BOARDSPROCEDURETheComplaintwasreceivedattheOfficeoftheCityClerkonDecember291999AsrequiredbySection885oftheCityCodetheComplaintwasreferredtothePoliceChiefforinvestigationTheChiefsReportwasdueMarch282000TheChiefturnedinareportMarch282000whichincludedthecompletecasefileTheBoardreturnedtheChiefsReporttoberevisedconsistentwiththestandardformatforhisreportsTherevisedReportwasreceivedApril172000TheBoardvotedtoreviewtheComplaintinaccordancewithSection887B1awhichmeanstheBoardwillreviewthecomplaintontherecordwithoutrequestingadditionalinformationAttheBoardsmeetingonMay232000theBoardvotedtochangethelevelofreviewinaccordancewithSection887B1ewhichmeanstheBoardwillperformitsownadditionalinvestigationTheBoardrequestedadditionalinvestigativeinformationfromtheChiefonMay252000AtthemeetingonMay232000theBoardvotedtorequestfromtheCityCouncila60dayextensionofitsreportdeadlinetoAugust12000SuchextensionwasgrantedTheChiefrespondedtotheBoardsrequestofMay23bymemorandumonJuly52000TheBoardmetonMarch28April11and25May9and23June13andJuly112000toconsiderthisComplaintFINDINGSOFFACTThecomplainantwasarrestedlateinDecemberintheearlyeveningashewasparkingonWashingtonStreetnearthepolicestationThearrestingofficerhadreceivedinformationregardingapossibleOWLofavehicleoccupiedbytwoblackmalesfittingthedescriptionofthecomplainantsvehicleOfficerAlocatedthecarbeingdriveninanerraticfashionOfficerAthenlostsightofthevehiclebutlaterlocateditasitwasbeingparkedinanerraticmannerWhenOfficerAmadePCRB9910Page2 contactwiththeoperatorhesheconcludedtheoperatorwasintoxicatedashewasunsteadyonhisfeetandhisspeechwasslurredPartofthisstopisonvideobutthereisnosoundduetobatteryrealfunctionThecomplainantinformedtheOfficerthathehadnodriverslicenseandthatthecarhewasdrivingwasnothisOfficerAleftthescenetoenteranearbybarwherethecarsownerallegedlywaslocatedTherehefoundthesecondpersonthathadbeeninthevehicleThisindividualclaimedhedidnotknowthedriverbuthadobtainedaridefromhimfromanotherbarThecomplainanthadbeenleftwithOfficerBwhohadalsorespondedtotheradiocallregardingapossibleOperatingWhileIntoxicatedWhenOfficerAindicatedviaradiothathewaswiththesuspectOfficerBdrovetoOfficerAslocationandarrivedwithin15minutesAthirdpersonOfficerCisreferredtoinbothOfficersnarrativesbutitisnotclearwhenheshearrivedWhenOfficerAreturnedfromthebarheinformedOfficerBthathehadanappointmentandrequestedOfficerBtocompletetheOWIinvestigationOfficerBagreedandasitwasverycoldadvisedthecomplainantthattheywouldgototheIowaCityPoliceDepartmenttoconductsobrietytestsThecomplainantwasplacedinthebackofOfficerBspatrolcarwithouthandcuffsHewasadvisedthathewasnotunderarrestatthatpointintimeOfficerBthendrovethecomplainanttotheIowaCityPoliceStationTheincarrecorderofOfficerBsupportsthiseventalthoughthecomplainantreportsthathewaswalkedtothePoliceDepartmentOfficerCremainedatthescenetotakecareofthecarAtthestationthecomplainantwasadministeredanumberofsobrietytestsHGNandWalkandTurnonwhichhedidpoorlyThecomplainantwasaskedtotaketheOneLegStandTestandaPBTTestbutrefusedOfficerBthenadvisedthecomplainantthathewasunderarrestforOperatingWhileIntoxicatedandrequestedthathesitintheintoxilyzerroomThecomplainantbecameagitatedandindicatedthathewouldfightbeforehewasdoneOfficerBreadtheIowaImpliedConsentFormtothecomplainantwhointerruptedthereadingseveraltimesandrefusedtotakethetestandtosignaformDuringthistimetwoofficersDandEweresenttotheareabythedispatcherbecauseofthecomplainantsPCRB9910Page3 behaviorasobservedonthevideoThecomplainantstoodupandsaiditstimetofightWhenthecomplainantarosesodidOfficerBDandEOfficerBpulledhisOCfromitscaseandindicateditwouldbeusedifthecomplainantbecameresistiveThecomplainantwashandcuffedbehindhisbackandthecuffsdoublelockedThecomplainantwasthentakentothefrontreportwritingroomsothatOfficerBcouldtypethechargesAsthechargeswerebeingtypedthecomplainantrosefromhischairandapproachedOfficeDOfficerDaskedthecomplainanttositbackdownbutherefusedOfficerBaroseandassistedOfficerDinattemptingtositthecomplainantbackdownAsthecomplainantresistedOfficerEtookhimtothegroundasthecomplainantwasflailingandscreamingthreatsOfficerEheldthecomplainantontheflooruntilatransportcarwasobtainedThecomplainantwasthenassistedtohisfeetbyOfficerEandwalkeddownthehalltowardsthecarAsOfficerEandthecomplainantapproachedtheGilbertStreetdoorthecomplainantplantedhisfeetandpulledawayfromOfficerEwhothenagaintookhimtothegroundThecomplainantafterbeinghelpedtohisfeetagainpulledawayandtriedtorunthroughtheGilbertStreetdoorOfficerEgrabbedthecomplainantsarmandpulledhimrearwardasheimpactedthewindowwithhisheadTheofficerreceivedaninjurytohisleftelbowThewindowwasshatteredcompletelyontotheoutsidewalkwayThecomplainantsheadwasphotographedafterhewasplacedinthesquadcartodocumentabsenceofinjuriesThecomplainantresistedplacementinthesquadcarHisfeetweresecuredwithflexcuffsandhewastakentotheUniversityofIowaEmergencyTraumaCenterandexaminedandXrayedThenhewastakentotheJohnsonCountyJailonthreechargesOperatingWhileIntoxicatedThirdOffenseDrivingWhileBarredandInterferencewithOfficialActsCausingInjuryCONCLUSIONThecomplainantindicatedthathehadnocomplaintsregardinghistreatmentbyIowaCityPoliceOfficersuntilafterhewashandcuffedinthepolicestationHisaccountofwhathappenedandwhichofficerswereinvolveddiffersfromthatofPCRB9910Page4 theofficersThecomplainantchargesthatexcessiveforcewasusedinthreedifferentcontextsAllegation1HandcuffswereplacedonthecomplainanttootightlyComplainantstatesthathandcuffswereplacedonhimsotightlythattheyleftmarksonhiswristsandpreventedhimfromsittingHeindicatesthatbehaviorperceivedasresistlyeandthreateningbyofficerswasaconsequenceofhiseffortstogettheofficerstorespondtohiscomplaintsandtoloosenthehandcuffsTheChiefsReportstatesthatOfficerBnormallycheckshandcuffsfortightnessbyplacinghisfingersbetweenthecuffandthewristOfficerBdoesnothaveaspecificrecallofcheckingthecuffsbuttocheckthecuffsishisnormalprocedureTheChiefsReportstatesthereisnoindicationinthemedicalreportsthatthecomplainantsufferedinjuriestohiswristTheChiefsReportnotedthattheaggressiveconductofthecomplainantwouldcausepainanddiscomfortfromthecuffsTheBoardfindstheChiefsconclusionthatthereisnoevidencethatthehandcuffswereontootightlyissupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAllegation1ofthecomplaintisNOTSUSTAINEDAllegation2OfficersthrewthecomplainanttothefloorandstruckandkickedhimThecomplainantstatesthatafterrefusingtotakethesobrietytesthestoodupandaskedtheofficerwhowastryingtotesthimtoloosenthecuffsWhenrefusedhecontinuedtotrytoshowtheofficerthatthecuffsweretootightThecomplainantstatesatleasttwootherofficerscameintotheroomandstartedhittinghimthenthrewhimonthefloorwhereoneofficerkickedhiminthefaceTheChiefsReportstatesthatthecomplainantwantedtofightwithOfficerBthroughouttheprocessingofthearrestandthathebecamemoreandmoreagitatedasthechargeswerecompletedHishatandglasseswereremovedbyOfficerDtofacilitatetheuseofpeppersprayifnecessaryThecomplainantbecamemoreabusiveWhenOfficerEwalkedintotheroomthecomplainantbackedintotheofficerwhothenplacedthecomplainantonthefloortogaincontrolTheChiefsPCRB9910Page5 ReportnotedthattheofficersactionsintakingthecomplainanttothefloorwereconsistentwiththedepartmentsuseofforcepolicyandthatthereisnoindicationthattheofficersstruckandorkickedthecomplainantTheBoardfindsthattheChiefsconclusionthattheofficersusedonlytheamountofforcenecessarytocontainandcontrolthecomplainantissupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAllegation2ofthecomplaintisNOTSUSTAINEDAllegation3OfficersforcedthecomplainantsheadandupperbodythroughtheglassintheupperpartofanexteriordooratthepolicestationThecomplainantstatesashewasbeingtakendownahallwaytobetransportedtojailhewasheldbytwoofficersonegraspedthehandcuffsbehindhisbackandraisedthemupThecomplainantstatedthatashenearedtheexitdoorhecouldseenoonetheretoopenitWhenhetriedtoleanbacktoseethedoorhewasgrabbedandhisheadrammedintothedoorstrikingthemetalportionbythedoorhandlerightbelowthewindowThecomplainantstatedthathebackedupandtriedtostraightenupandthenextthingheknewhewasputthroughthewindowofthedoorAccordingtotheChiefsReportasthecomplainantwasbeingmovedtowardthereardoorofthestationthecomplainantmovedtofaceandchallengetheofficersfollowinghimandhewastakentothefloorbyOfficerEtocontrolhimWhenassistedtohisfeetthecomplainantpulledawayfromtheofficerandrantowardthewindowedreardoorputhisheaddownanddrovehisheadthroughthewindowOfficerEgrabbedthecomplainantstoppinghimfromseriouslyinjuringhimselfTheBoardfindsnoreasontodisputetheChiefsconclusionsthattheofficersusedonlytheamountofforcenecessarytocontainandcontrolthecomplainanttheofficersdidnotforcethecomplainantintothedoorglassThecomplainantwasresponsibleduetohisattempttorunforwardTheChiefsconclusionissupportedbysubstantialevidenceandisnotunreasonablearbitraryorcapriciousAllegation3ofthecomplaintisNOTSUSTAINEDPCRB9910Page6
