2FINDINGSOFFACTThisComplaintarisesoutofatrafficstopofthecomplainantThecomplainantwasstoppedbecausehiscardidnothavefunctioningtaillightsOncehewasstoppedtheofficerconductingthestopbelievedbasedonthecomplainantsbehaviorthathemightbeundertheinfluenceofalcoholTheofficeraskedthecomplainanttotakeapreliminarybreathtestThecomplainantobjectedtotakingthetestaskedtheofficertosmellhisbreathandcomplainedthatheshouldnotberequiredtotakeabreathtestifhisbreathdidnotsmelllikealcoholHecontendsthathewasthreatenedwitharrestandlossofhislicenseifhedidnotcomplywiththerequesttotakethebreathtestThecomplainantdidtakethebreathtestandhisbloodalcohollevelwaszeroTheofficerissuedthecomplainantacitationforthetaillightviolationandpermittedhimtoleaveThecomplainantassertsthatthestopofhisvehiclewasunreasonablethathewasthreatenedwitharrestandlossofhisdriverslicenseifherefusedtotakethebreathtestthatoneoftheofficersonthescenemisidentifiedhimselfthathewasharassedwhentheofficeraskedhimifheusedaninhalerorhadasthmaandthatitwasimpropertoaskhimtotakeapreliminarybreathtestifhisbreathdidnotsmellofalcoholTheChiefsinvestigationincludedinterviewswiththecomplainantandthetwoofficerswhohadbeenpresentatthetimeofthestopandconsultationwithotherdepartmentalsupervisorsCONCLUSIONSAIleation1ThecomplainantalleiesthatthestopofhisvehiclewasunreasonableThestopwashoweverbasedonthefactthatthecarwasdrivingwithouttaillightsThestopofthevehiclewasproperAccordinglytheconclusionintheReportthatthestopofthecomplainantscarwasbasedonprobablecausetobelievehewasviolatingthelawissupportedby substantialevidenceandisnotunreasonablearbitraryorcapriciousThisallegationisNOTSUSTAINEDAllegation2Thecomplainantallegesthathewasthreatenedwitharrestandlossofhisdriverslicenseifherefusedthepreliminarybreathtestandthatthisviolatedhiscivilri3htsThePoliceChieffoundthatthecomplainantwastoldthatifherefusedtotakethepreliminarybreathtestatthescenehewouldbetakenintocustodyandofferedanIntoxilyzertestIfherefusedthattesthecouldlosehisdriverslicenseThebreathtesttheofficersoughttoadministeratthescenewithahandhelddeviceisapreliminarytestonlyonenotadmissibleincourtThetesthoweverhelpsanofficerdeterminewhetherthereisprobablecausetobelievethatapersonisorisnotintoxicatedWhilerefusaltotakethepreliminarybreathtestdoesnotresultinadriverslicenserevocationitcanbeconsideredbytheofficerinaddressingwhetherthereisadequateprobablecausetobelievethepersonrefusingtotakethetestisundertheinfluenceofalcoholIftheofficerconcludesthereisprobablecausetobelievethesuspectisintoxicatedtheofficermayarrestthesuspectAsuspectwhohasbeenarrestedforOWlandwhoisaskedtotaketheformalIntoxilyzertestadministeredatthecountyjailbutwhorefusestotakethattestdoessubjecthimselftodriverslicenserevocationAccordinglythePoliceChiefsconclusionthattheofficerproperlyadvisedthecomplainantoftheconsequencesofhisrefusaltotakethepreliminarybreathtestissupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAllegation2ofthecomplaintisNOTSUSTAINEDAlleation3ThecomplainantallegesthattheofficeronthescenemisidentifiedhimselfbywearingthewrongnametagThePoliceChiefconcludedthatthisdidnothappenThatconclusionissupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAccordinglyallegation3isNOTSUSTAINED 4Alleqation4ThecomplainantobjectedthataskinghimwhetherheusedaninhalerorhadasthmawasanattempttoharassorintimidatehimThePoliceChiefconcludedthatsuchquestioningwasappropriatebecausesuchcircumstancesmightcreateamedicalreasonforfailuretocomplywiththepreliminarybreathtestThisconclusionissupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAllegationisNOTSUSTAINEDAllegation5ThecomplainantarguesthatitwasimpropertoadministerapreliminarybreathtesttohimbecausehedidnotsmellofalcoholWhilethesmellofalcoholisonebasisforconcludingthatsomeoneisintoxicateditisnottheonlyoneThePoliceChiefsconclusionthattheofficerssuspicionthatthecomplainantwasimpairedwasproperlybasedontheirobservationsofhisbehaviorissupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAllegation5isNOTSUSTAINEDDATEDSeptember11998
