The License Agreement will allow the City to use Blue Zones trademarks in pursuit of certifications and publicity. 2014 STORM SEWER IMPROVEMENTS - RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR CONSTRUCTION OF THE 2014 STORM SEWER IMPROVEMENTS PROJECT. Comment: Bids for this project were opened on Tuesday, October 28, 2014, and the following bids were received: Dave Schmitt Construction Cedar Rapids, IA $ 255,458.00 Tschiggfrie Excavating Dubuque, IA $ 267,278.20 Maxwell Construction Iowa City, IA $ 269,365.00 Corner Stone Excavating Washington, IA $ 285,925.50 Original Engineer's Estimate $ 200,000.00 Revised Engineer's Estimate $ 250,000.00 The Engineer's Estimate was not correctly stated in the previous comments for this project. Public Works and Engineering recommend award of the contract to Dave Schmitt Construction of Cedar Rapids, Iowa. The project will be funded with Storm Water revenues. ITEM 3d(3) CITY HALL POLICE AND FIRE DEPARTMENT HVAC REPLACEMENT 2014 - RESOLUTION ACCEPTING THE WORK FOR THE CITY HALL POLICE AND FIRE DEPARTMENT HVAC 2014 PROJECT. Comment: The project has been completed by Day Mechanical Systems, Inc. of Cedar Rapids, Iowa, in substantial accordance with the plans and specifications. Comment: See Engineer's Report. REFUNDING 2009F PARKING REVENUE BONDS -- RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF A FUNDING TRUST AGREEMENT WITH RESPECT TO THE $9,110,000 PARKING SYSTEM REVENUE REFUNDING CAPITAL LOAN NOTES, SERIES 2009F. ITEM 3e. Setting Public Hearings: ITEM 3e(1) AIRPORT PURCHASE AGREEMENT - RESOLUTION SETTING A PUBLIC HEARING FOR NOVEMBER 18, 2014 TO APPROVE A PURCHASE AGREEMENT BETWEEN THE CITY OF IOWA CITY AND 14 -- 3e) 9 TAMARACK MATERIALS, INC. FOR LOTS 11, 12, AND 13 OF THE NORTH AIRPORT DEVELOPMENT SUBDIVISION AND TO CONSIDER A PROPOSAL TO CONVEY SAID PROPERTY. Comment: The North Airport Development Subdivision (aka, Aviation Commerce Park) includes commercial lots, which have been marketed for sale to the general public. The City has negotiated a purchase agreement with Tamarack Materials, Inc. which requires City Council approval. This resolution sets a public hearing on the purchase agreement for November 18. The sale price is $585,500, which is $4.25/sq. ft. and the price at which other lots have recently sold. ITEM 3e(2) AIRPORT PURCHASE AGREEMENT - RESOLUTION SETTING A PUBLIC HEARING FOR NOVEMBER 18, 2014 TO APPROVE A PURCHASE AGREEMENT BETWEEN THE CITY OF IOWA CITY AND iq 3/0 QCI THERMAL SYSTEMS, INC. FOR LOT 7 OF THE NORTH AIRPORT DEVELOPMENT SUBDIVISION AND TO CONSIDER A PROPOSAL TO CONVEY SAID PROPERTY. Comment: The North Airport Development Subdivision (aka, Aviation Commerce Park) includes commercial lots, which have been marketed for sale to the general public. The City has negotiated a purchase agreement with QCI Thermal Systems, Inc. which requires City Council approval. This resolution sets a public hearing on the purchase agreement for November 18. November 4, 2014 City of Iowa City Page 4 ITEM 3e(3) REZONING HERBERT HOOVER HIGHWAY -- MOTION SETTING A PUBLIC HEARING FOR NOVEMBER 18 ON AN ORDINANCE CONDITIONALLY REZONING 39.6 ACRES OF PROPERTY FROM INTERIM DEVELOPMENT SINGLE - FAMILY RESIDENTIAL (ID -RS) ZONE TO LOW DENSITY SINGLE - FAMILY RESIDENTIAL (RS -5) ZONE FOR 32.34 ACRES AND LOW DENSITY MULTI - FAMILY (RM -12) FOR 7.26 ACRES LOCATED AT 4701 HERBERT HOOVER HIGHWAY. (REZ14- 00015) Comment: At its October 16 meeting, by a vote of 6 -1 (Eastham voting no), the Planning and Zoning Commission recommended approval of this rezoning with conditions addressing the need to provide sanitary sewer and water service to the property, a pedestrian access route to the city sidewalk system and general adherence to the concept plan to assure that the RM -12 zone is designed to be in compliance with the Comprehensive Plan policies regarding compatibility with the adjacent residential neighborhood and appropriate development appearance for an entranceway to the city. Approval will allow development of a mixture of single - family detached and attached dwellings and multi - family dwellings. ITEM 3e(4) REZONING RIVERSIDE DRIVE AND BENTON STREET – MOTION SETTING A PUBLIC HEARING FOR NOVEMBER 18 ON AN ORDINANCE CONDITIONALLY REZONING APPROXIMATELY 0.5 ACRES OF PROPERTY FROM COMMUNITY COMMERCIAL (CC -2) ZONE TO RIVERFRONT CROSSINGS —WEST RIVERFRONT (RFC - WR) ZONE LOCATED AT LOCATED AT 708 SOUTH RIVERSIDE DRIVE. (REZ14- 00018) Comment: At its October 16 meeting, by a vote of 7 -0, the Planning and Zoning Commission recommended approval of this rezoning with conditions regarding dedication of right -of -way along South Riverside Drive for pedestrian improvements. Approval will allow redevelopment of the site in compliance with the Riverfront Crossings Master Plan. ITEM 3e(5) VACATION OLD BENTON STREET R -O -W – MOTION SETTING A PUBLIC HEARING FOR NOVEMBER 18 ON AN ORDINANCE VACATING 4,665 SQUARE FEET OLD BENTON STREET RIGHT -OF- WAY (AUDITOR'S PARCEL 2014085) LOCATED ADJACENT TO 708 SOUTH RIVERSIDE DRIVE. (VAC14- 00002) Comment: At its October 16 meeting, by a vote of 7 -0, the Planning and Zoning Commission recommended approval of this vacation with conditions regarding a public access easement and rezoning of the adjacent property to the Riverfront Crossings —West Riverfront zone. Action: /6, rrt% aG��° RALSTON CREEK IMPROVEMENTS PROJECT PHASE 1 — APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE RALSTON CREEK IMPROVEMENTS PROJECT - PHASE 1, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project includes the reshaping and armoring of the banks of Ralston Creek between Muscatine Avenue and Center Street. IOWA CITY MARKETPLACE DEVELOPMENT AGREEMENT - RESOLUTION APPROVING A DEVELOPMENT AGREEMENT WITH CORE SYCAMORE TOWN CENTER LLC FOR RENOVATION OF IOWA CITY MARKETPLACE. Comment: This development agreement provides up to $1.75 million in Tax Increment Financing assistance for a $4.4 million improvement project to get the former Von Maur department store space repurposed. It includes parking lot and pedestrian accessibility improvements to the mall property. The TIF assistance will be structured as a 6 year rebate. Action: ;YVLS ITEM 8. COOPERATIVE CONVERSION ORDINANCE - ORDINANCE AMENDING TITLE 17, BUILDING AND HOUSING, CHAPTER 10, CONDOMINIUM CONVERSION CODE, TO READ "CONDOMINIUM AND RESIDENTIAL COOPERATIVE CONVERSION CODE "; AND ADDING SECTION 17 -10 -2, "RESIDENTIAL COOPERATIVE CONVERSION CODE" TO GOVERN CONVERSIONS OF BUILDINGS TO RESIDENTIAL COOPERATIVES. (FIRST CONSIDERATION) Comment: This ordinance amendment will add a Residential Cooperative Conversion Code, similar to the already - present Condominium Conversion Code at 17 -10 -1. Conversion will require compliance with the building code to advance the health and safety of members and tenants. Action: 1" r►h..s CP ITEM 9. NOISE ORDINANCE AMENDMENTS - ORDINANCE AMENDING TITLE 6 OF THE CITY CODE, ENTITLED "PUBLIC HEALTH AND SAFETY," CHAPTER 4, ENTITLED "NOISE CONTROL," TO SIMPLIFY AND CLARIFY THE NOISE CONTROL PROVISIONS, TO DELETE PERMITS BASED ON DECIBEL LEVELS, AND TO REGULATE LOUD CAR RADIOS. (SECOND CONSIDERATION) Comment: The Code currently provides for 4 types of sound permits based on the decibel levels. Staff cannot recall issuing any such permit in over ten years, and in order to enforce such permits, the City would need to purchase decibel meters, calibrate them, and train staff on their use. Another shortcoming is that they are not effective in measuring bass sound. This ordinance would eliminate these permits and simply prohibit certain noises.
