE AMENDING TITLE 14: ZONING CODE TO ALLOW SCHOOLS OF GENERALIZED INSTRUCTION BY SPECIAL EXCEPTION IN THE COMMUNITY COMMERCIAL (CC -2) ZONE. Comment: At its June 6 meeting, by a vote of 6 -0 (Thomas absent), the Planning and Zoning Commission recommended approval of this amendment to the Zoning Code. Approval will allow schools of generalized instruction (primary and secondary schools) in the CC -2 zone by special exception. June 18, 2013 City of Iowa City Page 6 ITEM 4e(6) AMENDMENT TO MODIFY AREA SPACING BETWEEN DRINKING ESTABLISHMENTS - SETTING A PUBLIC HEARING FOR JULY 23 ON AN ORDNANCE AMENDING TITLE 14: ZONING CODE TO MODIFY THE REGULATIONS REGARDING THE SPACING OF DRINKING ESTABLISHMENTS SO THAT THE 500 -FOOT SPACING RULE WOULD ONLY APPLY TO THE UNIVERSITY IMPACT AREA AND THE RIVERFRONT CROSSINGS DISTRICT. Comment: At its June 6 meeting, by a vote of 2 -4 (Eastham, Dyer, Swygard and Theobald voting no, Thomas absent), the Planning and Zoning Commission recommended denial of this amendment to the zoning code to modify the 500 -foot spacing requirement for drinking establishments. 3 db� ITEM 4e(7) MOSS RIDGE ROAD CONSTRUCTION - SETTING A PUBLIC HEARING ON JULY 23, 2013 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE MOSS RIDGE ROAD PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project will include the construction of a street from Highway 1 to Moss Ridge Campus at Rapid Creek Preserve, N. Dodge Street / Highway 1 improvements, sidewalk, sanitary sewer, water main, traffic signals, and storm sewer system. The estimated construction cost is $3,520,000 and will be funded with General Obligation bond proceeds, tax increment financing, and RISE Grant funds. June 18, 2013 City of Iowa City Page 8 ITEM 7.L 2013 WILLIAM STREET STREETSCAPE - PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE 2013 WILLIAM STREET STREETSCAPE PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project involves improvements within the William Street public right - of -way between Muscatine Avenue and Towncrest Drive. The project improvements will include the reconstruction of William Street, on- street perpendicular parking, sidewalks, the removal and replacement of the existing water main, and streetscape improvements such as site furnishings, plantings, lighting, and a gateway sign. RESIDENTIAL WASTE CONTAINERS — AMENDING TITLE 16, Ick "PUBLIC WORKS," CHAPTER 3, ENTITLED "CITY UTILITIES," AND TITLE 17, ENTITLED "BUILDING AND HOUSING," CHAPTER 5, ENTITLED, "HOUSING CODE," TO REQUIRE THAT WASTE CONTAINERS BE STORED WITHIN TWO FEET OF A BUILDING WALL OF A RESIDENTIAL STRUCTURE. (FIRST CONSIDERATION) Comment: The ordinance amends the housing code and solid waste ordinance to require storage of residential solid waste, yard waste, and recycling containers to be within two feet of a residential building wall. If the trash container storage area becomes a nuisance, then the City could requires trash container storage areas to be enclosed /screened as a means to resolve a nuisance.
