GENERAIJBACKGROUNDThisComplaintisoneofthreefiledin1997bythecomplainantBecausethesethreecomplaintsappearedtoarisefrominterrelatedeventsandbecauseofthenatureofthevariousallegationsinthecomplaintstheBoarddecidedthatalthoughwewouldreviewtheReportoneachcomplaintseparatelyitwouldbehelpfultoobtaininformationaboutthecontextforcertainallegationscontainedinallthreecomplaintsOnDecember291997asubcommitteeoftheBoardmetwiththecomplainanttoobtainmoreinformationabouthisperspectiveonthecomplaintsandtoreiteratetheavailabilityofmediationOnJanuary231998thecomplainantdeliveredapackageofmaterialsanddocumentsthathefeltwererelevanttothecomplaintsBecauseoftheexpansivenessofthesematerialstheBoardaskedthesubcommitteethathadmetwiththecomplainanttoreviewthematerialsThesubcommitteereviewedallofthecontentsofthepackageofmaterialsincludinganaudiotapeandreportedtothefullBoardasummaryofitsmeetingwiththecomplainantandthematerialssubmittedbythecomplainantInadditionaspartofitsreviewoftheReportofanotherrelatedcomplainttheBoardviewedapolicevideotapeofeventsrelatedtothecomplainantsarrestforsimpleassaultThereviewofthesupplementaryandbackgroundinformationrevealsthatthecomplainantsdissatisfactionwiththeIowaCityPoliceDepartmentextendsbackseveralyearsandinvolvesanumberofclaimsbythecomplainantTheseclaimslistedbelowarepartofthebackgroundinformationcollectedbutarenotspecificallythesubjectofcomplaintstotheBoardPoliceinvestigationofcomplaintsconcerningincidentsinvolvinghiscarinhisformerapahnentcomplexparkinglotandathiscurrentresidenceOtherinteractionwithpolicerelatedtohistenancyatthisapartmentcomplexInvestigationofapropertyaccidentinvolvinghisbikeandacarinasupermarketparkinglot HistreatmentbypoliceinconnectionwithanarrestduringHomecomingParadein1994ContinuingproblemswithacurrentneighborandwithpolicehandlingoftheseproblemsAllegedsurveillanceofhishomeandfamilybypoliceVehiclestopsbypolicethatthecomplainantconsidersunwarrantedVariousotherinteractionswiththepoliceingeneralandseveralofficersinparticularthatheconsiderstohavebeeninsensitiveharassingandvindictiveApervasivefeelingthathiscivilrightsarebeingcontinuouslydeprivedbythepoliceFINBINGSOFFACTAnofficerwasdispatchedtothecomplainantsresidenceinresponsetoacallfromthecomplainantswiferegardingadisputewithaneighborTheofficerspokewiththecomplainantswifeandtheneighboranddeterminedthatchargesagainstneitherpartywerewanantedTheofficerattemptedtoconciliatethedisputeLaterthesamedaytheofficerwasinformedthatthecomplainanthadcalledthedispatcherandwantedtospeaktotheofficerTheofficerreturnedtothestationandcalledthecomplainantTheconversationconsistedprimarilyofreasonsthecomplainantfeltthatchargesshouldbefiledagainsttheneighborandtheofficersreasonsfornotfilingchargesThisconversationwastaperecordedbythecomplainantandthesubcommitteeoftheBoardlistenedtothistapeDuringthecourseoftheconversationtheofficerquestionedthecomplainantregardinganallegedevictionfromaformerapartmentresidenceThecomplainantdeniedthathehadbeenevictedandaskedtheofficertotellhimthesourceoftheallegationTheofficertoldhimthattheallegationcamefromanotherofficerTheComplaintallegesTheIowaCityPoliceconspiredtodenyhisrightsTwoofficersspecificallyconspiredagainstthecomplainant 4TheofficerswerevindictiveandmadeupchargesTheinvestigationbythePoliceChiefincludedinterviewswiththecomplainanttheneighbortheofficerandtheofficerssupervisorCONCIUSIONAllegation1PoliceconspiredtoderlyconlplainantsrightsTheincidentthatprecipitatedthisComplaintwasadisputebetweenaneighborandthecomplainantandhisfamilyPoliceinvolvementwasinresponsetoacallfromthecomplainantswifeandasubsequentrequestbythecomplainanttotalktotheofficerthatrespondedtohiswifescomplaintagainsttheneighborTheBoardfindsthattheconclusionintheReportconcerningallegation1issupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAccordinglythefirstallegationoftheComplaintisNOTSUSTAINEDAllegation2TwoofficersconspiredagainsttheconlplainantThetwoofficersinvolvedinthisComplaintoneofwhomwastheotherssupervisordiscussedthesituationafterthemeetingswiththecomplainantswifeandtheneighborThediscussionincludedsomebackgroundinformationregardingthecomplainantWhilethisinformationappearstohavebeenunsubstantiatedandevenerroneousitdoesnotsignitotheBoardtheexistenceofaconspiracytoharmthecomplainantTheonlyactionthatwasdiscussedandcarriedoutwastorerumthecomplainantsphonecallTheBoardfindsthattheconclusionintheReportconcerningallegation2issupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAccordinglythesecondallegationoftheComplaintisNOTSUSTAINED Allegation3TheofficerswerevindictiveandmadeupchargesWhileaskingthecomplainantabouthisallegedevictiondidnotappeartoberelevantorimportantenoughtobementionedduringthephonecallwiththecomplainantitwasstatedasaquestionandnotanaccusationThetoneofthetapedconversationdoesnotdemonstrateanyvindictivenessonthepartoftheofficerandthereisnootherevidenceofvindictivenessregardingthehandlingofthisincidentNochargeswerefiledagainstthecomplainantregardingthisincidentTheBoardfindsthattheconclusionintheReportconcerningallegations3issupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAccordinglythethirdallegationoftheComplaintisNOTSUSTAINEDDATEDFebruary251998
