Clinton Street from Intensive Commercial (CIA) Zone to Riverfront Crossings — Central Crossings (RFC -CX) Zone (REZ15-00008). The Mayor requested Council Members to disclose any ex parte communications and none were reported. City Planner Howard stated a signed conditional zoning agreement had not been received. Moved by Payne, seconded by Botchway, that the ordinance amending Title 14: Zoning to zoning to add a definition for "rooftop service areas" and establish standards for such uses, be given first vote. Moved by Mims, seconded by Dickens, that the ordinance amending Title 4, Alcoholic Beverages, to acknowledge and cross-reference amendments proposed to the zoning code allowing rooftop service areas and amendments to Title 10, Public Ways and property, to allow sidewalk cafes in the Riverfront Crossings District, be given first vote. A public hearing was held on a resolution amending the FY2016 Operating Budget. Mary Gravitt, 2714 Wayne Ave., appeared. Moved by Payne, seconded by Botchway, to adopt RES. 15-266, AMENDING THE CURRENT BUDGET FOR THE FISCAL YEAR ENDING JUNE 30, 2016. Moved by Mims, seconded by Botchway, that the rule requiring ordinances to be considered and voted on for final passage at two Council meetings prior to the meeting at which it is to be finally passed be suspended, the second consideration and vote be waived, and that ORD. 15-4635, AMENDING TITLE 9, ENTITLED "MOTOR VEHICLES AND TRAFFIC," CHAPTER 1, ENTITLED "DEFINITIONS, ADMINISTRATION AND ENFORCEMENT OF TRAFFIC PROVISIONS," AND CHAPTER 8, ENTITLED "BICYCLES," TO EXPAND THE DEFINITION OF "BICYCLE"; PERMIT THE RIDING OF TWO BICYCLES ABREAST EACH OTHER; REMOVE THE REQUIREMENT THAT BICYCLISTS RIDE TO THE FAR RIGHT SIDE OF THE ROAD; AND AUTHORIZE THE IMPOUNDMENT OF INOPERABLE BICYCLES. be voted on for final passage at this time. Complete Description August 18, 2015 Page 5 The Mayor noted the previously announced vacancies to Boards and Commissions: Airport Zoning Brd. of Adjustment for a five-year term January 1, 2014 — December 31, 2018; Appeals, Board of, for an unexpired five-year term January 1, 2014 - December 31, 2018, for a HVAC or building design professional or qualified by experience and training. (Unexpired term); Community Police Review Board for a four-year term, September 1, 2015 — September 1, 2019. (Fidencio Martinez Perez term expires); Historic Preservation Commission for a Jefferson St. representative to fill three-year terms, March 29, 2013 — March 29, 2016 (New District formed). Applications must be received by 5:00 p.m., Wednesday, September 9, 2015. Applicants MUST reside in Iowa City and be 18 years of age unless specific qualifications are stated. However, no additional publication costs will be incurred.] Council Member Dobyns thanked the Kingdom Center congregation for welcoming his wife and himself at services the previous week -end. Council Member Payne noted this was the time of year when there is more bicyclists and pedestrians and encouraged everyone to be watchful when driving. Council Member Dickens reminded the community of the Pathways fundraiser, Men Who Cook, coming up Saturday, the 22"d Mayor Pro tem Mims noted recent discussion on the KXIC radio show regarding the arrival of University students and echoed Council Member Payne's remarks about being safe. Council Member Throgmorton noted the recent passing of former Council Member Steven Kanner and a memorial celebration planned for August 23rd at Happy Hollow Park. Council Member Botchway reminded everyone of the Soul Fest event planned the week -end of the 29th/ Mayor Hayek noted the grand opening of Alexander Elementary on Thursday the 20th and the cooperative efforts of the City and School in the development, and encouraged the community to keep an eye on the facilities plan as it moves forward; noted the passing of former Human Rights Coordinator Heather Shank; and acknowledged the participation of City Manager Markus in an exchange program under the auspices of the State Department and the International City Managers Association (ICMA) and recently returned from a trip to Indonesia. City Manager Markus reported on his Indonesia visit. Council Member Payne noted the opening of the City's new Animal Shelter. Mayor Hayek noted two pieces of correspondence regarding an incident at the Iowa City Recreation Center and suggested adopting the Consent Calendar by removing both letters for separate consideration and public input and discussion after adoption of the Consent Calendar. Council Member Throgmorton indicated his support for the sale and the program. The Mayor noted that he had previously avoided involvement on discussions regarding the Unitarian Church, but after discussions with the City Attorney this presentation relates to the entire campus and does not involve City acquisition of the Church or imposition of the landmark status, and he would be participating in this discussion. Dave Zahradnik, Neumann Monson Architects, 221 E. College, presented a conceptual power point. Atty. Joe Holland, representing the potential developer, appeared. Individual Council Members expressed their views, and indicated their support to move forward with the Comp Plan amendment as proposed. STAFF ACTION: Proceed with Comprehensive Plan amendment as proposed (Yapp). BOARD AND COMMISSION APPLICATION PROCESS [IP # 5 of 7/23 Info Packetl City Clerk Karr and Equity Dir. Bowers reviewed the memo. After discussion: 1. Council indicated support for a resolution establishing a new formal policy that redefines and expands the definitions of prohibited relationships consistent with the City's current personnel policy. Board and commission members that are actively serving in violation of this expanded policy as of the date the Council resolution adopts the policy should be grandfathered in until the beginning of the next appointment. 2. Council expressed interest in adopting a resolution that establishes a new formal policy addressing the reappointment process for current board and commission members. 3. Council directed staff to discuss with staff members of the five board and commissions affected by the recommendation shortening the terms to no greater than 3 years. City Manager Fruin explained that the previous site was structured more for the internal customer and those familiar with City government; and the emphasis with the new site to provide other navigation paths for those not familiar with local government. Fruin encourages Council and the public to pass along comments and feedback as staff reviews a round of future changes. June 25 1. Council Member Throgmorton shared experiences from his hometown of Louisville, Kentucky. July 9 1. (IP3 — ... Listening Posts ) In response to Councilmember Throgmorton, Karr noted the Council Members Botchway and Dickens would be attending the event on July 29. In response to Council Member Throgmorton's request to attend and not speak, a majority of Council agreed only the two designated Council Members should attend a listening post event. Dilkes stated that it was her conclusion that legally Council could do an ordinance similar to what was done in Cook County, noting the City does not give business licenses. A majority directed staff to prepare an ordinance for Council consideration. 2.
