June 3, 2014 City of Iowa City Page 3 ITEM 3d(2) NORTH DUBUQUE STREET PEDESTRIAN BRIDGE OVER 1 -80 — RESOLUTION AUTHORIZING THE ACQUISITION OF PROPERTY INTERESTS NECESSARY FOR CONSTRUCTION OF THE NORTH DUBUQUE STREET PEDESTRIAN BRIDGE OVER 1 -80 PROJECT [IM- ' / NHS- 080 - 6(320)244- - 13 -52]. L` J `� Comment: The City of Iowa City must acquire right -of -way, fee title, permanent easements and /or temporary construction easement to construct the North Dubuque Street Pedestrian Bridge over 1 -80 Project. This project will result in connectivity of the Iowa River Trail along Dubuque Street from Foster Road north to the existing Butler Bridge. The project will be funded with General Obligation bond proceeds. ITEM 3d(3) BROOKWOOD POINTE THIRD ADDITION - RESOLUTION ACCEPTING THE WORK FOR THE SANITARY SEWER, WATER MAIN AND PAVING PUBLIC IMPROVEMENTS FOR BROOKWOOD POINTE y — /b �� THIRD ADDITION, AND DECLARING THE PUBLIC IMPROVEMENTS OPEN FOR PUBLIC USE. Comment: See Engineer's Report. ITEM 3d(4) IOWA CITY LANDFILL & RECYCLING CENTER - RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN AMENDMENT TO THE NOVEMBER 12, 2013 AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND BARKER LEMAR ENGINEERING CONSULTANTS TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE IOWA CITY LANDFILL AND RECYCLING CENTER. Comment: This amendment to the November 12, 2013 agreement authorizes Barker Lemar Engineering Consultants to provide engineering services necessary for groundwater and surface water monitoring and annual water quality reports, operation and monitoring of the landfill gas collection system in accordance with State and Federal regulations for calendar years 2014, 2015 and 2016. The total cost of engineering consultant services is $369,673 for all three years. Funding will be provided by landfill revenues. June 3, 2014 City of Iowa City Page 4 ITEM 3d(5) FIRST AVENUE GRADE SEPARATION - RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND SNYDER & ASSOCIATES, INC. TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE FIRST AVENUE GRADE SEPARATION PROJECT. Comment: This agreement authorizes Snyder & Associates, Inc. to provide design engineering services related to construction of the First Avenue Grade Separation Project. This project will include construction of new roadway, sidewalk, railroad, railroad bridge, retaining walls, water main, storm sewer, storm sewer pump station, detention basin, traffic signalization and other related work. The total anticipated cost of design engineering services is $463,500, and will be funded with General Obligation bond proceeds. ITEM 3d(6) FAIRMEADOWS PARK SPLASH PAD — RESOLUTION CORRECTING THE FINAL CONTRACT PRICE IN THE RESOLUTION ACCEPTING THE WORK FOR THE FAIRMEADOWS PARK SPLASH PAD PROJECT Ll Comment: The final cost for this project was incorrect in the resolution accepting the project on April 1, 2014. This resolution corrects the final contract price. The Engineer's Report and Performance and Payment bonds are on file with the City Engineer. ❖ Projected Estimated Cost: $389,985.65 Project Bid Received: $354,437.91 ❖ Project Actual Cost: $361,556.56 ITEM 3d(7) 2013 SEWER REPAIR — RESOLUTION CORRECTING THE FINAL CONTRACT PRICE IN THE RESOLUTION ACCEPTING THE WORK FOR THE 2013 SEWER REPAIR PROJECT Comment: The final cost for project was incorrect in the resolution accepting the project on May 20, 2014. This resolution corrects the final contract price. The Engineer's Report and Performance and Payment bonds are on file with the City Engineer. ❖ Projected Estimated Cost: $ 46,250.00 ❖ Project Bid Received: $ 79,336.00 Project Actual Cost: $157.944.55 June 3, 2014 City of Iowa City Page 5 ITEM 3d(8) FOOD TRUCK AND CART PILOT PROGRAM - RESOLUTION ESTABLISHING A FOOD TRUCK / FOOD CART PILOT PROGRAM FOR 2014. 17� Comment: This resolution establishes a pilot program to allow for the commercial use of two parks and one parking lot by food trucks and food carts during the summer and fall of 2014. The three locations are Chauncey Swan Park, City Park near the children's rides, and the East Side Recycling Center parking lot. The fee will be $15 per day for each site. The City may terminate the program at any time for any reason. Staff will report back to Council in the winter of 2014 -2015 on the results of the program. ITEM 3d(9) COMMERCIAL LEASE IN PUBLIC LIBRARY - RESOLUTION AMENDING THE LEASE AGREEMENT WITH THE STATE BOARD OF REGENTS FOR THE UNIVERSITY OF IOWA FOR LEASE OF COMMERCIAL SPACE IN THE IOWA CITY PUBLIC LIBRARY. P-1 J 1 7 Comment: This is an extension of an existing lease for the basement space in the Iowa City Public Library. The period is for 18 months, July 1, 2014 through December 31, 2015, after which the tenant has indicated they will no longer need the space. An increase of 2% in the payment has been agreed to, bringing monthly rental payments to $4013.19. The tenant also pays property taxes. ITEM 3d(10) SUMMER OF THE ARTS AGREEMENT - RESOLUTION APPROVING AN AGREEMENT BETWEEN THE CITY AND SUMMER OF THE ARTS, INC. TO ALLOW THE TEMPORARY AND LIMITED SALE, CONSUMPTION, AND POSSESSION OF BEER AND NATIVE WINES DURING ARTS FEST, JAZZ FEST, AND IOWA SOUL FESTIVAL WITHIN A SPECIFIED AREA ON A CITY STREET. q– 1-7 �—) rnmmant• gpr^tinn d -r;-'l of the City Cndp allows fnr the satp anti consumption of alcohol in a city park, on a right -of -way, or other public ground, excluding public buildings, pursuant to written agreement. The agreement, which is attached to the resolution, allows Summer of the Arts, Inc. (SOTA) to sell beer and native wines in a fenced off area on Iowa Ave. during Arts Fest, on N. Clinton St. during Jazz Fest, and on N. Clinton St. during Iowa Soul Festival. The exact locations and dimensions of the sites are attached as exhibits to the proposed agreement. The agreement is substantially similar to the one executed last year. June 3, 2014 City of Iowa City Page 6 ITEM 3d(11) BUDGETED POSITIONS IN THE LIBRARY- RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE IOWA CITY PUBLIC LIBRARY BY ELIMINATING ONE LIBRARY CLERK AND ADDING ONE TWENTY -FIVE HOUR PER WEEK (.625) LIBRARY CLERK, ADDING FIVE HOURS (.125) TO AN EXISTING LIBRARY ASSISTANT Iq _ / 1 �_3 III, AND ADDING FIVE HOURS (.125) TO AN EXISTING LIBRARY ASSISTANT I. Comment: Due to a retirement and changing personnel needs at the Library several staffing changes are recommended; eliminating one full time position and adding hours to two current part -time positions. These changes result in a slightly reduced staff overall and a FY14 budget savings of approximately $5,200 plus benefits. ITEM 3d(12) FIREWORKS AGREEMENT WITH UNIVERSITY - RESOLUTION APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY AND THE UNIVERSITY OF IOWA REGARDING THE 2014 INDEPENDENCE DAY FIREWORKS DISPLAY Iq - /-7� Comment: This resolution will approve the Memorandum of Understanding developed by the City and the University to facilitate the City's Independence Day fireworks display on July 4th. The display will take place at the University's Hubbard Park, with their permission and assistance. ITEM 3d(13) RELEASE OF LIEN FOR 3035 STANFORD AVENUE PROPERTY - RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO THE RELEASE OF LIEN REGARDING A MORTGAGE FOR THE PROPERTY LOCATED AT 3035 STANFORD AVENUE, IOWA CITY, IOWA. / y - 17S Comment: The Housing Fellowship received assistance through the City of Iowa City's HOME Investment Partnership Funds on September 20, 2005 to purchase a lot where a home already exists. The HOME assistance was secured by an agreement and a mortgage on this property. THE sold the house to an income eligible family and leased the land. THE wishes to sell the home and the land to another income eligible family. The City's mortgage filed prevents clear title going to the new homeowner buying the home, thus the City needs to release this lien. The deed restriction on this property requiring it to be owned by to an income - eligible person /family shall remain in place. ITEM 3d(14) MARCH DISBURSEMENTS - MOTION TO APPROVE DISBURSEMENTS IN THE AMOUNT OF $8,412,105.26 FOR THE PERIOD OF MARCH 1 THROUGH MARCH 31, 2014, AS RECOMMENDED BY THE FINANCE DIRECTOR SUBJECT TO AUDIT. DISBURSEMENTS ARE PUBLISHED AND PERMANENTLY RETAINED IN THE CITY CLERK'S OFFICE IN ACCORDANCE WITH STATE CODE. June 3, 2014 City of Iowa City Page 7 ITEM 3d(15) APRIL DISBURSEMENTS - MOTION TO APPROVE DISBURSEMENTS IN THE AMOUNT OF $7,733,434.78 FOR THE PERIOD OF APRIL 1 THROUGH APRIL 30, 2014, AS RECOMMENDED BY THE FINANCE DIRECTOR SUBJECT TO AUDIT. DISBURSEMENTS ARE PUBLISHED AND PERMANENTLY RETAINED IN THE CITY CLERK'S OFFICE IN ACCORDANCE WITH STATE CODE. ITEM 3d(16) NEW CITY WEBSITE -RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO A 28E AGREEMENT WITH THE UNIVERSITY OF IOWA FOR WEBSITE DEVELOPMENT AND SUPPORT SERVICES. N '/ -/& Comment: The 28E agreement will facilitate a partnership with the University of Iowa for the development of a new City website. The City's current site is out of date and lacks modern functionality and visual appeal. The City will compensate the University for the actual project costs at a not to exceed amount of $60,000. Ongoing website support will also be provided by the University of Iowa at a cost not to exceed $3,000 annually. ITEM 3e. Setting Public Hearings: ITEM 3e(1) CITY HALL NORTH COURT HVAC REPLACEMENT PROJECT 2014 — RESOLUTION SETTING A PUBLIC HEARING ON JUNE 17, 2014 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE CITY HALL NORTH COURT HVAC REPLACEMENT PROJECT 2014, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING I q , 1 7 THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: The project will involve the removal and replacement of the City Hall North Court Trane HVAC unit serving areas of the City Hall facility. The work will involve provisions to address pressurization and vibration issues in the system and the installation of an open platform networked digital controls for all new equipment as well as upgrading the controls for all terminal boxes and exhaust fans associated with the replaced HVAC units. A computer room air conditioning unit in the Police Department will be removed and replaced. The Taft Ave. section is from American Legion Road to Court Street. The total cost of the engineering services is $87,753 and will be funded through the American Legion Road — Scott Blvd to Taft Ave. account #R3854. 3d(18) AERIAL MAPPING SERVICES PROJECT — RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND KUCERA INTERNATIONAL TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE 2014 AERIAL MAPPING SERVICES PROJECT. Comment: This agreement authorizes Kucera International to provide engineering services for the 2014 Aerial Mapping Services Project. This project will include developing new planimetric and contour data for Iowa City. Presently, the City Code provides that a structure may only penetrate the horizontal overlay zone (HO) by special exception. The HO zone is an imaginary circular plane 150 feet above the ground measuring approximately 10,000 feet in diameter with the center of the circle being the airport.
