onanoutsidebackporchforsometimeincoldweatherinanapparentlyintoxicatedstatepossiblyholdingababyThearrestingofficerandbackupofficerbothidentifiedsignsofintoxicationexhibitedbythecomplainantbreathodorofalcoholimpairedspeechdisorientationunsteadinessonherfeetvomitingNobabywasfoundthecallerhadapparentlymistakenarolledupsweatshirtforaninfantThecomplainantwasarrestedThecomplainantallegesthat1shewasarrestedonprivatenotpublicproperty2shewasnotpermittedtoprovethatshewascurrentlyresidingattheaddresswherethearrestwasmade3thearrestingofficerdidnotreadherherrights4shewasforcedtotakeabreathtestHercomplaintalsoallegesthatwhileattheJohnsonCountyJailshewassubjectedtotreatmentsheconsideredaviolationofherrightsincludingdenialofaccesstoaphonedenialofaccesstoatoiletnotbeingallowedtotakeasthmamedicationnotreceivingmedicalattentionduringanasthmaattackandbeingplacedinasolitaryconfinementcellwithinsufficientclothingandblanketsTheComplaintwasreferredtotheChiefofPoliceforinvestigationTheinvestigatorinterviewedthecomplainantthearrestingofficerandtheofficercalledtoprovidebackuptransportationatthetimeofthearrestTheBoardreviewedtheChiefsReportonJanuary71998andrequestedadditionalinformationabouttwosubjects1theallegationthatthecomplainantwasnotreadherrightswhichwasnotaddressedintheChiefsReportand2thegeneralpoliciesgoverningarrestofapersonforpublicintoxicationTheChiefrespondedtothesequestionsinamemotothePCRBdatedJanuary151998TheChiefsReportandsupplementarymemoaddressthefourallegationsthatfallwithinthepurviewoftheIowaCityPoliceDepadmentwhicharetheonlypartsofthiscomplainttheBoardhastheauthoritytoaddressThecomplainanthasnotdeniedbeingintoxicatedatthetimeofherarrestThereisnoindicationthatthearrestingofficerreadthecomplainantherrightsAbreathtestwasadministeredaRerthecomplainantsarrestattheJohnsonCountyJailThecomplainantclaimedthatshefeltshehadtotakethetestbutnotthat shewasphysicallyforcedtodosoTheconsentformlistsanoralconsenttothetestThetestrevealedabloodalcohollevelof200CONCUSlONSAnumberofthecomplainantsallegationsrelatetohertreatmentwhileattheJohnsonCountyJailWhiletheseallegationsareserioustheyfalloutsidethejurisdictionoftheIowaCityPoliceDepartmentandarethereforebeyondtheBoardsauthoritytoaddressTheIowaCityPoliceDepartmenthasforwardedacopyofherComplainttotheSheriffsDepartmentandshehasbeenreferredtheretoaddressherconcernsaboutjailoperationArrestforpublicintoxicationThearrestappearstohavebeenmadeinaccordancewithcurrentIowaCityPoliceDepartmentpolicyonarrestsforpublicintoxicationandonthebasisofstatestatute12346whichaddressespublicintoxicationThearrestingofficerandbackupofficerconcurredthatthecomplainantexhibitedclearsignsofintoxicationThearrestingofficerhadbeencalledtothearrestsitebyaconcernedcitizenandthecomplainantdoesnotdenyhavingbeenintoxicatedInfactshehadbeenthesubjectofawomandowncallneartheVinetavernahalfhourpriortoherarrestattheapartmentcomplexTheofficerrespondingtothatcallhadletthecomplainantgowithherfriendswhohadsaidtheywouldseetoherwellbeingAtthetimeofherarrestshewasaloneArrestonprivatepropertyWhilethecomplainantdoesnotdenybeingintoxicatedsheclaimsshewasarrestedinaprivatenotpublicplaceMoreoversheclaimsthatatthetimeshewasarrestedforpublicintoxicationthearrestingofficerwouldnotpermithertoprovethatshewasactuallyatherhomeTheChiefsReportconcededthatthearresttookplaceonprivatepropertybutconcludedthatthecomplainantsconductcouldstillviolatethepublicintoxicationstatutesinceittookplaceinpublicviewAccordinglyproofthatsheresidedatthehousewherethearresttookplacewouldnothavebenefitedher 4ThislegalquestionwillberesolvedinthecomplainantscriminalproceedingbuttheReportsconclusionthatthearrestwasappropriateisnotunreasonablearbitraryorcapriciousFailuretoreadrightsInasupplementtotheChiefsReporttheChiefindicatesthatthecomplainantafterdiscussingwithanattorneyatLegalAidthematterofreadingofrightsindicatedtothedepartmentinvestigatorthatshenolongerwishedtopursuethispartoftheComplaintConsenttobreathtestTherecordsindicatethatthecomplainantgaveoralconsenttothebreathtestattheCountyJailHowevershemaintainsthatshefeltrequiredtotakethetestalthoughnotphysicallycompelledtodosoSheindicatesthatsheunderstandsthemedicalreasonsforadministeringthetestbutmaintainsthisshouldhavebeenmadeclearertoheratthetimeofadministrationTheChiefsReportconcludedthattheadministrationofabreathtestwascarriedoutinaccordancewithestablishedpolicyanddidnotviolatethecomplainantsrightsThisconclusionisnotunreasonablearbitraryorcapriciousAccordinglytheComplaintisNOTSUSTAINEDCOMMENTSTheDepartmentmightconsiderfurtherclarifyingthepoliciesandproceduresgoverningthearrestandtransportofpersonscitedforpublicintoxicationTheDepartmentshouldseekassurancethatpersonsreleasedtothecustodyoftheJohnsonCountyJailroutinelyreceiveadequateandappropriatetreatmentSomeofthecomplainantsallegationsabouthertreatmentatthejailmaymeritinvestigationbyappropriateauthoritiesDATEDFebruary919984
