Council Member Throgmorton noted the setting of two public hearings, a rezoning of 40
acres on Herbert Hoover Highway, and a rezoning of half an acre on South Riverside
Dr.
Moved by Mims, seconded by Payne, to adopt RES. 14-311, APPROVING THE
PRELIMINARY PLAT OF CARTER ESTATE, IOWA CITY (SUB14-00017).
Development Services Coordinator Yapp presented a power point. Individual Council
Members presented their views.
A public hearing was held on a resolution approving plans, specifications, form of
contract, and estimate of cost for the construction of the Ralston Creek Improvements
Project - Phase 1, establishing amount of bid security to accompany each bid, directing
City Clerk to publish notice to bidders, and fixing time and place for receipt of bids.
Christopher Munoz, 435 Rundell Street, appeared. Special Projects Engineer Reichart
present for discussion. Moved by Payne, seconded by Mims, to accept correspondence
from Susan and Marcus Eckhardt. Individual Council Members expressed their views.
Moved by Mims, seconded by Payne, to adopt RES. 14-312, APPROVING PLANS,
SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE
CONSTRUCTION OF THE RALSTON CREEK IMPROVEMENTS PROJECT - PHASE
1, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID,
DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME

Moved by Mims, seconded by Dickens, to defer to November 18, a resolution
approving a development agreement with Core Sycamore Town Center LLC for
renovation of Iowa City Marketplace.
Moved by Mims, seconded by Payne, that the ordinance amending Title 17, Building
and Housing, Chapter 10, Condominium Conversion Code, to read "Condominium and
Multiple Housing Cooperative Conversion Code"; and adding section 17-10-2, "Multiple
Housing Cooperative Conversion Code" to govern conveyances of buildings to multiple
housing cooperatives, be given first vote.
Moved by Payne, seconded by Dickens, that the ordinance amending Title 6 of the
City Code, entitled "Public Health and Safety," Chapter 4, entitled "Noise Control," to
simplify and clarify the noise control provisions, to delete permits based on decibel
levels, and to regulate loud car radios, be given second vote.
Moved by Mims, seconded by Throgmorton, to make the following appointments to
Boards and Commissions: appoint Fidencia Martinez Perez, 905 W. Benton #26, to the
Citizens' Police Review Board for an unexpired term, effective upon appointment to
September 1, 2015; reappoint Kim Hanrahan, 435 Grant St., Shams Ghoneim, 1104
Wylde Green Rd., and Stella Hart, 608 Normandy Dr., to the Human Rights
Commission for three appointments for three-year terms, January 1, 2015 - January 1,
2018; appoint Cheryll Clamon, 1023 Village Green Blvd., to the Senior Center
Commission for a three-year terms, January 1, 2015 - December 31, 2018. Moved by
Payne, seconded by Mims, to accept correspondence from Cody Shafer (2) and Harry
Olmstead.
The Mayor noted no applications were received for the following Boards and
Commissions and all will be readvertised: Board of Adjustment for a five-year term,
January 1, 2015 - January 1, 2020; Parks and Recreation Commission for two
vacancies to fill four-year terms, January 1, 2015 - January 1, 2019; Public Art Advisory
Committee for two vacancies to fill three-year terms, January 1, 2015 - January 1,
2018; Senior Center Commission for a three-year terms, January 1, 2015 - December
31, 2018. Applicants MUST reside in Iowa City and be 18 years of age unless specific
qualifications are stated. [Staff will not publish additional notices after a period of six
publications; but will continue to advertise vacancies with postings and on the Council
agenda. However, no additional publication costs will be incurred.]
The Mayor noted the previously announced vacancies: Airport Zoning Brd of
Adjustment for, a five- year term January 1, 2014 - December 31, 2018 (Formerly
advertised; Full term); Airport Zoning Brd of Adjustment for a five-year term January 1,
2012 - December 31, 2016 (Formerly advertised; Full term); Appeals, Board of, for a
five-year term January 1, 2014 - December 31, 2018 (Formerly advertised; Full term);
Historic Preservation Commission for a Jefferson St. representative to fill three-year
terms, March 29, 2013 - March 29, 2016 (New District formed); Housing and
Community Development Commission for an unexpired term effective upon
appointment - September 1, 2016. Applications must be received by 5:00 p.m.,
Wednesday, November 12, 2014.
The Mayor noted the current vacancy: Human Rights Commission for an unexpired
term, effective upon appointment - January 1, 2016. Applications must be received by

Council Member Throgmorton stated he had the opportunity to celebrate the
designation of MidwestOne Bank as a Blue Zones work space and reported it was a fun
event and he enjoyed tour the upstairs; said it was pleasure to attend the Human Rights
Award Breakfast and to see good people receiving praise for all their good work.
Mayor Pro tem Mims noted the polls were open another hour and half and
encouraged those that had not voted to do so.
Council Member Dickens congratulate Matt's uncle, Peter Hayek, on receiving the
Hayek award named after Matt's grandfather recognizing those for their military service
and service to their community.
Council Member Payne mentioned that starting on November 1 and running through
November 8th the Iowa City Public Library was hosting a traveling photo exhibit
"remembering our Fallen" honoring Iowans who have dies from wounds suffered in war
zones since September 11, 2001.
Council Member stated the Ad Hoc Senior Services Committee would be holding a
public input session on their draft report on Wednesday, November 12, at 3:30 PM in
Harvat Hall.
Mayor Hayek acknowledged the Human Rights Breakfast and the people recognized
for doing good work in the community; thanked Council Member Dickens on his remarks
concerning the Hayek Award, noting that the Veteran's Banquet would be on Sunday
evening, November 9th; and echoed comments to get out to the voting polls.
City Manager Markus noted that City Hall and the Senior Center has also been
named Blue Zones work places.

QUESTIONS FROM COUNCIL REGARDING AGENDA ITEMS
1. (Agenda item # 9) — noise ordinance ... loud car radios....) Council Member Payne
questioned the use of "and" rather than "or" in the example on the bottom of the first
page of staff memo listing two provisions. The City Attorney responded that "and" was
correct.
2. (Consent Calendar item # 4f(11) — correspondence Iowa City School District... Inclusive
Zoning...) In response to Council Member Throgmorton, Mayor Hayek stated the letter
had just arrived and staff would provide information to Council.
3. (Consent Calendar item # 4f(11) ... CPRB extension ... Complaint # 14-02) Council
Member Botchway reported the Ad Hoc Diversity Committee discussed extending the
reporting requirement, and City Clerk Karr confirmed the reporting had been extended
from 45 to 90 days. City Clerk Karr and Police Lt. Hart stated the CPRB had requested
additional information from the Police Chief and requested an extension to provide time
for the information to be compiled and considered.

Member Botchway, Police Lt. Hart and City Atty. Dilkes responded to current problems
regarding enforcement. Council Member Payne expressed confusion on the use of

Superintendent of Parks & Forestry Zac Hall presented a power point (archived) and passed
around an identification kit supplied by AFIS.

Throgmorton noted the compelling articles and the critical issues. Mayor Pro tem Mims
noted the second showing of "Woke Up Black" scheduled for October 30 at Phillips Hall.
2. (IP # 4 — Joint Meeting Items ...) Council agreed to add "Presentation on Emerald Ash
Borer plans and strategies" to the agenda.
COUNCIL TIME AND MEETING SCHEDULE
1. Council Member Botchway reported on the creation of a Johnson County Task Force on
Hunger, and stated he went to the first meeting and would be reporting back as
discussions continue and the importance of a collaborate effort.

Council Member Throgmorton noted Council was being urged to create a citizens advisory
committee to help staff develop a climate mitigation and adaption strategy and asked that the
item be added to the pending list. City Manager Markus suggested the item wait until the
results of a study being done by the group and could serve as a baseline.
UPCOMING COMMUNITY EVENTS/COUNCIL INVITATIONS
1. In response to City Clerk Karr, Council requested staff work to schedule a joint meeting
with the Board of Supervisors in November or December. City Clerk Karr will follow-up.
2. Council Member Throgmorton reminded members of two events on October 29th - the
Human Rights Breakfast and Dan Burden / Blue Zones.

Council Member Throgmorton reported on his participation in the Run for the
Schools event, and praised organizers, volunteers, and runners.
Council Member Botchway noted the numbers of vacancies on City Boards and
Commissions and urged younger members of the community to apply and become
involved in City discussions.
City Manager Markus reminded everyone of the Human Rights Breakfast scheduled
on Wednesday, October 29th, at the Iowa Memorial Union.
