TheBoardmettoconsidertheReportonthefollowingdates14August2003and9September2003FINDINGSOFFACTOnApril262003IowaCitypoliceofficersrespondedtoacivildisturbanceonHollywoodCourtwherethreefemalesandamalewereinvolvedinaconfrontationTheComplainantandhercousinwerefightingwiththeComplainantshusbandandhisgirlfriendThehusbandsgirlfriendhaddrivenhervantotheComplainantshousetopickupherboyfriendtheComplainantshusbandandwasconfrontedbytheComplainantandhercousinInthealtercationhairwaspulledfromthegirlfriendandthecomplainantandhercousinwereinjuredbythecomplainantshusbandAfterinvestigatingthesituationtheofficersconcludedthattheComplainantshusbandshouldbearrestedforAssaultCausingInjuryandPublicIntoxicationThefemaleswereadvisedthatnoneofthemwouldbechargedatthattimebuttheycouldbeafterfurtherinvestigationwascompletedTheComplainantwasoutspokeninherdesiretohaveherhusbandsgirlfriendarrestedforassaultingherAftertheofficershadfurtherinvestigatedthesituationtheyaddedDomesticAssaulttothehusbandschargeandchargedtheComplainantwithFirstDegreeBurglaryforenteringherhusbandsgirlfriendsvantocommitanAssaultCausingInjuryHercousinwaschargedwithDisorderlyConductCONCLUSIONScAllegationhTheComplainantwasunlawfullyarrestedTheComplainantwasdissatisfiedthatherhusbandsgirlfriendwasnotarresteatthesceneThewomenandtheComplainantshusbandwereinvolvedinaphysicalaltercationwhichtheComplainantstatedwasinitiatedbyherhusbandsgirlfriendThegirlfriendclaimedtheComplainantstuckthefirstblowandthenrequestedhercousinsassistanceinassaultingherthegirlfriendTheComplainantshusbandjoinedthefighttoassisthisgirlfriendandassaultedbothhisestrangedwifeandhercousinTherewereanumberofresidentsintheneighborhoodwhowitnessedthefightbutnonewereabletoprovideusefulinformationregardingwhoinitiateditOfficersonthescenedecidednottochargeanyofthewomenAfterfurtherinvestigationincludingconversationwiththeComplainantbyphoneandinpersonOfficerDinconsultationwithOfficerAdecideditwasappropriatetochargetheComplainantwithFirstDegreeBurglaryasitwasdecidedshehadasallegedenteredthevanofherhusbandsgirlfriendtocommitassaultTheofficersdecidednottochargethehusbandsgirlfriendsinceitwasbelievedthattheComplainantandhercousinhadstartedthealtercationandthehusbandsgirlfriendsactionsweredefensivePCRBComplaint0304Page2 TheBoardfindsthattheChiefsconclusionissupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAllegation1ofthecomplaintisNotSustainedAlleqation2OfficerCOfficerBandOfficerDenqaqedinimproperconductbibeinqmeanrudeandnotcarinqcausinqtheComplainanttofeelviolateddiscriminatedintimidatedandscaredOfficerCwasthesecondofficeronthesceneandisallegedbytheComplainanttohavetoldhertoshutupanddontmoveyoumustofstartedthefightbecauseImhiswifesicOfficerBstayedwiththeComplainantandhercousinwhiletheyweretreatedforinjuriesandthenlatertoseparatethemfromtheotherparticipantswhileofficersfurtherinvestigatedtheincidentBothdefendantsbecameloudandantagonisticduringthelaterperioddirectingtheircommentstowardtheComplainantshusbandsgirlfriendOfficerBdirectedthemtoshushtoquietthemandmaintainorderTheComplainanttookoffenseattheofficerscommentOfficerBdirectedhertogotoOfficerDwithhercomplaintsifshefeltbeingtoldtoshushwasinappropriateOfficerDindicatedthatatfirsthewasnotawarethattheComplainanthadbeenassaultedbyherhusbandandhadtriedtogivehermoreattentiononcehelearnedofhervictimstatusAnumberofneighborswereinterviewedregardingtheincidentTheyreportedthattheybelievedtheofficersinvolvedhandledthesituationappropriatelyandindicatedtheyheardnoinappropriatestatementsfromthepoliceofficersatthesceneOfficersatthescenereportedtheybelievedOfficerBandOfficerDactedappropriatelyandnotednothingthatwouldgivevaliditytoComplainantsallegationsTheBoardfindsthattheChiefsconclusionissupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAllegation2oftheComplaintisNotSustainedCOMMENTNone0rPCRBComplaint0304Page3
