Iowa City City Council regular meeting, 7:00 p.m. at City Hall. Mayor Hayek

A public hearing was held on an ordinance conditionally rezoning 7.8 acres of land
located on the west side of Miller Avenue south of Benton Street from Medium Density
Single Family (RS -8) to Planned Development Overlay/Medium Density Single Family
Residential(OPD-8) Zone (REZ13-00010). Mayor Hayek requested Council Members
report any ex parte communications and none were reported. Development Services
Coordinator Yapp presented a power point. Individual Council Members expressed
their views. Co -Housing project representatives Barb Bailey, 2357 Willenbrock Circle,
and Annie Tucker, 1425 Oaklawn Ave., presented a power point.
Moved by Mims, seconded by Botchway, that the ordinance conditionally rezoning

Development Services Coordinator Yapp presented a power point. Mayor Hayek
requested Council Members report any ex parte communications and none were
reported.
Moved by Mims, seconded by Botchway, to continue public hearing and defer first
consideration to July 27 of the ordinance conditionally rezoning 0.41 acres of land
located at 705 and 709 S. Clinton Street from Intensive Commercial (CI -1) Zone to
Riverfront Crossings — Central Crossings (RFC -CX) Zone (REZ15-00008).
A public hearing was held on an ordinance amending the Planned Development
Overlay Plan for Saddlebrook Meadows Part 1 to allow a reduction of the front yard
setback for certain properties located on Blazing Star Drive (REZ15-00011).
Development Services Coordinator Yapp presented a power point. The following
individuals appeared: Duane Musser, MMS Consultants; Steve Gordan, A&M
Management.
Moved by Mims, seconded by Dickens, that the ordinance amending the Planned
Development Overlay Plan for Saddlebrook Meadows Part 1 to allow a reduction of the
front yard setback for certain properties located on Blazing Star Drive (REZ15-00011), be
given first vote.
A public hearing was held on an ordinance rezoning approximately 12,000 square
feet of property from Central Business Service (CB -2) Zone to Central Business Support
(CB -5) Zone located at 410 Iowa Ave. (REZ15-00010). Development Services
Coordinator Yapp presented a power point. Mayor Hayek requested Council Members
report any ex parte communications and none were reported. Atty. Tom Gelman, 714
McLean, appeared representing the owner Whistler Apartment LLC.
Moved by Mims, seconded by Dickens, that the ordinance rezoning approximately
12,000 square feet from Central Business Service (CB -2) Zone to Central Business
Support (CB -5) Zone located at 410 Iowa Ave. (REZ15-00010), be given first vote.
Moved by Mims, seconded by Throgmorton, that the rule requiring ordinances to
be considered and voted on for final passage at two Council meetings prior to the
meeting at which it is to be finally passed be suspended, the second consideration and
vote be waived, and that ORD.15-4626, AMENDING TITLE 14: ZONING TO CREATE
AN EXEMPTION FROM THE FLOOR AREA RATIO LIMITATION AND ESTABLISH
NEW HEIGHT STANDARDS FOR HOSPITALS LOCATED IN THE COMMERCIAL
OFFICE (CO -1) ZONE (REZ15-00009), be voted on for final passage at this time.

time.

contract, and estimate of cost for the Willow Creek / Kiwanis Park Renovation Project

Code, by adopting the International Building Code, 2015 Edition, including Appendix K,
and the International Residential Code, 2015 Edition, including Appendix F and
Appendix J, and providing for certain amendments thereof; adopting Section
103.6(1)(a) of the Code of Iowa (The State Electrical Code) and Section 105.4(1)(a) of
the Code of Iowa (The State Plumbing and Mechanical Codes); repealing Chapters 2,
Plumbing Code, 3, Electrical Code, 4, Mechanical Code, 5, Abatement of Dangerous
Buildings Code, and 13, Fuel Gas Code; amending Chapter 12, entitled Appeals; and

the City of Iowa City and providing for the issuance of permits. No one appeared.

AGREEMENT; AND AUTHORIZING THE EXECUTION, PERFORMANCE AND
DELIVERY OF A PLEDGE AND SECURITY AGREEMENT, ASSIGNMENT AND
DELEGATION AGREEMENT, TRUST AGREEMENT, PROJECT WARRANTIES
AGREEMENT AND REVISED EXHIBIT B TO THE MASTER LEASE PURCHASE

AMENDED AGREEMENT FOR PRIVATE DEVELOPMENT BY AND BETWEEN THE
CITY OF IOWA CITY, IOWA AND A&M DEVELOPMENT II, L.L.C. FOR THE SABIN
TOWNHOMES.
Moved by Payne, seconded by Botchway, that the ordinance amending Title 6,
entitled "Public Health and Safety," Chapter 10, entitled "Smoke Free Places," to
prohibit smoking electronic cigarettes in areas where it is illegal to smoke tobacco, be
given first vote. The following individuals appeared: Doug Beardsley, 681 Sandusky,
Dir. of Johnson County Public Health; Joseph Dobrian, 1015 Second Ave.; Michael
Conroy, Muscatine Ave.; Michael McLaughlin, Vice -Chair Johnson County Public Health
Board; and Joy Beadleston. Individual Council Members expressed their views.
Moved by Mims, seconded by Botchway, that the rule requiring ordinances to be
considered and voted on for final passage at two Council meetings prior to the meeting
at which it is to be finally passed be suspended, the second consideration and vote be
waived, and that ORD. 15-4627, AMENDING TITLE 8, POLICE REGULATIONS,
CHAPTER 8, CITIZENS POLICE REVIEW BOARD, TO RENAME THE BOARD TO
COMMUNITY POLICE REVIEW BOARD AND REMOVE OR REPLACE THE WORD
"CITIZEN" IN ACCORDANCE WITH RECENT CHANGES TO THE CITY CHARTER, be
voted on for final passage at this time. Moved by Mims, seconded by Botchway, that
the ordinance be finally adopted at this time.

THE BY-LAWS OF THE COMMUNITY POLICE REVIEW BOARD, INCLUDING A
NAME CHANGE FROM CITIZENS POLICE REVIEW BOARD AND REPEALING
RESOLUTION 13-289.

St., to the Airport Zoning Brd of Adjustment for a five-year term January 1, 2012 -
December 31, 2016.
The Mayor noted that no applications were received for the following Boards and
Commissions and all will be readvertised: Airport Zoning Brd. of Adjustment for a five-
year term January 1, 2014 — December 31, 2018 (Formerly advertised; Full term);
Historic Preservation Commission for a Jefferson St. representative for a three-year
terms, March 29, 2013 — March 29, 2016 (New District formed).
The Mayor noted the current vacancy to Boards and Commissions: Appeals, Board
of for an unexpired five-year term January 1, 2014 - December 31, 2018, for a HVAC
or building design professional or qualified by experience and training (Unexpired term)
The Mayor noted the previously announced vacancies: Citizens' Police Review
Board for a four-year term, September 1, 2015 — September 1, 2019; Housing and
Community Development Commission for three vacancies to fill three-year terms
September 1, 2015 — September 1, 2018; Parks and Recreation Commission for I an
unexpired term, upon appointment — January 1, 2018. Applications must be received by
5:00 p.m., Wednesday, July 22, 2015. Applicants MUST reside in Iowa City and be 18

1. Council Member Throgmorton reported on the May 26th City of Literature board meeting,
noting it would be the last meeting for retiring University of Iowa President Sally Mason
and the contributions she has made over the years.
2. Council Member Throgmorton recounted the Iowa Work CEO meeting on May 28th in
Cedar Rapids; and reported on the grant received by Region 10 tracking dislocated
workers. He indicated he would be working with the City Manager on responding to the
situation and what the City could do.
3. Council Member Payne noted she would not be at the formal meeting during "Council
Time" and asked someone to mention Party in the Park starting Thursday, June 4, at
Kiwanis Park.
4. Council Member Payne stated she and Council Member Dobyns would be working the
City booth at Arts Fest Friday evening.
5. Council Member Payne questioned if Council would be discussing the priority list
outlined in Asst. City Manager Fruin's memo (IP5 of May 28 info packet) UIS rep. Neal
stated that the UISG leadership asked if the sidewalk repair policy could be reviewed
prior to the start of school in the fall based on safety concerns, noting the absence of a
side walking routes from Hawks Ridge to Walmart. PW Dir. Knoche present for
discussion. Asst. City Manager Fruin will meet with UISG.

considered and voted on for final passage at two Council meetings prior to the meeting
at which it is to be finally passed be suspended, the second consideration and vote be
waived, and that ORD. 15-4623, AMENDING CITY CODE TITLE 1, ENTITLED
"ADMINISTRATION," CHAPTER 5, ENTITLED "MAYOR AND CITY COUNCIL," TO
CHANGE THE REVIEW PROCESS FOR CITY COUNCIL MEMBERS AND THE
MAYOR, be voted on for final passage at this time. Moved by Mims, seconded by
Botchway, that the ordinance be finally adopted at this time.
Moved by Mims, seconded by Throgmorton, that the ordinance amending Title 8,
Police Regulations, Chapter 8, Citizens Police Review Board, to rename the board to
Community Police Review Board and remove or replace the word "Citizen" in
accordance with recent changes to the City Charter, be given first vote.

Citizens' Police Review Board for a four-year term, September 1, 2015 — September 1,
2019; Housing and Community Development Commission for three vacancies to fill

Mayor Pro tem Mims announced Party in the Park, Thursday, June 4 at Kiwannis
Park; and Arts Fest running Friday through Sunday in downtown Iowa City.
Council Member Throgmorton reported on two events held May 28th. The summer
kickoff at Wetherby Park and the second the Burr Oak Land trust Celebration honoring
Nancy Siberling at the Ashton House.
Council Member Botchway urged person to visit his Twitter account at kbforcouncil
and see over 30 festival and events being held in Iowa City and get updates on various
City projects.
Mayor Hayek congratulated students and teachers on the last day of classes in the
Iowa City School District; and wished everyone a safe and fun summer.
City Manager Markus commended on design of the Ned Ashton house; reported that
the two Fellows visiting in Iowa City over the past month were off to Washington D.C.;
and reported that he and his were once again "empty nesters". Council Member
thanked City Manager Markus for hosting the two Fellows.
