Market St. ITEM 4d. Resolutions and Motions: ITEM 4d(1) AIRPORT LEASE WITH MERSCHMAN SEEDS - RESOLUTION APPROVING AN AMENDMENT TO LEASE WITH MERSCHMAN SEEDS, INC. TO LEASE AN ACCESS WAY FROM MORMON TREK BLVD. TO THE NORTH / SOUTH RUNWAY. Comment: The Airport Commission leases some of the airport land for agricultural purposes. The farmer contracts with Merschman Seeds, Inc. to permit Merschman to plant test plots between the end of the north /south runway (which is closed) and Mormon Trek Blvd. In order to facilitate the planting and viewing of the test plots, Merschman has leased an access way from Mormon Trek to the runway since 2008, which terminated on 2/28/14. The access way is partially on City property which is why the City is a party to the lease. This amendment extends the lease for one year to 2/28/15. At its meeting on April 17, the Airport Commission approved this amendment. May 6, 2014 City of Iowa City Page 3 ITEM 4d(2) RELEASE OF LIEN FOR 1552 DICKENSON LANE PROPERTY RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT 1552 DICKENSON LANE, IOWA CITY, IOWA. Comment: The Housing Fellowship (THF) received assistance through the City of Iowa City's HOME Investment Partnership Funds on December 1, 2005 to buy a vacant lot. The HOME assistance was secured by an agreement and a mortgage on this property. THE constructed a house and sold only the house to an income eligible family and leased the land. That family now wishes to sell the house to an income eligible family and THE wishes to sell the land as well. The City's mortgage filed prevents clear title going to the new homeowner buying the home, thus the City needs to release this lien. The deed restriction on this property requiring it to be owned by an income - eligible person /family shall remain in place. ITEM 4d(3) RIVERSIDE THEATRE AGREEMENT IN CITY PARK - RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO AN AGREEMENT WITH RIVERSIDE THEATRE THAT ALLOWS THE SALE OF WINE AND BEER UNDER LIMITED CIRCUMSTANCES IN CITY PARK FROM JUNE 19, 2014 THROUGH JULY 13, 2014. Comment: Section 4 -5 -3 of the City Code allows for the sale and consumption of alcohol in a city park, on a right -of -way, or other public ground, excluding public buildings, pursuant to written agreement. Staff has approved the agreement, which is attached to the resolution, that allows Riverside Theatre to sell beer and wine and for attendees to consume beer and wine from June 19 through July 13, 2014 in a specified area in and around Riverside Festival Stage in City Park. The terms in the agreement are the same as last year with the exception of the dates. ITEM 4d(4) JANUARY DISBURSEMENTS - MOTION TO APPROVE DISBURSEMENTS IN THE AMOUNT OF $11,194,167.14 FOR THE PERIOD OF JANUARY 1 THROUGH JANUARY 31, 2014, AS RECOMMENDED BY THE FINANCE DIRECTOR SUBJECT TO AUDIT. DISBURSEMENTS ARE PUBLISHED AND PERMANENTLY RETAINED IN THE CITY CLERK'S OFFICE IN ACCORDANCE WITH STATE CODE. ITEM 4d(5) FEBRUARY DISBURSEMENTS — MOTION TO APPROVE DISBURSEMENTS IN THE AMOUNT OF $7,932,710.48 FOR THE PERIOD OF FEBRUARY 1 THROUGH FEBRUARY 28, 2014, AS RECOMMENDED BY THE FINANCE DIRECTOR SUBJECT TO AUDIT. May 6, 2014 City of Iowa City Page 4 / '-I -) 15 ITEM 4d(6) CITIZENS POLICE REVIEW BOARD COMPLAINT EXTENSION - MOTION GRANTING A 45 -DAY EXTENSION TO THE CITIZENS POLICE REVIEW BOARD FOR THE FILING OF THE PUBLIC REPORT WITH THE CITY COUNCIL ON COMPLAINT #13 -07. Comment: City Code section 8- 8 -7B(6) states The Board's report to the City Council shall be completed within ninety (90) days of receipt of the Chief's or City Manager's report. The City Council may grant requests for extensions to this deadline upon good cause shown. At their meeting of April 21, 2014, the Board requested a 45 -day extension. ITEM 4d(7) ITEM 4d(8) 1 L -)1(__ ITEM 4d(9) 1 L-i -1 1-1 JOHNSON COUNTY SENIOR CENTER FUNDING - RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A GRANT AGREEMENT WITH JOHNSON COUNTY FOR FUNDS TO SUPPORT THE IOWA CITY /JOHNSON COUNTY SENIOR CENTER. Comment: This resolution approves a one -year grant agreement for $59,224 from Johnson County to assist with the operating expenses of the Center for FY15. As in the past, the funds will be used to support operations, such as community outreach programming, Senior Center Television, and senior nutrition by hosting a seven day -a -week congregate meal program. This is the same amount provided by the County for FY14. The grant agreement is attached to the resolution. STREETS AND SOLID WASTE DIVISION BUDGETED POSITIONS — RESOLUTION AMENDING THE BUDGETED POSITION IN THE STREETS AND SOLID WASTE DIVISION OF THE PUBLIC WORKS DEPARTMENT AND THE AFSCME PAY PLAN BY RECLASSIFYING THE CLERK/TYPIST — SOLID WASTE POSITION TO ONE FULL -TIME SENIOR CLERK /TYPIST — STREETS AND SOLID WASTE POSITION. Comment: This resolution changes a Clerk/Typist — Solid Waste position to a Senior Clerk/Typist — Streets and Solid Waste position. This will combine the duties of the vacant Senior Clerk/Typist — Streets position with the Clerk/Typist — Solid Waste. The remaining position will be supplemented by a temporary part -time employee. NORTH PLANT SALVAGE AND DEMOLITION — RESOLUTION APPROVING, AUTHORIZING, AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND STRAND ASSOCIATES, INC. TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE NORTH PLANT SALVAGE AND DEMOLITION PHASE OF THE IOWA CITY WASTEWATER TREATMENT PLANT RELOCATION PROJECT. Comment: This agreement authorizes Strand Associates to provide consulting services including permitting assistance, preliminary design, final design, and bidding and construction services for the demolition of the North Wastewater Treatment Plant. The cost of these services is a not -to- exceed fee of $156,100. Funding will be provided by future state sales tax growth revenues approved by the State of Iowa Flood Mitigation Board. Comment: The project has been completed by City Construction Group of Iowa City, Iowa, in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Clerk. ❖ Project Estimated Cost: $ 275,774.00 ❖ Project Bid Received: $ 258,758.00 ❖ Project Actual Cost: $ 259,324.70 ITEM 4d(11) IOWA CITY PUBLIC WORKS FUEL FACILITY - RESOLUTION ACCEPTING THE WORK FOR THE IOWA CITY PUBLIC WORKS FUEL FACILITY PROJECT. ly -ll� Comment: The project has been completed by Selzer Werderitsch Associates of Iowa City, Iowa, in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Clerk. ❖ Project Estimated Cost: $ 665,545.00 ❖ Project Bid Received: $ 722,391.00 ❖ Project Actual Cost: $ 725,077.15 ITEM 4d(12) ALTERNATIVE SOLID WASTE DISPOSAL PROPOSAL EVALUATION — RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN I y _ / 2--0 AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND GERSHMAN, BRICKNER & BRATTON, INC. TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE ALTERNATIVE SOLID WASTE DISPOSAL PROPOSAL EVALUATION. Comment: This agreement authorizes Gershman, Brickner & Bratton, Inc. to provide additional engineering services necessary for evaluation of the alternative solid waste disposal from Fiberight. The cost of the engineering consultant services is a unit price contract not to exceed $20,000 and will be funded with Landfill revenues. ITEM 4d(13) SOFTWARE TRAINING - RESOLUTION AUTHORIZING THE PROCUREMENT OF TRAINING FOR ESRI SOFTWARE. I y — 1 2-1 Comment: This Resolution will approve the procurement of training for new GIS software the City recently acquired. The software was $150,000, which is within the City Manager's spending authority, but this $11,600 training package brings the total project cost over $150,000, thereby requiring Council approval. May 6, 2014 City of Iowa City Page 6 ITEM 4d(14) GRANT FOR CLIMATE ADAPTATION - RESOLUTION AUTHORIZING THE CITY MANAGER TO SIGN AND ACCEPT A GRANT FROM THE URBAN SUSTAINABILITY DIRECTORS NETWORK FOR CLIMATE y ADAPTATION PLANNING Comment: In collaboration with the Heartland Network, Iowa City was awarded a $33,200 grant from the Urban Sustainability Directors Network (USDN). Iowa City will act as the lead city for the Heartland Network grant, which focuses on collaborative climate adaptation planning. ITEM 4e. Setting Public Hearings: ITEM 4e(1) UNIVERCITY SALE, 324 NORTH LUCAS - RESOLUTION SETTING PUBLIC HEARING FOR MAY 20, 2014, ON A PROPOSAL TO CONVEY L4 _ ")_-3 A SINGLE FAMILY HOME LOCATED AT 324 NORTH LUCAS STREET. Comment: In the UniverCity Neighborhood Partnership Program, the City purchases rental units located in designated neighborhoods surrounding the University, rehabilitates them, and then sells them to income - eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 324 North Lucas Street. The amount of the sale will be $152,000 (this is what the City paid to purchase the home) plus the "carrying costs," which are which are all costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to repair and rehabilitate the home. ITEM 4e(2) COMPREHENSIVE PLAN AMENDMENT (AFFORDABLE HOUSING IN DOWNTOWN AND RIVERFRONT CROSSINGS) — MOTION SETTING A PUBLIC HEARING FOR MAY 20 ON A RESOLUTION APPROVING AN AMENDMENT TO THE COMPREHENSIVE PLAN — DOWNTOWN AND RIVERFRONT CROSSINGS MASTER PLAN TO INCLUDE A SECTION ON AFFORDABLE HOUSING. Comment: At its April 17 meeting, by a vote of 7 -0, the Planning and Zoning Commission recommended approval of an amendment to the Downtown and Riverfront Crossing Master Plan to include a policy regarding affordable housing. Approval would add the following paragraph to page 116, which outlines steps to implement the plan. "Affordable Housing: The Study Area provides opportunity for a mix of housing attractive to people of a variety of ages and income levels. As plans for the area move forward, the City shall consider development incentives (such as density bonuses) and policies that require affordable housing for City- assisted projects within the district." May 6, 2014 City of Iowa City Page 7 ITEM 4e(3) REZONING ( GOOSETOWN / HORACE MANN) — MOTION SETTING A PUBLIC HEARING FOR MAY 20 ON A REZONING ORDINANCE TO DESIGNATE THE GOOSETOWN / HORACE MANN CONSERVATION DISTRICT AS A CONSERVATION DISTRICT OVERLAY (OCD) ZONE. (REZ -14- 00004) Comment: At its April 17 meeting, by a vote of 6 -0 (Thomas abstaining), the Planning and Zoning Commission recommended approval of this rezoning. Approval will create a Conservation Overlay District for properties generally located on Ronalds, Church, Fairchild and Davenport streets from east of Linn Street to Governor Street including properties on Gilbert, Van Buren, Johnson, Dodge, Lucas and Governor streets, and properties generally located on Bloomington, Market, and Jefferson streets between Dodge and Governor streets including properties on Dodge, Lucas and Governor streets. If the Conservation District is approved, any significant alterations to the exterior of existing buildings and any demolition and new construction within the district will require Historic Preservation Commission approval. ITEM 4e(4) -UN Y SALE, 1821 B STREET - RESOLUTION SETTING PUBLIC HEARING FOR MAY 20, 2014, TO CONSIDER A PROPOSAL TO CONVEY A SINGLE FAMILY HOME LOCATED 1821 B STREET, IOWA CITY, IOWA. Comment: Staff has negotiated a purchase agreement with Logsden Properties, LLC for $215,500. In 2002, the City constructed a universally designed house at 1821 B Street and sold it to two persons with physical disabilities. In 2013, one of the owners was no longer able to live independently, and the City purchased it back. The tentative buyer intends to lease to persons with disabilities. ITEM 4f. Comment: At its April 3 meeting, by a vote of 6 -0, the Planning and Zoning Commission recommended approval of these zoning code amendments. Approval will clarify, cross - reference, and address differences in the regulation of uncovered decks and patios, fences, walls, and hedges, and drive - through facilities in the Riverfront Crossings Zones. 1. Gomment: In the UniverCity Neighborhood Partnership Program, the City purchases rental units located in designated neighborhoods surrounding the University, rehabilitates them, and then sells them to income - eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 1116 East Burlington Street. The amount of the sale will be $189,000 (this is what the City paid to purchase the home) plus "carrying costs" of approximately $12,100 (some of which is for upgrades at the buyers' request). (PASS AND ADOPT) Comment: A speed study on Lower West Branch Road, east of Hummingbird Lane, indicates that most drivers are traveling above the posted 25 MPH speed limit, and that a speed limit of 35 MPH would be more appropriate from a point 260 foot east of Hummingbird Lane, to 150 feet west of Brentwood Drive, and from a point 200 feet east of Broadmoor Lane to the centerline of Taft Avenue. The Public Works, Police, Fire, and Neighborhood and Development Services departments concur that the speed limit could be safely increased to 35 mph. As this section of Lower West Branch Road is partially located outside of the corporate limits, the Board of Supervisors is also considering approval of this speed limit change.
