February52002andFebruary262002toconsiderthecomplaintTheBoardreviewedcasereportssummariesofinterviewswiththeComplainantandawitnessandatranscriptofthe911callInadditionrepresentativesoftheBoardinterviewedtheComplainantandawitnessANameClearingHearingwasscheduledtobeheldonFebruary262002TheofficersignedawaiverandthehearingwasnotheldFINDINGSOFFACTiTheIowaCityPoliceDepartmentreceiveda911callfromtheComplainarttearlymorninginAugust2001ShewasexcitedandnervousandreportedthatsomeonewasattemptingtogainentrytoherresidenceanupperfloorapartmentbypoundingonherdoorTheComplainantandtheotherperonthepremisesdescribedtheactionasbodyslammingagainstthedoorTheComplainantalsoheardsoundsthatresembledthatofapersonvomitingordryheavingandgrowlingsoundsTheotherpersonintheresidenceplacedhisbodyagainsttheinsideofthedoorinanattempttopreventforcibleentrywhiletheComplainantwasmakingthe911callAfterthecallwascompletedbutpriortoarrivalofpoliceofficersthesoundsceasedOfficerAarrivedandcheckedtheperimeterofthebuildingonthegroundfloorandthesecondfloorlandingOfficerAthengatheredinformationfromtheComplainantandtheotherpersonintheapartmentabouttheincidentandduringthisprocessdidnotnoteanyapparentdamagetothedoorOfficerAthenwentdownstairstocheckwithanotherofficerwhohadarrivedatthesceneandwhohadstoppedasuspectnearthebuildingThetwoofficersconfirmedthatthesuspectwasthepersonwhohadattemptedtogainentrytotheapartmentOfficerAreturnedtotheapartmentandinformedtheComplainantthattheotherofficerwasgoingtogivethesuspectaridehomebecausehewasintoxicatedTherethenensuedaconversationbetweentheComplainantandOfficerAabouttheproperdispositionofthematterTheComplainantwantedthesuspectarrestedOfficerAindicatedthataccordingtostandardoperatingprocedureoneofthemethodsofdealingwithsuchacasewastotaketheintoxicatedpersonhomeDuringtheconversationapparentlythematterofcrowdingattheCountyJailcameupasareasonfornotarrestingtheintoxicatedpersonTheremainderoftheincidentinvolvedOfficerAandtheComplainantdisagreeingovertheresolutionofthemattertheproceduresusedandthedemeanorofOfficerAOfficerAthencontactedtheotherofficerihvolvedandtoldhimthattheComplainantwasbeingvindictiveandtheintoxicatedpersonwastobearrestedandtakentojailTheComplainantdisputedtheuseofthewordvindictiveandfeltthatshewasbecominganaccusedpersonratherthanthevictimSheobjectedtotheuseofthewordasunprofessionalunsympatheticandinconsiderateOfficerAthenarrestedtheintoxicatedpersonandinformedthecomplainantthattheintoxicatedpersonwouldbetakentojailPCRB0105Page CONCLUSIONThiscomplaintfocusesontwoissues1OfficerAsinitialdecisionnottoarrestanintoxicatedpersonafterthepersonhadattemptedforciblytoenteraresidencewasimproper2OfficerAsuseofthewordvindictivetodescribetheComplainantswishthatthepersonbearrestedwasinappropriateAlleqation1PoliceofficersareprovidedbroaddiscretionwhetherornotanarrestshouldbemadeandfactorstobeconsideredareclearlydescribedinGeneralOrder9911ArrestsOfficerAsinitialdecisiontoremovetheintoxicatedsubjectfromthescenebytransportinghimhomewasconsistentwiththispolicyTheBoardfindsthattheChiefsconclusionthatOfficerAactedinaccordancewithpolicyissupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAllegation1isNOTSUSTAINEDAlleqation2TheBoardbelievesthatuseofthetermvindictivebyOfficerArepresentedacasualanddismissivedemeanorandattitudethattheComplainantperceivedasdemeaningandinsensitiveStandardOperatingGuideline0111VictimWitnessAssistanceclearlystatesthatmembersofthedepartmentshalltreatallvictimsandwitnesseswithdignityandassistvictimsinobtainingavailableservicesandRegardlessoftheseriousnessorviolationthevictimwitnessdeservessupportandfairtreatmentIntheirinterviewwithrepresentativesoftheBoardtheComplainantandwitnessbothdeniedthatOfficerAapologizedforhisuseofthewordvindictiveorforhisdemeanorTheBoardfindsthattheChiefsconclusionthatuseofthewordvindictivewasinappropriateissupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAllegation2isSUSTAINEDCOMMENTSThePoliceCitizensReviewBoardcouldnotfindaGeneralOrderorStandardOperatingGuidelinethatspecificallyaddressespublicintoxicationWerecommendthattheChiefconsiderwhethersuchawrittenpolicyshouldbecreatedtoprovideclearerguidanceforofficersinthehandlinganddispositionofsuchincidentsPCRBI05Page
