2WhiletheordinancedirectstheBoardtomakefindingsoffactitalsorequiresthatwerecommendthatthePoliceChiefreverseormodihisfindingsonlyifthosefindingsareunsupportedbysubstantialevidenceiftheyareunreasonablearbitraryorcapriciousoriftheyarecontrarytoaPoliceDepartmentpolicyorpracticeoranyFederalStateorlocallawOrdinance887B2abcAccordinglyourjobisnottoredecidethefactualissuesraisedbytheComplaintbuttoreviewthefindingsintheChiefsReportconductwhateveradditionalinvestigationwethinknecessaryanddeterminewhetherthosefindingscomplywiththerequirementsoftheordinanceOurreportdoesnotincludethenamesofthecomplainanttheofficersoranyotherpersonsinvolvedFINDINGSOFFACTThiscomplaintaroseoutofthearrestofanindividualwhomweshallrefertoastheindividualonFridayAugust1atabout920pmonClintonStreetsouthofBurlingtonTheindividualayoungmanwasapproachedbytwopoliceofficersonthePedestrianMallTheindividualwasmakinglewcksexualcommentstopassersbyandofficersWhenapproachedbytheofficerstheindividualranawayTheofficercommunicatedoverthepoliceradiothattheindividualwasbeingchasedonfootTheradiocommunicationdidnotadviseotherofficersastothenatureoftheindividualssuspectedoffenseWithin43secondsanotherofficerwhomweshallrefertoasthearrestingofficerreceivedthetransmissionandusedhissquadcartoblockthepathoftheindividualalongClintonStreetThearrestingofficerorderedtheindividualwhohadslowedtoawalktogetup 3againstthewallTheindividualputhishandsintheairandfacedthewallwhichwasthecomeroftheoldGoodyearbuildingonClintonStreetThearrestingofficerpushedtheindividualintothewallHethentooktheindividualtothegroundwherehewashandcuffedTheindividualhadsomesuperficialabrasionsasaresultnoseriousinjuryisclaimedTheindividualultimatelypiedguiltytoachargeofpublicintoxicationandachargeofobstructinganofficerarisingoutofthisincidentTheComplaintwasfiledbyawitnesstothearrestoftheindividualTheComplainantassertedthatexcessiveforcewasusedinarrestingtheindividualThereisdisagreementaboutthefactsintwoareasThefirstdisputedissueiswhethertheindividualinquestionwasstillresistingorattemptingtofleetheofficersatthetimethearrestingofficerencounteredhimThereisnoquestionthathefledtheofficeronthePedestrianMallThereishoweversomedifferenceofopinionastowhetherhehadcompletelystoppedtryingtogetawaywhenthearrestingofficerpulledupinhiscarTheindividualsayshehadstoppedandputhishandsonthewallthearrestingofficersaysthattheindividualwasstillmovingatanangletowardsthecomerofthebuildingandtheofficerwasnotsurewhethertheindividualwasgoingtotryandrunawayTheviewsofotherwitnessestotheincidentaresomewhatdividedontheseissuesThechiefsReportconcludedthattheindividualhadnotclearlystoppedhisflightatthetimehewasarrestedThatconclusionisconsistentwiththestatementsofanumberofthewitnessesissupportedbysubstantialevidenceanddoesnotappearunreasonablearbitraryorcapriciousTheseconddisputedissueishowmuchforcethearrestingofficerusedinpushingtheindividualintothewallortothegroundTherewassomedisagreementamongthewitnesses 4aboutwhetherpushingtheindividualintothewallortakinghimtothegroundwasdoneinacontrolledoruncontrolledmannerTheChiefsReportconcludedthattheforceusedwascontrolledandthattheindividualwasnotforcefullythrownintothewallorontothegroundThatconclusionisconsistentwiththereportsofanumberofthewitnessesandwiththecomparativelyminimalinjuriessufferedbytheindividualissupportedbysubstantialevidenceanddoesnotappearunreasonablearbitraryorcapriciousOnthenightoftheincidentthecomplainantwenttotheIowaCityPoliceDepartmenttocomplaintothesergeantinchargeThesergeantwasdefensiveandbecameemotionalaskedthecomplainantifhewasinlawenforcementandtriedtogetthecomplainanttoseethematterfromtheofficerssideTheComplaintwasreferredtothePoliceChiefwhoorderedaninvestigationofthecomplaintTheinvestigatorinterviewedsixteenwitnessesincludingthecomplainanttheindividualinvolvedthearrestingofficerandthesergeantaswellasanumberofpassersbywhoobservedtheincidentandseveralpoliceofficersCONCLUSIONSTheChiefsReporttreatedthiscomplaintassettingforthtwoallegationsandwewilldothesameAllegation1useofexcessiveforceThecriticalissueiswhethertheindividualwasstillattemptingtofleetheofficeratthetimehewasarrestedThismattersbecauseundertheIowaCityPoliceDepartmentpolicyonuseofforcethedegreeofforcethatmaybeusedinarrestingapersonisrelatedtothedegreeof 5resistancebythatpersonWhereapersonsubjecttoarrestisactivelyresistingarrestthepolicypermitstheuseofcompliancetechniqueswhichmaywherereasonableandnecessaryincludetakingasuspecttothegroundtocontrolhiminordertotakehimintocustodyTheChiefsReportsfindingsonthetwocriticalquestionsherearesupportedbysubstantialevidenceandwemustdefertothemThosefindingsindicatethattheindividualwasstillmovingatthetimethearrestingofficerstoppedhimandthatthearrestingofficerbelievedthathemightcontinuetofleeeventhoughhehadhishandsintheairandthatasaconsequencetheofficertooktheindividualtothegroundinacontrolledmannerInadditiontheaccompanyingcircumstanceswererelevantTherewasanavenueofpotentialescapeonlyafewfeetawayfromthepointwheretheindividualwasstoppedThearrestingofficerdidnotknowwhatoffensetheindividualwassuspectedofhavingcommittedHedidhoweverknowthatotherofficerswerepursuingtheindividualandthathehadtriedtofleebeforeandlookedasthoughhemighttryagainUndertheexistinguseofforcepoliciesoftheIowaCityPoliceDepartmenttakinganactivelyresistingsuspecttothegroundinacontrolledandlimitedmannertoplacetheindividualunderarrestwasconsistentwithapplicablepolicyAccordinglythefirstallegationofthecomplaintisNOTSUSTAINEDAllegation2inappropriateresponsetoacitizencomplaintThesergeantinquestionwasdefensiveinresponsetothecomplaintbecameemotionalandargumentativeandtriedtopresenttheofficerssideofthestorytothecomplainantThisdefensiveresponsewasinappropriateNobodylikescriticismbuthardasitmaybethedepartmentmustlearntoacceptinputnegativeaswellaspositivefromthecommunity 6InformalinteractionssuchasthesegivethedepartmentthechancetounderstandthecommunitysviewofitsconductMoreovertheseoccasionspresentameaningfuloppommitytodemonstrateopennesstocommunityconcernsTryingtotalkcomplainantsoutoftheirviewsortreatingtheminanaggressiveandchallengingmannermayleadtoperceptionsthatpoliceofficersarerigiddefensiveorunwillingtohearothersidesofastoryThesecondallegationofthecomplaintisSUSTAINEDCOMMENTSWhenweaddressacomplaintwemustconsideritinlightofthepoliciesthatwereinforceatthetimetheactionsinquestiontookplaceAnyotherapproachwouldnotbefairpoliceofficerslikeanyoneelseshouldbeabletostayoutoftroublebyrelyingontherulesandacriticalelementofjusticeisthatpeopleknowwhatisexpectedofthemThearrestingofficeractedconsistentlywiththepoliciesineffectatthetimeofthisincidentAtthesametimethepoliciesunderlyingthiscomplaintmaybeworthyofreviewThepoliciesorpracticesofthedepartmentregardingarrestofintoxicatedindividualsthechargingofobstructionofjusticeforthosewhoattempttofleearrestingofficersandthepolicyonuseofforcewhichasweunderstanditconsidersonlytheresistanceofthesuspectandnottheseverityoftheunderlyingoffenseindeterminingthedegreeofforceappropriateinapprehendingasuspectareallworthyoffurtherpublicdiscussionWenotethattheChiefsReportexpressestheintentionfirsttoincludeaspartofroutinetrainingtherecommendationthatofficersneedwheneverpossibletoinformotherofficersofthecauseofaparticularpursuitandsecondtotrainsupervisorsandothersdealingdirectlywiththe 7publicintheappropriateobjectivemannertotakecomplaintsfromthepublicWeurgethatthesehighlyappropriateadditionstotxainingnotbedelayedbutbemadewithallpossiblespeedDatedNovember61997
