ITEM 5d(1) PARTIAL MORTGAGE RELEASE - RESOLUTION AUTHORIZING THE
MAYOR PRO TEM TO SIGN AND THE CITY CLERK TO ATTEST TO
THE PARTIAL RELEASE OF A MORTGAGE HELD BY IOWA CITY TO
SECURE A LOAN FOR THE COST TO CONSTRUCT CAMP
CARDINAL ROAD.
Comment: The City has a mortgage securing the loan made to
Southgate Construction Company for its portion of the cost to construct
Camp Cardinal Road in Iowa City. Monthly payments are current and the
loan will be paid in full no later than February 28, 2017. The loan
agreement requires additional payments to be made in the event of a sale
or final platting of more than 5 acres. While the proposed partial release
releases the auditor's parcel that is being transferred only a small portion
(a little over an acre) of the parcel is in Iowa City and subject to the
mortgage. The release will be signed by the Mayor Pro Tem as the
Mayor represents a party to the transaction.
ITEM 5d(2) UISG APPOINTMENT — MOTION APPROVING THE APPOINTMENT
OF NICOLE NEAL AS THE CITY COUNCIL LIAISON FROM THE
UNIVERSITY OF IOWA STUDENT GOVERNMENT (UISG) TO THE
CITY COUNCIL UNTIL MAY 1, 2016.
Comment: This motion affirms the appointment of alternate UISG
representative Nicole Neal as the City Council Liaison for 2015-2016. An
alternate will be names in the near future.

Comment: A preliminaqrp4gf of Churchill Meadows was approved on
January 6, 2015. Staff recommends approval of the final plat subject to
approval of legal papers and construction drawings by the City Attorney
and City Engineer. It is anticipated that legal papers and construction
C drawipgi§ will be approved prior to the May 5 City Council meeting.
Agpfoval will allow the development of Churchill Meadows, a 96 -lot,

APPROVING UNCLASSIFIED SALARY COMPENSATION FOR
FISCAL YEAR 2016 FOR THE CITY MANAGER, CITY ATTORNEY,
AND CITY CLERK AND AUTHORIZING AND DIRECTING THE MAYOR
TO SIGN AND CITY CLERK TO ATTEST AMENDMENT NO. 4 TO THE
CONTRACT OF THE CITY ATTORNEY AND AMENDMENT NO. 2 TO
THE CONTRACT OF THE CITY MANAGER.
Comment: City Council held an executive session on April15th to
evaluate the City Manager, City Attorney, and City Clerk. The resolution
provides the following compensation: City Manager - $173,409.60 (no
change) plus 5 days additional vacation and 5 days additional personal
leave; City Attorney - $139,068.80 (no change) plus 5 additional days'
vacation; City Clerk $109,720.00 (2% raise).

APPROVAL OF FLOOD BUYOUT APPLICATION - RESOLUTION TO
SUBMIT A HAZARD MITIGATION GRANT PROGRAM APPLICATION
TO PURCHASE PROPERTY IN THE 100 -YEAR FLOODPLAIN,
PROVIDE THE 15% REQUIRED LOCAL MATCH AND AUTHORIZING
THE CITY MANAGER TO SUBMIT AND SIGN ALL CONTRACTS AND
AMENDMENTS FOR SAID PROGRAM.
Comment: The State of Iowa will receive FEMA disaster funding under
the Hazard Mitigation Grant Program (HMGP) as a result of Presidential
Disaster Declaration DR -4187 for the severe storms, tornadoes, straight-
line winds, and flooding that occurred in Iowa in 2014. The City will apply
to purchase up to nine eligible properties near Creekside Park (Ralston
Creek floodplain) and properties on Normandy Drive, Manor Drive and
Taft Speedway (Iowa River floodplain). The City must provide a 15%
local match on total project costs.
CITY STEPS AMENDMENT #1 RESOLUTION APPROVING
PROPOSED AMENDMENT TO IOWA CITY'S 2016-2020
CONSOLIDATED PLAN (a.k.a. CITY STEPS).
Comment: This agenda item consists of a proposed amendment to the
2016-2020 Consolidated Plan (a.k.a. CITY STEPS) to utilize $50,000 in
Year One (Fiscal Year 2016) for sidewalk curb ramps in the downtown
commercial district to improve accessibility and prevent slum and blight.
The Consolidated Plan currently apportioned these funds for building
fagade improvements and micro -enterprise assistance. This new activity
will also be an eligible activity for Year Two to Year Five under the
economic development set-aside. The Housing and Community
Development Commission recommended unanimously in favor of this
amendment at their April 16, 2015 meeting. A 30 -day public comment
period started on April 3, 2015 and ends May 5, 2015.
APPROVAL OF THE CDBG / HOME BUDGET - RESOLUTION
ADOPTING IOWA CITY'S FY16 ANNUAL ACTION PLAN WHICH IS A
SUB -PART OF IOWA CITY'S 2016-2020 CONSOLIDATED PLAN (CITY
STEPS) AND AUTHORIZING THE CITY MANAGER TO SUBMIT SAID
PLAN AND AMENDMENTS AND ALL NECESSARY CERTIFICATIONS
TO THE U.S. DEPARTMENT OF HOUSING AND URBAN
DEVELOPMENT, AND DESIGNATING THE CITY MANAGER AS THE
AUTHORIZED CHIEF EXECUTIVE OFFICER.
Comment: At their April 16, 2015 meeting, the Housing and Community
Development Commission (HCDC) discussed and recommended that
City Council approve the FY16 Annual Action Plan — attached to this
resolution is Exhibit A that lists the FY16 CDBG and HOME projects
recommended for funding with revisions recommended by staff.

PROCUREMENT OF MOWERS RESOLUTION AUTHORIZING THE
PROCUREMENT OF TWO TORO GROUNDSMASTER MOWERS.
Comment: This Resolution will approve the procurement of two (2) Toro
large gang mowers for the Parks Division. The procurement is in
accordance with the State of Iowa Multiple Awards Contract purchasing
contract. The total purchase will be $163,614.75, which exceeds the
$150,000 spending authority of the City Manager, and so requires Council
approval. This purchase will replace current mowers in the fleet and
funding for the purchase is available in account # 73730140.
ITEM 5d(12) PROCUREMENT OF QUICKLIME — RESOLUTION AUTHORIZING THE
PROCUREMENT OF PEBBLE QUICKLIME FOR LIME SOFTENING OF
THE CITY'S DRINKING WATER.
J Comment: This Resolution will approve the procurement of pebble
quicklime for lime softening of the City's drinking water. The pebble
quicklime procurement follows a request for bid for which three bids were
received. The lowest bid came from Graymont Lime, for $233,600 for
approximately 1,600 tons. This purchase exceeds the $150,000.00
spending authority of the City Manager, and so requires Council approval.
The initial term of the contract will be one year, with an option to renew for
five (5) one (1) year terms. The Resolution provides the City Manager the
authority to execute subsequent renewals as are reasonable and
appropriate.

PROCUREMENT OF AUDIT SERVICES RESOLUTION
AUTHORIZING THE CITY MANAGER TO ENTER AGREEMENTS AS
APPROVED BY THE CITY ATTORNEY FOR AUDITING SERVICES OF
IOWA CITY FINANCIAL STATEMENTS FOR FISCAL YEARS 2015,
2016, AND 2017
Comment: This resolution will authorize the City Manager to enter
agreements as approved by the City Attorney for auditing services of Iowa
City financial statements for fiscal years 2015, 2016, and 2017. A Request
for Proposal (RFP) was issued to procure Audit Services. There were
multiple proposals received in response to the RFP. City staff, which
included members of the Finance Department, evaluated and scored the
proposals and recommended award to Eide Bailly. Eide Bailly proposed to
provide the requested auditing services for the following prices: $61,070
for FY15, $63,510 for FY16, and $65,820 for FY17. The total project cost
for the three-year (FY15 through FY17) engagement is an all-inclusive
maximum price of $190,400, which exceeds the City Manager's spending
authority of $60,000 for professional services, thus requiring City Council
approval.

ENTREPRENEURIAL DEVELOPMENT CENTER - RESOLUTION
AUTHORIZING FUNDING OF $6,250 IN FY15, $25,000 IN FY16 AND
INTENT TO BUDGET $25,000 IN FY17 FOR ENTREPRENEURIAL
DEVELOPMENT CENTER, INC.
Comment: The Entrepreneurial Development Center provides business
development services to the entrepreneurial community not otherwise
available in Iowa City. They have provided technical assistance and links
to outside funding sources for Iowa City business clients who would not
have access otherwise. The services they offer are unique and
complement existing entrepreneurial support offered through ICAD, the
CoLab, the Iowa City Area Chamber and the University's Small Business
Development Center. The City Council Economic Development
Committee voted to recommend Council support of the request at their
meeting March 30, 2015.

SINGLE FAMILY, TOWNHOUSE AND MULTI -FAMILY RESIDENTIAL

Comment: At its April 16 meeting, by a vote of 6-0 (Swygard absent), the
Planning and Zoning Commission recommended approval of the
proposed Comprehensive Plan amendment. Approval would change the
Comprehensive Plan designation of the property at the South West
corner of Court Street and Taft Avenue from `Mixed Use' to Medium/High-
Density Single Family, Townhouse and Multi -Family Residential.

Comment: At its April 16 meeting, by a vote of 6-0 (Swygard absent), the
Planning and Zoning Commission recommended approval of the
proposed rezoning. Approval would allow the development of a mix of
duplexes, four-plexes and a multi -family building subject to conditions

STREET - MOTION SETTING A PUBLIC HEARING FOR MAY 19 ON

Comment: At its April 16 meeting, by a vote of 3-3 (Freerks, Martin and
Theobald voting in the affirmative; Swygard absent), the Planning and
Zoning Commission failed to recommend approval of the proposed
rezoning. Approval with staff -recommended conditions would allow the
development of a mixed-use building up to 15 stories in height, building
height step -backs at the third and fifth floors, a minimum of two floors of
Class A Office space and all required residential parking being provided
on-site.

2015 HIGHLAND AVENUE WATER MAIN REPLACEMENT -
RESOLUTION SETTING A PUBLIC HEARING ON MAY 19, 2015 ON
PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE
OF COST FOR THE CONSTRUCTION OF THE 2015 HIGHLAND
AVENUE WATER MAIN REPLACEMENT PROJECT, DIRECTING CITY
CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING
THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC
INSPECTION.
Comment: This project includes the replacement of existing water main
along Highland Avenue from Marcy Street to Lukirk Street. The
estimated construction cost is $196,000 and will be funded with Water
revenues.
CONCESSIONS AT TRUEBLOOD RECREATIONAL AREA -
RESOLUTION SETTING PUBLIC HEARING FOR MAY 19, 2015
ON A CONCESSION AGREEMENT WITH FIN & FEATHER H2O
LLC FOR THE PROVISION OF RECREATIONAL RENTAL
EQUIPMENT AND FOOD SERVICES AT TERRY TRUEBLOOD
RECREATION AREA.
Comment: The City and Fin & Feather H2O LLC ("Fin & Feather") signed
a 3 -year agreement for the provision of rental equipment and food
services at Terry Trueblood Recreational Area that will expire on August
31, 2015. Fin & Feather would like to enter into another 2 -year
agreement on the same terms. Because the total terms of both
agreements exceed 3 years, state law requires a public hearing.

Comment: It is anticipated the Planning and Zoning Commission will
make a recommendation on this proposed rezoning at its April 2 meeting.
The intended purpose of the rezoning is to allow a medical clinic at the
northeast corner of Dubuque Road and N. Dodge St. Staff requests
expedited action.

ITEM 8. UNIVERCITY SALE, 403 DOGLASS COURT - RESOLUTION AUTHORIZING
CONVEYANCE OF A SINGLE FAMILY HOME LOCATED AT 403 DOUGLASS
COURT.
Comment: In the UniverCity Neighborhood Partnership Program, the City purchases
rental units located in designated neighborhoods surrounding the University,
rehabilitates them, and then sells them to income -eligible buyers. Under the
UniverCity Neighborhood Partnership Program, the City proposes to sell 403
Douglass Court. The amount of the sale will be $102,000 (this is what the City paid to
purchase the home) plus "carrying costs" of approximately $4,200. "Carrying costs"
are all costs incurred by the City to acquire the home, maintain it and sell it, including
abstracting and recording fees, interest on the loan to purchase the home, mowing
and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to
repair and rehabilitate the home.

SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE
CONSTRUCTION OF THE IOWA CITY PARKING GARAGE MAINTENANCE
PROGRAM 2015 PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO
ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO
BIDDERS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS.
Comment: The 2015 Project focuses on concrete floor repairs and membrane
patching in the Dubuque Street Ramp. Additional efforts in this facility include
repairs to deteriorated concrete beams, expansion joints, stair tower tread and risers,
and interior facade lintels, along with other isolated structural and waterproofing
repairs throughout the garage. Additionally, smaller repairs to the Capitol Street
Ramp, Chauncey Swann Ramp, and Tower Place Parking Ramp will be made. The
estimated construction cost for the base bid is $402,000 and will be funded with
Parking revenue proceeds.

ITEM 11. TRANSIT FUNDING APPLICATION - RESOLUTION AUTHORIZING THE FILING
OF AN APPLICATION WITH THE IOWA DEPARTMENT OF TRANSPORTATION
FOR FY2016 IOWA DOT STATE TRANSIT ASSISTANCE AND FEDERAL
TRANSIT ADMINISTRATION FUNDING.
Comment: MPOJC will be filing an application on behalf of Iowa City Transit with
Iowa DOT for State Transit Assistance (STA) and Federal Transit Administration
(FTA) funding for FY16. Iowa City Transit will be receiving approximately $501,799 in
Iowa DOT STA formula funds and is applying for $17,845,950 in FTA capital funding
and approximately $1,482,500 of FTA operating funds.

agencies. The Housing and Community Development Commission (HCDC) reviewed
and formulated a funding recommendation for these funds at their January 15, 2015
meeting. The minutes of the January 15, 2015 HCDC meeting are in the March 9,
2015 Council packet. Attached to this resolution is Exhibit A that lists the
applications recommended for funding.

Comment: This resolution provides final authorization for the issuance of $7,785,000
General Obligation Bonds, The Tax Exemption Certificate sets out in detail a
number of facts, promises and obligations that must be met and agreed to by the
City in order to maintain these bonds as tax exempt. The Continuing Disclosure
Certificate is being executed and delivered for the benefit of the holders and
beneficial owners of the bonds and in order to comply with Securities and Exchange
Commission (SEC) rule 15c2-12.

"POLICE REGULATIONS," CHAPTER 5, ENTITLED "MISCELLANEOUS
OFFENSES," TO ELIMINATE THE DEFAULT PENALTY OF JAIL TIME FOR
UNSCHEDULED SIMPLE MISDEMEANORS AND ESTABLISH THE PENALTY
FOR INDECENT EXPOSURE. (FIRST CONSIDERATION)
Comment: On April 3, 2015, the Iowa Supreme Court ruled in State v. Young
that the Iowa Constitution requires court appointed counsel for indigent
defendants in simple misdemeanors if the penalty includes the possibility of jail
time. The penalty for many of the City's simple misdemeanors is a set fine (aka,
a scheduled offense), but if the penalty is not specified in the ordinance, the
penalty defaults to Iowa Code section 903.1(1)(a). Under section 903.1(1)(a), the
fine for a simple misdemeanor ranges from $65.00 to $625.00, and additionally the
court may order imprisonment not to exceed 30 days. Before State v. Young, a
defendant was provided with counsel only upon the prosecutor's notification to
the court that it intended to request jail time. The City Attorney's Office can only
recall one instance in over twenty (20) years in which the City requested that a
defendant be sentenced to jail and the offense was for indecent exposure in City
Park. Staff believes it appropriate for the default penalty for simple
misdemeanors to be limited to a fine, but the penalty for indecent exposure
include the possibility of jail.
