TheBoardvotedtoreviewtheComplaintinaccordancewithSection887B1aontherecordwithnoadditionalinvestigationand887B1eperformancebyboardofitsownadditionalinvestigationTheBoardmettoconsidertheReportonthefollowingdates4March200311arch20039April2003FindinqsofFactOfficersAandBwerecheckingidentificationsataWashingtonStreetbarinJuly2002OfficerBtookoneunderagepersonoutsidetoissueaPAULAcitationOfficerAfound7of8personsatanothertablewereunderageandescortedthose7personsfromthebuildingtoissuePAULAcitationsOnthewayoutofthebuildinghestoppedintheentrywaytotalktotheproprietorTheComplainantenteredintotheconversationandvoluntarilyinformedthemthathehadpurchasedadrinkforanunderagepersonOfficerAandtheproprietortoldhimthiswasanoffenseandthathewasinterruptingtheirconversationTheComplainantcontinuedtointerruptandthenwastakenoutsidewiththe8underagepersonsWhilePAULAcitationswerebeingwrittentheComplainantcontinuedtointerrupttheproceedingsandtointerferewithverbalabuseandthreatsAftersomeofthe8PAULAcitationswereissuedandthosepersonsreleasedtheComplainantwasarrestedforprovidingalcoholtoaminorandforpublicintoxicationAprearrestbreathtestoftheComplainantindicatedabloodalcohollevelof169TheComplainantwashandcuffedbyOfficerAorBandtoldtositdownonanearbybenchHestoodupseveraltimessayingthathewasmorecomfortablestandingandthatthehandcuffsweretootightOnetimeOfficerBputhishandontheComplainantschesttoensurethathesatdownOfficerCarrivedtotransporttheComplainanttojailcheckedthehandcuffsandaccordingtotheComplainantheremovedtheoriginalhandcuffsandreplacedthemwithanothersetwhichfitmorecomfortablyTheComplainantthenwastransportedtojailwherehemadenocomplaintabouthiswristsduringadmissionproceduresTheComplainantassertedthatlaterthatmorninghenoticedevidenceofinjurytohisleftwristandthathisgidfriendphotographedtheinjuredareaNophotographsofthisinjuryhavebeensubmittedtotheICPDorPCRBTheComplainantrefusedachemicaltestandsubsequentlypleadedguiltytothechargesofpublicintoxicationandsupplyingalcoholtopersonsunderthelegalageICPDinvestigationincludedinterviewswiththeComplainantthebarproprietorand4oftheunderagepersonscitedforPAULAthatmorningOtherthantheComplainanttheotherpersonsinterviewedmadenoadversecommentsabouttheofficersbehaviororofficerstreatmenttoanyofthemAsalientpointinthiscaseisthelengthoftimebetweentheoriginalhandcuffingoftheComplainantandtheadjustmentandrehandcuffingTheComplainantstatedduringhisinterviewthatthisspanoftimeprobablywas3to5minutesOneunderagedrinkerestimatedthetimespantobe2minutesAnotherunderagedrinkerestimatedthetimespantobe5or6minutesbutsheleftthescenetousethebathroominanotherbarsoshemaynothaveanhadanaccurateideaofthetimeAnotherunderagedrinkersaidmaybe5maybe510minutesThefourthPCRB0202Page2 underagedrinkerwhowasinterviewedleftthesceneimmediatelyafterreceivingherPAULAcitationanddidnotmentionthehandcuffingatallThislatterinterviewwaswithapersonwhowasNOTatthetablewiththeComplainantConclusionAllegation1RudeanddisrespectfulbehavioronthepartoftheofficerinvolvedAllofthepersonsinterviewedwiththeexceptionoftheComplainantmaintainedthattheofficersinvolvedwiththeincidentwerecourteoustothembutthattheyusedraisedvoicestogettheComplainanttobequietstepawayfromthecitationwritingandsitdownTheBoardfindstheChiefsconclusionthattheofficersactedappropriatelyissupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAllegation1isNOTSUSTAINEDAllegation2OfficersusedunreasonableorunnecessaryforcetogaintheComplainantscomplianceandhandcuffedhiswristssotightlyastocauseinjuryThelengthoftimewhenthefirsthandcuffswereontheComplainantswristsvariesfrom2to10minutesdependingonwitnessinterviewsTheComplainantmadenomentionofinjuryduringjailprocessingandnophotographsofinjurytohisleftwristhavebeenpresentedtotheICPDorPCRBTheBoardfindstheChiefsconclusionthattheofficersactedappropriatelyissupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAllegation2isNOTSUSTAINEDAllegation3RudeanddisrespectfulbehaviortowardsthebarproprietoronthepartoftheofficerinvolvedNosuchallegationwasmadebythebarproprietorduringtheinterviewwithherShesaysoneofficerspoketoherinafairlyloudvoiceandshethoughthewasangrywithherShesaysthatshemetwiththatofficerlaterandresolvedthesituationbetweenthemTheBoardfindstheChiefsconclusionthattheofficersactedappropriatelyissupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAllegation3isNOTSUSTAINEDCOMMENTPCRB0202Page3
