ITEM 4d(1) TOBACCO PENALTY - RESOLUTION ACCEPTING A WAIVER OF RIGHT TO HEARING AND PAYMENT OF A $300 CIVIL PENALTY FROM DELI MART #3, PURSUANT TO IOWA CODE SECTION 453A.22(2) (2015) Comment: This resolution accepts a waiver of right to hearing and payment of a $300 civil penalty by Deli Mart #3. The civil penalty is required by Iowa Code Section 453A.22(2) due to an employee selling or providing tobacco to a minor. ITEM 4d(2) EASEMENT DEDICATION - RESOLUTION ACCEPTING THE DEDICATION OF CERTAIN EASEMENTS OVER AUDITOR'S PARCEL 2009016, IOWA CITY, IOWA. Comment: The City desires to construct a sidewalk along the north side of Sturgis Corner Drive to the sidewalk along the east side of Riverside Drive to improve pedestrian circulation. Because the right-of-way is not wide enough to accommodate this sidewalk, a temporary construction easement and public access easement are necessary. Comment: This resolution establishes a new formal policy that updates the definition of prohibited relationships consistent with the City's current personnel policy, and adopts a policy which addresses the reappointment process for current Boards and Commissions. The resolution is consistent with recommendations presented to Council at the July 27 and September 15 work sessions. CITY MANAGER SIGNATURE AUTHORITY - RESOLUTION REPEALING RESOLUTION No. 14-270 AND APPROVING A NEW COMPILATION OF CONTRACTUAL AUTHORITY DELEGATED FROM THE CITY COUNCIL TO THE CITY MANAGER WHICH ADDS AUTHORITY FOR THE CITY MANAGER TO SIGN DOCUMENTS RELATED TO INSURANCE COVERAGE. Comment: This resolution will approve a revised City Manager Signature Authority Resolution granting the City Manager authority to sign documents related to procurement and management of insurance of the City. The rest of the signature authority resolution is unchanged. ITEM 4d(10) SYCAMORE WOODS, PARTS 1 —RESOLUTION APPROVING FINAL PLAT (SUB15-00012) Comment: A preliminary plat of Sycamore Woods Parts 1 — 6 was approved in November 2014. Staff recommends approval of the final plat of Part 1 subject to approval of legal papers and construction drawings by the City Attorney and City Engineer. It is anticipated that legal papers and construction drawings will be approved prior to the October 6 City Council meeting. October 6, 2015 City of Iowa City Page 6 ITEM 4d(16) OUR TOWN GRANT - MOTION AUTHORIZING THE MAYOR TO PROVIDE A LETTER OF SUPPORT TO THE NATIONAL ENDOWMENT FOR THE ARTS (NEA) AS PART OF AN OUR TOWN GRANT APPLICATION THAT SEEKS FUNDING TO HOST SEVERAL CREATIVE PLACEMAKING EVENTS FOCUSED IN THE SOUTH DISTRICT AREA OF IOWA CITY. Comment: This motion will enable the City to apply for up to $200,000 from the National Endowment for the Arts (NEA) as primary partner with Summer of the Arts and the Iowa Initiative for Sustainable Communities/University of Iowa. If awarded, this funding will be used, over a two year period to support arts and education programming at the Iowa City Southeast District's Dream Center and other public spaces to foster neighborhood cohesion. An equal match is required provided substantially (@$168,000) by the University of Iowa providing in-kind staffing and project supplies and the remainder provided by in-kind staffing by Summer of the Arts (Lisa Barnes) and the City of Iowa City (Marcia Bollinger). ITEM 4d(17) TRANSPORTATION AND RESOURCE MANAGEMENT POSITIONS - RESOLUTION AMENDING THE BUDGETED POSITIONS IN THE TRANSPORTATION AND RESOURCE MANAGEMENT DEPARTMENT )5-313 AND THE AFSCME PAY PLAN BY DELETING TWO FULL-TIME MAINTENANCE WORKER III POSITIONS AND ONE FULL-TIME RECYCLE CLERK POSITION AND ADDING TWO FULL-TIME LANDFILL OPERATOR POSITIONS AND ONE FULL-TIME CUSTOMER SERVICE REPRESENTATIVE POSITION. Comment: The Transportation and Resource Management Department has two full-time Maintenance Worker III positions (one of which is currently vacant) and one vacant full-time Recycle Clerk position. After evaluating the position needs of the Transportation and Resource Management Department it has been determined that staff in the current Maintenance Worker III and Recycle Clerk positions can better serve the Department and City of Iowa City by being upward classified to Landfill Operator and Customer Service Representative positions. The financial impact of these upgrades in position classifications will result in a total annual increase to the Transportation and Resource Management budget of $4,300 - $5,600. Setting Public Hearings: ITEM 4e(1) UNIVERCITY SALE, 606 NORTH GILBERT - RESOLUTION SETTING PUBLIC HEARING FOR OCTOBER 20, 2015, ON A PROPOSAL TO I S —3 IS CONVEY A SINGLE FAMILY HOME LOCATED AT 606 NORTH GILBERT STREET. Comment: In the UniverCity Neighborhood Partnership Program, the City purchases rental units located in designated neighborhoods surrounding the University, rehabilitates them, and then sells them to income -eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 606 North Gilbert Street. The amount of the sale will be $176,000 (this is what the City paid to purchase the home) plus the "carrying costs," which are which are all costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to repair and rehabilitate the home. ,/��777 11 'c eyp'KTll11^� ITEM 4e(2) MERCER PARK PLAYGROUND REPLACEMENT — 1M # SETTING A PUBLIC HEARING ON OCTOBER 20, 2015 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE MERCER PARK PLAYGROUND REPLACEMENT PROJECT. DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project involves the purchase and installation of a new playground at Mercer Park. The new playground will meet the latest safety and ADA standards and will be an improved neighborhood amenity while also reflecting the regional nature of the park. The budget for the project includes $150,000 in GO Bonds and $64,855 in parkland dedication fees. ITEM 4e(3) 2015 SANITARY SEWER REHABILITATION -- RESOLUTION SETTING A PUBLIC HEARING ON OCTOBER 20, 2015 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST /5-3)_7 FOR THE CONSTRUCTION OF THE 2015 SANITARY SEWER REHABILITATION PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project will repair the sanitary sewer located at various sites throughout Iowa City. The project will utilize underground repair technology for sewer repairs that requires no excavation. The estimated construction cost is $300,000 and will be funded with Wastewater revenues. October 6, 2015 City of Iowa City Page 8 ITEM 4e(4) COMPREHENSIVE PLAN AMENDMENT, DOWNTOWN DISTRICT — MOTION SETTING A PUBLIC HEARING FOR OCTOBER 20 ON A RESOLUTION APPROVING AN AMENDMENT TO THE COMPREHENSIVE PLAN — TO ADD A THREE BLOCK AREA BOUNDED BY BURLINGTON STREET, IOWA AVENUE, GILBERT STREET, AND VAN BUREN STREET TO THE DOWNTOWN DISTRICT SECTION OF THE DOWNTOWN AND RIVERFRONT CROSSINGS MASTER PLAN. Comment: At its September 17 meeting, by a vote of 6-0 (Martin absent), the Planning and Zoning Commission recommended approval of this amendment. Approval will allow properties in a three block area bounded by Burlington Street, Iowa Avenue, Gilbert Street, and Van Buren Street to be added to the Downtown District of the Downtown and Riverfront Crossings Master Plan. UNIVERCITY SALE, 1104 EAST BURLINGTON - AUTHORIZING CONVEYANCE OF A SINGLE FAMILY HOME LOCATED AT 1104 EAST BURLINGTON STREET. Comment: In the UniverCity Neighborhood Partnership Program, the City purchases rental units located in designated neighborhoods surrounding the University, rehabilitates them, and then sells them to income -eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 1104 East Burlington Street. The amount of the sale will be $199,600 (this is what the City paid to purchase the home) plus "carrying costs" of approximately $18,400. "Carrying costs" are all costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to repair and rehabilitate the home. Action: (EXTENSION OF IOWA CITY DOWNTOWN SELF -SUPPORTED MUNICIPAL IMPROVEMENT DISTRICT (SSMID) A/K/A IOWA CITY DOWNTOWN DISTRICT) - MOTION SETTING A PUBLIC HEARING FOR NOVEMBER 10, 2015, ON AN ORDINANCE TO RE-ESTABLISH THE IOWA CITY DOWNTOWN SELF -SUPPORTED MUNICIPAL IMPROVEMENT DISTRICT FOR A PERIOD OF TEN YEARS IN ACCORDANCE WITH IOWA CODE CHAPTER 386. Comment: The Iowa City Downtown Self -supported Municipal Improvement District (a/k/a Iowa City Downtown District) was established by ordinance in 2011 pursuant to Chapter 386 of the Iowa Code. On September 11, 2015 a petition was filed to re-establish the District for a period of 10 years. The petition met the technical requirements of Iowa Code and was forwarded to the Planning and Zoning Commission for their evaluation. Comment: The residents of Sandusky Drive, between Keokuk and Broadway Streets, have completed the City of Iowa City's approved traffic calming program. A survey of the neighborhood indicated that a 92% majority of responding households are in favor of speed humps on Sandusky Drive, between Keokuk and Broadway Streets. Twenty-eight households were surveyed; thirteen (46%) responded, fifteen did not respond. Action: WESTBURY DRIVE TRAFFIC CALMING RESOLUTION AUTHORIZING THE INSTALLATION OF SPEED HUMPS ON WESTBURY DRIVE, BETWEEN GLASTONBURY STREET AND WESTBURY COURT. Comment: The residents of Westbury Drive, between Glastonbury Street and Westbury Court, have completed the City of Iowa City's approved Traffic Calming Program. A survey of the neighborhood indicated that a 90% majority of responding households are in favor of speed humps on Westbury Drive, between Glastonbury Street and Westbury Court. Thirteen households were surveyed; ten (77%) responded, three did not respond. Action: ITEM 12. HOUSING CODE - ORDINANCE AMENDING TITLE 17, NTITLED "BUILDING AND HOUSING," CHAPTER 5, ENTITLED "HOUSING CODE," TO SUPPORT NEIGHBORHOOD STABILIZATION BY PROHIBITING FURNITURE ON ROOFS, ADDING STANDARDS FOR EXTERIOR BUILDING AND FENCE SURFACES, REQUIRING SCREENING OF DUMPSTERS ON MULTI -FAMILY DWELLINGS AND UNDER CERTAIN DECKS/PORCHES, LIMITING THE STORAGE OF LANDSCAPING/CONSTRUCTION MATERIAL, AND REQUIRING GFCI PROTECTED OUTLETS AND CARBON MONOXIDE DETECTORS. (FIRST CONSIDERATION) Comment: At the August 18 work session, staff discussed proposed changes to the Housing Code as part of the City's ongoing efforts to stabilize neighborhoods. As directed by Council, this ordinance amends the Code in the following ways: a) prohibits storing and use of furniture on roofs and other surfaces above 30 inches without guard rails; b) establishes standards for treatment of exterior surfaces of buildings, fences, and retaining walls; c) requires areas beneath decks and porches in Historic and Conservation Districts to be screened; d) requires screening of dumpsters on existing multi -family sites; and d) limits the storage of landscaping and construction material to areas not visible from the street. Additionally, this ordinance requires GFCI protected outlets and carbon monoxide detectors in all dwelling units. Note that the Housing Code applies to owner -occupied and rental housing. ALARM SYSTEMS - ORDINANCE AMENDING TITLE 8, ENTITLED "POLICE REGULATIONS," CHAPTER 2, ENTITLED "ALARM SYSTEMS," TO UPDATE THE PROVISIONS REGARDING ALARM SYSTEMS. (FIRST CONSIDERATION) Comment: The current code provisions governing alarm systems for intruders are antiquated. The provisions are based on alarms that are directly connected to the police department, but intruder alarms no longer are directly connected to the police department. The alarm systems are connected to alarm companies. This ordinance updates the alarm provisions to reflect how the systems currently operate. _ Action: - �Z�°-�—� --�� ITEM 14. TASTING EVENTS - ORDINANCE AMENDING TITLE 4, ALCOHOLIC BEVERAGES, CHAPTER 5, PROHIBITIONS AND RESTRICTIONS, SECTION 7 LIMITATIONS ON SALES, SUBSECTION B, TO CLARIFY INAPPLICABILITY TO TASTING EVENTS. (SECOND CONSIDERATION) Comment: The City has long prohibited all-you-can-drink specials, due to the binge drinking they can encourage. However, many responsible tasting events, including community-wide attractions, utilize a format that may be construed as all-you-can-drink. The Iowa Alcoholic Beverage Division has recently proposed new rules defining and regulating tasting events. Historically, the City has not viewed community-wide tasting events as violating the City's ordinance, but now wishes to incorporate these new ABD definitions and regulations into an exception formalizing the City's past practice.
