Resolutions and Motions: ITEM 4d(1) CONTINUING DISCLOSURE COOPERATIVE - RESOLUTION AUTHORIZING REVIEW OF DISCLOSURE ACTIVITIES AND PARTICIPATION IN THE MUNICIPALITIES CONTINUING DISCLOSURE COOPERATIVE INITIATIVE (MCDC) OF THE SECURITIES AND EXCHANGE COMMISSION (SEC). Comment: This Resolution will authorize the Finance Director, in consultation with the City Attorney, the City's Bond Counsel and the City's Financial Advisor, to review the City's disclosure activities and determine whether City participation in the MCDC of the SEC is advisable, and if so, to take all actions necessary in connection therewith. ITEM 4d(2) 2015 LEGISLATIVE PRIORITIES — ESTABLISHING THE CITY'S 2015 LEGISLATIVE PRIORITIES Comment: The Council traditionally adopts legislative priorities and communicates the City's positions on those issues to our elected delegation. Staff has reviewed the priorities adopted by the Iowa League of Cities and the Metro Coalition and have compiled a list of six priorities for Council consideration. ITEM 4d(3) CONTRACT FOR LOBBYING SERVICES — AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO A CONTRACT FOR LOBBYING SERVICES iy -,�5i`/ ITEM 4d(4) 1q —3/Jr Comment: Since 2011 the City has contracted lobbying services with Davis, Brown, Koehn, Shors & Roberts, P.C. The City has benefitted from their services and staff wishes to enter another contract for 2015. No significant changes to the previous contract are proposed and the fee schedule remains unchanged. 2014 SEWER REHABILITATION - RESOLUTION ACCEPTING THE WORK FOR THE 2014 SEWER REHABILITATION PROJECT. Comment: The project has been completed by Visu-Sewer, Inc. of Pewaukee, Wisconsin, in substantial accordance with the plans and specifications. Comment: The project has been completed by Iowa Bridge and Culvert of Washington, Iowa, in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Engineer. ❖ Project Estimated Cost: $ 98,400.00 ❖ Project Bid Received: $ 51,860.00 ❖ Project Actual Cost: $ 51,686.00 TRICKLING FILTER MERCURY ABATEMENT - RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND NORTH SHORE ENVIRONMENTAL CONSTRUCTION, INC. TO PROVIDE CONSULTANT SERVICES FOR THE TRICKLING FILTER MERCURY ABATEMENT FOR THE NORTH PLANT SALVAGE AND DEMOLITION PHASE OF THE IOWA CITY WASTEWATER TREATMENT PLANT RELOCATION PROJECT. Comment: This agreement authorizes North Shore Environmental Construction, Inc. to provide consulting services on a time and materials basis estimated at $11M to $2M depending on the actual conditions encountered. The consultant will provide consulting services, regulatory management, decommissioning and mitigation of the trickling filters and associated mercury sealed bearing assemblies at the North Wastewater Treatment Plant. The trickling filters and mercury seals are original equipment dating back to the 1930's. Funding will be provided by sales tax revenues approved by the State of Iowa Flood Mitigation Board. NATIONAL ENDOWMENT GRANT -- RESOLUTION AUTHORIZING THE CITY TO APPLY TO THE NATIONAL ENDOWMENT FOR THE ARTS (NEA) FOR AN OUR TOWN GRANT THAT WILL HOST SEVERAL CREATIVE PLACEMAKING EVENTS FOCUSING EFFORTS IN THE SOUTH DISTRICT AREA OF IOWA CITY AS WELL AS COORDINATE DISCUSSIONS TO ASSESS NEEDS AND ENCOURAGE GROWTH OF EXISTING ARTS ORGANIZATIONS. Comment: This resolution will enable City staff to apply for up to $200,000 from the National Endowment for the Arts (NEA) as co -applicant with Summer of the Arts and partnering with the Iowa Initiative for Sustainable Communities/University of Iowa. If awarded, this funding will be used, over a two year period, to host concerts, temporary art installations, university and student led workshops to create neighborhood stories and art making projects in schools and neighborhood centers. November 18, 2014 ITEM 4d(8) ITEM 4d(9) I -3Z,Q City of Iowa City Page 4 PUBLIC ART CHALLENGE GRANT - RESOLUTION AUTHORIZING THE MAYOR TO SUBMIT A LETTER OF INTEREST IN PARTNERSHIP WITH SUMMER OF THE ARTS TO THE BLOOMBERG PHILANTHROPIES FOR A PUBLIC ART CHALLENGE GRANT THAT WILL EXPAND SUMMER OF THE ARTS EVENTS BOTH DOWNTOWN AND IN SOUTH DISTRICT NEIGHBORHOODS IN CELEBRATION OF THE 10TH YEAR OF SUMMER OF THE ARTS IN 2016. Comment: This resolution will enable the Mayor to apply for up to $1,000,000 from the Bloomberg Philanthropies as co -applicant with Summer of the Arts to request funds to create Latino and Soul Fests as well as host several notable events to celebrate the 10th year of Summer of the Arts. These events will occur both downtown and in the South District neighborhoods. The Bloomberg Philanthropies, founded by Michael Bloomberg, former mayor of New York City requires that the Letter of Interest come from the mayor of the community. PARKING SYSTEM REVENUE REFUNDING CAPITAL LOAN NOTES - APPOINTING BANKERS TRUST COMPANY OF DES MOINES, IOWA, TO SERVE AS PAYING AGENT, NOTE REGISTRAR, AND TRANSFER AGENT, APPROVING THE PAYING AGENT AND NOTE REGISTRAR AND TRANSFER AGENT AGREEMENT AND AUTHORIZING THE EXECUTION OF THE AGREEMENT Comment: This resolution provides final authorization for Bankers Trust Company of Des Moines, Iowa to act as paying agent for the City of Iowa City to refund the $9,110,000 Parking System Revenue Refunding Capital Loan Notes, Series 2009F. ITEM 4d(12) REPEALING RESOLUTION OF PROCUREMENT OF BODY WORN CAMERA SYSTEM - RESOLUTION REPEALING RESOLUTION NO. 14-275 REGARDING THE PURCHASE OF A BODY WORN DIGITAL CAMERA SYSTEM FOR THE POLICE DEPARTMENT. Comment: This resolution will repeal resolution 14-275 which authorized the Police Department to purchase a body worn camera system. On September 16, 2014, the City Council deliberated resolution number 14- 275 which authorized the approval of spending $211,000 for the purchase of a body worn digital camera system for the Police Department. At the time there was discussion surrounding the limitations of current body camera technology. Prior to approval of the resolution, members of the City Council encouraged the Department to continue to review emerging body camera technology. In October Chief Hargadine attended the annual International Association of Chiefs of Police Conference and became aware of emerging technology that was not available when the City initiated the RFP process. This emerging technology would enable the Police Department to utilize its current in car recording software. The benefits of being able to use our current in car recording software include utilization of a single software platform for both in car and body worn cameras. This translates into a lower initial investment as well as ongoing support and maintenance fees, as compared to a separate system. Additionally, there will be a significant reduction in staff time associated with managing one software platform as opposed to two. November 18, 2014 City of Iowa City Page 6 ITEM 4e. Comment: At its November 6 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of this rezoning. This rezoning represents a shift of existing zoning boundaries to coincide with the lot lines in a revised preliminary plat of Moss Ridge Campus, a 9 -lot, 4-outlot commercial subdivision and also includes a revision of the conditional zoning agreement to eliminate the requirement that all site plans have to be reviewed and approved by the Planning and Zoning Commission. Jefferson Street. In a letter dated August 28, Michael Pugh representing St. Mary's, submitted an appeal of the Commission's decision. In deciding the appeal, the City Council must consider whether the Commission has exercised its powers and followed the adopted guidelines, and whether the Commission's action was patently arbitrary and capricious. After applying this standard of review, the City Council may in conformity with the provisions of 14-8E-2 (D) (Historic Review section of the Zoning Code) affirm the Commission's decision, or upon finding the Commission acted in error, reverse or modify, wholly or partly, the decision, and to that end, shall have all the powers of the historic preservation commission. AIRPORT PURCHASE AGREEMENT - RESOLUTION APPROVING A PURCHASE AGREEMENT BETWEEN THE CITY OF IOWA CITY AND QCI THERMAL SYSTEMS, INC. FOR LOT 7 OF THE NORTH AIRPORT DEVELOPMENT SUBDIVISION AND AUTHORIZING CONVEYANCE IN ACCORDANCE THEREWITH. Comment: The North Airport Development Subdivision includes commercial lots, which have been marketed for sale to the general public. The City has negotiated a purchase agreement with QCI Thermal Systems, Inc. which requires City Council approval. The purchase agreement provides a sale price of $179,575 for Lot 7, which is $4.25/sq. ft. and the amount for which other lots have recently sold. At the Octpber 28th Airport Commission meeting, the Commission voted to recommend that the Council approve the purchase. Excerpt of draft minutes are included. a. IOWA CITY MARKETPLACE DEVELOPMENT AGREEMENT • RESOLUTION APPROVING A DEVELOPMENT AGREEMENT WITH CORE SYCAMORE TOWN CENTER LLC FOR RENOVATION OF IOWA CITY MARKETPLACE. Comment: This development agreement provides up to $1.75 million in Tax Increment Financing assistance for a $4.4 million improvement project to get the former Von Maur department store space repurposed. It includes parking lot and pedestrian accessibility improvements to the mall property. The TIF assistance will be structured as a year rebate. This item was deferred from the November 4 Council meeting. 7 Action: ITEM 11. CERTIFICATION OF URBAN RENEWAL PROJECT8 - RESOLUTION DIRECTING THE FILING OF CERTIFICATION UNDER IOWA CODE SECTION 403.19 FOR THE 2014 END OF YEAR CERTIFICATION OF URBAN RENEWAL PROJECTS. y Comment: This resolution authorizes the certification of debt/obligations which qualify for reimbursement from the TIF special revenue funds created for the following Urban Renewal Areas: City -University Project I; the Heinz Road, Riverside Drive, Scott Six, Sycamore and First Avenue, and Towncrest. URBAN RENEWAL ANNUAL REPORT - RE OLUTION APPROVING THE FISCAL YEAR ENDING 2014 ANNUAL URBAN RENEWAL AREA REPORT. / Ll - 32-q Comment: The Iowa Legislature enacted changes regarding urban renewal in Section 384.22 (2) of the Iowa Code, effective July 1, 2013, to aid in providing greater public access to information about Tax Increment Financing. All reports must be approved by City Council before submission to the Iowa Department of Management on or before December 1, 2014. Action: , ,v �4% Xd November 18, 2014 City of Iowa City Page 11 ITEM 14. ly -moo NOISE ORDINANCE AMENDMENTS - ORDINANCE AMENDING TITLE 6 OF THE CITY CODE, ENTITLED "PUBLIC HEALTH AND SAFETY," CHAPTER 4, ENTITLED "NOISE CONTROL," TO SIMPLIFY AND CLARIFY THE NOISE CONTROL PROVISIONS, TO DELETE PERMITS BASED ON DECIBEL LEVELS, AND TO REGULATE LOUD CAR RADIOS. (PASS AND ADOPT) Comment: The Code currently provides for 4 types of sound permits based on the decibel levels. Staff cannot recall issuing any such permit in over ten years, and in order to enforce such permits, the City would need to purchase decibel meters, calibrate them, and train staff on their use. Another shortcoming is that they are not effective in measuring bass sound. This ordinance would eliminate these permits and simply prohibit certain noises.
