THE CITY MANAGER TO SIGN AN AGREEMENT WITH HILLS BANK &
TRUST COMPANY, MIDWESTONE BANK AND THE UNIVERSITY OF
IOWA COMMUNITY CREDIT UNION FOR THE BUILDING CHANGE LOAN
PROGRAM.
Comment: The City of Iowa City will administer a Building Change Loan
program to encourage private reinvestment to buildings in the Downtown and
Northside Marketplace. Hills Bank & Trust Company, MidWestOne Bank and
the University of Iowa Community Credit Union will each provide up to
$50,000 into the Building Change Loan program. The program will provide
0% interest, 5- year loans for fagade improvements, accessibility
improvements, fire safety, and upper level renovations that will convert
underutilized upper level space into commercial /office space or residential
living. The City will not be providing funds for this program, but will provide
the staff to implement and administer the program.
EVAN HEIGHTS — RESOLUTION APPROVING FINAL PLAT OF EVAN
HEIGHTS (SUB14- 00016)
Comment: A preliminary plat of Evan Heights was approved September 16,
2014. Staff recommends approval of the final plat subject to approval of legal
papers by the City Attorney. It is anticipated that legal papers will be
approved prior to the October 7, 2014 City Council meeting. Approval will
allow the development of Evan Heights a 10 -lot, 3.6 -acre residential
subdivision located east of First Avenue, north of Hickory Trail.

ITEM 3d(3) SANDHILL ESTATES, PART 3 — RESOLUTION APPROVING FINAL PLAT

IL% " 94q Comment: A preliminary plat of Sandhill Estates - Part 3 was approved
August 19. Staff recommends approval of the final plat subject to approval of
legal papers and construction drawings by the City Attorney and City
Engineer. It is anticipated that legal papers and construction drawings will be
approved prior to the October 7 City Council meeting. Approval will allow the
development of Sandhill Estates - Part 3, a 25 -lot, 7.76 -acre residential
subdivision located on Langenberg Avenue.

Comment: This agreement authorizes Shive - Hattery, Inc. to provide
engineering construction phase services including design interpretation, shop
drawing review, material testing, and site visits. The negotiated contract
amount is not -to- exceed $84,500 and will be funded General Obligation bond
proceeds.

Comment: As part of a 2005 28E Agreement for the construction of Camp Cardinal
Blvd. the City financed (sold bonds) the Developer's share of the construction costs
in Iowa City and the Developer gave the City a promissory note secured by a
mortgage on the property. In 2012 the City agreed to subordinate its mortgage to
new financing secured by the Developer (The Crossing Development LC) from
MidWestOne Bank to increase its investment in property located in Iowa City. The
Developer is refinancing that loan with West Bank and West Bank requires a
subordination agreement from the City. The Developer is current on its loan with the
City and such a subordination agreement will not change the City's position.

SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE
CONSTRUCTION OF THE 2014 STORM SEWER IMPROVEMENTS PROJECT,
ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID,

Comment: This project consists of repairing or improving the storm sewer system at
various locations throughout Iowa City. The estimated construction cost is $200,000
and will be funded with storm sewer revenues.

Comment: Staff has negotiated a purchase agreement with Trust Under the Will of
Frieda A. Chadek for 5.02 acres of vacant land located at the northeast quadrant of
Friendship Street and 5th Avenue for $280,000 contingent on Council approval. The
land is intended for a park and community gardening. The following agenda item
proposes to name the park "Chadek Green."

CONSISTING OF 5.02 ACRES OF VACANT LAND AT THE INTERSECTION OF
FRIENDSHIP STREET AND 5T" AVENUE AS " CHADEK GREEN."
Comment: The previous agenda item is a resolution approving a purchase
agreement with Trust Under the Will of Frieda A. Chadek for 5.02 acres of vacant
land located at the northeast quadrant of Friendship Street and 5th Avenue. The land
is intended for a park and community gardening, and this resolution proposes to
name the park "Chadek Green." As required by the City Naming Policy, the name of
the proposed park is being recommended by an ad hoc committee consisting of the
City Manager, the Park and Recreation Director, and a member of the Parks and
Recreation Foundation. If the previous item is not approved, then this matter should
not be considered.

ITEM 10. ASSESSMENTS -RESOLUTION ADOPTING AN ASSESSMENT SCHEDULE OF
UNPAID MOWING, CLEAN -UP OF PROPERTY, SNOW REMOVAL, SIDEWALK
REPAIR, AND STOP BOX REPAIR CHARGES AND DIRECTING THE CLERK TO
J Ll I`j CERTIFY THE SAME TO THE JOHNSON COUNTY TREASURER FOR
COLLECTION IN THE SAME MANNER AS PROPERTY TAXES.
Comment: The City has the authority under Iowa Code §364.138 to assess the
nuisance abatement costs in the same manner as a property tax. This resolution
allows the City Clerk to certify to the Johnson County Treasurer the abatement cost
to be assessed against the property. This assessment is being pursued only after the
City took many steps to resolve the matter. The City notified the home owners to
abate the nuisance (for example, to remove snow from the sidewalk) and after the
home owner did not take action to abate the nuisance, the City abated the nuisance
and billed the owner. After being billed at least twice, these owners still have not
paid the abatement costs. The City has sent a letter to the home owner giving them
notice that this resolution would be on the agenda, a copy of which is attached to the
resolution. No interest will be charged if the owner pays within 30 days of the first
required publication. Attached as an exhibit to the resolution is a list of the properties
that will be assessed and the amount that will be assessed.
