2thevariousallegationsinthecomplaintstheBoarddecidedthatalthoughwewouldreviewtheReportoneachcomplaintseparatelyitwouldbehelpfultoobtaininformationaboutthecontextforcertainallegationscontainedinallthreecomplaintsOnDecember291997asubcommitteeoftheBoardmetwiththecomplainanttoobtainmoreinformationabouthisperspectiveonthecomplaintsandtoreiteratetheavailabilityofmediationOnJanuary231998thecomplainantdeliveredapackageofmaterialsanddocumentsthathefeltwererelevanttothecomplaintsBecauseoftheexpansivenessofthesematerialstheBoardaskedthesubcommitteethathadmetwiththecomplainanttoreviewthematerialsThesubcommitteereviewedallofthecontentsofthepackageofmaterialsincludinganaudiotapeandreportedtothefullBoardasummaryofitsmeetingwiththecomplainantandthematerialssubmittedbythecomplainantInadditionaspartofitsreviewoftheReportofanotherrelatedcomplainttheBoardviewedapolicevideotapeofeventsrelatedtothecomplainantsarrestforsimpleassaultThereviewofthesupplementaryandbackgroundinformationrevealsthatthecomplainantsdissatisfactionwiththeIowaCityPoliceDepartmentextendsbackseveralyearsandinvolvesanumberofclaimsbythecomplainantTheseclaimslistedbelowarepartofthebackgroundinformationcollectedbutarenotspecificallythesubjectofcomplaintstotheBoardPoliceinvestigationofcomplaintsconcerningincidentsinvolvinghiscarinhisformerapartmentcomplexparkinglotandathiscurrentresidenceOtherinteractionwithpolicerelatedtohistenancyatthisapartmentcomplexInvestigationofapropertyaccidentinvolvinghisbikeandacarinasupermarketparkinglotHistreatmentbypoliceinconnectionwithanarrestduringHomecomingParadein1994ContinuingproblemswithacurrentneighborandwithpolicehandlingoftheseproblemsAllegedsurveillanceofhishomeandfamilybypoliceVehiclestopsbypolicethatthecomplainantconsidersunwarrantedVariousotherinteractionswiththepoliceingeneralandseveralofficersinparticularthatheconsiderstohavebeeninsensitiveharassingandvindictiveApervasivefeelingthathiscivilrightsarebeingcontinuouslydeprivedbythepolice 3FINDINGSOFFACTTwoofficersweredispatchedtothehomeofaneighborofthecomplainantTheneighborallegedthatthecomplainanthadusedhisautomobiletocuthimoffwhiletheneighborwasrunningnearSycamoreMallAtapproximately1000pmthetwoofficerswenttotheresidenceofthecomplainanttointerviewhimTheofficersobservedlightsoninthehouseOneoftheofficersknockedonthefrontdoorframeandwhennooneansweredopenedthestormdoorandknockedontheentrancedoorwhichhaspanesofglassOneofficernoticedthatatleastonepaneofglasswasalreadycrackedandthattheotherofficerknockeddirectlyonapaneofglassNeitherofficerbelievedthattheyhadcausedapanetocrackTherewasstillnoresponsesotheofficersleftafterabouttenminutesTheydidnotreturnbecauseofothercallsforserviceThecomplainantadmitsthathewashomeandheardtheknockingbutdidnotwanttoopenthedoorat1000pmThecomplainantallegesthatHewasharassedbythepoliceHewasdeniedhishumanrightsHewassubjectedtomaliciousprosecutionOfficerscrackedtheglassinhisfrontdoorTheinvestigationbythePoliceChiefincludedinterviewswiththecomplainantthecomplainantswifetheneighborandthetwoofficersandaninspectionofthedoorCONCIJUSIONAllegation1HewasharassedbythepoliceThetwoofficersinvolvedinthiscaserespondedtoacomplaintbyaneighboragainstthecomplainantAfterinterviewingtheneighbortheofficerswenttothecomplainantshometointerviewhimAfterknockingforabouttenminutestheofficersleftTheBoardfindsthattheconclusionintheReportconcerningallegation1issupportedbysubstantialevidenceandisnot 4unreasonablearbitraryorcapriciousAccordinglythefirstallegationofthisComplaintisNOTSUSTAINEDAllegationHewasderfledhishumanrightsTheinvestigatoroftheComplaintstatesthatbasedonhisinterviewwiththecomplainantthisallegationpertainstoeventsaddressedinPCRBComplaint973TheBoardfindsthattheconclusionintheReportconcerningallegation2issupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAccordinglythesecondallegationoftheComplaintisNOTSUSTAINEDAllegation3HewassubjectedtomaliciousprosecutionNochargeshadbeenfiledatthetimeoftheReportTheinvestigatorstatesthatthisallegationpertainstoeventsaddressedinPCRBComplaint973TheBoardfindsthattheconclusionintheReportconcerningallegation3issupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAccordinglythethirdallegationoftheComplaintisNOTSUSTAINEDAllegation4OfficerscrackedtheglassinhisfrontdoorTheReportfindsthatthereisinsufficientevidencetoproveordisprovetheclaimandthatiftheofficersdidcausedamageitwasunintentionalStatementsbythecomplainantthecomplainantswifeandthetwoofficersarenotconsistentTherecommendationtofileaclaimwiththeCityFinanceDepartmentappearsappropriateTheBoardfindsthattheconclusionintheReportconcerningallegationg4issupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAccordinglythefourthallegationoftheComplaintisNOTSUSTAINEDDATEDFebruary251998
