Re: Permit Fees - Public Assembly/Parade Permits
Introduction:
The City Manager's Office has been involved with approving public assembly and parade permits. These
permits are used by many organizations and individuals to plan gatherings, races, marches, and other
events.

It has been past practice that the City Manager's office receives, distributes, and approves public
assembly and parade permits for the general public. Any event held outside of city parks is under the
jurisdiction of the City Manager's Office. When a permit comes in for approval, the Manager's Office
sends copies of the permit to various departments which is then reviewed by staff prior to approval.
After all comments are received, the Manager's Office collects and ensures that any issues with the event
are followed prior to final approval of the permit. It has been the case in the past, that staff has dedicated
a significant amount of time in ensuring that events are safe and protect the public. With over 150 permit
applications submitted on average (increasing per year), the time it takes to review permits and assist with
safety concerns, can be considerable.
Furthermore, it has also been the case that staff has reviewed a permit application and then the applicant
pulls the permit. The administrative costs for reviewing the permit are not recovered in this case.
Discussion of Solutions:
The average time spent by staff to review public assembly permits is approximately 14 -18 hours per
week. With a conservative hourly rate of $25 per hour for staff time, the total cost -time comparison is
approximately $350 -$450 per week ($17,500- $22,500 per year). The majority of staff time reviewing
permits is devoted to events larger than 500 people or racing events that require the review and
coordination from the Iowa City Police Department. For these events, it is not uncommon for city staff to
spend a disproportional amount of time (over 10 hours, depending on the need to meet with the
organizers) on reviewing those permits relative to smaller events.
Implementing a cost recovery model for events that require significant administrative time will reimburse
the city for costs associated with individual events throughout the community.
Fiscal Impact:
The cost -time comparison for one year's worth of staff time dedicated to reviewing Public
Assembly/Parade permits is conservatively $17,500- $22,500. The following table highlights how the
addition of fees ($50) will recover costs given a requirement of more than a 1 hour review per permit.

As the table notes, the cost - recovery model shows a maximum of a 52% recovery of staff time. Monies
generated from this model would be routed to the general fund for general property tax relief.
Recommendation:
Staff would recommend researching and proposing a fee structure that aims to achieve a cost recovery
model to recoup costs associated with events that require significant administrative time.

Development Phase Plans
The City of Iowa City has received funding from the Federal Emergency Management Agency
(FEMA) to construct a new Animal Center to replace the previous facility damaged by the 2008
Flood of the Iowa River. The City has approval from FEMA to proceed with an improved project
and timeline for the selected site. The City staff worked with architecture firm Neumann Monson
PC on design development plans for a new facility. The design development plans are now
complete and are ready to be submitted to FEMA for review.
The former Animal Control Facility was damaged beyond repair in the 2008 flood. Operations
since the flood have been housed in a rented facility south of town.

The future Animal Center will be located on City property west of the Salt Storage structure at 3910
Napoleon Lane. This site has been approved by the Federal Emergency Management Agency
(FEMA) for relocation.
28e agreements with neighboring jurisdictions are in place for proportional funding of the facility,
based on a three -year average of animal intakes. Project costs, less FEMA reimbursements and
Friends of the Animal Center fundraising, will be shared with Johnson County, Coralville, University
Heights, and the University of Iowa. The City is solely absorbing the cost the property.
The total project budget is $3 million and excluding fees and soft costs the construction budget is
approximately $2.6 million. The following goals have been established for the project, to the extent
that they can be achieved within the budget:
• A functional, efficiently operable facility
• Strong durable, lasting materials with low life cycle costs
• Meeting the animal care and capacity needs, by following the 2010 Guidelines of standards
of care in Animal Shelters, by the Association of Shelter Veterinarians
• Safety of staff, volunteers and the public
• A sustainable approach to the design
While the building design has encompassed many sustainable goals, including creative approaches
in working with MidAmerican Energy with system bundling packages, the facility will not be a LEED
certified building and LED lighting and a geothermal system will not be incorporated into the
building package due to budget constraints.
Pending FEMA approval of the design development plans, the next step in this process is to
proceed with producing plans and specification for bidding.

existing GSA building located at 400 S. Clinton Street to a site yet to be identified. As part of this project, a
new "right- sized" retail customer services facility would be secured in the same general vicinity and internal
carrier operations would be split between the new space and existing owned space located in nearby Coralville.
After further assessment and input from community members during the August 70' meeting, the Postal Service
has decided to proceed with this relocation project. In the near future, we will be reviewing potential sites for
the new Postal facility. Our preference is to relocate to an existing building rather than seek a new construction
option. In accordance with postal regulations, we will continue to keep your office and the community informed
of any progress.

It was a pleasure meeting you, other leaders of the community, and citizens of Coralville who attended the
meeting held on August 7, 2013. As stated in the meeting, the Postal Service proposed relocating from the
existing postal facility located at 420 10`x' Avenue to the postal owned facility located at 2150 James Street. As
stated, the move of the Coralville facility is part of a larger project that involves nearby Iowa City's Post Office.
Specific to Coralville, it was proposed that retail customer service and carrier operations would be relocated in
its entirety to the existing owned property on James Street.
After further assessment and input from community members during the August 7t` meeting, the Postal Service
is re- evaluating its options in regards to the retail customer service portion of the plan. We have decided to
proceed with the overall project in regards to relocating operations to the James Street facility; however, we will
continue to review the best course of action regarding the retail customer service for the citizens of Coralville. I
will be in contact with your office soon to discuss this issue further.

Re: Response to Mary Gravitts comments at City Council meeting 8/20/13
This is a response to Mary Gravitts remarks during the community comment portion of the
August 20, 2013 City Council meeting. Gravitts stated that Senior Center's registration software,
Active.net, misidentified her friend's address which resulted in doubling her membership fee.
Membership fees are processed through Active.net, a software program which utilizes a
Geographic Information System (GIS) provided by Johnson County to identify residency.
Occasionally the system does not recognize an address and further investigation from staff is
required.
In researching this issue I found that the member Gravitts was referring to in her comments
resides at an address that is not recognized by the GIS. Because the member was eligible for
The Center's low- income scholarship program she paid $10 for membership, the lowest rate
available. Further investigation of this address was done after the transaction was complete. In
the event the participant did not qualify for the discounted rate staff would have pursued the
issue before collecting the membership fee.

The seventh annual Rummage in the Ramp is over and was a huge success!
The event continues to be a popular, win -win event for the City, non - profits and
the public. Each year we receive great press about the event and have
capitalized on that to help encourage the public to reduce, reuse, and recycle,
not only for Rummage in the Ramp, but year- round. This year we received
feedback from the Refuse Division and from several citizen "scavengers" that the
curbs were cleaner.
This year, we had 30 local organizations participate with over 240 volunteers.
The organizations split the profits from sales; groups will each receive a check for
$725 for their four hour shift. The City retained about $350 to cover advertising
and disposal costs. About 250 staff hours are utilized to plan and execute the
event and do follow -up analysis and reporting. Below are some statistics from the
six years the event has been held.

Rummage in the Ramp 2013 was held in the lower level of Chauncey Swan
Parking Ramp from Friday, July 26 through Saturday, August 3. This was the
seventh year for the event, which was introduced in 2007 as an effort to keep
reusable household items out of the Iowa City Landfill and redistribute them to
households who could reuse them. The event is always scheduled in late
July /early August, when annual lease turnovers occur. Other goals of.the project
include:
• Improving neighborhood relations between single - family homeowners and
renters "~
• Utilizing the sales events to provide a way for low- income families, who may
not be able to afford new items, to purchase furniture and household goods
• Creating a fundraiser for local environmental groups and human service
agencies
• Reducing the workload of City refuse workers and private waste haulers

Since 2008, the Iowa City housing Authority and the Iowa City VA Medical Center have
partnered in the HUD -VASH program to pair housing for at -risk veterans and veteran families
with supportive services. Our original and ongoing funding allocations support 35 rental
assistance vouchers. On April 30, 2013, the Housing Authority was contacted by HUD to
determine whether or not we would be interested in administering an additional 15 vouchers.
History/Background:
Seventy -five million dollars was included in HUD's FY 2008 Appropriations for the voucher
assistance portion of the HUD -VASH program. The Iowa City Housing Authority administers the
housing assistance portion of the HUD -VASH program. Ongoing VA case management, health
and other supportive services is made available to homeless veterans in the Iowa City /Cedar
Rapids Corridor through the Iowa City VA Medical Center. In order to participate in the program,
the Veteran must commit to the VA's 5 -year case management program, be income eligible,
and not subject to any lifetime sex offender registry.
Grant Award:
On August 21, 2013, HUD announced the Iowa City Housing Authority was granted $65,147 to
support an additional 15 HUD -VASH vouchers to provide rental assistance for homeless
veterans. The Iowa City Housing Authority will immediately accept referrals from the Iowa City
VA Medical Center.

FYI - I think all of us have been getting questions on the Dubuque / 1 -80 interchange project. There was some incorrect
information apparently via Cedar Rapids radio stations that the WB off -ramp would still be closed this Saturday. An
update from Iowa DOT is below.
In summary, the WB off -ramp will be open starting Thursday, and Dubuque St through the interchange will be open two
lanes in each direction. The WB ramp will be stop - controlled.
The interchange project will be completed next spring.

Had heard conflicting reports about traffic on Dubuque Street for football and wanted to clarify what would be
happening.
Discussion /Response:
I explained that we would be opening Dubuque to 2 lanes each direction on Thursday as well as opening the west bound
exit ramp. The westbound exit ramp would be stop sign controlled. The south ramps for eastbound traffic would be
controlled by a traffic signal.
In order to have the interchange function during football season, we stopped the project, not finished it. We would be
re closing the exit ramp and having two way traffic on the southbound side of Dubuque next spring to finish the project.
Also explained that on 80 we were trying to have eastbound open to 3 lanes by the weekend all the way thru the area
and westbound open to 3 lanes west of Dodge. They are removing barrier each night, so production rates will
determine how much is able to be opened. We hope to have all the barrier removed by the second game on Sept 7.
No additional follow -up is required

HOUSING TRUST FUND ACCEPTING APPLICATIONS
The Housing Trust Fund of Johnson County is currently offering $350,000 in funding to
support the development and/or rehabilitation of housing for income qualified
households. Note: Funding will be awarded to applicants who support housing
development or activities for low income households (80% or below AMI) or extremely
low income households (30% or below AMI). Up to $50,000 of this funding may be
awarded as a grant if the activity benefits populations below 30% AMI. Eligible
applicants include businesses, nonprofits, builders, developers, and governmental
agencies seeking funds for owner- occupied, affordable rental, transitional or emergency
housing in Johnson County. Funds must be used by December 31, 2014. The

Public Comment of Items Not on the Agenda:
LaTasha Massey discussed her work in the community and also an upcoming event being held on August
28`x' at Uptown Bills to commemorate the 50'' Anniversary of the March on Washington.
New Business:
Human Rights Breakfast
Members of the public and the Commission spoke on the possibility of changing the
Business /Community Award to the Bill Reagan Community Award. Motion Ghoneim, seconded by
Olmstead. Motion passed 6 -0. (Finnerty not present). Bowers will prepare and send a letter for Bill's
family and The Arc of Southeast Iowa.
The subcommittee will be Orville, Diane, Kim and Harry. Townsend suggested contacting Diane Penny
for information that may assist in planning the breakfast. Ghoneim will contact the Press Citizen to see if
they have any archives related to the Commission. Bowers will send out a press release requesting past
Commissioners with any photos or information on past events to contact the office.
Cultural Diversity Day
This year the event is being held in the fall over homecoming weekend. Commissioners voted to
participate in the event. Amos and Hanrahan will cover from 12 -2 pm. Commissioners will decide at the
next meeting how to staff the rest of the time.
Iowa Women's Music Festival
The Commission will make a monetary donation in the amount of $25 for this event. Motion Ghoneim,
seconded Coulter. Motion passed 7 -0.
Annual Report (Draft) FY 13
With one repetitive sentence removed, Olmstead moved, Coulter seconded. Motion passed 7 -0.
Coalition for Racial Justice Report
Bowers will prepare a letter to the Coalition for Racial Justice thanking them for their hard work and time
on the report.
Proclamations
Bowers will submit a proclamation to the Mayor for Hispanic Heritage Month. At the meeting in
September, Commissioners can select who will accept it, if the Mayor chooses to read it.
Updates & Reports:
Conference on Racial Justice & Disproportionate Minority Incarceration
Ghoneim updated the Commission on the tentative agenda of the conference scheduled for October 17.
The conference will be held in the Lindquist Center from 10 am — 3 pm. So far former State
Representative Wayne Ford, ACLU President Ben Stone and Professor of Law Adrien Wing are
scheduled to speak at the conference.
ADAAA Training
The program was well attended. The program was recorded and streams on the City Cable website and
replays on City Channel 4.
SEATS
Olmstead reported that beginning January 1, 2014 Sunday and half fare services will be eliminated.
Education Subcommittee
The subcommittee will meet with the Governance & Policy representatives of the school board.
Immigrant Subcommittee
The need for this to be a continual'agenda item will be discussed at the meeting in September.
In the meantime, Hanrahan will write out a brief summary on the history of the subcommittee to present
to the Commission at the September meeting.
Building Communities
Townsend reported that the group is looking at housing issues here in Iowa City.

King had a question regarding the review process of the General Orders and
if there was someone within the Police Department that does the review and
would make the necessary changes in accordance with the new Board
ordinance. Steffen noted that would be an administrative duty and would be
taken care of. Treloar asked if those are part of the accreditation process.
Steffen explained that they go through that process every three years and
members from the Board come and randomly review policies, interview
officers, etc.
Botchway had additional questions regarding a specific general order.
Motion by King, seconded by Jensen, to withdraw the original motion and put
the consent calendar back on the floor for discussion. Motion carried, 5/0.
Botchway had a comment regarding General Order 99 -11 (Arrests), Section
III, Arrest/Citation. He wondered if there was a way to work something into
the education component of the Board to let the public know their
responsibilities at the time of being stopped by an officer or issued a citation.
Treloar commented that it could be a special topic at a forum as a form of
education.
Motion by King, seconded by Jensen, to adopt the consent calendar as
presented or amended. Motion carried, 5/0.
OLD BUSINESS Council Resolution #13 -217 regarding staff review of Ad -Hoc Diversity
Committee Recommendations (PCRB pages 11 -16) - Karr explained that
the information in the packet were the red -lined versions of the proposed
going to the City Council and that Karr and Bowers were there to answer any
questions. Pugh asked whether 8- 8- 713(1)(c) of the City Code should be
removed since the Board does not have the power to make the officer(s)
meet with them. Karr said she would talk with City Attorney's office regarding.
King questioned, and the Board agreed, if section I. Complaint Process,
135(b)(4) of the Standard Operating Procedures should be omitted, since the
Board can only review complaints against a sworn Iowa City police officer.
Karr will follow up with the City Attorney's office. Karr also gave an overview
of the timeline of the documents going to Council for approval.
Treloar and the Board thanked Botchway for his commitment while serving on
the Board. Botchway left meeting (6:11 PM)
Holiday introduced herself to the Board and commented on the accessibility
of information on the City website. Karr stated that the City is doing a City
wide overhaul of the website and providing more information on Twitter and
Facebook. Improvements have been made, but the Board /City is always
looking for suggestions. Porter also commented the various locations that
information is now available. Karr suggested Holiday follow up with the City
Clerk's office.

POLICE CITIZENS REVIEW BOARD
GENERAL RESPONSIBILITIES
Established in 1997, by ordinance #97 -3792, the Iowa City Police Citizens Review Board (PCRB)
consists of five members appointed by the City Council. The PCRB has its own legal counsel.
The Board was established to review investigations into claims of police misconduct, and to assist the
Police Chief, the City Manager, and the City Council in evaluating the overall performance of the
Police Department by reviewing the Police Department's investigations into complaints. The Board is
also required to maintain a central registry of complaints and to provide an annual report setting forth
the numbers, types, and disposition of complaints of police misconduct. The Board shall hold at least
one community forum each year for the purpose of hearing citizens' views on the policies, practices
and procedures of the Iowa City Police Department. To achieve these purposes, the Board complies
with Chapter 8 of the Iowa City Code and the Board's By -Laws and Standard Operating Procedures
and Guidelines.
ACTIVITIES AND ACCOMPLISHMENTS FOR FISCAL YEAR 2013
Meetings
The PCRB tentatively holds monthly meetings on the second Tuesday and special meetings as
necessary. During FYI the Board held sixteen meetings and one Community Forum.
ICPD Policies /Procedures /Practices Reviewed By PCRB
The ICPD regularly provided the Board with monthly Use of Force Reports, Internal Investigation
Logs, Demographic Reports and various Training Bulletins. The Department also provided various
General Orders for the Board's review and comment. A senior member of the Police Department
routinely attended the open portion of the PCRB meetings, and was available for any questions Board
members had regarding these reports.
Presentations
In April of 2013 the Board held its fifth Community Forum as required by the City Charter. The Board
did introductions and the forum was opened to the public for questions. There were four members of
the public that spoke at the forum. Topics of discussion included the following: service dog
awareness and recommendations from the Ad Hoc Diversity Committee.
Board Members
In October officers were nominated with Joseph Treloar as Chair and Melissa Jensen as Vice - Chair.
Melissa Jensen and Royceann Porter were re- appointed to the Board in July of 2013 for four -year
terms beginning September 1.
COMPLAINTS
Number and Type of Allegations
Five complaints (12 -05, 12 -06, 13 -01, 13 -02, 13 -03) were filed during the fiscal year July 1, 2012 —
June 30, 2013. Five public reports were completed during this fiscal period (12 -01, 12 -03, 12 -04, 12-
05, 12 -06) and two complaints were dismissed (13 -02, 13 -03). The remaining complaint filed in FY13
is pending before the Board (13 -01).

Complaint Resolutions
The Police Department investigates complaints to the PCRB of misconduct by police officers. The
Police Chief summarizes the results of these investigations and indicates in a report (the Chief's
Report) to the PCRB whether allegations are sustained or not sustained. (If complaints are made
against the Chief, the City Manager conducts the investigation and prepares and submits the reports.)
The Board reviews both the citizens' complaint and the Chief's Report and decides whether- its
conclusions about the allegations should be sustained or not sustained. The Board prepares a report
which is submitted to the City Council.
Of the sixteen allegations listed in the five complaints for which the Board reported, none were
sustained.
The Board made comments and /or recommendations for improvement in police policy, procedures, or
conduct in one of the reports:

Complaint #12 -01
The Board sees the need for more education on an individual's rights and responsibilities when
responding to police officers' directions.
Name - Clearing Hearings
The ordinance requires that the Board not issue a report critical of the conduct of a sworn officer until
after a name - clearing hearing has been held. During this fiscal period, the Board scheduled no name -
clearing hearings.
Mediation
Officers and complainants are notified by mail that formal mediation is available to them at any stage
in the complaint process before the Board adopts its public report. All parties involved must consent to
a request for mediation. No mediations were convened this year.
Complaint Histories of Officers
City ordinance requires that the annual report of the PCRB must not include the names of
complainants or officers involved in unsustained complaints and must be in a form that protects the
confidentiality of information about all parties. In the five complaints covered by the FY13 annual
report a total of eight officers were involved with allegations against them.
ICPD Internal Investigations Logs
The Board reviewed the quarterly ICPD Internal Investigations Log, provided by the Chief of Police.
