ITEM 3d(1) RELEASE OF LIEN FOR 1937 KEOKUK STREET PROPERTY
RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY
CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING A
Ll l MORTGAGE FOR THE PROPERTY LOCATED AT 1937 KEOKUK
STREET, IOWA CITY, IOWA.
Comment: Legaspi Properties, L.L.C. was purchasing the property
located at 1937 Keokuk Street under a contract sale. Their business, La
Reyna, Inc., received assistance through the City of Iowa City's
Community Development Block Grant (CDBG) Funds. The CDBG
assistance was secured by a mortgage on this property. Legaspi
Properties, L.L.C. was in default of their contract sale agreement and the
property went back to the original owner. The City's mortgage filed
prevents clear title going to the new entity buying the building thus the
City needs to release this lien.
ITEM 3d(2) SANITARY SEWER DEDICATION - RESOLUTION ACCEPTING THE
DEDICATION OF AND AUTHORIZING THE MAYOR TO ENTER INTO A
SANITARY SEWER EASEMENT AGREEMENT FOR A PORTION OF
LOTS 7, 8, 9 AND 10, BLOCK 7, LYON'S SECOND ADDITION, IOWA
CITY, JOHNSON COUNTY, IOWA.
Comment: This sanitary sewer easement is being dedicated to the City to
facilitate redevelopment of the subject property. The existing public
sanitary sewer currently runs underneath the proposed 6 -plex and the
proposed 5 -plex residential buildings (475 - 509 S. Dodge Street) and will
be relocated so that it runs between the proposed buildings and is able to
be maintained.

ACCEPTING THE WORK FOR THE CITY PARK SHELTER SIX
REPLACEMENT PROJECT.
Comment: The project has been completed by Selzer Werderitsch
Associates of Iowa City, Iowa, in substantial accordance with the plans
and specifications. The Engineer's Report and Performance and
Payment bonds are on file with the City Clerk.

DOWNTOWN STREETSCAPE PLAN ADOPTION — RESOLUTION
ADOPTING THE IOWA CITY DOWNTOWN AND PEDESTRIAN MALL
STREETSCAPE PLAN
Comment: An overview of the Iowa City Downtown and Pedestrian
Mall Streetscape Plan was provided at the March 4th City Council work
session. The streetscape plan was drafted over the last year with
involvement from local stakeholder groups and significant public input.
Adoption of the plan does not commit the City to funding any particular
project, but it does establish a vision for future improvements.
REAP GRANT FOR CITY PARK CABINS - RESOLUTION
AUTHORIZING CITY STAFF TO MAKE APPLICATION FOR FUNDING
ASSISTANCE FROM THE STATE HISTORICAL SOCIETY OF IOWA
FOR THE RESTORATION OF THE OLD SETTLERS' ASSOCIATION
LOG CABINS IN UPPER CITY PARK.
Comment: Staff recommends approval of a resolution authorizing
application for funding assistance from the State Historical Society of
Iowa, Historical Resource Development Program (HRDP) for the
restoration of the log cabins in Upper City Park.

Comment: In the UniverCity Neighborhood Partnership Program, the City
purchases rental units located in designated neighborhoods surrounding
the University, rehabilitates them, and then sells them to income - eligible
buyers. Under the UniverCity Neighborhood Partnership Program, the City
proposes to sell 312 Fairchild Street. The amount of the sale will be
$230,000 (this is what the City paid to purchase the home) plus the
"carrying costs," which are all costs incurred by the City to acquire the
home, maintain it and sell it, including abstracting and recording fees,
interest on the loan to purchase the home, mowing and snow removal,
utilities, real estate taxes, and any costs in excess of $50,000 to repair
and rehabilitate the home.

Comment: The Metropolitan Planning Organization of Johnson County
will be filing a Consolidated Transit Funding Application on behalf of Iowa
City Transit with the Iowa Department of Transportation. In accordance
with statutory requirements, this motion will set the public hearing for the
May 6, 2014 City Council meeting. A notice will be published announcing
the date of the hearing.

ITEM 3e(4) RIVERFRONT CROSSINGS FORM -BASED CODE — MOTION SETTING
A PUBLIC HEARING FOR APRIL 15 ON AN ORDINANCE AMENDING
TITLE 14: ZONING, ADDING ARTICLE 14 -2G, RIVERFRONT
CROSSINGS FORM -BASED DEVELOPMENT STANDARDS, AND
AMENDING OTHER ASSOCIATED PARTS OF TITLE 14 TO
INTEGRATE THE FORM -BASED CODE.

Comment: At its February 20 meeting, by a vote of 6 -1 (Thomas voting
"no "), the Planning and Zoning Commission recommended approval of
the Riverfront Crossings Form -Based Development Standards and other
associated amendments to the zoning code that are necessary to
integrate the form -based code into the larger zoning code, including
eliminating the Near Southside Parking Facility fee district in order to
establish a more cohesive set of parking policies for Downtown and
Riverfront Crossings.
SOLID WASTE COLLECTION FEES - RESOLUTION SETTING A
PUBLIC HEARING FOR APRIL 15, 2014, ON AN ORDINANCE
AMENDING TITLE 3 ENTITLED "FINANCES, TAXATION & FEES,"
CHAPTER 4 ENTITLED "SCHEDULE OF FEES, RATES, CHARGES,
BONDS, FINES AND PENALTIES," SECTION 5 ENTITLED "SOLID
WASTE DISPOSAL," OF THE CITY CODE TO INCREASE OR
CHANGE RESIDENTIAL SOLID WASTE COLLECTION FEES.
Comment: This proposed ordinance will increase residential solid waste
collection fees by $.40 per month on July 1, 2014. The current fee is
$11.40, with the increase it will be $11.80 per month.
WATER SERVICE CHARGES AND FEES- RESOLUTION SETTING A
PUBLIC HEARING FOR APRIL 15, 2014, ON AN ORDINANCE
AMENDING TITLE 3 ENTITLED "FINANCES, TAXATION & FEES,"
CHAPTER 4 ENTITLED "SCHEDULE OF FEES, RATES, CHARGES,
BONDS, FINES AND PENALTIES," SECTION 3 ENTITLED "POTABLE
WATER USE AND SERVICE," OF THE CITY CODE TO INCREASE OR
CHANGE WATER SERVICE CHARGES AND FEES.
Comment: This proposed ordinance will increase water user charges by
5% on July 1, 2014, and by 5% on July 1, 2015. Various other water fees
are being increased on July 1, 2014 to recover the City's cost of providing
these services.

Comment: These amendments will clarify several matters related to exception certificates
associated with the Under 21 ordinance, for both those establishments whose primary business
purpose is not the sale of alcoholic beverages and Entertainment Venues. First, that the
behaviors that presently would cause either certificate to be revoked also serve to prevent either
from being granted that status in the first place. Second, the period of time considered relating to
alcohol sales to minors will be the last 5 years at the time of application, not any five year period
in the history of the venue. Third, what counts as a disk jockey is clarified to include all those
advertised as a DJ, and anyone playing pre- recorded music outside performances of theater.
More explanation will be offered in a staff memo.

CHAPTER 5, PROHIBITIONS AND RESTRICTIONS, SECTION 8, PERSONS UNDER
THE LEGAL AGE IN LICENSED OR PERMITTED ESTABLISHMENTS, SUBSECTION
B, TO CLARIFY THE REQUIREMENTS FOR ISSUANCE OF ALL EXCEPTION
CERTIFICATES; AND TITLE 4, ALCOHOLIC BEVERAGES, CHAPTER 1,
DEFINITIONS, SECTION 1, DEFINITIONS OF WORDS AND TERMS TO CLARIFY THE
DEFINITION OF A "PERFORMER" UNDER THE ORDINANCE. (FIRST
CONSIDERATION)
Comment: These amendments will clarify several matters related to exception certificates
associated with the Under 21 ordinance, for both those establishments whose primary business
purpose is not the sale of alcoholic beverages and Entertainment Venues. First, that the
behaviors that presently would cause either certificate to be revoked also serve to prevent either
from being granted that status in the first place. Second, the period of time considered relating to
alcohol sales to minors will be the last 5 years at the time of application, not any five year period
in the history of the venue. Third, what counts as a disk jockey is clarified to include all those
advertised as a DJ, and anyone playing pre- recorded music outside performances of theater.
