Washington St., Iowa City, IA 52240 (319) 356 -5144 RESOLUTION NO. 13 -29 RESOLUTION ACCEPTING THE WORK FOR THE IOWA CITY INDUSTRIAL CAMPUS RAILROAD SIDING AND SPUR IMPROVEMENTS PROJECT WHEREAS, the Engineering Division has recommended that the work for construction of the Iowa City Industrial Campus Railroad Siding and Spur Improvements Project, as included in a contract between the City of Iowa City and Peterson Contractors, Inc. of Reinbeck, Iowa, dated May 1, 2012, be accepted; and WHEREAS, the Engineer's Report and the performance and payment bond have been filed in the City Clerk's office; and WHEREAS, funds for this project are available in the Iowa City Industrial Campus Project account # 4512; and WHEREAS, the final contract price is $1,373,422.54. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT said improvements are hereby accepted by the City of Iowa City, Iowa. WHEREAS, the Engineering Division has certified that the following improvements have been completed in accordance with the plans and specifications of the City of Iowa City: Sanitary sewer, storm sewer, and water main improvements for Lots 81 -92 and Outlots F and G of Cardinal Ridge - Part Three, as constructed by Carter and Associates, Inc. of Coralville, Iowa. WHEREAS, the property at 321 East Davenport Street was declared a public nuisance and acquired by the City through a voluntary sale; and WHEREAS, due to its condition, the City demolished the home located at 321 East Davenport Street; and WHEREAS, the City has entered into a purchase agreement for the sale of the property for $70,000, which will reimburse the City for the cost to acquire the property and demolish the existing house; and WHEREAS, conveyance of the property is in the public interest. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: 1. The City Council does hereby declare its intent to convey the property located at 321 East Davenport Street for the sum of $70,000. 2. The applicant is now requesting final plat approval. Approval will allow the property to be development with approximately 60 multi - family dwelling units. The plat also establishes Eastbrook Drive which will provide vehicular access to this property and property located to the east when it is annexed into the city in the future. The plat includes dedication of right -of -way necessary for improvement to Scott Boulevard and American Legion Road. ANALYSIS: The final plat of Eastbrook Flats is in general compliance with the approved preliminary plat, and subdivision regulations. Construction drawings are currently being reviewed by the City Engineer. Legal papers are being reviewed by staff and must be approved by the City Attorney. It is anticipated that these documents will be approved prior to the October 1 Council Meeting. Conditional Zoning Agreement: The rezoning of this property to Low Density Multi- family Residential (RM -12) was approved subject: 1) Payment of fees for street improvement on American Legion Road; 2) Installation of an 8 -foot wide sidewalk (the City will pay for 3 feet of the required 8 -foot width) along the property's frontage with Scott Boulevard; and 3) Installation of a temporary sidewalk along the property's frontage with American Legion Road until American Legion Road is reconstructed to City standards. These requirements should be addressed in the Subdivider's Agreement. Neighborhood parkland or fees in lieu of: The open space requirement for the subject properties would be .277 acres (12,098 square feet). Given that Scott Park is located to the north of the subject property thet Parks and Recreation Commission has recommend fees in lieu of parkland dedication. These fees will need to be addressed in the Subdivider's Agreement. Infrastructure fees: Water main extension fees of $395 per acre will apply. The requirement for payment of this fee should be addressed in the Subdivider's Agreement. There are no sanitary sewer tap -on fees for Eastbrook Flats. RECOMMENDATION Staff recommends approval of SUB13- 00014, the final plat of Eastbrook Flats a 1 -lot, 4.83 acre residential subdivision located east of Scott Boulevard and north of American Legion Road subject to approval of construction drawings and legal papers by the City Engineer and City Attorney. The applicant is now seeking approval of the final plat County Club Estate Fifth Addition, a 13 -lot, 10.62 -acre residential subdivision located on Wildcat Lane west of Lakeshore Drive. ANALYSIS: The final plat of County Club Estates Fifth Addition is in general compliance with the approved preliminary plat, and subdivision regulations. Construction drawings are currently being reviewed 2 by the City Engineer. Legal papers are being reviewed by staff and must be approved by the City Attorney. It is anticipated that these documents will be approved prior to the October 1 Council Meeting. The applicant has requested minor change for lot 66. The applicant is proposing to shift the property line for lot 66 in Country Club Estates Fifth Addition, approximately 50 feet to the north so approximately 10 feet may be added to the width of lots 82 to 86 in Country Club Estates Fifth Addition. Staff views this as a minor change in the subdivision design and recommends approval. Slothower Road: Wildcat Lane connects to Slothower Road to the west. Slothower Road is currently a chip -seal surface and requires substantial improvements to meet City Standards, including right -of -way acquisition. Because this is a major development, with a significant number of new residential lots, vehicular traffic, as well as pedestrian and bicycle traffic on Slothower Road will increase. Improvements to Slothower Road are not yet included in the Capital Improvements Program (CIP). As a condition of approval of the preliminary plat, it was agreed that that Wildcat Lane will be barricaded at Slothower Road until Slothower Road is reconstructed either to City standards, or at a minimum widened to a 22 -feet wide chip seal road (rural residential standards). A sign at the barricade indicating that the dead -end will eventually be opened to Slothower Road is shown on the plat. These requirements should be contained in the Subdivider's Agreement. As a requirement of the Subdivision Code, the applicant/owner is required to dedicate land to the City as public right -of -way for Slothower Road, and provide necessary utility and construction easements. Neighborhood parkland: The open space requirement for all phase of Country Club Estates will be fulfilled with the dedication of Outlot B located along the western portion of this subdivision. Infrastructure fees: The developer will be responsible for a $395 /acre water main extension fee upon approval of the final plat. The requirement for payment of this fee should be addressed in the Subdivider's Agreement. The applicant is now seeking approval of the final plat County Club Estate Sixth Addition, a 19 -lot, 6.58 -acre residential subdivision located on Dunley Court west of Lakeshore Drive. ANALYSIS: The final plat of County Club Estates Sixth Addition is in general compliance with the approved preliminary plat, and subdivision regulations. Construction drawings are currently being reviewed by the City Engineer. Legal papers are being reviewed by staff and must be approved by the City 2 Attorney. It is anticipated that these documents will be approved prior to the October 1 Council Meeting. The applicant has requested minor changes in lots 82 through 86. The preliminary plat shows these lots as being 60 to 78 feet wide. The applicant is proposing to shift the property line for lot 66 in Country Club Estates Fifth Addition, approximately 50 feet to the north so approximately 10 feet may be added to the width of lots 82 to 86. Staff views this as a minor change in the subdivision design and recommends approval. Infrastructure fees: The developer will be responsible for a $395 /acre water main extension fee upon approval of the final plat. The requirement for payment of this fee should be addressed in the Subdivider's Agreement. RECOMMENDATION Staff recommends approval of SUB13- 00016, the final plat of County Club Estates Sixth Addition a 19 -lot, 6.58 -acres residential subdivision located on Dunley Court west of Lakeshore Drive be approved subject to approval of construction drawings and legal papers by the City Engineer and City Attorney. WHEREAS, staff has negotiated a purchase agreement with Ruppert Family LLC for 12.09 acres located south of Highway 1, west of Westport Plaza, and north of runway 7 (Outlot A, Westport Plaza -Part 2) for $5,000,000; WHEREAS, the 1996 Airport Master Plan provides for its acquisition; and the FAA is providing a grant for 90% of the purchase price; and WHEREAS, as part of the purchase agreement, Ruppert Family, LLC is agreeing to buy Lot 6 in the North Airport Subdivision from the City for $500,000 (listing price is $465,000) which will be used for the 10% grant match; and WHEREAS, the purchase agreement should be approved. WHEREAS, Section 10 -1 -8 authorizes fees for parade /public assembly fees to be set by resolution; WHEREAS, fees are not currently charged; WHEREAS, on average over 150 permit applications are submitted annually, and the applications have been increasing each year; WHEREAS, processing applications for parades /public assemblies range from less than thirty minutes to over ten hours; WHEREAS, larger events, namely those that place items on the right of way or in a park, take place over a substantial period of time, and require more than one city block to be closed, take considerably more time to process than smaller events; and WHEREAS, a nonrefundable administration fee of $75.00 should be charged to applicants for larger events. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA: 1. A non - refundable application fee of $75.00 is required for a parade /public assembly if: a) equipment, cables, objects, structures, or similar items are placed on city plaza, on a sidewalk, or in a park; b) it lasts more than six hours; or c) it is held on a street and requires the closure of more than one block. Block means the area on the street in a residential zone between two intersections or between an intersection and the stub /termination of a street or 500 feet in a nonresidential zone. 2. The speech content of the parade /public assembly shall not be a factor in determining whether it is a fee is required. 3. The fee may be waived if the applicant demonstrates inability to pay the fee.
