CARTER ESTATE
Comment: A prelimigapylplat and Sensitive Areas Site Plan of Carter
Estate was appro on November 4. Staff recommends approval. It is
anticipated t egal papers and construction drawings will be approved
prior to December 16 City Council meeting. Approval will allow the
devoOment of one outlot and two single family lots accessed by a
shared driveway east of Camp Cardinal Road, north of Eagle Place.
ITEM 3d(2) PHASE 2 OF THE FIRST AVENUE STORM SEWER IMPROVEMENTS -
RESOLUTION ACCEPTING THE WORK FOR THE PHASE 2 OF THE
FIRST AVENUE STORM SEWER IMPROVEMENTS PROJECT.
Comment: The project has been completed by Ricklefs Excavating of
Anamosa, Iowa, in substantial accordance with the plans and
specifications. The Engineer's Report and Performance and Payment
bonds are on file with the City Clerk.

RESOLUTION APPROVING A TRANSFER OF HISTORIC
PRESERVATION DEVELOPMENT RIGHTS TO 201 E. BENTON AND
912 S. DUBUQUE STREET IN THE RIVERFRONT CROSSINGS —
CENTRAL CROSSINGS (RFC -CX) ZONE.
Comment: The Staff Form -based Code Committee has reviewed the
building design proposed for the property at 912 S. Dubuque Street and
finds that the proposal meets the approval criteria for a transfer of
development rights for preservation of a historic property (Tate Arms).
Approval of the transfer of development rights will allow development of a
5 -story, 20 -unit multi -family building at 912 S. Dubuque Street, provided
the historic Tate Arms is preserved and maintained as a historic landmark
and according to the provisions of the approved zoning. It should be
noted that only a portion of the development rights have been transferred
to 912 S. Dubuque Street and the reminder the development rights that
result from the preservation of the Tate Arms will be available for transfer
to one or more sites in Riverfront Crossings in the future.

TREATMENT PLANT TRICKLING FILTER MEDIA TRUCKING
PROJECT.
Comment: This project includes trucking 15,600 CY of Trickling Filter
Media from the Iowa City North Waste Water Plant to the Iowa City Landfill.
Trucks will be loaded at the plant by North Shore Environmental
Construction and all material will be hauled to the Iowa City Landfill. Bids
for this project were solicited by Competitive Quotation. The bid results are
listed in Agenda Item 3(f)13). Public Works and Engineering recommend
the contract be awarded to Neuzil & Sons of Oxford, Iowa. The project will
be funded through the Iowa Flood Mitigation Program.

Comment: At its December 18, meeting, by a vote of 7-0, the Planning
and Zoning Commission recommended approval of this rezoning. At its
December 11, meeting, by a vote of 9-0 the Historic Preservation
Commission recommended approval. Approval will require Historic
Preservation Commission approval of any significant changes to the
exterior of the buildings. Landmark status will also make the properties
eligible for transfer of development rights according to the Riverfront
Crossings Form Based Code, and special exceptions that would allow the
Board of Adjustment to waive or modify certain zoning requirements. The
property at 614 S. Dubuque St. no longer qualifies for Historic Landmark

Comment: This project will include reconstruction of the existing chipseal

system. The estimated construction cost is $3,200,000. This project will
be funded by General Obligation bond proceeds and funding agreement

PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID
HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID

Comment: This project involves construction of 1.1 miles of new 10' wide
recreational trail along Dubuque Street from Foster Road to the Butler
Bridge, including a pedestrian bridge of 1-80. The new pedestrian bridge
will be similar to the existing pedestrian bridge over 1-80 along Dodge
Street. This project will complete the Iowa River Trail through Iowa City.
The estimated construction cost is $1,728,000 and will be funded through
the State Recreational Trails Program, the regional Surface
Transportation Program and the National Highway Performance Program.

Comment: In the UniverCity Neighborhood Partnership Program, the City
purchases rental units located in designated neighborhoods surrounding
the University, rehabilitates them, and then sells them to income -eligible
buyers. Under the UniverCity Neighborhood Partnership Program, the City
proposes to sell 1128 Muscatine Avenue for $154,750. The sale price is a
combination of what the City paid to purchase the home ($144,500) plus the
"carrying costs" ($10,250) which are which are all costs incurred by the City
to acquire the home, maintain it and sell it, including abstracting and
recording fees, interest on the loan to purchase the home, mowing and
snow removal, utilities, real estate taxes, and rehabilitation expenses. /

ITEM 6. LEASE PURCHASE HARRISON STREET PARKING FACILITY — INSTITUTING
PROCEEDINGS TO TAKE ADDITIONAL ACTION FOR THE AUTHORIZATION OF
A MUNICIPAL PARKING SYSTEM REVENUE LEASE PURCHASE AGREEMENT

Comment: This item authorizes the Lease -Purchase Agreement between the City
and A&M Development for the construction of a 600+ space parking facility on
Harrison Street between Clinton and Dubuque Streets, and the subsequent
lease/purchase of the facility by the City. The lease will be assigned to a third -party
financial institution upon completion of the parking ramp construction in 2016. Bids
were due from financial institutions to provide the financing on December 9 and are
currently being evaluated.

SABIN TOWNHOMES DEVELOPMENT AGREEMENT —RESOLUTION
APPROVING A DEVELOPMENT AGREEMENT WITH A&M DEVELOPMENT II,
LLC FOR THE SABIN TOWNHOMES MULTIFAMILY HOUSING URBAN
RENEWAL PROJECT.
Comment: This development agreement provides Tax Increment Financing rebates
of $976,277 for construction of 28 townhouses on Dubuque Street in Riverfront
Crossings. The townhouses will be constructed in conjunction with a municipal
parking facility. 3 units will be sold to an affordable housing provider for households
at 80% of Area Median Income or less. The total estimated construction cost of the
28 townhouses is $6,986,549.

"BUSINESS AND LICENSE REGULATIONS," CHAPTER 2, ENTITLED
"TAXICABS," IS AMENDED TO PROVIDE FOR THE REGULATION OF RIDE
SHARING SERVICES OPERATING VIA A WEB BASED APPLICATION SYSTEM,
TO REQUIRE THE CITY TO ISSUE IDENTIFICATION CARDS, TO ELIMINATE THE
EXCEPTION FOR DISPATCHING FROM A LOCATION OTHER THAN THE OFFICE
FROM MIDNIGHT TO 6:00 AM, TO REQUIRE COLOR SCHEMES, TO REVISE THE
DEFINITION OF DESTINATION RATES, AND TO REGULATE SHARED RIDES.

ITEM 9.
Comment: In response to public safety issues and the likely entry of ridesharing
businesses into the market, this ordinance makes a series of changes, most notably:
1) It creates a regulatory scheme for businesses that operate exclusively through a
web -based application system to connect drivers with passengers. The regulations
largely mirror those for businesses that dispatch drivers and use meters. 2) The City
will issue identification cards to all drivers. 3) The current exception that allows
dispatching to be done from a non -office location from midnight to 6:00 AM is
eliminated. 4) Metered taxi cab business must have a unique color scheme. 5) A
destination rate is defined to be the flat rate from a location within the City limits to a
location outside the City limits. 6) Passengers can share rides if they all get into the
taxi at the same point and they expressly agree to share the ride. The driver cannot
ask the passengers to share a ride, and the driver cannot stop and pick-up additional

CODE, ENTITLED "HUMAN RIGHTS," CHAPTER 4, ENTITLED
"ENFORCEMENT," SECTION 2, ENTITLED "INVESTIGATION OF COMPLAINTS;
PREDETERMINATION SETTLEMENT" TO AMEND TIME PERIODS
CONCERNING HOUSING COMPLAINTS. (SECOND CONSIDERATION)
Comment: The Iowa City Human Rights Commission has requested that time periods
applicable to (1) serving notice of complaint and (2) providing answers to mandatory
questionnaires and document requests be amended for the area of housing only.
Chapter 5 of the Human Rights Ordinance, entitled "Fair Housing," requires that a
determination on housing complaints must be made within 100 days of filing. This time
restriction is not applicable to the other four areas the Ordinance addresses. The
current time limits for service and response are in conflict with the 100 -day resolution
requirement.
