NTheBoardvotedtoreviewtheComplaintinaccordancewithSection88711aptherecordwithnoadditionalinvestigationcTITheBoardmettoconsidertheReportondanuary132004andFebruary1f04ofFactFindinsOnSeptember172003atapproximately1034pmpolicewerecalledto507NLinnStinIowaCityinreferencetoamalebeatingafemaleUponarrivalOfficerAreposedhearingyellingandababycingOfficerArepodedlookingthroughthefrontwindowandobseedamanandawomanpushingehotherThewomanwaslateridentifiedasthecomplainantandthemanasthebabysfatherOfficerAreposedthatthecomplainantworeatshiwithwhatappearedtobebloodonitOfficerArepodedknockingatthedoorandthemanansweredWhenofficerAinquiredaboutthebloodthemanrepoedlystatedtheywerecutupinhereThecomplainantthenbeganpushingatthedoorandyellingfortheofficertogetoutofherhouseandthatsheneededawaffantWhenoffirAgainedacssintotheroomthecomplainantsfoothadbemecaughtunderthedoorOfficerBnowarrivedonthesceneThemplainantexitedthelivingroomareaandhadenteredthebedroomshuffingthedoorbehindherOfficerAknockedonthedoorWhenOfficerAenteredthebedroomthemplainantwaswearingadifferentshianddeniedtheistenceofanothertshidorthatshehadchangedshistotheOfficerOfficerArepodhatthecomplainantbecamelesscooperativeassherealizedthatthemanwasgoingtobearrestedOfficerAalsoreposedthecomplainantwasallowedtogetthecingbabyandbringthechildfromthelivingroomtothebedroomThecomplainantsatdownonthebedinthebedroomandlaidthebabybesideherThecomplainanttoldOfficerAthatshetriedtogetthemantoleaveandtheythecomplainantandthemanbeganpushingeachotherThemplainanttoldOfficerAthatshebangedherheadonthernerofthewallandcutherlipcausingbloodtobesplaEeredonthewallPicturesweretakentodocumenttheinjuriesOfficerAlaternoticedascrapetotherighttempleareaofthecomplainantbutreposedseeingnobloodfromthisinjuOfficerAcleanedtheareaandputabandaidoverthescrapeOfficerCaskedthecomplainanttoconsenttoasearchwhileshewasinthebedroomShensentedandlaterwithdrewherconsentpriortothediscoveorconfistionofanyphysicalevidenceOfficerAarrestedthecomplainantandtookhertoasquadcarOfficerCpedormedaSearchIncidenttoArrestandfoundaweaponhandgununderthebedwherethemplainanthadbeensiEingThecomplainantwaslaterbroughtbackintothebedroomandwasconfrontedwiththediscoveoftheweaponTheIowaDepadmentofHumanSeiceswascalledtothesceneandtookthebabyintoprotectivecustodyAnassistantJohnsonCountyAEorneyfollowedupaPCRB0311Page2 fewdayslaterbyfilingaCHINApetitionThecomplainanttoldinvestigatorsofthiscomplaintthatwhoeverwasatthedoorOfficerAwasbeingdisrespectfultothemanandthatshedidnotrealizeitwasapoliceofficerShestatedshethoughtthatsinceshedidnotsummontheofficershedidnothavetolettheofficerinThecomplainanttoldtheinvestigatorsthatshewentintothebedroomtochangehershirtShestatedshewasnottryingtohidethebloodyshirtandshowedOfficerAwherethetshirtwasThecomplainanttoldinvestigatorsthatsheknewOfficerAwascallingHumanServiceswhenshewasatthefrontdoorThecomplainanttoldinvestigatorsthatshedidnotknowshehadaninjurytohertempleuntilOfficerAmentionedittoherThecomplainantlatertoldinvestigatorsthatshethoughttheinjurytobeseriousandlifethreateningandthatitwasabigholeandpouredanddrippedbloodallnightAtnotimedidthecomplainantrequestmedicalassistancefortheinjurytohertempleareaConclusionAlleqation1FalsestatementsaqainstOfficerATheboardhasnocausetosuspectorbelieveOfficerAmadefalsestatementstoanypartyinvolvedwiththissituationOfficerAsstatementsweresupportedbythewrittenreportsofotherofficersonthesceneandinsomecircumstancesbythecomplainantShereportedaccuratelytheorderofeventsandmovementsofthoseinvolvedbothpoliceandcitizenOfficerAdocumentedtheneedforthetemporarycustodyremovalofthebabyfromtheresidenceduetothedangeroussurroundingsthateveninganddidnothingtoconveyfalseinformationtoeithertheDepartmentofHumanServicesortheJohnsonCountyAttorneysOfficeTheBoardfindstheChiefsconclusionissupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAllegation1againstOfficerAisnotsustainedAlleqaton1FalsestatementsaqainstOfficerCTheboardhasnocausetosuspectorbelievethatOfficerCmadefalsestatementstoanypartyinvolvedwiththissituationOfficerCplayedasecondaryroleinregardtotheinvestigationandcallingoftheIowaDepartmentofHumanServicesTheBoardfindstheChiefsconclusionissupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAllegation1againstOfficerCisnotsustainedAlleqaton2IlleqalSearchagainstOfficerATheboardhasnocausetosuspectorbelievethatOfficerAcommittedanunconstitutionalsearchofthesuspectorthepremisesExigentcircumstancesexistedallowingawarrantlessentrybytheofficerTheBoardfindstheChiefsconclusionissupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAllegation2againstOfficerAisnotsustained
