HomeMy WebLinkAbout2014-08-19 Public hearingPublish 8/5 NOTICE OF PUBLIC HEARING TO CONSIDER APPROVAL OF A PROPOSED AMENDMENT TO THE CITY - UNIVERSITY PROJECT I URBAN RENEWAL PLAN IN THE CITY OF IOWA CITY, IOWA The City Council of the City of Iowa City, Iowa will hold a public hearing at its meeting on August 19, 2014 which commences at 7:00 P.M. in the Emma J. Harvat Hall, City Hall, Iowa City, Iowa, or if said meeting is cancelled, at the next meeting of the City Council thereafter as posted by the City Clerk to consider adoption of the City- University Project I Urban Renewal Plan, Amendment No. 12 (the "Plan ") which adds the following projects to the Plan: The Chauncey, the Harrison Street Townhouse project, a downtown hotel, streetscape improvements in the Central Business District and park planning for the Riverfront Crossings district. A copy of the plan is on file for public inspection in the office of the City Clerk, City Hall, Iowa City, Iowa. The City of Iowa City, Iowa is the local agency which, if such Plan is approved, shall undertake the urban renewal activities described in such Plan. The general scope of the urban renewal activities under consideration in the Plan is to assist qualified industries and businesses in the Urban Renewal Area through various public purpose and special financing activities outlined in the Plan. To accomplish the objectives of the Plan, and to encourage the further development of the Urban Renewal Area, the plan provides that such special financing activities may include, but not be limited to, the making of loans or grants of public funds to private entities under Chapter 15A of the Code of Iowa. The City also may install, construct and reconstruct streets, parking facilities, open space areas and other substantial public improvement, and may acquire and make land available for development or redevelopment by private enterprise as authorized by law. The Plan provides that the City may issue bonds or use available funds for such purposes and that tax increment reimbursement of such costs will be sought if and to the extent incurred by the City. Any person or organization desired to be heard shall be afforded an opportunity to be heard at such hearing. In recent months, several potential urban renewal projects in the City- University Project I Urban Renewal Area have come to light and this amendment would allow Council to consider financial participation in them. History /background The original City- University Project I Urban Renewal Area was established in 1969 and has been amended eleven times to accomplish various urban renewal projects. Amendment #12 would allow Council to consider new projects within the existing urban renewal area. One would allow for the use of the tax increment in the district to help finance the costs of the Central Business District streetscape improvement project. The streetscape project includes improvements to public infrastructure that residents and the downtown business community depend upon and for public streetscape amenities that set Iowa City apart. The other public infrastructure project includes planning expenses for the new Riverfront Crossings Park. Developers are also working out the details of several projects that are likely to be presented to the City Council for consideration of Tax Increment Financing. They include The Chauncey at the corner of Gilbert and College Streets, the Harrison Street Townhouses at the corner of Harrison and Dubuque Streets, and a high rise hotel project on S. Clinton Street across from the new School of Music. While details of each of these projects are still being refined, this amendment will allow for the discussion of City participation in them. The decision to move forward with any of the projects would be made in the future and require Council approval of development agreements for each. Discussion of Solution The following paragraphs document the procedural requirements completed for amending an Urban Renewal Plan: a) Resolution of Necessity A Resolution of Necessity to consider Amendment #12 to the City University Urban Renewal Plan was adopted by City Council ( #14 -211) on July 15, 2014. b) Consultation with Taxing Entities August 4, 2014 Page 2 Notice of a consultation between the City of Iowa City and the affected taxing entities (the school district and the county) concerning the proposed Amendment #12 to the City- University Urban Renewal Area was sent with individual letters of invitation to the meeting. The consultation was held on July 25, 2014, at 12:00 p.m. in the City Manager's Conference Room in City Hall. Rod Sullivan of the Johnson County Board of Supervisors attended. State law requires that the taxing entities must submit any written recommendations for modification to the proposed division of revenue within 7 days after the consultation. There were no submissions. c) Notice of Public Hearing On August 5, a Notice of the Public Hearing on August 19 regarding Amendment #12 to the City- University Project 1 Urban Renewal Plan will be published in the Iowa City Press Citizen, meeting the requirement that the notice be published between 4 and 20 days prior to the public hearing. Recommendation All procedural steps have been completed and staff recommends adoption of the City- University Project 1 Amendment #12. Originally adopted in 1969, the Plan has been previously amended eleven times. Of those previous amendments, land was added to the Area pursuant to the 2001 and the 2012 Amendment No. 10. The Original Area, the 2001 Amended Area, and the 2012 Amendment No. 10 Amended Area, comprise the Area. The Area is depicted on Attachment No. 1 and legally described on Attachment No. 2, attached hereto. No land is being added to the Area by this Amendment. This amendment does not change the Plan's previously approved project area objectives or urban renewal activities. Except as modified by this Amendment, the provisions of the original City - University Project I Urban Renewal Plan, as previously amended, are hereby ratified, confirmed, and approved and shall remain in full force and effect. In case of any conflict or uncertainty, the terms of this Amendment shall control. Subject to the foregoing, it is estimated that the cost of the Proposed Urban Renewal Projects described above will be approximately as follows: SECTION 4 — URBAN RENEWAL PLAN AMENDMENTS If the City of Iowa City desires to amend this Plan, it may do so in conformance with applicable state and local laws. SECTION 5 - EFFECTIVE PERIOD This Urban Renewal Plan Amendment #12 will become effective upon its adoption by the City Council. Notwithstanding anything to the contrary in the Urban Renewal Plan, any prior amendment, resolution, or document, the Urban Renewal Plan shall remain in effect until terminated by the City Council, and the use of incremental property tax revenues, or the "division of revenue," as those words are used in Chapter 403 of the Code of Iowa, will be consistent with Chapter 403 of the Iowa Code. SECTION 6 - REPEALER Any parts of the previous Plan, as previously amended, in conflict with this Amendment are hereby repealed.
