FINDINGSOFFACTOnanearlyJulymorningthecomplainantwasapassengerinavehiclestoppedbyanIowaCitypoliceofficerThevehiclewasstoppedattheintersectionofLucasStreetandMarketStreetforbeingdriventhewrongwaydownaonewaystreetOfficerAorderedthedriveroutofthevehicleandadministeredfieldsobrietytestsThecomplainantadvisedthatwhilethiswashappeningasecondofficerOfficerBarrivedandorderedthecomplainantandtwootherpassengersoutofthevehicleOfficerBidentifiedall3passengersAccordingtothecomplainanthepolitelyaskedOfficerBwhyhisfriendwasbeingarrestedThecomplainantwentontosaythatOfficerBapparentlytookexceptiontobeingquestionedandtoldthecomplainanthehaduntilthecountoftwotoleavetheareaorbearrestedthenimmediatelycounted12hecomplainantestimatedthatthiswaswaytoofastforanyonetobeablethesceneThecomplaintwassubsequentlyarrestedandchargedwithlpubiicintoxicationandobstructionofapeaceofficerThecomplainantsaidthatOfficerBthenapproachedtheremainingtwopassengersandtoldthemtoleavebeforetheywerearrestedaswellTbcomplainantsaidhedidntresistbeingplacedintothesquadcarasindicatedbyOfficerBinhisobstructingofficerschargeDuringthesubsequentpoliceinvestigationintothecomplainantsconcernsofOfficerBsconductOfficersAandBthecomplainantandoneofthetwoadditionalpassengerswereinterviewedOfficersAandBbothtoldinvestigatorsthatthecomplainantsquestionsabouthisfriendsarrestwereansweredandthathewasallowedtoleavewiththeotherpassengersThecomplainantstartedtoleavebutreturnedandcontinuedtoaskquestionsconcerninghisfriendsarrestOfficerBtoldinvestigatorsheofferedtospeakwiththecomplainantwhenhewassoberBothofficersindicatedthecomplainantwasgiven3opportunitiestoleavethesceneandthatOfficerBdidcounttothreeslowlypausedandthenarrestedthecomplainantwhenhedidntleaveOneofthepassengerswasinterviewedonthephonebyICPDinvestigatorsThepassengersaidthatallthepassengersweretoldtoleaveafterthedriverwasarrestedandtheydidsoWhenaskedbyinvestigatorswhyhethoughtthecomplainantwasarrestedhetoldthemhethoughtitwasforaskingtheofficerquestionsThecomplainantsinformationwasthesameasthecomplaintthathefiledwiththeboardhoweverhedidtellpoliceinvestigatorsthathedidresistOfficerBsattempttoplacehiminthepatrolvehiclePCRB0106Page2 On20February2002amemberoftheboardconductedindependentinterviewswiththecomplainantandthedriverofthevehicletheboardmemberwasunabletomakecontactwiththeothertwopassengersThedriversaidhewasstillonthesceneandstandingabout20feetawayfromOfficerBandthepassengersformostoftheincidentThedriversaidthatallthepassengersweretoldtheycouldleaveThecomplainantstayedandcontinuedtoasktheofficerquestionsTheofficerstoldthecomplainanttoleavetwotothreemoretimesbeforehewasarrestedThedrivercouldntrecalltheofficercountinganddidntseethecomplainantwhenhewasplacedinthesquadcarCONCLUSIONThiscomplaintfocusesontwoissues1OfficerBsdecisiontoarrestthecomplainantforpublicintoxicationconsideringthecircumstancessurroundingthearrestmainlythecomplainantbeingapassengerinavehicle2WhethertherewasprobablecausefortheobstructionchargeChieflywasthecomplainantallowedtoleavewashewarnedhewouldbearrestedanddidheresistbeingplacedinthesquadcarafterthearrestAlleqafion1ThecomplainantwasinappropriatelyarrestedforpublicintoxicationWhilepoliceofficersarenolongeratlibertytoarrestapassengerdirectlyfromavehicleforpublicintoxicationalltheevidencepresentedtotheboardindicatesthatthecomplainantwasallowedtoleaveandstayedofhisownfreewillAtthatpointhewasnolongerapassengerinavehiclebutapedestrianinapublicplaceAllegation1isNOTSUSTAINEDAlleqation2ThecomplainantwasinappropriatelyarrestedforobstructionofjusticeAllpartiesinterviewedwiththeexceptionofthecomplainantsaidthecomplainantwasinitiallyallowedtoleavewiththeotherpassengersandthathewaswarnedtoleaveatleasttwicepriortobeingarrestedWithregardtowhetherornotthecomplainantresistedbeingplacedinthesquadcarthecomplainanttoldthepoliceandajudgeduringthetrialthatheresistedtheofficerwhenbeingplacedintheofficerscarAllegation2isNOTSUSTAINEDCOMMENTSNonePCRB0106Page3
