Resolutions and Motions: ITEM 4c(1) TEMPORARY WAIVER OF DELINQUENT ANIMAL LICENSE - RESOLUTION TEMPORARILY WAIVING SELECT DELINQUENT ANIMAL LICENSE FEES BY AMENDING RESOLUTION NO. 97 -233. Comment: Resolution No.97 -233 approves a fee schedule for animal control services. A delinquent fee is required if a license is not renewed within 30 days of the anniversary date of the issuance of the license. Due to a computer programming error, many residents did not receive renewal notices. This resolution is a limited and temporary waiver of the delinquency fees for those who did not receive renewal notices. For those who have paid the delinquency fee, the waiver will be shown as a credit toward the fee for next licensing cycle. April 15, 2014 City of Iowa City Page 3 1t1-q ITEM 4c(2) ECONOMIC DEVELOPMENT POLICIES - RESOLUTION ADOPTING ECONOMIC DEVELOPMENT POLICIES OF THE CITY OF IOWA CITY AND RESCINDING RESOLUTION NOS. 07-39,09-343, AND 11 -394. Comment: These amendments are intended to provide direction to City staff in negotiating financial assistance arrangements for economic development projects in Iowa City. The proposed amendments are intended to link the City Council's adopted Strategic Plan and the achievement of community objectives with City funding of economic development projects. The City Council Economic Development Committee recommended approval on a 3 -0 vote at their April 1, 2014 meeting. In order to have just one document rather than a series of amendments, this resolution rescinds all current economic development polipes. /Am ITEM 4c(3) UISG APPOINTMENT - MOTION APPROVING THE APPOINTMENT OF EVAN MCCARTHY AS THE CITY COUNCIL LIAISON FROM THE UNIVERSITY OF IOWA STUDENT GOVERNMENT (UISG) TO THE CITY COUNCIL UNTIL MAY 1, 2015. The Public Housing Reform Act requires submission of an Annual Plan. The Annual Plan provides details about the Housing Authority's current programs and the residents served, as well as the Housing Authority's strategy for addressing the housing needs currently assisted families and the larger community. Comment: An agent for Fannie Mae is requesting that a release be filed for improvements under the subdivider's agreement. Although subdivided in the late 1950's, the abstract does not show that this lot was released, and the City has no such record either. Improvements are complete. In old subdivider's agreements, there was not a provision authorizing staff to sign releases and thus it must be approved by Council. This contract is consistent with the plan's implementation strategy and includes schematic design services for portions of Washington Street, Dubuque Street and the Pedestrian Mall. In 1983, the City of Iowa City entered into a 99 -year agreement with the previous hotel owner for parking in the Dubuque Street and Capitol Street ramps for hotel guests. As part of a loan refinancing, the owner's lender is requesting that the parking agreement be assigned to it as collateral. The parking agreement provides that the City's consent to an assignment not be unreasonably withheld and only for the reasons it would deny an alcohol license. Setting Public Hearings: ITEM 4d(1) UNIVERCITY SALE, 1116 EAST BURLINGTON - RESOLUTION SETTING PUBLIC HEARING FOR MAY 6, 2014, ON A PROPOSAL TO CONVEY A SINGLE FAMILY HOME LOCATED AT 1116 EAST BURLINGTON STREET. Comment: In the UniverCity Neighborhood Partnership Program, the City purchases rental units located in designated neighborhoods surrounding the University, rehabilitates them, and then sells them to income - eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 1116 East Burlington Street. The amount of the sale will be $189,000 (this is what the City paid to purchase the home) plus the "carrying costs," which are which are all costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to repair and rehabilitate the home. ITEM 4d(2) AMENDMENTS TO SIGN ORDINANCE — MOTION SETTING A PUBLIC HEARING FOR MAY 6 ON AN ORDINANCE AMENDING TITLE 14: ZONING, ARTICLE 513, SIGN REGULATIONS, TO BROADEN THE STOREFRONT SIGNAGE TYPES AND SIZES ALLOWED IN COMMERCIAL ZONES AND TO REGULATE TEMPORARY WINDOW SIGNS Comment: At its March 20 meeting, by a vote of 6 -0, the Planning and Zoning Commission recommended approval of these zoning code amendments. Approval will change the standards for projecting signs and allow them in all commercial zones; allow canopy roof signs in all commercial zones; address the size and number of storefront signs allowed per storefront; and clarify definitions and regulate temporary window signs and the placement of permanent window signs in required storefront windows. (SUB13- 00021) Comment: A preliminary plat of Westwinds Second Addition was 14 — qq approved on December 3, 2013. Staff recommends approval of the final plat subject to approval of legal papers and construction drawings by the City Attorney and City Engineer. It is anticipated that legal papers and construction drawings will be approved prior to the March 25 City Council meeting. Approval will allow the development of Westwinds Second Addition, a 2 -lot, 1.31 -acre residential subdivision containing a duplex and a 7 -unit multi - family building located south of Melrose Avenue west of Westwinds Drive. Comment: In the UniverCity Neighborhood Partnership Program, the City purchases rental units located in designated neighborhoods surrounding the University, rehabilitates them, and then sells them to income - eligible buyers. The amount of the sale will be $165,000 (this is what the City paid to purchase the home) plus "carrying costs" of approximately $11,600. Comment: The East Central Iowa Council of Governments ( ECICOG) with the assistance of an Iowa City staff committee has prepared the Johnson County Multi - Jurisdictional Hazard Mitigation Plan. Said Plan has been placed in the City Clerk's office and on the Johnson County website for public review. ECICOG has requested all Johnson County communities hold a public hearing and subsequently consider adopting the plan by April 20th. The Hazard Mitigation Plan documents how a community can minimize the negative impacts of natural and human - caused hazards, and is required to maintain eligibility to apply for Hazard Mitigation Grant Program funding. a. Comment: This resolution allows for the advertisement for the sale of the bonds and for the receipts of electronic bids by FAX machine and through the PARITY competitive bidding system. The PARITY electronic bidding system has been determined to provide reasonable security and to maintain the integrity of the competitive bidding process, and to facilitate the delivery of bids by interested parties in connection with the offering at public sale. LOWER WEST BRANCH ROAD SPEED LIMIT -ORDINANCE AMENDING TITLE 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC," CHAPTER 3, ENTITLED "RULES OF THE ROAD," SECTION 6, ENTITLED "SPEED RESTRICTIONS," SUBSECTION B, ENTITLED "EXCEPTIONS ". (SECOND CONSIDERATION) Comment: A speed study on Lower West Branch Road, east of Hummingbird Lane, indicates that most drivers are traveling above the posted 25 MPH speed limit, and that a speed limit of 35 MPH would be more appropriate from a point 260 foot east of Hummingbird Lane, to 150 feet west of Brentwood Drive, and from a point 200 feet east of Broadmoor Lane to the centerline of Taft Avenue. The Public Works, Police, Fire, and Neighborhood and Development Services departments concur that the speed limit could be safely increased to 35 mph. As this section of Lower West Branch Road is partially located outside of the corporate limits, the Board of Supervisors is also considering approval of this speed limit change. MECHANICAL CODE AMENDMENT - ORDINA14CE AMENDING TITLE 17 ENTITLED "BUILDING AND HOUSING," CHAPTER 4, ENTITLED "MECHANICAL ` Yw CODE," BY AMENDING THE INTERNATIONAL MECHANICAL CODE, 2009 EDITION, TO REGULATE COMMERCIAL KITCHEN HOOD TERMINATION LOCATIONS. (FIRST CONSIDERATION) Comment: The amendment would restrict commercial hood exhaust terminations to roofs, except where an exhaust could terminate at an exterior wall that is adjacent to an alley. Roof - mounted terminations would be prohibited within 10 feet of an exterior wall or property line, minimizing or eliminating their appearance from a public street, sidewalk, or adjacent private property. Exhaust terminations into a public alley would be required to be installed not less than 10 feet from a property line or a building corner. The Board of Appeals, at their public meeting on March 24, 2014, voted unanimously to recommend approval of the code amendment. �✓ ITEM 20.
