ITEM 4d(3) NORMANDY DRIVE — RESOLUTION ACCEPTING THE WORK FOR
THE NORMANDY DRIVE PHASE ONE LANDSCAPING PROJECT.
Comment: On October 23, 2012 a contract was entered into with Iowa
State Contractors of Ottumwa, Iowa, to landscape Normandy Drive -
Phase one. The final contract amount is $173,765.29. All the work
covered by the contract has been complete, all required paperwork has
been submitted and all invoices have been paid.

ITEM 4d(4) CPRB EXTENSION - MOTION GRANTING A 60 -DAY EXTENSION TO
THE CITIZENS POLICE REVIEW BOARD FOR THE FILING OF THE
PUBLIC REPORT WITH THE CITY COUNCIL ON COMPLAINT #14 -02.
Comment: City Code section 8- 8 -7B(6) states The Board's report to the
City Council shall be completed within ninety (90) days of receipt of the
Chief's or City Manager's report. The City Council may grant requests for
extensions to this deadline upon good cause shown. At their meeting of
October 13, 2014, the Board requested a 60 -day extension.

ITEM 4e(1) RALSTON CREEK IMPROVEMENTS PROJECT, PHASE 1 —
RESOLUTION SETTING A PUBLIC HEARING ON NOVEMBER 4, 2014
ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND
ESTIMATE OF COST FOR THE CONSTRUCTION OF THE RALSTON
CREEK IMPROVEMENTS PROJECT - PHASE 1, DIRECTING CITY

Comment: This project includes the reshaping and armoring of the
banks of Ralston Creek between Muscatine Avenue and Center Street.
Work will also include vegetation and debris removal, outlet protection,
installation of riffle pools, and site restoration. The estimated cost of
construction is $180,225 and will be funded with 04/13 Flooding — Storm
Water funds.

AMENDMENT NO. 2 TO THE SYCAMORE AND FIRST AVENUE URBAN ltdbsen
RENEWAL PLAN TO ADD A PROPOSED URBAN RENEWAL PROJECT.
Comment: This item approves an amendment to the Sycamore Mall First
Avenue Urban Renewal Plan that includes a project at the Iowa City
Marketplace. Any project considered by the City Council for financial assistance
must first be amended to the plan. At its meeting on October 13, 2014, the City
Council Economic Development Committee voted to recommend the Iowa City
Marketplace project for approval by the full City Council. A development
agreement will be considered at a future date. All required steps to amend the
plan are now complete. Correspondence included in packet.

commercial use since 2006. The space is currently leased to The Wedge
through April 23, 2016. The Wedge wishes to terminate the lease. City staff and
The Wedge have negotiated an Agreement to Terminate Lease, effective
November 1, 2014, which staff recommends Council approve. The space would
then become immediately available for lease to other tenants.

ITEM 9. NOISE ORDINANCE AMENDMENTS - ORDINANCE AMENDING TITLE 6 OF
THE CITY CODE, ENTITLED "PUBLIC HEALTH AND SAFETY," CHAPTER 4,
ENTITLED "NOISE CONTROL," TO SIMPLIFY AND CLARIFY THE NOISE
CONTROL PROVISIONS, TO DELETE PERMITS BASED ON DECIBEL
LEVELS, AND TO REGULATE LOUD CAR RADIOS. (FIRST
CONSIDERATION)
Comment: The Code currently provides for 4 types of sound permits based on the
decibel levels. Staff cannot recall issuing any such permit in over ten years, and in
order to enforce such permits, the City would need to purchase decibel meters,
calibrate them, and train staff on their use. Another shortcoming is that they are not
effective in measuring base sound. This ordinance would eliminate these permits
and simply prohibit certain noises. Additionally, this ordinance adds a new, but
limited, provision regulating loud music from a car radio. ,Zlflr
