The 28E Agreement, which has been executed by the School District, sets forth the responsibilities of the District and the City. AGREEMENT WITH COUNTY RE: SYCAMORE STREET - RESOLUTION APPROVING A 28E PROJECT AGREEMENT BETWEEN JOHNSON COUNTY, IOWA AND THE CITY OF IOWA CITY, IOWA FOR IMPROVEMENTS TO A PORTION OF SYCAMORE STREET. Comment: The east side of Sycamore Street is county right-of-way. This agreement authorizes the City to construct improvements to Sycamore Street within the county right-of-way at no expense to the County. The City agrees to maintain the sidewalk that will be constructed within the County right-of-way until the property is annexed into the City. ITEM 3d(3) DECEMBER DISBURSEMENTS - MOTION TO APPROVE DISBURSEMENTS IN THE AMOUNT OF $10,713,930.89 FOR THE PERIOD OF DECEMBER 1 THROUGH DECEMBER 31, 2014, AS RECOMMENDED BY THE FINANCE DIRECTOR SUBJECT TO AUDIT. February 23, 2015 City of Iowa City Page 3 ITEM 3d(4) TEMPORARY CONSTRUCTION EASEMENT ON SLOTHOWER ROAD - RESOLUTION APPROVING AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A TEMPORARY CONSTRUCTION 115-3? EASEMENT AGREEMENT WITH JOHNSON COUNTY FOR THE EXTENSION OF THE CITY'S WATER DISTRIBUTION SYSTEM ON SLOTHOWER ROAD. Comment: The Council approved a resolution regarding the conditions of Johnson County's dedication of right-of-way along Slothower Road for the extension of the City's Water Distribution System on February 9, 2015. This resolution approves the necessary temporary construction easement. ITEM 3d(5) SLOTHOWER ROAD DEDICATION - RESOLUTION ACCEPTING THE DEDICATION OF .35 ACRES ALONG SLOTHOWER ROAD FROM I5_39 SLOTHOWER FARMS, L.L.C. IN IOWA CITY, JOHNSON COUNTY, IOWA, AS PUBLIC RIGHT-OF-WAY. Comment: This right-of-way dedication is being made pursuant to the approval of an auditor's parcel that allowed a two lot split of certain land along Slothower Road. This dedication will provide adequate right-of-way to allow Slothower Road to be improved to City standards at such time as the City determines to do so. ITEM 3d(6) POSITIONS IN PARKS AND RECREATION - RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE PARKS AND RECREATION DEPARTMENT BY ELIMINATING ONE FULL-TIME MAINTENANCE 7S — `fD WORKER II - CBD AND ONE SENIOR MAINTENANCE WORKER - CBD POSITION AND ADDING ONE FULL-TIME MAINTENANCE WORKER II - HORTICULTURE AND ONE FULL-TIME SENIOR MAINTENANCE WORKER -HORTICULTURE SPECIALIST. Comment: Changes in the operation of the Central Business District and Parks Division necessitate some changes in staff operations. These changes are only in title to reflect new responsibilities within their respective divisions. There are no monetary changes proposed. ITEM 3d(7) ASBESTOS REMOVAL OF MISC. HAZARDOUS MATERIALS & MISC. HAZARDOUS WASTE AT THE NORTH WASTEWATER TREATMENT PLANT - RESOLUTION ACCEPTING THE WORK FOR THE ASBESTOS ABATEMENT REMOVAL OF MISC. HAZARDOUS MATERIALS AND REMOVAL OF HOUSEHOLD HAZARDOUS WASTE AT THE CITY OF IOWA CITY NORTH WASTEWATER TREATMENT PLANT PROJECT. Comment: The project has been completed by New Horizons Enterprises, Inc. of Lincoln, Nebraska, in substantial accordance with the plans and specifications. The Engineer's Report and Performance and Payment bonds are on file with the City Engineer. Project Estimated Cost: $ 45,000.00 Project Bid Received: $ 25,019.00 Project Actual Cost: $ 25,019.00 February 23, 2015 City of Iowa City Page 4 ITEM 3d(8) POSITIONS IN POLICE DEPARTMENT - RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE POLICE DEPARTMENT AND THE AFSCME AND ADMINISTRATIVE AND CONFIDENTIAL PAY _ PLANS BY DELETING ONE FULL TIME RECORDS SUPERVISOR, ONE FULL-TIME ADMINISTRATIVE SECRETARY, TWO FULL-TIME POLICE RECORDS CLERKS AND TWO FULL-TIME SENIOR POLICE RECORDS CLERKS AND ADDING ONE FULL-TIME POLICE ADMINISTRATIVE COORDINATOR AND FOUR FULL-TIME POLICE RECORDS TECHNICIANS. Comment: Changes in the operation of the Police Department necessitate some changes in staff operations. These changes reflect combining the higher skill level job duties of Police Records Supervisor and Police Administrative Secretary into one position titled: Police Administrative Coordinator. This position combines the higher skill level job duties of Police Records Supervisor and Police Administrative Secretary. Merger of these positions will equate to a reduction of $89,262.00/year in salary and benefits (FY16). Currently the Records Division is comprised of 2 Records Clerks, 2 Sr. Records Clerks, and 1 Records Supervisor. Since the job classification process that occurred in 2007, Records Clerks' job duties have expanded to where they are currently required to complete the same essential job duties as Sr. Records Clerks. In the future absence of a Records Supervisor, the Records Clerks will be required to assume even more of a share of the those duties that will need to be distributed amongst the remaining Records personnel. To accommodate and manage this we are proposing that Records Clerks are moved up in job classification equivalent to Senior Records Clerk and that this job title be changed to Police Records Technician. It is estimated that the difference in pay when all Police Records Technicians are topped out on the current pay scale will be an increase of $7,975.00/year (FY16). Supervisor duties of the records department will be allocated to the Sergeant assigned to Planning/Research/Public Information. The total estimated reduction of the above position changes is $81,208.00 ITEM 3d(9) ECONOMIC DEVELOPMENT COMMUNICATION PROTOCOL - RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST TO AN / -43 AGREEMENT BETWEEN THE THREE CITIES OF IOWA CITY, CORALVILLE, AND NORTH LIBERTY ESTABLISHING A COMMUNICATION PROTOCOL FOR ECONOMIC DEVELOPMENT ACTIVITY. Comment: This agreement establishes a communications protocol between the cities of Iowa City, Coralville, and North Liberty when pursuing economic development activities. The agreement precludes any of the three cities from actively recruiting a business to relocate from another participating city. The agreement also establishes a process of communication in the event a business expresses an interest in relocating. The agreement was endorsed by the Iowa City Area Development Group Board of Directors in a unanimous vote. February 23, 2015 City of Iowa City Page 5 ITEM 3d(10) WASHINGTON STREET AND NORTH PEDESTRIAN MALL DOWNTOWN STREETSCAPE - RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND i S -S3 THE CITY CLERK TO ATTEST AN AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND GENUS LANDSCAPE ARCHITECTS, PC, OF DES MOINES, IOWA TO PROVIDE CONSULTANT SERVICES FOR THE WASHINGTON STREET AND NORTH PEDESTRIAN MALL PORTIONS OF THE DOWNTOWN STREETSCAPE PLANNING PROJECT. Comment: This agreement authorizes Genus Landscape Architects, PC to provide consultant services including design development, construction documents, bid phase services, and limited construction administration services necessary to enable construction of the 2016 Washington Street and North Pedestrian Mall portions of the Downtown Streetscape Planning Project. The consulting services also include coordination with Cecil Balmond, of Balmond Studio, the preferred artist recommended by the City Public Art Advisory Committee, for the development of a concept for the work of art to be located in Black Hawk Mini Park. The total cost of the services is not to exceed $501,234. This will be funded by 2014 and 2015 GO bonds. ITEM 3d(11) SETTLEMENT - RESOLUTION RATIFYING SETTLEMENT OF IMMINENT LITIGATION. 5 - ` q Comment: This resolution will confirm and ratify a proposed settlement of imminent litigation which is set for discussion during the executive session scheduled earlier on Tuesday, February 23, 2015. ITEM 3e. Setting Public Hearings: ITEM 3e(1) PROPOSED FISCAL YEAR BUDGET - RESOLUTION SETTING A PUBLIC HEARING ON MARCH 9, 2015 TO DISCUSS THE PROPOSED /5 -LIS OPERATING BUDGET FOR THE FISCAL YEAR JULY 1, 2015 THROUGH JUNE 30, 2016, THE PROPOSED THREE-YEAR FINANCIAL PLAN FOR FY2015 - 2017, AND ALSO THE MULTI-YEAR CAPITAL IMPROVEMENTS PROGRAM THROUGH FISCAL YEAR 2019. Comment: This resolution sets a public hearing on March 9, 2015 to discuss the FY2016 Proposed Operating Budget, the three-year Financial Plan for FY2015 — FY2017 and multi-year Capital Improvements Program (CIP) through Fiscal Year 2019. Detailed information on the budget will be available for public inspection on February 17, 2015. ITEM 3e(2) PORTABLE SIGNS — MOTION SETTING A PUBLIC HEARING FOR MARCH 9 ON AN ORDINANCE AMENDING TITLE 14-56 'SIGN REGULATIONS' FOR CENTRAL BUSINESS ZONES. Comment: At its February 5 meeting, by a vote of 6-0, the Planning and Zoning Commission recommended approval of this zoning code amendment. Approval will allow businesses in the Central Business (CB) zones to place portable signs in the public right of way subject to certain conditions regarding placement, height, and size. February 23, 2015 City of Iowa City Page 6 ITEM 3e(3) COMPREHENSIVE PLAN AMENDMENT — MOTION SETTING A PUBLIC HEARING FOR MARCH 9, 2015 ON A COMPREHENSIVE PLAN AMENDMENT FOR THE THREE BLOCKS SOUTH OF IOWA AVE., EAST OF GILBERT ST., WEST OF VAN BUREN ST AND NORTH OF BURLINGTON ST. Comment: At its February 5 meeting, by a vote of 1-5, the Planning and Zoning Commission failed to recommend approval of this Comprehensive Plan amendment. Approval would add the three blocks, largely owned by the City, to the Downtown District of the Downtown and Riverfront Crossings Master Plan, and identify these three blocks as suitable for mixed-use development and civic uses. ITEM 3e(4) BOYD'S FASHIONABLE ACRES CONVEYANCE - RESOLUTION OF INTENT TO CONSIDER THE PROPOSED CONVEYANCE OF OUTLOT B, BOYD'S FASHIONABLE ACRES, IOWA CITY, IOWA TO CASEY BOYD, -q4W L.L.C., AND SETTING A PUBLIC HEARING ON SAID PROPOSED CONVEYANCE FOR MARCH 9, 2015. Comment: Outlot B of Boyd's Fashionable Acres was intended to be conveyed to the adjacent property owner. The owner, however, recorded a deed purporting to convey title to the City. The City had not accepted the outlot, and does not desire to do so as it serves no public purpose. Therefore, the City proposes to convey any interest it has in this land back to the owner via a quit claim deed without compensation. ITEM 3e(5) NORMANDY DRIVE RESTORATION PROJECT - RESOLUTION SETTING A PUBLIC HEARING ON MARCH 9, 2015 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE NORMANDY DRIVE 4[ -7 RESTORATION PROJECT-- PHASE IIIB, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPEC- TION. Comment: This phase of the project will finish the trail connection from Rocky Shore Drive to Normandy Drive and finish the last phase of renovation to the Normandy Drive area after the 2008 flooding. This project is budgeted as a CIP # R4160. A REAP grant for the Iowa River Corridor Project has been transferred to this account for $200,000. February 23, 2015 City of Iowa City Page 7 ITEM 3e(6) SLOTHOWER ROAD WATER MAIN — RESOLUTION SETTING A PUBLIC HEARING ON MARCH 9, 2015 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE 1 5 _q CONSTRUCTION OF THE SLOTHOWER ROAD WATER MAIN 5 PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project will include the installation of new water main along the east side of Slothower Road from Tempe Place to Melrose Avenue. The project also includes the installation of new hydrant assemblies, connection to existing water mains, restoration and other related work. The estimated construction cost is $619,000 and will be funded with Water revenues. ITEM 3e(7) NORTH PLANT SALVAGE AND DEMOLITION PROJECT — RESOLUTION SETTING A PUBLIC HEARING ON MARCH 9, 2015 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE NORTH PLANT SALVAGE AND DEMOLITION PHASE OF THE IOWA CITY WASTEWATER TREATMENT PLANT RELOCATION PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: The proposed project is part of a multiphase flood mitigation plan that will permanently remove structures and public facilities from the path of repetitive flooding. The estimated construction cost is $ 5,500,000. The Iowa Flood Mitigation Program (IFMP) is designed to allow cities to capture 70% of future state sales tax growth to fund flood mitigation projects and has allowed Iowa City to capture up to $8.5 million dollars in future state sales tax growth to pay for the project. ITEM 3e(8) UNIVERCITY SALE, 711 NORTH GILBERT - RESOLUTION SETTING PUBLIC HEARING FOR MARCH 9, 2015 ON A PROPOSAL TO CONVEY A SINGLE FAMILY HOME LOCATED AT 711 NORTH GILBERT STREET. Comment: In the UniverCity Neighborhood Partnership Program, the City purchases rental units located in designated neighborhoods surrounding the University, rehabilitates them, and then sells them to income -eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 711 North Gilbert Street. The amount of the sale will be $218,000 (this is what the City paid to purchase the home) plus the "carrying costs," which are which are all costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to repair and rehabilitate the home. Comment: This project involves lowering First Avenue, raising the Iowa Interstate Railroad tracks, and constructing a railroad bridge over First Avenue. The total estimated construction cost is $10,933,000, and work will be completed under two contracts within the same construction area and timeframe. Comment: This development agreement provides tax increment financing rebates of $4.7 million for the construction of a mixed use multi-family/student housing project. The estimated construction cost is $39 million for a 15 story 154 unit building. The rebates will be partial rebates such that only the taxes in excess of that which would be generated by a 5 -story building will be rebated. SHARED RIDES REVISION - ORDINANCE AMENDING TITLE 5, ENTITLED "BUSINESS AND LICENSE REGULATIONS," CHAPTER 2, ENTITLED "TAXICABS," SECTION 4, ENTITLED "DRIVER REQUIREMENTS," TO REVISE THE PROVISION ON SHARED RIDES. (SECOND CONSIDERATION) Comment: The previous agenda item is a proposed ordinance amending the City's taxicab requirements, and if approved, this ordinance should be considered. Section 5-2-4H of the newly approved ordinance allows for "shared rides" only if all the passengers have the same origin and prohibits the driver/company from charging a fee for the extra passengers. This ordinance amends the provision on shared rides by allowing passengers to get into the taxicab at different locations with consent and allows the driver / company to charge a fee for extra passengers.
