As the Hwy 1 trail nears completion, I am writing to thank you for your support of this project. Your allocation
of funding to construct this much needed trail system and the sidewalks along Hudson St. and Miller Avenue,
has greatly improved safe pedestrian and bicycle access to this area. More and more people are using it every
day, especially bicyclists who can now ride from Sunset St. to the Iowa River trail on the east side of Riverside
Dr. I encourage you to stop by and see the trail system for yourselves. However, if that isn't feasible, I've
attached a couple of photos in appreciation of this work.

County Affordable Homes Coalition.

JOHNSON COUNTY AFFORDABLE HOMES COALITION

To the City Council of Iowa City:
Good evening. My name is Sally Scott, and I serve as facilitator of the Johnson County
Affordable Homes Coalition. I want to use this opportunity to clarify our coalition's
position on affordable housing in Riverfront Crossings.
After several months of presenting before the Planning and Zoning Commission, we
supported an amendment to the City's Master Plan for Riverfront Crossings that read,
"development incentives (such as density bonuses) and policy options that require
affordable housing for City- assisted projects within the district, shall be considered."
At the May 20th City Council working session, this amendment was interpreted as
advocating mandatory inclusionary zoning. That was not our intention.
Our coalition wants to generate affordable homes in Riverfront Crossings, and we are
not wedded to any particular means to achieve that goal: the possibilities include
regulations, incentives, or a mix of the two. We hope that others share this goal, and
also will be open to discussing different means to achieve it.
A successful process will generate public /private /nonprofit partnerships, and will
require compromise, and creativity.
Increasing access to affordable housing for people making less than 80% of area median
income is socially and economically productive for the community as a whole. You will
find letters in your packet supporting this point of view, from a wide range of people in
our community.
We look forward to working with the Iowa City community, City staff, the Planning &
Zoning Commission, and City Council on this issue.

Dear Iowa City Council members,
We are juniors who attend Iowa City High School who have noticed a concerning
issue within our community that we want to address. That issue is homelessness.
The issue of homelessness, more specifically the lack of programs offered to support the
people affected by homelessness, affects our community negatively by discouraging people
to come here and also encourages people to possibly leave. As well as having citizens that
do not contribute to the welfare of our city. Obviously, as a city, we do not want this.
We would like to propose the creation of a new program that would help teach homeless
and anyone in need important life skills, such as: job maintaining, interviewing, and overall
mental health treatment as there is such a large correlation between mental health and
homelessness. This program would be possible with the help of volunteers, donations,
fundraisers, and building space to rent out.
We would appreciate if you considered our proposal and we thank you for your time.

Dear Members of the City Council„
We are juniors at Iowa City High School researching the topic of drunk driving. Our research
has brought the severity of the crime to our attention and the effects it can have on the citizens
of Iowa. We believe something needs to be done to address this problem.
Even as high school students, we have been affected by drunk driving. A student at our school
was recently at home when his parked car in the street was hit. The driver of the car was found
to be driving over the legal limit of blood alcohol content. Therefore, we were exposed to one of
the minor impacts drunk driving can have.
Through research, we have learned about many accidents involving alcohol and the impact of
these poor decisions. In August of 2013 in Waterloo, a family of three was killed by Raul
Salazar, who ran a stop sign while driving under the influence. A similar situation in Sheridian
resulted in the death of 72 year old Larry Caflin when another driving ran a stop sign. Looking al
the facts of drunk driving could be very helpful when considering solutions. According to the
Iowa Department of Transportation, there have already been 96 drunk driving deaths in 2014
alone. This is alarming considering the number of deaths in 2013 was 97, making the chance of
an increase in deaths this year probable. Also, according to DUI -USA, there are over 10,000
DUI arrests in Iowa each year.
Although drunk driving is not as apparent as other community problems in Iowa, the severity of
this problem makes it worthy of publicity. While nothing will completely solve the problem, small
steps could save many lives. Considering the statistics and cases, a step towards resolving the
problem could be an increase in sobriety checkpoints. An increase in these checkpoints could
possibly reduce the number of people that decide to risk it and drive home by increasing the
chance of getting arrested for the poor decision. These checkpoints could stop a drunk driver
before another innocent member of our community is killed. Please consider this option to save
the citizens of this community.

We are a group of students attending City High. As part of a class project researching a local problem,
we are writing to you about the issue of underage drinking.
We know that the City Council has already implemented an Under 21 ordinance and the citizens of Iowa
City have upheld it twice. However, we would like to see it enforced more regularly.
We personally have friends that go out drinking and are under age. They are unable to drive and
function as human beings. This is an important issue that needs to be addressed. Youth that start
drinking under age are five times more likely to abuse alcohol. In addition, in 2011 police ticketed about
3000 under age teens caught with drinking. Although the police do enforce the underage drinking laws,
we believe it should be enforced more by checking more ID's and stopping any student that looks under
the influence. We believe you should continue to hold the bars more accountable just as you have done
recently with The Union. By setting an example for other bars, you have made it clear that serving
under aged drinkers in Iowa City is not okay.
Our proposal is having more police officers going into bars downtown and checking ID's. Starting at ten
pm. the police would patrol different bars and take out underage drinks. This would show them that
they have no leeway and that downtown bars are safe and clear of all underage drinkers.

We are aware of the 21 and Under ordinance in Iowa City and ask that the City Council continue to
enforce it. In fact, we feel it isn't stressed enough. For example, we read an article about the U of I rapes
on campus and found a connection between alcohol consumption and rape. Considering the increased
number of on- campus sexual assaults, this problem is even more important right now.
We would suggest adding more police officers around the downtown /pedestrian mall area at night. In
addition, we would ask that restaurants and bars that serve alcohol be more serious about ID'ing
people. Serving alcohol to a minor should also be more consistently punished. If a business has had a
proven minor found on their premises with alcohol, both the minor and the business should be fined,
and after a set amount of busts, their alcohol license should be suspend or altogether removed, like the
Union Bar. It set a good example for the rest of the bars to see. By doing this we hope that it will lower
the rate of underage drinking, and ultimately, decrease the number of rapes on campus, making the
community a safer place for everyone.

Thank you again for your very diligent and very thorough style as you review crime evidence on behalf of my
own very emphatic allegation that one or more current or former employees or officers of the Austin Police
Department (APD) of the City Government of Austin in Austin, Texas, have allegedly violated the law in a
context allegedly victimizing myself, John Kevin McMillan of Austin.
Today I have one more tentative possible crime report for you that points to possible alleged antipathy toward
me and alleged defiance of my own very honest and accurate crime reports to APD, by one or more of the
current APD officers.
At roughly 2:30 p.m. this Tuesday, June 3, 2014, I was myself standing politely while wearing my Outback
Steakhouse black -shirt work uniform at the Capital Metro Route 383 bus stop situated along the northbound
access road to U.S. Highway 183, also known as Research Boulevard.
I had just completed a workshift of mine as a maintenance staff employee at the first -rate Outback Arboretum
corporate -owned chain steakhouse location. At the cited bus stop, I was waiting for a Capital Metro bus that
would transport me to a bus stop near my first -rate Luby's Lakeline cafeteria restaurant workplace, where I was
scheduled to begin work duties at 4 p.m. this Tuesday.
Suddenly and at roughly 2:30 p.m. this Tuesday, June 3, a clearly - identified Austin Police Department patrol
car drove past me and toward the intersection of Research Boulevard and Duval.
I happened to glance at that APD patrol car with a possible spontaneous but civilly- expressed grimace on my
own face.
The sudden spectacle of an APD patrol car had reminded me once again of the alleged very alarming and truly
outrageous failure by a variety of APD officers to pursue ANY actual CRIME investigation of any of my
dozens of factual and honest crime reports to APD throughout a multi -year period ever since late 2011, in
particular, about myself being a victim of alleged felony anal -rape crimes and personal - injury crimes, including
alleged illegal contamination of my store - bought foods and store - bought beverages inside my bolt - locked rental
aprtment unit.
I have alleged, and I continue to allege, that I myself have been subjected against my wishes to alleged
personal - injury- crimes, including during my sleep, and to alleged anal- rape- crimes during my sleep, on a daily
and year -round and multi -year and still -to- this -day continuing basis inside my bolt - locked private bedroom of
my bolt - locked rental apartment unit at Wind River Crossing Apartments in Austin.
In regard to the incident at about 2:30 p.m. this Tuesday, June 3,
I was dismayed to observe that a male APD officer sitting on the front passenger side of an APD squad car
made what appeared to be an obscene gesture as that squad car drove past me.
The male APD officer in question thrust his thumb and index finger against the upper portion of the interior of
the passenger -side window, with that APD officer placing his thumb approximately five or six inches from his
index finger.
It was apparent to me that that male APD officer was possibly making an obscene gesture at me in which he
was indicating the possible "length" (five or six total inches) of his own phallus.
The "vulgar gesture" interpretation of what I observed this Tuesday occurred in a multi -year context in which,
as I have mentioned to you before with factual details I provided you in writing, several APD officers dining in
their APD uniforms inside IHOP Duval restaurant allegedly whistled at me one night with apparent
sarcastic and obscene vulgarity toward me as I walked alone toward the men's restroom inside IHOP Duval
restaurant one night in either 2011 or 2012.
I was the only guest walking anywhere inside IHOP Duval restaurant at the time of that vulgar whistling
incident suggestive of an obscene leer having been allegedly directed at myself by the cited three or four male
APD officers seated at a dining table inside that ACG- franchise -owned chain restaurant situated along the
southbound Research Boulevard a few blocks south of Duval.
That obsene- whistling incident by APD officers in uniform occured shortly after I had myself handed to a male
APD officer as crime evidence one or more video cards I owned that contained photographic evidence obtained
for myself during my sleep of one or more alleged illegal intruders inside my private bedroom of my Wind
River Crossing apartment unit during my bedtime hours.
As I have also reported to you previously, one male Anglo
APD officer in 2011 or 2012 very surprisingly stated to me as he and several colleagues of his stood on the
outdoor balcony in front of my apartment unit at Wind River Crossing Apartments:
"So if this doesn't turn out for you (criminal -law complainant and self - identified crime victim John Kevin
McMillan) as you had wanted, and we (APD) don't arrest anyone on any of this, are you going to turn
violent toward any of us (APD officers) ?" (approximate quote of that Anglo APD officer's very surprising and
completely unsolicited comment to me outdoors on the balcony in frontIof my apartment unit).
As I mentioned to you before, I did politely and orally assure that particular APD officer that I myself am
dependably civil and law- abiding at all times.
Investigator Carter and Prosecuting Attorney Drummond, I hope that this follow -up crime report is helpful to
each of you as you review whether and when your courageously vigilant Public Integrity Unit will file felony
criminal charges in a court of law in Austin against one or more current or former APD employees.

My name is Tony Villhauer. I am a life long Iowa Citia�4a�e M
participated and volunteered for many activities and ortu;atio in
Iowa City and Johnson County. Today, I reach out to you as a member
of the Fraternal Order of Eagles which has been a fixture in Iowa City
for 110 years.
The economy has hit many people and groups hard over the past 10
years, including government entities, forcing many difficult decisions
trying to prioritize monetary expenses. Many fine and worthy
organizations and their deserving causes are left unfunded or under
funded, not because for not wanting to help, but because of an inability
to help.
Non profits are then called upon to help fill the gap and to help where
government is no longer able to. In order for these groups to do so,
limiting restrictions must not be placed upon them. We must make it
easier for them to help others.
Here in recent memory, we in Eastern Iowa have dealt with floods,
drought, extreme winters, tornados and a serious down turn in the
economy, which is not groundbreaking news to any of you.
As a non profit fraternal organization, we've also lost business when the
Iowa Clean Air Act was enacted, prohibiting smoking in public
establishments. However, I believe the vast majority of our members
have not only adjusted to this change, but would indeed hesitate to
return to the way things were prior to this law.
Yet there is one local law that hinders those of us in Iowa City that,
while certainly not a cure all for all economic concerns, would indeed
help to get things pointed in the right direction. That would be Iowa
City allowing the use of what I'll call gaming tickets to be used to
purchase all items a place of business offers for sale.
I'll try to illustrate the difference in our ability to give: in 2008, we took
in $18,480 from video games. This money paid our utilities and a
portion of our maintenance for the year. In 2009, the year the Iowa
smoking ban was enacted, even though it only was in place 6 months
that year, our video game revenue dropped from $1540 a month to
$900 a month, or $10,800.50 for the year.
When the Iowa City restriction on video game tickets took place in
2010, that same income drops to $484 a month, or $5813.25 a year in
2011, the first full year after the regulation passed. Now if I figure that
correctly, that's a 69% drop in money, or about $12,000 that could have
been used as contributions to the youth baseball and softball programs,
party after proms, Big Brothers /Big Sisters, ICFD benevolent fund,
food banks, free lunch programs, etc., but instead was used to pay
operating expenses. And no, we take no administrative fees, our officers
are all volunteers, and 100% of charitable donations go to the charity
designated.
For this reason, I ask that you consider removing the restrictions on
video game ticket usage, if not for all establishments, at leastjor non
profit groups, so we can be on equal footing with surroi
communities and be able to continue supporting worth �aJf es the
greater Iowa City area.
As a clarification, we do not do this as some other establishments have
done, but ask if using the tickets won to purchase gift certificates would
be acceptable.

My name is Tony Villhauer. I am a life long Iowa Citian (4th generation). During my life I was
taught that giving back to the community is of vital importance. While not on the same public
level as you, I believe we see eye to eye in our belief Iowa City is a great place to live, and we
would love to make it even better.
I have particpated with various groups through the years - -- -Iowa City Boy's Baseball, Babe
Ruth, the Democratic Party, Special Olympics, Iowa City Officials Association, to name a few.
I am now a Past President of the Iowa City Fraternal Order of Eagles. We have 11 national
charities we support, and many many local causes, from the ICFD benevolant fund, Big
Brothers/Big Sisters, Wild Bills Coffee Shop, many youth leagues, after prom parties, etc,etc,etc.
More and more groups are in need of help, and we would love to do more. If we only could.
We have 'video games' that pays tickets to the winners. In years past, the winner could redeem
those tickets for anything in our establishment - -- -food, shirts we might be selling, and yes even
beverages. The income from those machines used to pay the large portion of our operating
expenses -- -heat, water, snow removal, etc.
A few years ago the then council decided that these tickest would no longer be allowed to be
used for beverages. As you can imagine, the use of such ticket machines dropped vastly. Thus,
more of our revenue is going to everyday expenditures leaving less for charity. And yes, we give
ALL to charity NO salaries to officers, no percentage to us, etc.
I would like to ask the council to consider recinding the local law that blocks the usage for
tickets won in such video games. To my knowledge we are the only community with this law,
putting Iowa City charities behind the eight ball in be able to assist as many as we would love to
help. Eve if it is only ammended to allow non profit orginizations this small break, it would help
so many people.
If their is anything I, or any other officer of the Eagles could do to answer questions or further
this cause , please do not hesitate to contact us.

It has come to our attention that many licensees In Iowa City have gaming devices In their
establishments that distribute tickets to winners with which they can purchase goods and
services at the establishment While the devices are regulated by the State, and may be legal .
under State law, licensees must be mindful of Iowa City Ordinance 4-5-7, as folkw a:
4-5 -7: LIMITATIONS ON SALES:
A. Unlawful: It shag be unlawful for a holder of a liquor lo*ol license, or wine permit or
beer permit, or he employees or agents, to do any of the following:
... 6. Encourage or-permit any game or contest or tournament of any kind which
Involves drinking any alcoholic liquor, wine, or beer or the awarding of alcoholic
liquor, wine, or beer as a prize. (emphasis added.)
Because -of tho limitations of this ordinance, no alcoholic, beverage, bar tab, or bar credit can be
awarded as winnings from these gaming devices. More specifically, no winning tickets or
vouchers can be redeemeO for alcohol. It bears reminding that no alcoholic beverage, bar tab,
-or bar credit can be awarded as a prize for any other contests, games or tournaments, such as
Halloween or other costume contests.
Should you have any questions regarding the legality of any drink special or contest, please do

Dozens and dozens of people were in the building recently for the new art display. Other big events
happen. WITH NO PROGRAM GUIDES available. Sad. Sad. Double sad. ...... Yes, a stack of Program
Guides were on First Floor near a door, as well as the usual supply near the flag. But the other
Floors ? ? ? ?? Other days ? ? ? ??
And if allowed, supplies of the P.G. should be at libraries..... Iowa City, Coralville, and other towns in Johnson
County. We must reach out to people and let them know what we have.

RE: CU14 -00001 Verizon Wireless Communication Tower
Johnson County has received an application from Verizon Wireless requesting a conditional use
permit for 9.2 acres of land located on the northwest corner of 420th St SE and Taft Ave SE. The
applicant proposes to contract SBA Communications to construct a 195' self- supported
communications tower. The property is located east of Iowa City's City Limits in Fringe Area B and is
within the growth area of the city.
The Johnson County Unified Development Ordinance permits cities to review conditional use permits
for applications within their extra - territorial jurisdiction. A conditional use permit requires a four -fifths
majority vote of the County Board of Adjustment to approve a permit opposed by Iowa City City
Council.
Zoning Requirements:
Communications towers are allowed in the County Heavy Industrial Zone by conditional use permit.
Prior to obtaining a permit, several conditions must be met. One condition requires that the tower
base be located a distance of 100 percent of the tower height from adjoining property lines. This
prevents towers from falling into other property and protects surrounding property owners from
damage. While the tower height is 195', the tower's center is 107.92' from the abutting property to the
west and 59.65' from the railroad Right Of Way to the north. This application does not comply with
that condition.
Compatibility with City Plans:
The property is located within the City's growth area. Therefore it is likely that the property will be
annexed into Iowa City in the future, and upon annexation, will likely be zoned industrial. Iowa City
industrial zones have a similar requirement to the County's in that the tower base must be located a
distance of 100 percent of the tower height from adjoining property lines. While staff believes that a
communications tower is an appropriate use for industrial zones, it cautions waiving the County's
setback requirements for the location of the tower.
STAFF RECOMMENDATION:
Staff recommends that Council forward a letter to the Johnson County Board of Adjustment
recommending that the application submitted by Verizon Wireless for a conditional use permit for the
construction of a communications tower be approved subject to compliance with Iowa City and
Johnson County setback conditions and Federal Aviation Administration approval if required by FAA.

Discussion of an application submitted to Johnson County from Verizon Wireless
requesting a conditional use permit to allow a 195 foot tall communications tower on 9.2
acres of land located on the northwest corner of 420th St SE and Taft Ave SE, in Area B of
the Iowa City and Johnson County Fringe Area.
Miklo indicated that this is in Fringe Area B of the Iowa City /Johnson County Fringe Area
Agreement. The County Zoning Code provides for City review of Conditional Use Permits when
they are within two miles of a city. He said this area will likely be annexed into the city and
zoned Industrial in the future. He said that such towers are allowed in the city's industrial zones
proved that the tower be setback from the property line a distance at least equal to the tower's
height. He said the application has been revised to adhere with the City's requirement regarding
the setback and staff recommends approval.

Dear Members of the Board,
The Iowa City City Council and the Planning and Zoning Commission have reviewed the
request submitted to Johnson County by Verizon Wireless and SBA Communications, to allow
the construction of of a 195' self - supported communications tower on the northwest corner of
4201h St SE and Taft Ave SE. The Johnson County Zoning Code requires review by the City for
all conditional use permits for property within the Fringe Area.
In a memo dated May 27, City Staff noted that the site for the conditional use is within the Iowa
City growth boundary, and it will likely be annexed into the city as an industrial zone. A
communications tower is compatible with that zoning, given compliance with both the City's and
County's requirement of locating the tower base a distance of 100 percent the height of the
tower from adjoining property lines. At its June 17 meeting, the Iowa City Planning and Zoning
Commission recommended approval of this conditional use permit subject to the setback
conditions and Federal Aviation Administration approval if required by FAA. The City Council
concurs with the Commission and recommends that the conditional use permit requested by
Verizon Wireless be approved subject to these stipulations.
