Resolutions and Motions: ITEM 3d(1) DUBUQUE STREET, 100 MEN AND WOMEN WHO CARE EVENT - RESOLUTION APPROVING AGREEMENT BETWEEN THE CITY OF `-� IOWA CITY AND IOWA CITY DOWNTOWN SELF -SUPPORTED MUNICIPAL IMPROVEMENT DISTRICT TO ALLOW THE TEMPORARY AND LIMITED SALE, CONSUMPTION, AND POSSESSION OF ALCOHOL ON S. DUBUQUE STREET DURING "100 MEN AND WOMEN WHO CARE EVENT" Comment: Section 4-5-3 of the City Code allows for the sale and consumption of alcohol in a city park, on a right-of-way, or other public ground, excluding public buildings, pursuant to written agreement. The agreement, which is attached to the resolution, allows the Iowa City Downtown District to sell alcohol in the 0-100 block of S. Dubuque Street on June 18 from mid-afternoon to early evening during the 100 Men and Women Who Care event. ITEM 3d(2) PARKING GARAGE MAINTENANCE PROGRAM 2015 - RESOLUTION AWARDING CONTRACT AND AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A CONTRACT FOR CONSTRUCTION OF THE IOWA CITY PARKING GARAGE MAINTENANCE 2015 PROJECT. Comment: Bids for this project were opened on Thursday, May 28, 2015. Staff is reviewing the bids and a recommendation for award will be presented to Council at the Council meeting on Tuesday, June 2. The estimated cost of construction is $402,000 and will be funded with Parking revenue proceeds. The Engineer's Report and Performance and Payment bonds are on file with the City Engineer. ❖ Project Estimated Cost: $ 90,000.00 ❖ Project Bid Received: $ 103,800.00 ❖ Project Actual Cost: $ 103,800.00 IOWA CITY GATEWAY PROJECT - RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO ATTEST AN AMENDMENT NO. 2 TO THE NOVEMBER 18, 2010 AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND HNTB CORPORATION OF KANSAS CITY, MO TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE IOWA CITY GATEWAY PROJECT. Comment: The City of Iowa City entered into a contract with HNTB Corporation to coordinate a National Environmental Policy Act (NEPA) study and prepare preliminary and final design documents for the construction of the Iowa City Gateway Project. It has become necessary to amend the original contract due to additional work required to complete the design for the more complex Through -Arch Bridge. The negotiated additional work is $826,248.37 for a revised maximum amount payable of $6,123,017.20. Funding for these services is available through Local Option Sales Tax Funds and the $3M Federal EDA Grant. FIREWORKS AGREEMENT WITH UNIVERSITY - RESOLUTION APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY AND THE UNIVERSITY OF IOWA REGARDING THE 2015 INDEPENDENCE DAY FIREWORKS DISPLAY Comment: This resolution will approve the Memorandum of Understanding developed by the City and the University to facilitate the City's Independence Day fireworks display on July 4th. The display will take place at the University's Hubbard Park, with their permission and assistance. June 2, 2015 City of Iowa City Page 4 ITEM 3d(7) is -l79 UNIVERSITY HEIGHTS TRANSIT SERVICE - RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST THE FY2016 AGREEMENT BETWEEN THE CITY OF IOWA CITY AND THE CITY OF UNIVERSITY HEIGHTS FOR THE PROVISION OF TRANSIT SERVICE WITHIN THE CORPORATE LIMITS OF UNIVERSITY HEIGHTS. Comment: This resolution approves the FY2016 agreement for Iowa City Transit to provide transit service within the corporate limits of University Heights. The level of transit service provided will remain the same as in FY2015. The proposed FY2016 contract amount of $36,161 is an increase from the FY2015 amount based on the National Consumer Price Index, and is an increase of 1.8%. University Heights will consider this agreement at their June 9, 2015 city council meeting. ITEM 3d(8) WORKFORCE HOUSING TAX CREDITS - RESOLUTION IN SUPPORT OF THE APPLICATION OF ICCH, LLC FOR WORKFORCE HOUSING TAX INCENTIVES PROGRAM FROM THE IOWA ECONOMIC /5—/717 DEVELOPMENT AUTHORITY TO CONSTRUCT RESIDENTIAL HOUSING UNITS ON THE 900 -BLOCK OF MILLER AVENUE AND COMMITTING LOCAL FUNDS TO THE PROJECT. Comment: ICCH, LLC, is applying for Workforce Housing Tax Incentives from the Iowa Economic Development Authority to assist financing the construction of residential housing that will include up to 33 dwelling units. The applicant anticipates that up to 15 housing units will qualify under this program. As part of its application, the developer needs a resolution by the local governmental subdivision supporting the application and committing at least $1,000 per dwelling unit to this project (at least $15,000 for 15 assisted housing units). This resolution also authorizes the City Manager to enter into a funding agreement with ICCH, LLC for the Prairie Hill Cohousing Development. Correspondence included in Council packet. ITEM 3d(9) PLEIADES FIRST ADDITION — RESOLUTION APPROVING FINAL PLAT (SUB15-00009) S_ Comment: A preliminary of Pleiades First Addition was approved on May 19, 2015. Staff recommends approval of the final plat subject to approval of legal papers and construction drawings by the City Attorney and City Engineer. It is anticipated that legal papers and construction drawings will be approved prior to the June 2 City Council meeting. Approval will allow the development of a 1 -lot and 1-outlot, 7.15 -acre Mixed -Use and Residential subdivision. ITEM 3d(10) ICN AGREEMENT- RESOLUTION APPROVING, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE AND ATTEST, RESPECTIVELY, A MASTER AGREEMENT FOR SHARED USE PROJECTS BETWEEN THE CITY AND THE STATE OF IOWA'S IOWA COMMUNICATIONS NETWORK. Comment: This resolution will approve a master agreement developed by City staff and the State of Iowa ICN to enter future agreements to share facilities, services, and maintenance responsibilities for fiber optic cable. June 2, 2015 ITEM 3d(11) / 5 -%8a City of Iowa City Page 5 JUSTICE ASSISTANCE GRANT- RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF IOWA CITY AND JOHNSON COUNTY, IOWA FOR THE APPLICATION AND ADMINISTRATION OF ANY AWARDED EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT (JAG) PROGRAM AWARDS. Comment: The Iowa City Police Department, in partnership with the Johnson County Sheriff's Office, is making application for the 2015 Edward Byrne Memorial Justice Assistance Grant (JAG) program administered by the U.S. Department of Justice. The Departments were notified that they were eligible for a total of $25,029.00. In accordance with past practice and the application process, the parties have agreed to split the award 52% for Iowa City ($13,015) and 48% to Johnson County ($12,014), and that the City of Iowa City will take responsibility for the application and management of this grant under the terms of the interlocal agreement. The Iowa City Police Department would like to allocate the $13,015.00 towards the development of a program that would educate and train officers, interested vulnerable persons that wander, and interested loved ones of vulnerable persons that wander with strategies to reduce the chances of wandering and/or utilization of a GPS or other tracking device that can send electronic alerts about a missing persons location. ITEM 3d(12) COUNTY REZONING NEWPORT ROAD— LETTER RECOMMENDING APPROVAL OF COUNTY REZONING OF 28.04 ACRES OF LAND LOCATED AT 3022 NEWPORT ROAD NE FROM A- AGRICULTURAL TO R- RESIDENTIAL AND 1113 -RESIDENTIAL (CZ15-00001) Comment: At its May 21 meeting by a vote of 7-0 the Planning and Zoning Commission recommended that the City send a letter to the Johnson County Planning and Zoning Commission finding that the requested rezoning at 3022 Newport Road NE is consistent with the Johnson County/Iowa City Fringe Area Agreement and the City recommends approval. Comment: United Action for Youth voluntarily terminated their $25,000 CDBG agreement for facility rehabilitation as they are considering moving to another site. The Housing Fellowship declined the $200,000 HOME award as they were unable to secure a site for a Low Income Housing Tax Credit application. No funds were drawn for either project. The FY15 Plan Amendment #1 proposes to use $111,954 in HOME funds for two new housing projects by The Housing Fellowship and Habitat for Humanity. The Housing and Community Development Commission voted unanimously in favor of approval of this item at their April 16, 2015 meeting. Excerpts of the meeting minutes are included in the packet. ITEM 3e. Setting Public Hearings: ITEM 3e(1) REZONING AT MILLER AVENUE SOUTH OF BENTON — MOTION SETTING A PUBLIC HEARING FOR JUNE 16, 2015 ON AN ORDINANCE CONDITIONALLY REZONING 7.8 ACRES OF LAND LOCATED ON THE WEST SIDE OF MILLER AVENUE SOUTH OF BENTON STREET FROM MEDIUM DENSITY SINGLE FAMILY (RS -8) TO PLANNED DEVELOPMENT OVERLAY/MEDIUM DENSITY SINGLE FAMILY RESIDENTIAL(OPD-8) ZONE (REZ13-00010). Comment: At its May 21 meeting, by a vote of 6-0 (Dyer abstained), the Planning and Zoning Commission recommended approval of this rezoning to allow development of Prairie Hill, a 33 -unit co -housing development. June 2, 2015 ITEM 3e(3) /S-1 gs ITEM 3e(4) City of Iowa City Page 7 WILLOW CREEK / KIWANIS PARK RENOVATION PROJECT - RESOLUTION SETTING A PUBLIC HEARING ON JUNE 16, 2015 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE WILLOW CREEK/KIWANIS PARK RENOVATION PROJECT. DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project will allow for improvements to include creek bank restoration, trail improvements, an additional restroom, and a youth baseball backstop to Willow Creek and Kiwanis Parks. After meeting with the neighborhood, HBK engineering prepared a master plan for proposed park improvements. The estimated construction cost is $350,000 and funds are available in the Capital Improvement Plan. COURT STREET TRANSPORTATION CENTER COMMERCIAL SPACE LEASE PUBLIC HEARING - RESOLUTION SETTING A PUBLIC HEARING FOR JUNE 16, 2015 REGARDING THE INTENT TO ENTER INTO A LEASE AGREEMENT WITH PHOENIX CHILDREN'S ACADEMY, INC. FOR LEASE OF COURT STREET TRANSPORTATION CENTER SPACE. Comment: This resolution sets a public hearing for June 16, 2015 for consideration of the proposed lease of space in the Court Street Transportation Center to Phoenix Children's Academy. This lease would be for five years with two additional five year options, which is a length that requires a public hearing. ITEM 3e(5) INTERNATIONAL BUILDING CODE, RESIDENTIAL CODE, FIRE CODE, ELECTRICAL CODE, AND PLUMBING CODE - MOTION SETTING A PUBLIC HEARING FOR JUNE 16, 2015 TO RECEIVE PUBLIC COMMENTS REGARDING ORDINANCES ADOPTING THE 2015 EDITIONS OF THE INTERNATIONAL BUILDING CODE, INTERNATIONAL RESIDENTIAL CODE, AND INTERNATIONAL FIRE CODE, AND ADOPTING SECTIONS 103.6(1)(A) (THE IOWA STATE ELECTRICAL CODE) AND105.4(1)(A) (THE IOWA STATE PLUMBING CODE AND THE IOWA STATE MECHANICAL CODE) OF THE CODE OF IOWA. CONSIDER A RESOLUTION Action: ecoz Ae ASSESSMENTS - RESOLUTION ADOPTING AN ASSESSMENT SCHEDULE OF UNPAID MOWING, CLEAN-UP OF PROPERTY, SNOW REMOVAL, SIDEWALK REPAIR, AND STOP BOX REPAIR CHARGES AND DIRECTING THE CLERK TO CERTIFY THE SAME TO THE JOHNSON COUNTY TREASURER FOR COLLECTION IN THE SAME MANNER AS PROPERTY TAXES. Comment: The City has the authority under Iowa Code §364.136 to assess the nuisance abatement costs in the same manner as a property tax. This resolution allows the City Clerk to certify to the Johnson County Treasurer the abatement cost to be assessed against the property. This assessment is being pursued only after the City took many steps to resolve the matter. The City notified the home owners to abate the nuisance (for example, to remove snow from the sidewalk) and after the home owner did not take action to abate the nuisance, the City abated the nuisance and billed the owner. After being billed at least twice, these owners still have not paid the abatement costs. The City has sent a letter to the home owner giving them notice that this resolution would be on the agenda, a copy of which is attached to the resolution. No interest will be charged if the owner pays within 30 days of the first required publication. Attached as an exhibit to the resolution is a list of the properties that will be assessed and the amount that will be assessed.
