Discussion of 2014 legislative priorities Date: September 25, 2013 To: Tom Markus, City Manager From: Jeff Davidson, Planning and Community Development Director Re: Acceptance of additional I -Jobs funding for Wastewater Treatment Facility History: In July 2009 the City of Iowa City applied for $10 million in funding from the Iowa Finance Authority I -Jobs program to relocate the operations of the North Wastewater Treatment Plant out of the floodplain. However, there were not enough funds for this project to be fully funded. At their August 31, 2009 meeting the I -Jobs Board of Directors were able to allocate $3,495,293 in Wobs I funds to Iowa City's project and deferred the remaining portion. They indicated the deferred amount would be funded if additional funds were allocated or returned to the I -Jobs program. The Iowa Legislature subsequently appropriated an additional $2 million of I -Jobs II funds for the wastewater project, resulting in total funding of $5,495,293 out of the $10 million requested. Iowa City also received funds from the I -Jobs Program to help construct Fire Station #4. Once the project was completed and closed out, there was still $600,000 in Fire Station #4 I -Jobs funds remaining. In January 2013, Iowa City submitted a letter to the I -Jobs Board of Directors requesting the unused funds be transferred to the Wastewater Treatment Plant Project. On March 25, 2013 the I -Jobs Board decided to not transfer the funds. City staff reviewed recordings of meetings leading up to and including the August 31, 2009 meeting. Staff also continued to have discussions with I -Jobs staff regarding the granting of additional funds to the project. We continued to take the position that additional I -Jobs funds should be awarded to the wastewater plant project by virtue of the I -Jobs Board's action at the August 31, 2009 meeting. On July 16, 2013 the City of Iowa City received a letter from the Iowa Finance Authority indicating they believed the I jobs Board of Directors had intended to factor in all sources of funding when determining the allocation of funds. Since Iowa City had received a substantial amount of Disaster Recovery Community Development Block Grants (CDBG) funds for the wastewater plant project they felt their obligation had been met. City staff participated in a conference call with I -Jobs staff on July 25, 2013 to discuss the letter. Staff said that while Iowa City did receive additional CDBG funds, it would still need to contribute $14 million in local funds towards the $55 million project. On September 10, 2013 Iowa City received an email from Iowa Finance Authority staff offering to allocate a total of $850,000 in additional I -Jobs funds. The additional funds were contingent on the funds being disbursed before December 3, 2013; the I -Jobs portion of the project being closed out by June 30, 2014; and the City of Iowa City agreeing to not request additional I -Jobs funds. September 25, 2013 Page 2 Discussion of Solutions: The I -Jobs Program is in the process of being closed. The I -Jobs Board of Directors was dissolved by the Iowa Legislature on July 1, 2013. It is the intention of the Iowa Finance Authority to have all projects closed by June 30, 2014. Recommendation: Staff is recommending the City of Iowa City accept the offer of $850,000 of additional I -Jobs funds. I'm attaching a letter I will drop off for Tom Markus today, which includes an invitation for you and your staff to attend one of two (or both) events at the 1105 Project site from 1 -3 p.m. or 4 -5 p.m. Sunday, October 6. I believe we sent City Council members personal invitations to the events -- to show supporters the progress of our renovations to date -- as we are most grateful for their support, as well. I want to clarify that construction is not complete! We still are seeking donations, and hope to be ready for agencies to move in by January 1, 2014.
