Doing an onsite inspection I found the manhole lid to be about and 1.5" below the street. There are numerous cracks in the street surrounding the manhole but nothing severe. I saw no indication of erosion of the roadbed or pipelines. This department will do another inspection of the site when the weather has warmed and frost is gone. I was able to join the Center because they lowered the age cut -off. I received a scholarship which offsets my membership fee because I am low- income. I am also disabled. I am currently participating in three classes, playing pool in a group that meets on Friday morning (I know at least one other member of that group is low- income), and using the gym. I enjoy the Center's programming a great deal and hate to think what my life would be like without it.. Please continue to support the Senior Center. IS FIBERIGHT RIGHT FOR IOWA CITY? The City of Iowa City is contemplating a new trash -to- ethanol initiative, but some questions remain. • CAROL DEPROSSE and CAROLINE DIETERLE he City of Iowa City is contemplating signing a contract with a company called Fiberight for trash -to- ethanol conversion. Fiberight is a Maryland - based company that creates cellulosic ethanol and biogas from materials that would other- wise end up in a landfill. After a Fiberight presentation at a city council meeting in early January, it was de- cided that further investigation should be un- dertaken, that preliminary negotiations could be started and that public discussion would be scheduled. When things reach the `investigate and negotiate' stage, it is very likely they will come to pass, so it's important to understand what's at stake. Public meetings to discuss Fiberight are expected to take place in May WILL WE LOSE ALL OF OUR SUCCESSFUL WASTE REDUCTION PROGRAMS IN THE APPARENT RUSH FOR TRASHANOLIESST or June, and the council will not take up the issue until then. We want the city council to represent the residents of Iowa City in this deal, and, unless members ask tough ques- tions, think about the answers and thoroughly discuss the issue, residents' interests may not be protected. LOGISTICS AND ECONOMICS Before going to Fiberight's conversion pro- cess machinery in Blairstown, Iowa, the col- lected mixed trash must be sorted in order to remove the non - convertible materials. Will a new processing facility be built in Iowa City to do this initial sorting? Or will all our trash be trucked directly to the Fiberight sorting facility that is planned for construction in Marion —a town that has already signed a contract with the company? Where would a sorting facil- ity in Iowa City be located and at what cost to taxpayers? Who will monitor the sorting process to ensure that it is meeting contractual obligations? What is the cost per ton of pre- processing and sorting waste for inclusion in the biofuel creation process? 4 1 MARCH 19 - APRIL 11 LITTLEVILLAGEMAG.COM /LV151 Will the cost of a gallon of the finished trashanol include the cost of transportation and processing of material from curbsides in Iowa City to the initial sorting plant and then to Blairstown; including vehicles and their maintenance, road wear, fuel and labor? Is Fiberight asking for a "put or pay" con- tract with a minimum tonnage? And if Iowa City fails to meet that tonnage goal will it have to pay Fiberight a penalty (possibly leading to discontinuation of the existing recycling and composting programs to increase tonnage for Fiberight)? ENVIRONMENTAL IMPACT Mashed trash will need water to be added to facilitate enzyme action. How much water will be needed to process the waste and run the Blairstown plant? Iowa's supply of water is already overtaxed. Where will that water come from? Fiberight's process uses added enzymes to break down cellulose waste more efficiently and quickly than ordinary physical forces (heat, pressure) can, thereby lowering produc- tion costs. How much enzyme addition will be needed and how is this additive manufactured? Is it consumed in the process, or recycled? Or will it need disposal? Will it be delivered as microbes containing it or as an independent product? Will it be a biohazard if it is released accidentally? Everything in trash is not made of carbon, hydrogen and oxygen (ethanol's components). How much residual waste will remain after sorting? Where will this waste be stored and disposed? Even if it's a small amount rela- tive to the initial mass put into the Fiberight processor, it could be nasty stuff —contain - ing toxic heavy metals, VOCs, PCBs, halides, asbestos, etc. Will it be trucked back to Iowa City and put in our landfill? Will Iowa City's very successful recycling program partnership with City Carton be maintained? Will curbside pickup of recy- clables continue? Will the very successful and expanding composting efforts being done at the Johnson County landfill continue so that local gardeners can go on putting much of our food waste to good use to grow more food? What will happen to all the wood waste that currently becomes wood chips for mulching and landscaping? Will we lose all of our suc- cessful waste reduction programs in the appar- ent rush for trashanol/E85? GOING FORWARD Before moving forward with any contract, we propose: one, that the city hire an inde- pendent engineer to review the schematics of the Fiberight conversion facility in Blairstown and the facility proposed near Marion and of- fer his/her professional opinion regarding the positive and negative aspects of the plant as well as the contract provisions; two, that the city have an ironclad contract that protects the city from any liability, bankruptcy or harm to the environment associated with Fiberight; and three, that the city provide no subsidy or grant of land to Fiberight, that it continue its recycling and composting programs, and not agree to any "put or pay" stipulation in the contract. Fiberight has raked in approximately $55 million in government and state loans, grants and private investments. If the EPA's proposed reduction of the Renewable Fuel Standard moves forward, one has to wonder: Is investing in celluolosic ethanol production a doomed venture? Why is ever more effort going into produc- ing more liquid fuel for vehicles, instead of making increased efforts to produce energy that is less polluting such as solar and wind energy? Is the ultimate goal to turn absolutely everything fermentable into E85, while ignor- ing the effects on the food supply, air qual- ity, water resources and the environment as a whole? Can we curb our consumerist - insane soci- ety and economy so that we produce less trash in the first place? Because "throwing away" is really just "moving it to another place" — where it may be out of sight, out of mind for the thrower, but will become a problem some- where else. Marian Karr 3e(4) From: mg9425 @mchsi.com Sent: Tuesday, March 25, 2014 1:18 PM To: Council Subject: Iowa City Park sandbars Dear Council Members: Assuming the matter was accurately reported (see link below), I am writing to express my disappointment that Iowa City will not leave intact the sand bars that appeared in Iowa City Park after the flood. I certainly understand that building a beach is not appropriate; however, leaving natural sand bars in place seems most appropriate and reflective of the true nature of rivers and floods. Even though a grant from FEMA may pay for the removal of the sand, this does not mean that accepting and acting upon such a grant is a wise move. I am unaware of any DNR requirement that forces cities to remove naturally appearing sand bars from river banks. Rivers like the Iowa River are supposed to have sand bars and it seems unnatural to take them out. Further, for those who use the river, it is very easy to launch a kayak from a sand bar. My preference would be to leave the sand bars intact. I suspect many would agree with me. Thank you. "There were a lot of people who wanted to see that," Mike Moran, director of the Iowa City parks and recreation department said. "It's just not practical at this time." Moran said a work -order had been filed with FEMA after the summer flooding to clean -up the park. FEMA officials recently informed the city of plans to move forward with the project, which includes removing a large amount of sand. Moran said making a portion of the park into a beach would have also presented safety issues as the river isn't ideal for swimming. Moran also had doubts the Department of Natural Resources would have been on board with such an idea. Work is expected to last about two weeks. As of now, when confronted with an alcohol violation, police are left with only two options: issue no citation, or issue a criminal misdemeanor citation. This means that whether or not the individual is cooperative or problematic, they generally face criminal charges, and if convicted will have a criminal record. Our discussion at our work session will change how our peace officers protect and serve our community, how minor alcohol violations are charged, and the decriminalization of members of our community. Iowa City is home to one of the most prestigious universities in the Midwest. Like our fellow state institutions, we share a common good: our students, students who we educate and who pursue careers all across the world. It is important to note that education is a business, and as such it is always in a business's best interest to create a product that is highly sought after, of the best quality, and competitive in the market. Unfortunately, a high number of Iowa graduates are leaving the University with criminal convictions as a result of minor alcohol violations. As young and upcoming professionals we educate ourselves in a variety of different ways. Making mistakes and learning from them is an essential part of education and gaining life skills. Learning from these mistakes shapes us into the people we are today and instills respect and responsibility; values that are essential to building a better local community. By providing law enforcement with the option of issuing civil citations for minor alcohol charges, students will have an opportunity to learn the importance of following the law while at the same time not bearing the burden of a criminal conviction. Furthermore, as knowledge of the new discretion given to officers becomes known to students, students in such a situation will have a greater incentive to cooperate with law enforcement. This could have a long term effect of improving the general state of relations and trust between students and local law enforcement. Currently, an individual who makes the mistake of public intoxication or PAULA is by default charged with a criminal offense in Iowa City. That means a person who is cooperative, respectful, and honest with their detaining officer will still likely be charged with a crime. This is problematic because these criminal charges tend to follow students beyond their time at the University and burden them during their stay here, making it harder and sometimes impossible to obtain employment, admission to certain academic programs, or graduate school programs. While criminal charges generally must be reported on job applications, civil citations are generally not required to be disclosed. That is what is before you tonight, to seek a discretionary tool that can provide our peace officers with the tools used to uphold our laws yet seek discretion when they deem it suitable. I have full confidence in the ICPD, UIPD, UHPD, and the JCSD to utilize this tool when and where they deem it appropriate. I encourage the Council to instruct staff to compose an ordinance that will allow for these civil citations options to be presented to Council and voted on. Thank you Marian! -Alec Honorable Council, I would like to respond to the staff memo addressing civil citations and whether or not to create them in addition to the criminal citations that currently exist. I would like to address the sincerity of the staff report and address the arguments and examples that may be confusing with respect to how these citations are used. I will be addressing the arguments for PAULA and Public intoxication as those are the most relevant charges and deserving of discussion. I understand that no jury/ trial is given for civil citations, the increased paperwork for peace officers and city staff, and the up -front filing court costs. With no jury or trail, the City has only to prove "clear, satisfactory and convincing" evidence (3/27/14 Memo). As these cases are easier to prove, up -front filing costs would be refunded, and additional funds that stay within the City would help negate additional paperwork. Civil citations do not result in an arrest; rather they result in a civil fine the violator must pay to the municipality. Civil citations exist in addition to criminal citations, they do not supersede state law, nor should they. Civil citations can be issued by state certified peace officers within a municipality with the authorization of that municipal government. For example, `after hours in a bar' and `disorderly house' are both municipal citations that are enforced not solely by the ICPD but also by the UIPD. Civil citations may be issued by police, is cases where peace officers feel an individual does not need to be arrested, but should not be let go without consequence. Civil Citations for PAULA PAULA is possession of alcohol under the legal age (Iowa Code 123.47). Staff does not support creating civil citations for PAULA "principally because PAULA can be expunged after 2 years" (3/27/14 Memo). This is correct. After two years of maintaining this charge on a criminal record an individual can seek expungement from the State, it is not automatic. This charge, after expungement, will not show up on Iowa Courts Online and is therefore is not accessible to the general public. However, this charge will show up as `expunged' on a state or federal background check. The charge is still criminal and must be disclosed when consent is given to initiate a background check, most often done by employers. Expungement is simply a band -aid solution for a criminal record. An individual with an expunged charge must still disclose it as a criminal conviction, which will be done for life. A civil citation is not a criminal charge, it is simply a municipal infraction enforced by a municipality. An individual cited with a civil PAULA would pay a fine (set by the municipality with a maximum of $750 for 1St incident and $1000 for 2nd incident). This civil citation would not show up on Iowa Courts Online and would not have to be disclosed as a criminal charge. This citation will appear when a state or federal background check is undergone. It is important to note that a civil citation will show up on a background check just as an expunged criminal citation does. There are two differences between the two: 1. a civil citation is not criminal and 1 does not have to be disclosed, and 2. a criminal citation (for alcohol related charges) remains visible on an individual's record for two years and must be disclosed for life. Staff points out that civil PAULAs cannot be expunged. This is technically correct but only because the only violations that can be expunged in the State of Iowa are criminal alcohol misdemeanors such as public intoxication and PAULA. It does not matter whether civil PAULAs can be expunged because they do not show up on a criminal record. They will show up on a state or federal background check, but so will an expunged criminal PAULA or criminal public intoxication charge. The benefit of civil citations is that they are not criminal and will not have to be disclosed for life as criminal citations would. To put things in perspective, if an individual who age is 20 years of age, is cited with a criminal PAULA, this will remain on their record for 2 years (without further misdemeanors minus speeding tickets). Between the ages of 20 and 22 many individuals are searching for part- time jobs, internships, hoping to enter the workforce and begin a career. A criminal citation, expunged or not, must be disclosed and will turn up on a state or federal background check. This may lower job prospects and possibly lead to rejection from career employment. A civil citation will show up on a state or federal background check; however it cannot be found on Iowa Courts Online as it is not criminal, and therefore does not have to be disclosed. Public Intoxication I would like to dispel the assumption that staff presumes, that is, not all public intoxication cases are to be issued a civil citation. A criminal charge for public intoxication is a state offense and can be found in Iowa code (123.46). Criminal charges for public intoxication do, and will always remain a crime. I do not seek its elimination nor do I imply this in any way. Municipal ordinances cannot supersede Iowa State law. I am, however, seeking an additional civil citation which could be utilized by the peace officer in cases where officers feel an individual does not need to be arrested, but should not be let go without consequence. Public intoxication is defined in Iowa State code as being or simulating public intoxication in a public place (123.46). The code does not state that a person who is a danger to themselves or others is a reason for issuing a criminal public intoxication citation, however this is the City's interpretation and it is valid. The memo states that "In almost all cases in which public intoxication is charged the person has already been exhibiting problem behavior." (3/27/14 Memo). I will not argue the legitimacy of that statement however I find it illogical. An individual does not need to be exhibiting problem behavior to be charged with a public intoxication. Iowa Code (123.46) has no specific provisions for public intoxication, it simply says "A person shall not be intoxicated or simulate intoxication in a public place." Additionally, the Code has no definition of what intoxication is. The argument for problem behavior is unreasonable, it is simply a way peace officers claim to identify individuals prior to issuing a public intoxication charge. 2 The public intoxication law (123.46) is vaguely worded, it is designed to be used as a secondary charge, not necessarily a primary one. If this is the case, then an individual may be arrested for a primary charge, but then charged with a civil public intoxication, for example. If an officer comes across an individual who they believe should be cited with public intoxicated but is not posing a threat to themselves or the public, an officer currently only has two options: issue no citation, or issue a criminal citation and arrest them. If a civil citation was available to peace officers, that individual may be cited under a civil public intoxication; whether it be a primary or secondary charge. This means the officer can still charge an individual with public intoxication, but does not need to go as far as arresting them. Public intoxication misdemeanors are expugnable after two years, as are PAULA's. The same argument exists for civil citations in this regard. While a criminal public intoxication charge with be publicly visible as a criminal offense for two years before expungement, a civil public intoxication charge would not be. Both an expunged criminal charge and a civil charge will show up on a state or federal background check, however only the criminal charge will be reported.
