ThecomplainantwhenaskedhisidentityprovidedOfficerAwiththenameofhisolderbotherOfficerBhoweverknewthecomplainantandleftthefirstpersontoapproachthecomplainantaddressingthecomplainantbyhispropernameBasedonthecomplainantslevelofintoxicationandprovidingfalseinformationOfficerAtookhisarmandtoldhimhewasunderarrestThecomplainantbrokefreeandascufflefollowedinwhichanofficerwasinjuredAfterseveralwarningsandthecomplainantstillresistingOfficerAsprayedthecomplainantwithOCDuringtheseeventsthefirstpersonranfromthesceneAninvestigatortriedwithnosuccesstolaterinterviewthispersonThecomplainantstatedhewouldbeanuncooperativewitnessBothindividualshadbackpackswiththemThefirstpersonfledfromthescenewithabackpackThecomplainantclaimedthebackpackleftatthescenebelongedtohimInthebackpackwasapotpipewithresidueinitThisresultedinachargeofpossessionofacontrolledsubstanceThecomplainantalsoclaimedhehadabagofmarijuanawhichofficerssubsequentlyfoundonthegroundNochargeswerefiledbecausetheofficerswereunabletodeterminetowhomthebagbelongedThecomplainantwastakentoUniverSityHospitalstohavehiseyesflushedandtreatedforOCexposureHewasalsotreatedforsuperficialabrasionsTheemergencyroomreportstatedthecomplainantwasveryuncooperativeandspitatpersonsintheroomThecomplainantwasthentransportedtotheJohnsonCountyJailwherehecontinuedtobeuncooperativeforthebookingprocedureConsequentlybookingprocedureswerecompletedthenextmorningThecomplainantwaschargedwithpublicintoxicationinterferencewithofficialactscausinginjuryandpossessionofacontrolledsubstanceThecomplainantclaimshehadnoideawhyhewasarrestedHehadamemorylapseinregardtomosteventsincludingtakingthebreathtestandhistriptoUniversityHospitalsHeclaimshehadsmokedmarijuanaPCRB997Page3
