Resolutions and Motions: ITEM 4d(1) DOWNTOWN ALLEY DUMPSTERS - RESOLUTION REPEALING RESOLUTION NO. 06-46 AND ADOPTING A NEW PERMIT SYSTEM FOR SOLID WASTE CONTAINERS IN THE DOWNTOWN ALLEYS INCLUDING PROVISIONS FOR APPLICATION, DURATION, INSPECTION, SUSPENSION, REVOCATION, REMOVAL, FEES, AND INSURANCE. Comment: Resolution No. 06-46 adopts a permit policy for solid waste containers in the downtown alleys. Staff recommends amending the policy to change the dates of the permit year, to decrease the time for a permit holder to cure a violation, and to increase the cost to store a container removed by the City because it is in violation of the permit. The policy is attached to the resolution. February 9, 2015 i5 -meq City of Iowa City Page 3 ITEM 4d(2) WADE STREET WATER MAIN REPLACEMENT - RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR CONSTRUCTION OF THE WADE STREET WATER MAIN REPLACEMENT PROJECT. ITEM 4d(3) Comment: Bids for this project were opened on Tuesday, January 13, 2015, and the following bids were received: Hometown Plumbing & Heating Davenport, IA $ 224,139.20 Rathje Construction Marion, IA $ 246,930.00 Calacci Construction Iowa City, IA $ 248,636.50 Tschiggfrie Excavating Dubuque, IA $ 296,641.00 Engineer's Estimate $ 215,000.00 Public Works and Engineering recommend award of the contract to Hometown Plumbing & Heating of Davenport, IA. The project will be funded with Water revenues. This item was deferred from the January 20 Council meeting. TRAIL EASEMENT RELEASE - RESOLUTION APPROVING THE RELEASE OF A TRAIL EASEMENT ON LOT 194 OF GALWAY HILLS PART 10. Comment: The owner of Lot 194 of Galway Hills Part 10 has requested the trail easement originally platted on Lot 194 be released. As part of recent street and sidewalk improvements in the area, the trail connection on Lot 194 is no longer utilized and the easement is no longer necessary. ITEM 4d(4) GRANT ACCOUNTANT - RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE ACCOUNTING DIVISION OF THE FINANCE DEPARTMENT BY REPLACING THE BUDGETED TEMPORARY STAFF WAGES WITH A PERMANENT .6 FTE GRANT ACCOUNTANT POSITION, GRADE 13. Comment: This resolution will allow the Accounting Division more flexibility to attract experienced personnel needed to maintain the many grants the Accounting Division is responsible for reporting. ITEM 4d(5) SENIOR SYSTEMS ENGINEER RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE INFORMATION TECHNOLOGY SERVICES DIVISION OF THE FINANCE DEPARTMENT BY REDUCING THE SENIOR SYSTEMS ENGINEER POSITION WAGES X5-2 FROM GRADE 30 TO GRADE 29 ON THE ADMINISTRATIVE/CONFIDENTIAL PAYPLAN. Comment: This resolution will allow the Information Technology Services Division to realign responsibilities by moving the supervisory duties from the Senior Systems Engineer position to the Information Technology Services Coordinator position. February 9, 2015 City of Iowa City Page 4 ITEM 4d(6) JANITORIAL SERVICES - RESOLUTION AUTHORIZING THE RENEWAL OF THE CONTRACT FOR JANITORIAL SERVICES WITH ABM JANITORIAL SERVICES. i5 -D--7 /S -2e Comment: This Resolution will approve the renewal of the janitorial contract with ABM Janitorial Services and allow the City Manager to execute subsequent annual renewals as appropriate. The initial term of the contract will be for one year, and will cost approximately $189,000. ITEM 4d(7) SLOTHOWER ROAD RESOLUTION REGARDING CONDITIONS OF JOHNSON COUNTY'S DEDICATION OF RIGHT-OF-WAY ALONG SLOTHOWER ROAD FOR THE EXTENSION OF THE CITY'S WATER DISTRIBUTION SYSTEM ITEM 4d(8) Comment: This resolution memorializes the conditions that the City is agreeing to regarding the sidewalk in exchange for the County's dedication of right-of-way that is necessary for the extension of the City's water distribution system. ROCKY SHORE LIFT STATION AND FLOOD GATE - RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST AMENDMENT #3 TO THE JANUARY 25, 2011 AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND H.R. GREEN TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE ROCKY SHORE LIFT STATION AND FLOOD GATE PROJECT. Comment: This amendment authorizes H.R. Green to provide extended engineering services and project design modifications. The amendment cost is $12,620 and will bring the total consultant services fees to $716,620. The consultant services and construction costs are funded through a Community Development Block Grant. ITEM 4d(9) HOUSING VOUCHER ADMINISTRATIVE PLAN , RESOLUTION TO ADOPT THE IOWA CITY HOUSING AUTHORITY'S HOUSING CHOICE VOUCHER (HCV) ADMINISTRATIVE PLAN Comment: The Department of Housing and Urban Development requires City Council approval on the adoption of a Housing Choice Voucher (HCV) Administrative Plan. The purpose of the HCV Administrative Plan is to govern administration of the HCV and Family Self -Sufficiency programs administered by the Iowa City Housing Authority, including those policies not covered under Federal regulations. On January 15, 2015, the Housing and Community Development Commission reviewed the proposed amendments to the HCV Administrative Plan. They recommend City Council approve the proposed amendments. Staff recommends approving all proposed amendments to the HCV Administrative Plan. February 9, 2015 City of Iowa City Page 5 /L ITEM 4e. Setting Public Hearings: ITEM 4e(1) UNIVERCITY SALE, 601 SOUTH GOVERNOR - RESOLUTION SETTING PUBLIC HEARING FOR FEBRUARY 23, 2015, ON A PROPOSAL TO CONVEY A SINGLE FAMILY HOME LOCATED AT 601 SOUTH GOVERNOR STREET. ITEM 4e(2) ITEM 4e(3) /5- J�3 Comment: In the UniverCity Neighborhood Partnership Program, the City purchases rental units located in designated neighborhoods surrounding the University, rehabilitates them, and then sells them to income -eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 601 South Governor Street. The amount of the sale will be $199,500. FIRST AVENUE GRADE SEPARATION — RESOLUTION SETTING A PUBLIC HEARING ON FEBRUARY 23, 2015 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE FIRST AVENUE GRADE SEPARATION PROJECT [STP -U-3715(636)--70-52], DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project involves lowering First Avenue, raising the Iowa Interstate Railroad tracks, and constructing a railroad bridge over First Avenue. Improvements include the construction of new roadway, sidewalk, railroad tracks, railroad bridge, retaining walls, water main, storm sewer, traffic signalization and other related work. The total estimated construction cost is $10,933,000, and work will be completed under two contracts within the same construction area and timeframe. The first contract (estimated $2,762,000) will include the railroad track work and will be completed by the Iowa Interstate (IRIS) Railroad, and the second contract (estimated $8,171,000) will include all other work and will be bid through the Iowa Department of Transportation. This project will be funded with Federal Surface Transportation Program (STP) proceeds, Traffic Safety Improvement Program (TSIP) proceeds, General Obligation bond proceeds and a contribution from the IAIS Railroad. AMEND DOWNTOWN URBAN RENEWAL AREA PLANS - RESOLUTION DETERMINING THE NECESSITY OF AND SETTING DATES OF A CONSULTATION (FEBRUARY 20, 2015) AND PUBLIC HEARING (MARCH 9, 2015) ON A PROPOSED AMENDMENT NO. 13 TO THE CITY -UNIVERSITY PROJECT I URBAN RENEWAL PLAN IN THE CITY OF IOWA CITY, IOWA. Comment: This Resolution is the first step to amend an Urban Renewal Plan. The amended plan will allow for City Council consideration of City funding of a new downtown hotel in the Central Business District. Comment: The Quality Housing" and Work Responsibility Act of 1998 ("QHWRA") requires submission of both a 5 -Year and n Annual Plan. The 5 -year, PHA (Public Housing Agency) Plan describ sl the agency's mission and the long-term plan for achieving that mission over the subsequent fire years. The PHA must assure that its Fiv�Year Plan is consistent wit" the Consolidated Plan for the jurisdiction in which the PHA is located. Thei Annual Plan provides details about the PH'A's current programs and the resident population served, as well as the PHA's strategy for addressing the housing needs of currently assiste families and the larger community. The 5 -year PHA (Public Housing Agency) Plan describes the agency's mission and the long-term plan for achieving that mission over the subsequent five years. These strategies for meeting the Housing Authorities mission, goals, and objective are based on data collected in CITY STEPS 2016-2020 Iowa City's Consolidated Plan for Housing, Jobs, and Services for Low -Income Residents. Council will discuss # 6a, 6b, 6c, 6d at formal meeting) ITEM 6a REZONING 608 AND 610 S. DUBUQUE STREET LANDMARK DESIGNATION ORDINANCE TO DESIGNATE PROPERTIES LOCATED AT 608 AND 610 S. DUBUQUE STREET AS LOCAL HISTORIC LANDMARKS. (REZ14-00024) Comment: At its December 18 meeting, by a vote of 7-0, the Planning and Zoning Commission recommended approval; and at its December 11 meeting the Historic Preservation Commission recommended approval of the rezoning for Local Landmark designation for properties at 608, 610 and 614 S Dubuque St. The structure at 614 S Dubuque St has been demolished and no longer qualifies for Historic Landmark designation. Landmark status would require Historic Preservation Approval for significant changes to the exterior of the buildings, and also allow for transfer of density and modifications to certain zoning requirements. The City Council and Planning and Zoning Commission will hold a joint discussion on this item at the February 9 Work Session. (REZ14-00010) Comment: At its December 18, meeting, by a vote of 6-0 (Freerks absent), the Planning and Zoning Commission recommended approval of this rezoning with conditions regarding installation of infrastructure. Approval will allow the development of 72 multi -family dwelling units in four buildings in lieu of 73 manufactured dwelling units permitted by the existing plan. (REZ14-00023) ITEM 6d Comment: At its January 15 meeting by a vote of 7-0, the Planning and Zoning Commission recommended approval of this rezoning. Approval will allow an expansion of Northgate Corporate Park. 1. PUBLIC HEARING Action: 2. CONSIDER AN ORDINANCE (FIRST CONSIgRAT ION) Action: SLOTHOWER ROAD REZONING - REZONING APPROXIMATELY 1.1 ACRES LOCATED AT 965 SLOTHOWER ROAD FROM COUNTY AGRICULTURE (A) ZONE TO RURAL RESIDENTIAL (RR -1) (REZ14- 00022) (PASS AND ADOPT) Comment: At its November 20 meeting, by a vote of 6-0 (Dyer absent), the Planning and Zoning Commission recommended approval of this annexation and rezoning. Approval will allow an approximately 3.1 acre portion of the Slothower Farm to be split from the larger property. The new parcel would contain 2 acres (location of the farm house) that is already located in the city in addition to the 1.1 acres requested for annexation, which contains a portion of the barn. The property could then be sold as an acreage. Annexation has been approved by the State. ITEM 7. UNIVERCITY SALE, 936 EAST BLOOMINGTON - RESOLUTION AUTHORIZING CONVEYANCE OF A SINGLE FAMILY HOME LOCATED AT 936 EAST BLOOMINGTON STREET. %5- 3q Comment: In the UniverCity Neighborhood Partnership Program, the City purchases rental units located in designated neighborhoods surrounding the University, rehabilitates them, and then sells them to income -eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 936 East Bloomington Street. The amount of the sale will be $185,000 (this is what the City paid to purchase the home) plus "carrying costs" of approximately $17,000. "Carrying costs" are all costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to repair and rehabilitate the home. a. CONSIDER A RESOLUTION Action: �D ��O February 9, 2015 City of Iowa City Page 9 ITEM 8. 2015 LANDFILL GAS FLARE REPLACEMENT — APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE 2015 LANDFILL GAS FLARE REPLACEMENT PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND 1 - 5- FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project consists of removing the existing landfill gas collection system enclosed ground flare and replacing it with a new one. REVISION TO TAXICAB - ORDINANCE AMENDING TITLE 5, ENTITLED "BUSINESS AND LICENSE REGULATIONS," CHAPTER 2, ENTITLED "TAXICABS," IS AMENDED TO PROVIDE FOR THE REGULATION OF RIDE SHARING SERVICES OPERATING VIA A WEB BASED APPLICATION SYSTEM, TO REQUIRE THE CITY TO ISSUE IDENTIFICATION CARDS, TO ELIMINATE THE EXCEPTION FOR DISPATCHING FROM A LOCATION OTHER THAN THE OFFICE FROM MIDNIGHT TO 6:00 AM, TO REQUIRE COLOR SCHEMES, TO REVISE THE DEFINITION OF DESTINATION RATES, AND TO REGULATE SHARED RIDES. (PASS AND ADOPT) Comment: In response to public safety issues and the likely entry of ridesharing businesses into the market, this ordinance makes a series of changes, most notably: 1) It creates a regulatory scheme for businesses that operate exclusively through a web -based application system to connect drivers with passengers.
