I am referring to the factual report you received this year which stated that a variety of employees or officials of five different departments of the City Government of Austin in Austin, Texas, in a multi -year period that began in mid -2011 reportedly consulted the City Attorney's Office of the City Government of Austin in a context that referred to myself, John Kevin McMillan of Austin. I am writing to you today to politely ask you if I could please receive from you as soon as possible a copy of an official transcript of any action of any type that your Iowa City Council took anytime this year in regard to that particular cited agenda item at your May 20, 2014, City Council meeting in Iowa City. This Monday morning, for instance, I was awakened abruptly in the middle of my sleep at about 6:35 a.m. with discomfort in my anus and constriction or tightness to the mouth of my anus when I checked using my finger. I had taken a shower just before I went to bed inside my bolt - locked private bedroom at about 1:30 a.m. today. I also noticed a baffling nasal sensation in my nostrils (also noted by me with handwritten notes I jotted down on a piece of paper in my bedroom at the time of the incident). Oddly enough, at 6:37 a.m. I suddenly heard the sound of running water for 10 or more consecutive minutes that appeared to be someone taking a long shower in their bathroom in Apartment 315 (the apartment unit situated directly below the apartment where I reside as an official tenant) or possibly in Apartment 314 (a ground -level apartment unit on the other side of the Building, Building 3, where I reside). One of the apartment- management- team - approved tenants in Apartment 315 is reportedly a rock -music musician and tall slender man with the first name of "Danny." I do not know Danny's last name. I have told Danny about security concerns I have had inside my apartment unit, this during a brief and polite outdoor conversation I had with him near Building 3 of this complex in 2012 or 2013. At that time, Danny replied to me that if he himself ever observes anyone breaking into my apartment unit, he will personally run up to the front balcony in front of my rental unit and physically assault that alleged intruder, Danny stated with emphasis. Danny added that he is himself a biological father with a young son, and that partly for that reason Danny is very mindful of the importance of first -rate home security for myself and for himself and for others as well, he indicated. In that brief outdoor conversation I had with Danny in a recent prior year, I then politely stated to Danny that I definitely DO NOT want him to physically assault any suspected intruder. Instead, I stated to Danny, I would appreciate it if he would please call 911 and report the incident to the Austin Police Department if Danny ever at any time observes any possible illegal intruder or trespasser on the fully -lit (I keep the front porch lights on at all times during my bedtime hours) outdoor balcony in front of my rental apartment unit, Apartment 325, at Wind River Crossing Apartments. I might also note that I myself have never once myself directly observed Danny anywhere on the balcony abutting my apartment unit (Apt. 325). Nor have I myself ever once directly and on an in- person basis ever at any time observed Danny anywhere inside Apartment 325 at any time. I am not a personal friend or associate of Danny's. My current apartment- management -team- approved roommate, "John Douglas Martin" his own stated legal name, does occasionally chat with Danny in an apparently friendly manner, and I can hear their chatting with each other from inside Apartment 325. I believe that Mr. Martin has occasionally also been physically present inside Danny's apartment unit while chatting with Danny in an often jovial or good- humored manner featuring some chuckling on Mr. Martin's part, if I remember correctly. He is currently unemployed, after he abruptly "quit" his most recent job several weeks ago. That job was one for which Mr. Martin would leave this apartment unit at about 3:30 a.m. every weekday, from what he told me at the time. He stated that he did assembly work for a computer - industry company, but he never stated the name of that employer. As a former full -time reporter for you who had a very good accuracy record in my reporting for you at "The (El Campo) Leader - News" general - circulation semi - weekly newspaper in El Campo, I want to thank you for kindly volunteering to me on the phone in the cited most recent phone conversation I had with you that you regard me as being a "lovable" single adult gentleman. "You remind me of a Teddy Bear, and a lot of people want to cuddle with you," you then kindly commented to me on the phone. I hope you won't mind if I take this opportunity to politely mention to you with emphasis at this time that I value leading an always -sober and completely celibate -by- choice lifestyle in which I have as little physical contact as is humanly possible with other people during this period. Those two adult case workers for the St. Albert the Great Roman Catholic Church were very firm on that point as I discussed with an adult female case worker and an adult male case worker for the St. Vincent de Paul Society of that congregation why I was myself experiencing severe financial problems at that time, and why I had a definite need for financial assistance from the Roman Catholic Church at that time. As part of my in- person interview with those two Catholic Church case workers, I did refer to my being victimized by unwanted and illegal intruders during my sleep inside my bolt - locked apartment unit, and I also cited the expenses I had myself incurred from having to myself document crime evidence of illegal intruders inside my private bedroom, since the police were unwilling to install temporary APD- sponsored electronic surveillance inside my bedroom that I had repeatedly sought from APD ever since 2011. I continue to find it very baffling to sense that I had a need to urinate on three separate occasions this morning after being abruptly awakened in the middle of my sleep. I am baffled by that partly because I had urinated very thoroughly before going to bed shortly before midnight on Sunday. This suggests to me that one or more alleged illegal intruders inside my bolt - locked private bedroom are allegedly subjecting me to liquids being forced upon me against my wishes during my sleep. I wish to politely emphasize that I have NOT authorized ANY so- called "medical services" for myself during periods when I am sleeping. And my current primary care physician, Dr. Edie Shulman, did state to me during my most recent follow -up medical appointment with her (on Friday, April 4, 2014), that she is NOT aware of any medical services provider anywhere in the world that is authorized to be inside my private bedroom in any context during periods when I am sleeping on my bed. I continue to find it curious that when I am awakened in the middle of my sleep with pain or discomfort in my anus among my medical symptoms, I frequently note that I do not hear any snoring emanating from the living room at that time. My roommate, an older man in his 60s, sleeps alone on a bed he owns in the living room, and he almost always snores when he is in fact asleep. More recently, I was informed by City of Austin Law Department, this in another signed official legal letter from Assistant City Attorney Elaine Nicholson seeking a ruling from Texas Attorney General Gregory Abbott, that "numerous" (exact quote from that legal letter Ms. Nicholson wrote) employees of the Austin Police Department over the course of a two - total -month period that began April 16, 2014, had each consulted the City of Austin Law Department in a context directly referring to myself, John Kevin McMillan of Austin. I have been asked by the City Manager's Office to provide some information and assistance in response to your August 20 letter to the Iowa City City Council. Mediacom currently holds a non - exclusive, state - issued cable TV franchise agreement that includes Iowa City in its list of service areas. Prior to November 2013, a non - exclusive municipal agreement had been in effect. However, the City's authority was limited to only cable TV service. The City's ability to regulate cable TV rates was limited to only the basic tier of service and in our present situation, the State is also limited in this way and is not able to control Mediacom's Internet service pricing. Although the City does not have the authority to control any aspect of cable Internet service, we do maintain an informal working relationship with the local Mediacom office and are often able to provide some level of resolution or understanding with regards to service issues experienced by local subscribers. If you have experienced specific issues with your service from Mediacom, I would be happy to assist by working with our local Mediacom representatives to attempt to resolve them. While the City has made efforts over the years to explore opportunities for bringing in competition, the end result is that cable -based companies find it cost - prohibitive in a market of Iowa City's size to build a parallel cable system for providing services. The cost of building such an infrastructure is just too great, especially given that only a percentage of the current cable TV and Internet subscribers would sign up for their service, since the customer base would be split between the two providers. The City, however, continues to seek opportunities to expand high -speed Internet offerings for the benefit of its residents and local businesses. Last year, the Iowa City Telecommunications Commission conducted a survey of residential broadband Internet consumers and found a trend in local consumer dissatisfaction with broadband service (including DSL), especially as connected to cost and value of the services provided. Recently, our local Mediacom representatives have informed me that system upgrades have just been completed in Iowa City to provide faster speeds to customers subscribing to 20 Mbps service and up at no additional charge. This seems to be at least a small step in the right direction. Also, the Federal Communications Commission's Office of Engineering and Technology and Consumer and Governmental Affairs Bureau released a 2014 report on consumer wireline broadband performance in the U.S., finding that Mediacom was, on average, delivering over 100% of its advertised speeds during hours of peak usage. Of course, system performance can vary greatly between service areas, with many factors playing a part. Again, I would welcome any information you may have regarding the performance of service in your area so that potential technical issues can be addressed. Currently two animal service officers patrol Iowa City responding first to citizen requests for service; emergency calls of dangerous, sick, injured, abused and loose animals. All parks are patrolled during the hours of operation Monday through Saturday. At times when we are closed or no animal service officer is on duty, the police or community service officers handle our calls for service. We understand the issue with timing that occurs as citizens often appear to be violating the leash law during our closed hours of operations. To address this issue, community service officers, when not handling higher priority calls, patrol park areas during high peak times early mornings and evening hours. It does assist us to get direct calls from citizens when the violation is occurring or to give us an idea of regular times and areas of the city where these issues are taking place so we can better address them with special patrols or catch the dog and owner in the act. Because of our current animal shelter location, officers pass Terry Trueblood Recreation area many times a day. A number of warnings and citations have been issued to citizens violating the leash law there. In addition 68 calls and patrols have taken place since January of 2014 in the area of Wetherby Park. Numerous animals have been impounded, fines assessed and notices issued. We will continue in these efforts to keep the area safe but realize we cannot catch all violations that may occur. To address your concerns, I have taken the following actions: 1. 1 am working with the Park and Recreation Director, Mike Moran to get new signage posted. He explained there is a problem with the signage being stolen. New signage will be posted soon and will be better monitored for replacement in the future. 2. Extra patrols have been set up in the specific locations you mentioned in your letter. 3. 1 have contacted Johnson County Dog Park Action Committee for their assistance with additional advertising of the designated off leash dog parks in the City. 4. 1 will be working with the press and City T.V. to put together some Public Service Announcements. Upon reading letters published in the IC Press - Citizen addressing the problem of loose dogs, I know others are also concerned about the issue. Can the Council consider action to help reduce or eliminate this problem? I live in the southeast area of Iowa City and like to walk my dog through the neighborhood and around the trail at Wetherby Park. At Wetherby Park I've numerous times witnessed people walk their dogs on leash to the park, but as soon as entering the park, they let their dog(s) off leash to run around. I also like to walk my dog on the trail at Terry Trueblood Recreation Area, but there are frequently loose dogs running around there as well. I'm becoming reluctant to walk my dog at either park. This morning I saw two loose dogs running through my neighborhood and called Animal Control. The loose dogs escaped and couldn't be found. Last Thursday, I encountered no less than six loose dogs while walking my dog. In other words, it happens a lot. I'm a responsible dog owner. When walking my dog, I use a special harness and leash to exert as much control as I can over my medium -size dog who becomes excited and can be aggressive (or protective) when encountering other dogs. Last Thursday one of the six loose dogs we encountered came running up to my dog while we were walking. My dog grabbed the other dog by the neck and while snarling and growling wouldn't let go. I felt sure he meant to kill the other dog. Fortunately, the other dog managed to get loose, but it was a very scary situation. I'd like to take a peaceful walk with my dog, knowing other dogs are confined in yards or under leash control. There used to be signs at both Wetherby and Terry Trueblood that stated all dogs must be on leash. The signs have disappeared; they've been gone for at least a year or more. It seems without the signs, there is tacit approval of unleashed dogs. And the more dog owners see other dogs running loose -- whether in neighborhoods or in parks- -they might assume there is either no leash law or a law that isn't enforced. And that's what I'm concerned is happening... even more loose dogs. I don't like being put in the position of continually calling Animal Control or the police department about loose dogs. Will you consider addressing the problem? Something needs to be done ... perhaps a feature article in the newspaper that reminds people of the tie -up ordinance, or random checks at parks for loose dogs, or posting flyers, or all of the above. I have driven taxis in Iowa City for 17 years with Yellow Cab and currently Marco's Taxi. Recently, Iowa City Police Chief Sam Hargadine recommended updating our local taxi ordinance for safety and accountability reasons. All of his recommendations are good ideas and should be made law. 24 -hour dispatch from an office, city- issued photo IDs, requiring owners to know who drives what cab and when, and unique color schemes for each company - these are all very important. Some have objected to the cost of painting cabs as onerous. Since it's done in virtually all taxi markets nationwide, even worldwide, I can't understand the objection. Two new companies managed to paint all their cabs in 2012. It establishes a brand and it's expected behavior, a cost of doing business. Hargadine's main recommendation would require drivers to be employees rather than independent contractors, and require vehicles to be owned by each taxi business. Marco's is currently the only local company which employs its drivers. As an employee, I favor this, but I can see why owners are not thrilled with the idea. Employed cabbies cost more. Ownership of cabs, however, should be required. Ownership of a taxi makes one more responsible for what happens in it. "Owners would have an expressed interest beyond simply collecting fees from drivers," Chief Hargadine writes. Critics claim these recommendations are a wish -list for established companies. Yellow Cab and Marco's are often assailed as anti- competitive monopolies afraid of competition. Over the last 10 years Yellow Cab's share of taxis in town has gone from 50% to about 16 %, Marco's has about 9 %. What sort of monopoly is it when your market share keeps going down? In September of 2013 American Taxi alone had 36 registered taxis (and two unregistered) on the streets at one time, the most by one company in Iowa City history, I believe - twice as many as Yellow Cab had. The vast majority of these cabs are just guys in cheap vans with a name and a toplight slapped on. No overhead. And no accountability. The Guys With Vans Model allows drivers to come to Iowa City from other markets at peak times - mid - August to Spring Break. They provide minimal service during the slower times of year. If they have offices at all, they are not staffed much of the time. They answer phones only when it's convenient for them to do so. They refuse unfavorable fares, inflate prices at busy times, and when busy times end - they leave town. Leaving this situation up to the markets to decide is fine, but the cost will come in security and accountability - as it already has with the huge loss of time and resources during the recent sexual assault investigation. Please Iowa City, make them OWN it. If you want to run taxis here, you should have to buy cars and paint them. You should have to maintain an office, answer your phone and charge posted rates. You should know who is driving your taxis and when. The failure to make any changes will make taxi services indistinguishable from Uber and similar transportation providers. If you think there are problems with security and accountability now, just wait until all of our so- called taxis are indistinguishable from civilian vehicles (not to mention under - insured or uninsured). Police Chief Hargadine's recommendations are all good. Please take them seriously and do the hard work of regulating taxis as he suggests. And while you're at it, you might also require taxis to have GPS *, security cameras, and credit card options for passengers. Many comparable city markets already do so. * Five local cabbies had guns pointed at them in robberies last year. GPS helped police solve two of those crimes in mere minutes. - Perry A. We ask that the City Council, in evaluating these and future housing proposals, place greater priority (for that matter, at least some priority!) on the need for more senior - friendly housing in and near downtown, i.e., within a roughly 1.5 -mile radius of Old Capitol. Our definition of senior - suitable housing — whether rental or owner- occupied — would accommodate a wide range of income brackets and include features such as these: • Universal design, e.g., wider doorways, grab bars, and other amenities for individuals who are or may become mobility- impaired and needing wheelchairs and /or walkers • Shared amenities such as a fitness center, game room(s), and /or other spaces designed for recreation and socialization • Close proximity to public transportation, dining, groceries, and other services We do not believe such projects need to be confined exclusively to seniors, however one might define that age category. In fact, one of the chief attractions of living on the Northside, as is true of most of Iowa City's historic neighborhoods, is that we are surrounded by neighbors young and old, including college students, young professionals, and families with children. We are not advocating the creation of a "retirement home" in the midst of downtown; rather, we believe the time has come to shift some portion of the new housing being built in and near downtown (including Riverfront Crossings) to consider the wants and needs of Iowa City's aging population. Given the rapid expansion of predominantly student - oriented housing projects in and near downtown in recent years, we fear that seniors are being squeezed and priced out of close -in housing options. This phenomenon hurts downtown — and hence Iowa City as a whole — in several ways: Aging Boomers — those of us who are long -time residents as well as recent transplants — are a growing segment of the local population (see "City Faces Aging Population," the Daily Iowan, February 17, 2014). According to the U.S. Census Bureau, approximately 8 percent of the Iowa City population is above age 65. Across the state, 15 percent of Iowans are age 65 and older, a number that state officials expect to approach 20 percent by 2025. We can and should expect similar increases here. Iowa City has been cited in numerous national publications as an ideal retirement destination. We believe the City should be taking steps to ensure that our community retains this distinction by making it easier for seniors to live within walking distance of downtown and its amenities. • Based on the number of University retirees and other educated professionals among Iowa City's 60 -plus population, it would appear that this segment of the community has considerable discretionary income, which they enjoy spending downtown. Observe the age mix at downtown restaurants, bookstores, clothing stores, music festivals, and other venues and attractions: We may not be hanging out in the "warehouse bars" any longer, but you'll find us everywhere else, enriching the local economy. We don't believe it's an exaggeration to state that senior citizens are keeping Iowa City's diverse nonprofit community alive and well, including the arts - related organizations that have made downtown Iowa City so attractive. The Englert Theater, Summer of the Arts, Riverside Theatre, FilmScene, and the University's many arts and culture programs — none would be thriving today without donors and volunteers age 60 and above. Enabling us to live "where the action is" keeps us further engaged with and investing in these essential community assets. • Promoting more senior - suitable housing downtown contributes to Iowa City's many efforts to "go green" by reducing reliance on motorized transportation and encouraging walking and biking. These activities are healthier for all individuals. With a new UI dorm nearing completion, and literally thousands of student - focused housing units in and near downtown, surely we have reached a student - housing saturation point. Conversely, it appears that only three housing projects in downtown Iowa City — Ecumenical Towers (81 units), Capitol House (81 units), and the Citizen Building (18 units) — are designated as "supportive housing" for the elderly and /or disabled, and those projects are restricted to residents of limited income. Plaza Towers is home to many seniors, but those units, as well as the new units at Park @201, are cost - prohibitive for many. Between these extremes, we believe there is a large and growing market of active Boomers eager to "downsize to downtown." To reiterate: For these reasons and more, we urge the City Council to encourage developers to propose more senior - friendly housing projects in and near downtown. As discussion of plant demolition solidified, ITS began planning the process to reconfigure fiber optic cable around town to account for the loss of this central hub location. With that plan accelerated, competitive quotations were sought. Discussion of Solutions: Plans were developed and competitive quotations were sought.
