Resolutions and Motions: ITEM 5d(1) ITEM 5d(2) /5-32-3 STAFFING AGREEMENT BETWEEN MPOJC AND IOWA CITY — RESOLUTION AUTHORIZING THE EXECUTION OF A STAFFING AGREEMENT BETWEEN THE METROPOLITAN PLANNING ORGANIZATION OF JOHNSON COUNTY AND THE CITY OF IOWA CITY AND RESCINDING RESOLUTION NO. 99-287. Comment: This resolution provides an updated staffing agreement between the Metropolitan Planning Organization of Johnson County (MPOJC) and the City of Iowa City by way of a 28E agreement. As City employees, the resolution is necessary to reflect an accurate description of MPOJC staff provided by the City of Iowa City. The resolution rescinds the existing implementation agreement (Resolution No. 99-287) which provides for positions that no longer exist within MPOJC. This action does not change the structure or function of MPOJC as it currently exists, nor does it have budget implications. The staffing agreement was approved unanimously by the MPOJC Urbanized Area Policy Board at their September 30, 2015 meeting. EASEMENT AGREEMENT, LOTS 7 AND 8 SAND LAKE ADDITION - RESOLUTION ACCEPTING THE DEDICATION OF AND AUTHORIZING THE MAYOR TO ENTER INTO AN EMERGENCY VEHICLE ACCESS EASEMENT AGREEMENT FOR A PORTION OF LOT 7 AND 8, SAND LAKE ADDITION, IOWA CITY, JOHNSON COUNTY, IOWA. Comment: This resolution will establish an emergency vehicle access to a new building addressed as 1821 Stevens Drive. The building does not have direct access from Stevens Drive which required the establishment of this easement. Comment: An evaluation of the overall maintenance needs of the City in light of recent vacancies has determined that staff resources would be more efficiently utilized by consolidating Recreation and Government Buildings maintenance staff into the Government Buildings division. This is the first of two steps needed to approve the recommended change. Comment: An evaluation of the overall maintenance needs of the City in light of recent vacancies has determined that staff resources would be more efficiently utilized by consolidating Recreation and Government Buildings maintenance staff into the Government Buildings division. This is the second of two steps needed to approve the recommended change. ITEM 5d(5) STONE BRIDGE ESTATES, PART NINE — RESOLUTION APPROVING FINAL PLAT (SUB15-00020) Comment: A preliminary plat of Stone Bridge Estates — Part Nine was approved in October 2013. Staff recommends approval of the final plat subject to approval of legal papers and construction drawings by the City Attorney and City Engineer. It is anticipated that legal papers and construction drawings will be approved prior to the October 20 City Council meeting. Approval will allow the development of Stone Bridge Estates — Part Nine, a 22 -lot, 8.17 -acre residential subdivision located on Lower West Branch Road, Chadwick Lane and Eversull Lane. Riverside Drive. �`'�, October 20, 2015 City of Iowa City Page 4 ITEM 5d(7) RESALE 840 LONGFELLOW PLACE - RESOLUTION AUTHORIZING MAYOR TO SIGN AND CITY CLERK TO ATTEST TO RESALE AND OCCUPANCY AGREEMENT FOR 840 LONGFELLOW PLACE. ITEM 5d(8) Comment: The City constructed 840 Longfellow Place through the Affordable Dream Home Ownership Program (ADHOP) program and sold it to an income -eligible family in 2009. The City provided the owners with a loan of $38,000 to assist in the purchase. The owners agreed to a 15 - year occupancy agreement that provided it could only be resold to an income eligible family who would live in the unit (i.e., could not be a rental). The owners wish to sell but have been unable to locate an income -eligible family to purchase it. A family with a disabled adult is willing to purchase it without any City assistance and to keep it owner - occupied until 2024. Staff recommends approving the re -sale. The current owners will repay their loan to the City at closing and those funds will be used for affordable housing. DEPARTMENT OF AGRICULTURE GRANT AGREEMENT - RESOLUTION AUTHORIZING THE CITY MANAGER TO SIGN A GRANT AGREEMENT WITH THE IOWA DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP FOR EDIBLE CLASSROOMS TO PROMOTE SPECIALTY CROPS. Comment: The Iowa Dept. of Ag. And Land Stewardship administers subgrants from the USDA for Iowa specialty crops. Staff has applied for a grant of $23,990 to: a) Create a self -guided, edible classroom at Robert A. Lee; b) Conduct on-going seasonal classes at the classroom; c) Develop an edible classroom publication for use by other organizations and communities; and d) Mentor at least two other schools/sites wanting to implement edible classrooms. The local match is staff time. The grant has been awarded, and this authorizes the City Manager to sign the grant agreement. ITEM 5d(9) AUGUST DISBURSEMENTS - MOTION TO APPROVE DISBURSEMENTS IN THE AMOUNT OF $10,897,207.22 FOR THE PERIOD OF AUGUST 1 THROUGH AUGUST 31, 2015, AS RECOMMENDED BY THE FINANCE DIRECTOR SUBJECT TO AUDIT. Comment: The prior agenda item is an ordinance amending the false alarm provisions for burglar and intrusion alarms. Resolution No. 06-365 established a fee for police department services, and it does not grant the Police Chief any discretion in assessing fees even if the cause of the false alarm is, for example, weather related. The proposed fee schedule grants the Police Chief limited discretion in waiving a false alarm fee. Under the current and proposed schedule, there is no fee assessed for the first four false alarms in a calendar year. The current fee is $30 for the 5th false alarm in one calendar year and increases gradually until the 8th or subsequent false alarm, which remains at $50. The proposed fee is $60 for the 5th and subsequent false alarms in one calendar year. It generally takes staff approximately two hours to address a false alarm, which is why $60 is being proposed. JOHNSON COUNTY AGRICULTURAL ASSOCIATION LEASE - RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CITY CLERK TO ATTEST A LEASE FOR PROPERTY WITH THE JOHNSON COUNTY AGRICULTURAL ASSOCIATION FOR RENTAL OF THE JOHNSON COUNTY SWINE BARN AND BUILDING B FOR PURPOSES OF STORAGE OF CITY EQUIPMENT. Comment: The renewal of the lease agreement is for the seasonal rental of two buildings located at the Johnson County Fairgrounds and will provide warm storage for vehicles and equipment of the Streets Division. Warm storage is required due to the fluids in the equipment and the diesel engines. The yearly cost for the rentals is $17,000. RESOLUTION SETTING A PUBLIC HEARING FOR NOVEMBER 10, 2015 ON A LEASE AGREEMENT BETWEEN THE CITY AND IMON COMMUNICATIONS, L.L.C. FOR THE LEASE OF SECURE SPACE LOCATED IN THE IOWA CITY DATA CENTER. Comment: The City and IMON Communications have negotiated a proposed lease agreement for the rental of secure space located within the Iowa City Data Center to IMON. Approval will allow the development of Churchill Meadows, Parts Two and Three, a 42 -lot, 18.66 -acre residential subdivision located south of Herbert Hoover Highway and northwest of St. Patrick's Church. Action: ITEM 8. 2015 SANITARY SEWER REHABI ITATION — APPROVING PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE 2015 SANITARY SEWER REHABILITATION PROJECT, ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID, DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME AND PLACE FOR RECEIPT OF BIDS. Comment: This project will repair the sanitary sewer located at various sites throughout Iowa City. The project will utilize underground repair technology for sewer repairs that requires no excavation. The estimated construction cost is $300,000 and will be funded with Wastewater revenues. a. UNIVERCITY SALE, 606 NORTH GILBERT - RESOLUTION AUTHORIZING CONVEYANCE OF A SINGLE FAMILY HOME LOCATED AT 606 NORTH GILBERT STREET. 15-33? Comment: In the UniverCity Neighborhood Partnership Program, the City purchases rental units located in designated neighborhoods surrounding the University, rehabilitates them, and then sells them to income -eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 606 North Gilbert Street. The amount of the sale will be $176,000 (this is what the City paid to purchase the home) plus "carrying costs" of approximately $14,000. "Carrying costs" are all costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to repair and rehabilitate the home. According to the abstract, Emma J. Harvat acquired land that includes 606 North Gilbert Street on April 17, 1899, and conveyed it on August 20, 1900. a. PUBLIC HEARING Action: b. DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project involves the purchase and installation of a new playground at Mercer Park. The new playground will meet the latest safety and ADA standards and will be an improved neighborhood amenity while also reflecting the regional nature of the park. The budget for the project includes $150,000 in GO Bonds and $64,855 in parkland dedication fees. a. PUBLIC HEARING Action: b. CASH CONTRIBUTION FOR A LIHTC SENIOR HOUSING APPLICATION - RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND THE CLERK TO ATTEST TO AN AGREEMENT TO GRANT $600,000 TO DEVELOP MIXED INCOME SENIOR HOUSING AT 1030-1070 WILLIAM STREET. 15 -3Lf-D Comment: Iowa City Senior Apartments L.P. (Applicant) requests a grant of $600,000 for development costs in the Towncrest Urban Renewal Area to construct a 41 unit mixed rental residential development for seniors 55 and older (36 units will be affordable to households under 60% of area median income). The request is contingent upon the Applicant securing a Low Income Housing Tax Credit award from the Iowa Finance Authority (IFA). LIHTC applications are due to IFA December 7, 2015. The source of funds for this award is taxable bonds for the Towncrest Redevelopment project area or other non tax-exempt sources of funds at the City's discretion. If the project is not awarded tax credits, the request is withdrawn. Action: ITEM 12. SNOW EMERGENCY PARKING FEE CHANGE - ORDINANCE AMENDING TITLE 3, "FINANCES, TAXATION, AND FEES", CHAPTER 4, "SCHEDULE OF FEES, RATES, CHARGES, BONDS, FINES, AND PENALTIES", SECTION 8, "PARKING VIOLATIONS", TO ADD A $50 PENALTY FOR SNOW EMERGENCY PARKING VIOLATION. (FIRST CONSIDERATION) Comment: This ordinance will amend the fine for violation of the snow emergency parking ordinance from $15.00 to $50.00. On November 7, 2009 a separate higher fine amount for this violation of parking where prohibited or restricted during a snow emergency was created. The $50.00 fine was set at that time. However, the fine was inadvertently removed from the fee structure in 2013, leaving a default fine of $15. This amendment will reestablish the earlier approved fee and assist in the effort to encourage better compliance with the parking regulations during a snow emergency so snow and ice can be removed efficiently and promptly from City streets. (SECOND CONSIDERATION) Comment: At the August 18 work session, staff discussed proposed changes to the Housing Code as part of the City's ongoing efforts to stabilize neighborhoods. As directed by Council, this ordinance amends the Code in the following ways: a) prohibits storing and use of furniture on roofs and other surfaces above 30 inches without guard rails; b) establishes standards for treatment of exterior surfaces of buildings, fences, and retaining walls; c) requires areas beneath decks and porches in Historic and Conservation Districts to be screened; d) requires screening of dumpsters on existing multi -family sites; and d) limits the storage of landscaping and construction material to areas not visible from the street. Additionally, this ordinance requires GFCI protected outlets and carbon monoxide detectors in all dwelling units. Note that the Housing Code applies to owner -occupied and rental housing. DEPARTMENT Comment: The prior agenda item is an ordinance amending the false alarm provisions for burglar and intrusion alarms. Resolution No. 06-365 established a fee for police department services, and it does not grant the Police Chief any discretion in assessing fees even if the cause of the false alarm is, for example, weather related. The proposed fee schedule grants the Police Chief limited discretion in waiving a false alarm fee. Under the current and proposed schedule, there is no fee assessed for the first four false alarms in a calendar year. The current fee is $30 for the 5th false alarm in one calendar year and increases gradually until the 8th or subsequent false alarm, which remains at $50. The proposed fee is $60 for the 5th and subsequent false alarms in one calendar year. It generally takes staff approximately two hours to address a false alarm, which is why $60 is being proposed.
