Staff recommends approval that will allow the development of one outlot and two single family lots accessed by a shared driveway east of Camp Cardinal Road, north of Eagle Place. This item was deferred from the December 20 and January 6 meeting agendas at the request of the applicant. DUBUQUE STREET PEDESTRIAN BRIDGE OVER 1-80 AND RECREATIONAL TRAIL — RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE IOWA DEPARTMENT OF TRANSPORTATION FUNDING AND CONSTRUCTION ADMINISTRATION AGREEMENT [2013-16-284] FOR THE DUBUQUE STREET PEDESTRIAN BRIDGE OVER 1-80 AND RECREATIONAL TRAIL PROJECT. Comment: This agreement provides funding for the Dubuque Street Pedestrian Bridge over 1-80 and Recreational Trial Project through the Federal Interstate Maintenance Discretionary Funds (IMD), the Surface Transportation Program (STP) and the State Recreational Trails Fund (SRT) and includes designation of the Iowa Department of Transportation as the construction administrator for the project. This funding will provide up to $1,797,000 toward construction costs. The estimated cost of the project is $1,728,000. General Obligation bond proceeds will be used for local participation if construction costs exceed the funding provided. ITEM 3d(4) NOVEMBER DISBURSEMENTS - MOTION TO APPROVE DISBURSEMENTS IN THE AMOUNT OF $16,496,231.01 FOR THE PERIOD OF NOVEMBER 1 THROUGH NOVEMBER 30, 2014, AS RECOMMENDED BY THE FINANCE DIRECTOR SUBJECT TO AUDIT. DISBURSEMENTS ARE PUBLISHED AND PERMANENTLY RETAINED IN THE CITY CLERK'S OFFICE IN ACCORDANCE WITH STATE CODE. January 20, 2015 City of Iowa City Page 3 ITEM 3d(5) RISE FUNDS FOR PROPOSED NORTHGATE DRIVE EXTENSION — RESOLUTION APPROVING THE CITY OF IOWA CITY'S APPLICATION FOR RISE FUNDS FOR THE PROPOSED EXTENSION OF NORTHGATE DRIVE FROM ITS CURRENT TERMINUS NORTH TO THE CITY OF IOWA CITY CORPORATE LIMIT. Comment: This resolution will enable City staff to apply for grant funds from the Iowa Department of Transportation Revitalize Iowa's Sound Economy (RISE) funding program. If awarded funds, such funds will be used to construct an extension of Northgate Drive from its current terminus north to approximately the City of Iowa City Corporate Limit to enable development of commercial and office uses. The total RISE eligible project cost is estimated to be $836,183.65 and staff will apply for fifty percent of eligible project costs ($418,091.82). ITEM 3e. Setting Public Hearings: ITEM 3e(1) REZONING EXPANDING NORTHGATE CORPORATE PARK — MOTION SETTING A PUBLIC HEARING FOR FEBRUARY 9, 2015 ON AN ORDINANCE REZONING 34.21 ACRES OF PROPERTY FROM INTERIM DEVELOPMENT RESEARCH PARK (ID -RP) ZONE TO COMMERCIAL OFFICE (CO -1) ZONE LOCATED NORTH OF NORTHGATE DRIVE. (REZ14-00023) Comment: It is anticipated that the Planning and Zoning Commission will consider this rezoning application at their January 15 meeting and forward their recommendation prior to the February 9 Council meeting. Approval will allow an expansion of Northgate Corporate Park. ITEM 3e(2) 2015 LANDFILL GAS FLARE REPLACEMENT — RESOLUTION SETTING A PUBLIC HEARING ON FEBRUARY 9, 2015 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE 2015 LANDFILL GAS FLARE REPLACEMENT PROJECT, DIRECTING CITY CLERK TO PUBLISH 7 NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project consists of removing the existing landfill gas collection system enclosed ground flare and replacing it with a new one. The estimated construction cost is $482,500 and will be funded by landfill revenues. January 20, 2015 City of Iowa City Page 4 ITEM 3e(3) UNIVERCITY SALE, 936 EAST BLOOMINGTON -- RESOLUTION SETTING PUBLIC HEARING FOR FEBRUARY 9, 2015, ON A PROPOSAL TO CONVEY A SINGLE FAMILY HOME LOCATED AT 936 EAST BLOOMINGTON STREET. Comment: In the UniverCity Neighborhood Partnership Program, the City purchases rental units located in designated neighborhoods surrounding the University, rehabilitates them, and then sells them to income -eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 936 East Bloomington Street. The amount of the sale will be $185,000 (this is what the City paid to purchase the home) plus the "carrying costs," which are which are all costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to repair and rehabilitate the home. PLANNING AND ZONING MATTERS. . (In accordance with the City Attorney's memo of 2/28/07 entitled "Rezonings, Due Process and Ex parte communications". Council will discuss # 5a, 5b, 5c at formal meeting) ITEM 5a REZONING 608 AND 610 S. DUBUQUE STREET LANDMARK DESIGNATION -- ORDINANCE TO DESIGNATE PROPERTIES LOCATED AT 608 AND 610 S. DUBUQUE STREET AS LOCAL HISTORIC LANDMARKS. (REZ14-00024) Comment: At its December 18 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval; and at its December 11 meeting the Historic Preservation Commission recommended approval of the rezoning for Local Historic Landmark designation for three properties at 608, 610 and 614 S. Dubuque St. Since the Planning and Zoning Commission and Historic Preservation Commission meetings, the structure at 614 S. Dubuque St has been demolished and no longer qualifies for Historic Landmark designation; the ordinance has been revised to reflect designation of the remaining properties/structures at 608 and 610 S. Dubuque St. With Historic Landmark designation, Historic Preservation Commission review and approval is required for any significant changes to the exterior of the buildings. Landmark status also makes the properties eligible for transfer of development rights according to the Riverfront Crossings Form Based Code, and special exceptions through the Board of Adjustment to waive or modify certain zoning requirements. If a majority of Council is inclined to not concur with the Planning and Zoning recommendation a consult with the Planning and Zoning Commission should be offered prior to a vote. 1. Approval will allow an approximately 3.1 acre portion of the Slothower Farm to be split from the larger property. The new parcel would contain 2 acres (location of the farm house) that is already located in the city in addition to the 1.1 acres requested for annexation, which contains a portion of the barn. The property could then be sold as an acreage. Action: Qa,2 January 20, 2015 ITEM 6 ITEM 7. 15-1-7 City of Iowa City Page 7 DUBUQUE STREET PEDESTRIAN BRIDGE OVER 1-80 AND RECREATIONAL TRAIL — APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE DUBUQUE STREET PEDESTRIAN BRIDGE OVER 1-80 AND RECREATIONAL TRAIL [IM -080- 6(32)244--13-52], ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project involves construction of 1.1 miles of new 10' wide recreational trail along Dubuque Street from Foster Road to the Butler Bridge, including a pedestrian bridge of 1-80. The new pedestrian bridge will be similar to the existing pedestrian bridge over 1-80 along Dodge Street. This project will complete the Iowa River Trail through Iowa City. The estimated construction cost is $1,728,000 and will be funded through the State Recreational Trails Program, the regional Surface Transportation Program and the National Highway Performance Program. Comment: This project will include reconstruction of the existing chipseal road surface of Sycamore Street from City of Iowa City Limit line to the intersection of Lehman Avenue and Sycamore Street. Improvements shall include roadway reconstruction, sidewalk, and storm drainage system. The estimated construction cost is $3,200,000. This project will be funded by General Obligation bond proceeds and funding agreement with the Iowa City Community School District. a. PUBLIC HEARING b. UNIVERCITY SALE, 1128 MUSCATINE - RESOLUTION AUTHORIZING CONVEYANCE OF A SINGLE FAMILY HOME LOCATED AT 1128 MUSCATINE AVENUE. /5-4 Comment: In the UniverCity Neighborhood Partnership Program, the City purchases rental units located in designated neighborhoods surrounding the University, rehabilitates them, and then sells them to income -eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 1 -1 -41 -East Budington-Street. The amount of the sale will be $154,750. The sale price is the 1714al-WA-le— , combination of what the City paid to purchase the home ($144,500) plus "carrying costs" of $10,250. "Carrying costs" are all costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and repair and rehabilitate the home. a. LEASE PURCHASE HARRISON STREET PARKING FACILITY - INSTITUTING PROCEEDINGS TO TAKE ADDITIONAL ACTION FOR THE AUTHORIZATION OF A MUNICIPAL PARKING SYSTEM REVENUE LEASE PURCHASE AGREEMENT /5-/q IN THE PRINCIPAL AMOUNT OF NOT TO EXCEED $16,000,000 FOR THE LEASE PURCHASE ACQUISITION OF THE HARRISON STREET PARKING FACILITY. Comment: This item authorizes the Lease -Purchase Agreement between the City and A & M Development II, LLC for the construction of a 600+ space parking facility on Harrison Street between Clinton and Dubuque Streets, and the subsequent lease/purchase of the facility by the City. The lease will be assigned to a third -party financial institution upon completion of the parking ramp construction in 2016. Bids were due from financial institutions to provide the financing on December 9 and are currently being evaluated. SABIN TOWNHOMES DEVELOPMENT AGREEMENT — RESOLUTION APPROVING A DEVELOPMENT AGREEMENT WITH A&M DEVELOPMENT II, LLC FOR THE SABIN TOWNHOMES MULTIFAMILY HOUSING URBAN RENEWAL PROJECT. Comment: This development agreement provides Tax Increment Financing rebat( of $976,277 for construction of 28 townhouses on Dubuque Street in Riverfront Crossings. The townhouses will be constructed in conjunction with a municipal parking facility. 3 units will be sold to an affordable housing provider for household at 80% of Area Median Income or less. The total estimated construction cost of tr 28 townhouses is $6,986,549. At their meeting on December 8, 2014, the Econorr Development Committee voted to recommend the project to the full City Council. This item was deferred from the January 6 meeting. REVISION TO TAXICAB - ORDINANCE AMENDINGTLE 5, ENTITLED "BUSINESS AND LICENSE REGULATIONS," CHAPTER 2, ENTITLED "TAXICABS," IS AMENDED TO PROVIDE FOR THE REGULATION OF RIDE SHARING SERVICES OPERATING VIA A WEB BASED APPLICATION SYSTEM, TO REQUIRE THE CITY TO ISSUE IDENTIFICATION CARDS, TO ELIMINATE THE EXCEPTION FOR DISPATCHING FROM A LOCATION OTHER THAN THE OFFICE FROM MIDNIGHT TO 6:00 AM, TO REQUIRE COLOR SCHEMES, TO REVISE THE DEFINITION OF DESTINATION RATES, AND TO REGULATE SHARED RIDES. (SECOND CONSIDERATION) Comment: In response to public safety issues and the likely entry of ridesharing businesses into the market, this ordinance makes a series of changes, most notably: 1) It creates a regulatory scheme for businesses that operate exclusively through a web -based application system to connect drivers with passengers. The regulations largely mirror those for businesses that dispatch drivers and use meters. 2) The City will issue identification cards to all drivers. 3) The current exception that allows dispatching to be done from a non -office location from midnight to 6:00 AM is eliminated. 4) Metered taxi cab business must have a unique color scheme. 5) A destination rate is defined to be the flat rate from a location within the City limits to a location outside the City limits. 6) Passengers can share rides if they all get into the taxi at the same point and they expressly agree to share the ride. The driver cannot ask the passengers to share a ride, and the driver cannot stop and pick-up additional passengers after departing with the initial passengers. Action: January 20, 2015 ITEM 12. /5 _. y 6� n(, City of Iowa City FAIR HOUSING COMPLAINTS ORDINANCE AMENDING TITLE 2 OF THE CITY CODE, ENTITLED "HUMAN RIGHTS," CHAPTER 4, ENTITLED "ENFORCEMENT," SECTION 2, ENTITLED "INVESTIGATION OF COMPLAINTS; PREDETERMINATION SETTLEMENT" TO AMEND TIME PERIODS CONCERNING HOUSING COMPLAINTS. (PASS AND ADOPT) Comment: The Iowa City Human Rights Commission has requested that time periods applicable to (1) serving notice of complaint and (2) providing answers to mandatory questionnaires and document requests be amended for the area of housing only. Chapter 5 of the Human Rights Ordinance, entitled "Fair Housing," requires that a determination on housing complaints must be made within 100 days of filing. This time restriction is not applicable to the other four areas the Ordinance addresses.
