Council Members,
I am writing to provide feedback regarding the City's pilot mobile food vendor program.
I discussed the mobile food program with Geoff Fruin as it was developed and agreed with the method of the
pilot, which permits mobile food vending in areas 200 feet from brick and mortar stores. It was a fair
approach.
I also spoke with Rockne Cole and Kyle Siek about their beliefs that a strong mobile food program would
actually draw more people to Downtown and pockets of Iowa City where the mobile vendors would be allowed
to locate. After reading the comments in the Daily Iowan this morning (below) and discussions with an ICDD
business that chose to vend in Chauncey Swan park as part of the program, I think it is important to weigh in on
the future of this program while the conversation is relevant. My understanding is that Kyle and others will
come to you to ask to change the parameters of this program so that mobile food vending is allowed to locate in
parking stalls and in high traffic areas, mostly likely Downtown.

It appears that the mobile food vendors have realized that they themselves are not traffic- generators, as they
initially had envisioned, but require pedestrian traffic to entice walker -bys to purchase their food. The pilot was
successful in helping everyone understand this.
The ICDD does not support modifications to the current mobile food program. Mobile food vendors can an
enrich a "food desert," for other areas of town, but Downtown Iowa City and the Northside Marketplace are
well serviced with food. Downtown currently hosts 6 mobile food vendors as it is. We are not interested in
allowing additional mobile food vendors Downtown for several reasons. It does not support our mission to
diversify our tenant mix. We have over 100 food and beverage brick and mortar businesses downtown in an
extremely competitive environment and many still struggle to make it. Our businesses also pay property tax
payers that contribute to supporting the area with critical government services where mobile vendors don't. It
also has the potential to create conflict between restauranteurs and vendors in close proximity.
I applaud what mobile food vending can bring to certain settings where brick and mortar restaurants are
deficient. I hope you understand my concerns for any future changes to the existing program. Thank you for

This is to confirm that because your property is currently vacant, it is not in violation of the Iowa City Housing Code and
does not need a rental permit. The case has been closed.
However, please keep in mind that any owner - occupied property in Iowa City that is not occupied by the owner of the
property does require a rental permit. If you plan on renting the property in the future you may want to contact Sue
Dunlap in Neighborhood Services to ask about the process of applying for a permit. The rental inspection and
subsequent rental permit will ensure that your property meets the minimum rental inspection standards, primarily

www.icgov.org, under Rental Housing Inspection.

Dear Steve,
Thank you for the response to this matter. Your email confirms that the error was on the City's side, since your office
only checked advertisement and assumed we were renting the house, as you precisely state below. We pulled the ad off
and left the house empty. As I mentioned in my letter to the mayor, advertising for rental does not require permit from
the City and therefore, on two counts your departmrnt stepped off course:
1. you assumed, on the basis of ad, that we were already renting the house.
2. you issued the notice of violation without verifying the fact.
All I want is the official action from you stating in writing that the notice was issued in error and has since been
withdrawn. I am hoping this should not be so onerous.

I am the Neighborhood Services Coordinator and your email was forwarded to me for a response. Sorry about the late
response, but I was out of the office last week.
It is my understanding that Stan Laverman received a complaint from a resident that your home at 701 Normandy Drive
was being advertised as a rental. Stan viewed the website that was created to advertise your home
www. rentiowacityhome. com< http : / /www.rentiowacityhome.com> (also attached) and then checked the City's records
to see if a rental permit had been issued. When he discovered that a rental permit had not been issued he sent the
attached Notice of Violation.
Iowa City has nearly 18,000 rental properties and the City has a goal of maintaining healthy neighborhoods, so it is
important to be proactive when a situation arises. The City needs to make sure that homes that are being used as a
rental property pass the minimum inspection criteria to make sure that the home is a safe place to live.
I appreciate you bringing this to our attention because customer service is very important to the City. I will talk with
Stan to get a better understanding of the tone of the conversation. This, of course, is a personnel matter and will be
treated confidentially.

Dear Honorable Mayor and Members of the Council:
I am writing to draw your attention to and submit a grievance regarding the recent incidence that occurred between
myself and the city's housing inspection department.
In late August, I received a notice (attached), sent to my husband's name (Bradley Kaldahl), stating that we have violated
a housing code by renting our home without a rental permit. We are currently out of town and the house is sitting
empty. I reached out to the city by phone and asked Stan Laverman, the senior housing inspector, whether the housing
inspection department verified the factual basis of this notice. As you are fully aware, issuance of this type of notice
carries a weight, since it is a presumption of guilt, or declaration of guilt. Stan's answer was that we advertised the
house for rent. We did, for about two weeks, and took the ad off. I inquired whether the advertising required a permit.
His answer was negative. I requested he issue an apology and follow it up with a paperwork, admitting it was issued in
error. He not only said he had nothing to add but also, literally, laughed. He laughed and said "you can talk all you want."
I criticized him for his attitude, when, clearly, the fault was on his part. Later, my attorney called him, and even my
attorney received a similar treatment, that is to say, shrugging off the entire problem.
I see a number of issues here. The city workers, it appears, have bestowed on themselves such a disproportionate
degree of authorities that they feel they can behave arrogantly and rampantly toward residents and their
representatives. I deem this incidence as an example of government over - reach, going out of their way to turn residents'
lives into some kind of surveillance object, while, when they made an error, they not only do not admit it and follow it
up with due diligence, but also behave in such an unacceptable way toward residents. I request that this incident be
reviewed by the council and request that Stan Laverman be sent to re- training.

I have two things I would like to address for the city.
First. The 300 block of Lexington Avenue has huge pot holes. One is so big, I ruined a tire
hitting it in the rain. If someone walking stepped in it, they could break an ankle. I feel the
reason this street is not taken care of is, the famous gate. This gate means people can't drive
through, so no need to fix it.
Second. The gate. Why can't it be taken down when the leaf pick up starts? The city
employees have to unlock, open, shut and re lock it when they take a load of the leaves and all
equipment through it. It is a terrible inconvenience for your and my employees. If you would
ask all the street people, including garbage, re cycling, etc. they would tell you they do not like
it
I know there is no chance of getting it permanently taken down. Please consider this. Nora

Dear Council Members,
Having recently retired, I was delighted to find The Center in downtown Iowa City. It provides so many resources for
seniors for 1) fitness, 2) social engagement, 3) opportunities for community service through the band, choir and
volunteer information, 4) access to routine medical needs, 5) a convenient setting by parking, 6) daily meals, and 7)
positive, helpful staff. It is my understanding that the Council is considering decentralizing these components and
eliminating this community gathering location. I strongly voice opposition to this approach as it would decimate this
strong community, strand many downtown seniors without access to low cost meals, and undermine the health and
vitality of the Iowa City and Johnson County senior citizens. I am disappointed that even with strong expressions of
concerns from senior community members this proposal is still being considered. Please clearly speak to the angst of
our members and friends that the Center is a valuable site with abundant services that need to be retained and the
dismantling the Center is not an option for consideration.

Dear City Council,
My wife and I just learned of Steve Harding's decision to close his location next to the library and we are
deeply concerned that Iowa City is losing an irreplaceable resource. We understand that his decision is based
upon a lack of City support for his efforts and we appeal to you to address his concerns and keep an invaluable
resource for our citizenry. Our family walks downtown 4 -5 times a week and are attuned to the culture and
needs of the diverse community that frequents the area. Steve provides a unique environment for families with
young children, the disabled, students, and many others that come in every shape and size. We have spent
hours sitting at his tables and understand the place in a way that you, and the powers that be, might not.
First, the Wedge, next to the Library, play area, and pedestrian mall, provides a unique, non - alcoholic
environment that offers pizza, truly fresh - squeezed lemonade, ice cream, cookies, coffee, pastries, breakfast all
day, and so much more to families and children... supporting and enhancing the purpose of this area. The space
inside the Wedge is highly maneuverable for families with children, and the disabled, making it unique
downtown. Steve uses high quality ingredients, rejecting high fructose corn syrup and the like, and is always
experimenting to offer new and better options. Steve Harding is an owner who cares about people more than
profit.
Second, Steve Harding is a unique, home grown proprietor who celebrates everything great about Iowa
City ... family and friends. My wife, a UCSF trained pediatric rheumatologist with the University, chose Iowa
City as the place she wants to raise our children (she had higher paying offers from several top ten children's
hospitals). We chose Iowa City for the child- centric environment which is best expressed in a single location in
the pedestrian mall by the play equipment, Library, fountain and gathering area. The Wedge is the only non-
alcoholic child- centric full service restaurant in the area and it is at ground zero. Spend a weekend day there
and you will see hundreds of children pass through the doors. The combination of child friendly foods, open
accessible spaces, friendly servers, community based art exhibits, and a diverse patronage (many with special
needs) makes the Wedge a model of everything that Iowa City should be and that local government should
support and nurture.
For your insight, I would like to offer an example of everyday life at the Wedge that should matter in your
decision making process. A few weeks ago my family watched as a wheelchair bound patron with
communication challenges came in and went to his usual table. We exchanged acknowledgements as usual and
he exchanged smiles with my son. As usual, a server came to his table and engaged him and took his order (I
cannot understand his speech, but several of the servers have learned to understand him). Soon after the food
was served, Steve came out and exchanged pleasantries with several of us and then engaged this patron. A
great deal of patience is needed to converse with this man, but Steve, busy with tables full of people, took
the time to acknowledge him and spend time with him. While Steve sat conversing something touching
happened. The patron, unable to control his mouth, drooled food down his front. Without losing a beat, Steve
got a towel, and while talking to the man, wiped off his face and clothes. He did so in a manner that was
compassionate and caring and without drawing attention to his gesture. When the two were done talking, Steve
excused himself to return to the kitchen and the patron clearly said "thank you ". This is not an exception, this is
Steve. He engages his patrons with a smile ... he gave us Wedge onesies when our son was born. He aids the
disabled and listens to patrons who need an ear. He invites diverse groups of all ages to use his tables. He
hires a unique group of creative and caring students who often become close friends, and he is a father figure
giving advise and occasionally lending money to his staff when needed. Steve and the Wedge are anchors,
creating and nurturing community.
I have read that some interests in City government want this space for retail. This might look good on
paper, or to certain interests invested in the downtown, but for those of us who frequent this space, this desire
represents a fundamental misunderstanding of what Iowa City families seek. Simply put, retail will not make
Iowa City a great place to be a child. From my understanding, Steve asked for an extended lease of several
years so that he could feel secure with his investment of time and money. This makes sense if you consider
Steve's commitment to the community as a relationship. No one gets married for two year increments. Steve
cares, he wants to give and grow and nurture, but he wants to know that his efforts are supported by the City
with security. If you, as a representative of the citizens of Iowa City, truly support what is best for our
community, please call Steve (351 -9400) and ask him to stay and support his desire for an extended lease. This
should not be about money, it should be about attracting the very best citizenry and their families to Iowa City
and creating and maintaining a high quality of life for those of us, and our children, who already call this place
home.
Please do everything within your power to keep this special place and the community it serves and creates.

DENIAL OF CERTIFICATE OF APPROPRIATENESS

A meeting of the Iowa City Historic Preservation Commission was held at City Hall on August 14, 2014, at 5:30
pm. The following members were present: Dent Ackerson, Esther Baker, Andrew Litton, Pamela Michaud, Ben
Sandell and Ginalie Swaim. By a vote of 6 -0, the Commission denied a Certificate of Appropriateness for a
proposed alteration at 220 E. Jefferson Street, a Iocal Landmark and National Register property.
The proposed alteration consists of the replacement of existing windows in the rectory house, a total of
approximately twenty eight windows. The application was denied due to the following reasons:
The Commission found that the proposed work threatens to destroy an element of the historic
character of this house, and is therefore unacceptable. The existing historic windows are distinctive
features that significantly contribute to the building's historic character. Referring to the Iowa City
Historic Preservation Handbook, the guidelines recommend repair of existing historic windows, and
.reserve replacement only for badly deteriorated windows. The Secretary of the Interior's Standards for
Rehabilitation, on which the guidelines are based, state that distinctive features shall be preserved,
and deteriorated historic features shall be repaired rather than replaced, with exceptions for severe
deterioration. Based on inspection hymembers of the Commission and City staff, the Commission
determined that the historic windows are in good to fair condition and not deteriorated beyond repair.
The decision may be appealed to the City Council, which will consider whether the Historic Preservation
Commission has exercised its powers, and followed the guidelines established according to this Title (Title 14 of
Iowa City Zoning Code), and whether the Commission's action was patently arbitrary or capricious (Iowa City
Zoning Code, Article 148E -2D). To appeal, a written letter requesting the appeal must be filed with the City Clerk
no later than 10 business days after the date of the filing of this certificate.

Hi.
I've been living here a long time now, and I remember what it used to be like when cops busted bars for
underage. It wasn't like this. I also remember actually going into a house with a loud party, across the street
from me, in my bathrobe and slippers, and waiting till they noticed the grumpy lady, and making the "turn it
down" sign, and those kids were embarrassed and said "sorry ma'am" and turned it down. After which I said
"thank you" and padded back across the street to my house and went back to bed.
Now I am not a conflict mediator, I am not Dag Hammarskj old. But I do know that it's almost certainly not
necessary to storm into a college kids' party and start barking at people and waving guns around and slamming
them up against the wall.
If you haven't taken a look at this thing in a few days, please take another look. And then I would like for at
least one of you to write back to me with an explanation of why this degree of force and antagonism was
necessary to defuse that tense standoff situation, kids drinking beer.

(15) Provide necessary and reasonable clerical, research and professional
assistance to boards within limitations of the budget.

B. The city manager, in performing the foregoing duties, may:
(1) Present recommendations and programs to the council and participate in
any discussion by the council of any matters pertaining to the duties of
the city manager.
(2) Cause the examination and investigation of the affairs of any department
or the conduct of any employee under supervision of the city manager.
(3) Execute contracts on behalf of the city when authorized by the council.

Section 4.05. Ineligibility; Prohibited Acts.
Except for the exercise of the right to vote, the city manager shall not take part
in any election of councilmembers. This prohibition shall in no way limit the city
manager's duty to make available public records as provided by state law or

ARTICLE V. BOARDS, COMMISSIONS AND COMMITTEES
Section 5.01. Establishment.
With the exception of the police citizens review board, the council may establish
boards in addition to those required by state law and shall specify the title,
duties, length of term, qualifications of members and other appropriate matters.
The council may reduce or increase a board's duties, transfer duties from one
board to another or dissolve any board, except as otherwise provided by state
law or this charter.
A. There shall be a permanent police citizens review board, which shall have
vested in it the following minimum powers: .
1. To hold at least one community forum each year for the purpose of hearing
citizens' views on the policies, practices, and procedures of the Iowa City police

department, and to make recommendations regarding such policies, practices,
and procedures to the city council;
2. To investigate citizen claims of misconduct by sworn police officers and to
issue independent reports of its findings to the city council; and

Section 5.02. Appointment; Removal.
The council shall, subject to the requirements of state law, seek to provide
broad representation on all boards. The council shall establish procedures to
give at least thirty days' notice of vacancies before they are filled and shall
encourage applications by citizens. Council procedures for the removal of

A. The council shall establish rules and procedures for the operation of all
boards, which must include but are not limited to, the adoption of by -laws and

communication with council, time schedules for the completion of reports
