COMPLETE DESCRIPTION OF COUNCIL ACTIVITIES
OCTOBER 20, 2015
Iowa City City Council regular meeting, 7:00 p.m. at City Hall. Mayor Hayek
presiding. Council Members present: Dickens, Dobyns, Hayek, Mims, Payne,
Throgmorton. Absent: Botchway. Staff members present: Markus, Fruin, Dilkes, Karr,
Yapp, Kelsey, Andrew, Korpel , Boothroy, Hargadine, Grier, Ralston, Walz, Knoche,
Rummel, Hightshoe, Scott, Laverman.
Police Chief Hargadine and Fire Chief Grier made special presentations of
recognition for a July 10th Garage Fire rescue. Certificates of Commendation were
presented to: Javeyel Jones, Marquelle Jones, and Jaztinique Jones. Life Saving
Awards were presented to Shift B Firefighters: Thomas Hartshorn; Ryan Haxmeier;
Mery Miller; Glenn Pauley; Timothy Recker; and Andrew Wulfekuhle.
Ryan Johnson and Andy Chihak, representing the Government Accounting Division
of Verizon, presented the Verizon Wireless Hopeline Champion Award to Police Chief
Hargadine and the Iowa City Police Department for their commitment to preventing
domestic violence, providing support to victims, and raising awareness and education
about the issue in the community as nominated by the Domestic Violence Intervention
Program. Verizon also presented a check to Kristie Fortmann-Doser, Executive
Director Domestic Violence Intervention Project. Johnson County Attorney Janet Lyness
also appeared.
The Mayor presented Student Leadership Awards to Shimek Elementary students:
Ella Hackathorn, Elliott Newbold, Olivia Tompkins.
The Mayor proclaimed National Disability Employment Awareness Month — October,
Human Rights Commissioner Harry Olmsted accepting; Change Your Clock, Change
Your Battery Day — November, Firefighter Wulfekuhle accepting; Rotary Month —
November, Rotary Club President Thais Winkelblack accepting.
Unless otherwise noted, all actions were affirmative and unanimous.

A public hearing was held on a resolution approving an amendment to the
Comprehensive Plan — to add a three block area bounded by Burlington Street, Iowa
Avenue, Gilbert Street, and Van Buren Street to the Downtown District Section of the
downtown and Riverfront Crossings Master Plan. Development Services Coordinator
Yapp presented a power point. Individual Council Members expressed their views. The
following individuals appeared: Justin Doyle, Blackbird Investments; Rev. Steen
Protzman, Minister Unitarian Universalist Society; Kirk Witzberger, Unitarian
Universalist Board. Moved by Payne, seconded by Dickens, to accept correspondence

Moved by Payne, seconded by Dickens, to adopt RES. 15-334, APPROVING AN
AMENDMENT TO THE COMPREHENSIVE PLAN TO ADD A THREE BLOCK AREA

COMPREHENSIVE PLAN, FOR PROPERTY GENERALLY LOCATED WITHIN THE
IOWA CITY GROWTH AREA, SOUTH OF HIGHWAY SIX AND EAST OF THE IOWA
RIVER. Individual Council Members expressed their views.
Moved by Payne, seconded by Dickens, that ORD. 15-4645, CONDITIONALLY
REZONING APPROXIMATELY 18.66 ACRES OF PROPERTY LOCATED SOUTH OF
HERBERT HOOVER HIGHWAY, FROM COUNTY MULTIFAMILY RESIDENTIAL

PRELIMINARY PLAT FOR CHURCHHILL MEADOWS - PARTS TWO AND THREE,
IOWA CITY, IOWA. Development Services Coordinator Yapp presented a power point.
Duane Musser, MMS Consultants, representing the applicant, appeared.
A public hearing was held on a resolution approving plans, specifications, form of
contract, and estimate of cost for the construction of the 2015 Sanitary Sewer
Rehabilitation Project, establishing amount of bid security to accompany each bid,
directing City Clerk to publish notice to bidders, and fixing time and place for receipt of
bids. No one appeared.
Moved by Dobyns, seconded by Payne, to adopt RES. 15-337, APPROVING PLANS,
SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE
CONSTRUCTION OF THE 2015 SANITARY SEWER REHABILITATION PROJECT,
ESTABLISHING AMOUNT OF BID SECURITY TO ACCOMPANY EACH BID,
DIRECTING CITY CLERK TO PUBLISH NOTICE TO BIDDERS, AND FIXING TIME
AND PLACE FOR RECEIPT OF BIDS.
A public hearing was held on a resolution authorizing conveyance of a single family
home located at 606 North Gilbert Street. No one appeared.

CONVEYANCE OF A SINGLE FAMILY HOME LOCATED AT 606 NORTH GILBERT

A public hearing was held on a resolution approving plans, specifications, form of
contract, and estimate of cost for the Mercer Park Playground Replacement Project.

PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR
THE MERCER PARK PLAYGROUND REPLACEMENT PROJECT. DIRECTING CITY
CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY
ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION.
Moved by Mims, seconded by Throgmorton, to adopt RES. 15-340, AUTHORIZING
THE MAYOR TO SIGN AND THE CLERK TO ATTEST TO AN AGREEMENT TO
GRANT $600,000 TO DEVELOP MIXED INCOME SENIOR HOUSING AT 1030-1070
WILLIAM STREET. Neighborhood Services Coordinator Hightshoe present for
discussion.
Moved by Payne, seconded by Dickens, that ordinance amending Title 3, "Finances,
Taxation, and Fees", Chapter 4, "Schedule of Fees, Rates, Charges, Bonds, Fines, and
Penalties", Section 8, "Parking Violations", to add a $50 penalty for snow emergency
parking violation, be given first vote.
Moved by Mims, seconded by Payne, that the second consideration and vote be
waived on the ordinance amending Title 17, entitled 'Building and Housing," Chapter 5,
entitled "Housing Code," to support Neighborhood Stabilization by prohibiting furniture
on roofs, adding standards for exterior building and fence surfaces, requiring screening
of dumpsters on multi -family dwellings and under certain decks/porches, limiting the
storage of landscaping/construction material, and requiring GFCI protected outlets and

Individual Council Members expressed their views. After discussion original motion
withdrawn to allow staff time to respond to the concerns raised by Ms. Baum prior to
passage of the ordinance. Moved by Mims, seconded by Payne, that the ordinance be
given second vote. Moved by Payne, seconded by Throgmorton, to accept
correspondence from Ms. Baum.
Moved by Mims, seconded by Payne, that the rule requiring ordinances to be
considered and voted on for final passage at two Council meetings prior to the meeting
at which it is to be finally passed be suspended, the second consideration and vote be
waived, and that ORD. 15-4646, AMENDING TITLE 8, ENTITLED "POLICE
REGULATIONS," CHAPTER 2, ENTITLED "ALARM SYSTEMS," TO UPDATE THE
PROVISIONS REGARDING ALARM SYSTEMS, be voted on for final passage at this
time. Moved by Mims, seconded by Payne, that the ordinance be finally adopted at this
time.

FEES FOR POLICE DEPARTMENT SERVICES AND RESCINDING RESOLUTION

Moved by Mims, seconded by Payne, to appoint Julie Bockenstedt, 3437 Hampton, to
the Airport Commission for an unexpired four-year term effective upon appointment -
March 1, 2017.
The Mayor noted that no applications were received for the following Boards and
Commissions and all will be readvertised: Airport Zoning Brd. of Adjustment for a five-
year term January 1, 2014 - December 31, 2018. (Formerly advertised; Full term);
Appeals, Board of, for one vacancy to fill an unexpired five-year term January 1, 2014 -
December 31, 2018. For a HVAC or building design professional or qualified by
experience and training. (Unexpired term); Historic Preservation Commission for a
Jefferson St. representative to fill three-year terms, March 29, 2013 - March 29, 2016.
(New District formed). Applicants MUST reside in Iowa City and be 18 years of age
unless specific qualifications are stated. [Staff will not publish additional notices after a
period of six publications; but will continue to advertise vacancies with postings and on
the Council agenda. However, no additional publication costs will be incurred.]
The Mayor noted the previously announced vacancies for Boards and Commissions:
Airport Zoning Brd of Adjustment for a five-year term January 1, 2016 - December 31,
2021; Appeals, Board of, for a five-year term January 1, 2016 - December 31, 2020. For
a Licensed Electrician or qualified by experience and training; Human Rights Commission
for three vacancies to fill three-year terms, January 1, 2016 - January 1, 2019; Parks and
Recreation Commission for two vacancies to fill four-year terms, January 1, 2016 -
January 1, 2020; Public Art Advisory Committee for a three-year term, January 1, 2016 -
January 1, 2019; Senior Center Commission, for three vacancies to fill three-year terms (2
Council appointments and 1 County appointment) January 1, 2016 - December 31, 2019.
Applications must be received by 5:00 p.m., Wednesday, November 4, 2015.
Council Member Throgmorton noted Election Day November 3 and a number of
upcoming candidate forums.
Council Member Payne reiterated earlier remarks encouraging the community to
check out the city website for information, including vacancies on City Boards and
Commissions.
Council Member Dobyns noted West High student Eric Smith who was attending the
Council meeting for extra credit for his Government class.

Mayor Hayek and Mayor Pro tem Mims reported on a meeting with a group of
Venezuelan officials through a State Department program.
City Manager Markus introduced two visiting Fellows Soytavanh Mienmany form
Vientiane, Laos; and Margaretta Christita from Sulawesi Utara, Indonesia who will be
here for two and half weeks. Mayor Hayek thanked City Manager Markus and his wife
for hosting the two Fellows.

QUESTIONS FROM COUNCIL REGARDING AGENDA ITEMS
1. (Consent Calendar Item 4f(4) — PIN Grant) - Council Member Throgmorton thanked
staff for their response.
2. (Agenda Item 9 — SSMID) - Mayor Hayek stated that he and Council Member
Dickens would not be voting on SSMID motion setting a hearing and Mayor Pro tem
Mims will be presiding.
3. (Agenda Item 12 — Housing Code) — Council Members Botchway and Throgmorton
raised question about changes in the ordinance since the August presentation. Sr.
Housing Inspection Laverman and Neighborhood Service Coordinator Hightshoe
responded to questions noting the ordinance reflected the changes discussed in
August.
4. (Agenda Item 14 — Tasting Events) — In response to Council Member Botchway, City
Attorney Dilkes stated the ordinance clarifies events such as the recent Oktoberfest.
5. (Agenda Item 8 - Debt Management Policy) — In response to Council Member
Throgmorton, Finance Director Bockenstedt stated that he will have a presentation at
the formal meeting.
6. (Consent Calendar Item 4d(3) — Appointment Process for City Boards and
Commissions) — Council Member Throgmorton questioned wording in ordinance
(Sec.A2) regarding current members of Boards and Commissions. City Attorney
Dilkes said she would review.
DISCUSS JOHNSON COUNTY MINIMUM WAGE ORDINANCE fIP 3 and 4 Info Packet of
10/1
Council discussed the two City Attorney memos and City Attorney Dilkes provided a synopsis.
After discussion a majority agreed to do nothing to stop the ordinance from taking effect in the
City for the first increase on November 1 but discussed the need to analyze the impact of the
ordinance within the City and to include nonprofits in the process. The possibility of a task force
was discussed.

Dobyns, Asst. City Mgr. Fruin stated the fundraising committee was being assembled
and led by the Iowa City Downtown District.
2. (1 P4 — Memo ... Park Trails in winter) Council Member Dobyns noted Park &
Recreation Director Moran's last memo and stated the amount of trails not being de -
snowed was minimal.

Botchway thanked the City Attorney for her detail and analysis.

Member Payne thanked Executive Director MPO Ralston and Special Project
Administrator Clow for the clarification regarding speed limit change south of Foster
Road.
3. (IP 14 — Memo ... City Council Listening Post) Council Member Throgmorton stated
listening posts should be held in parts of the community that do not feel connected
and questioned Java House rather than Pheasant Ridge for the next site. Individual
Council Members expressed their views, and agreed to retain the present Java
House location and directed staff to contact Pheasant Ridge directly to post a notice;
and asked for input on future sites from diversity staff roundtable.
4. (IP 7- Information from Council Member Botchway ..... Know Your Rights Street
Harassment and the Law) After discussion staff was directed to research the matter
locally and report back.
COUNCIL TIME / MEETING SCHEDULE

organized by the City of Literature.

2. City Manager Markus encouraged Council to read "Just Mercy" by Brian Stevenson
regarding our justice system and how it is relevant to what is going on in our country
right now.
3. City Manager Markus noted the late addition Item 4d(18) regarding the lease with ICAD,
and stated a conflict of interest was brought up by a community member on the City
Manager signing the lease as a member of the ICAD Board, and reported the lease
would be signed by the Mayor.

Moved by Payne, seconded by Botchway, that the ordinance rezoning ordinance
conditionally rezoning approximately 18.66 acres of property located south of Herbert
Hoover Highway, from County MultiFamily Residential (RMF) to 16.75 acres Low
Density Single Family (RS5) and 1.91 acres Low Density MultiFamily (RM -12) (REZ15-
00014 / ANN15-00001), be given second vote. The Mayor requested Council Members
disclose any ex parte communications and none were reported.
Moved by Mims, seconded by Botchway, that the rule requiring ordinances to be
considered and voted on for final passage at two Council meetings prior to the meeting
at which it is to be finally passed be suspended, the second consideration and vote be
waived, and that ORD. 15-4643, REZONING APPROXIMATELY 1.45 ACRES OF
PROPERTY FROM COMMUNITY COMMERCIAL (CC -2) TO RIVERFRONT
CROSSINGS - WEST RIVERFRONT (RFC -WR) ZONE LOCATED AT THE
NORTHWEST CORNER OF BENTON STREET AND RIVERSIDE DRIVE (Kum & Go

A public hearing was held on a resolution authorizing conveyance of a single family

DEBT MANAGEMENT POLICY FOR THE CITY OF IOWA CITY. Finance Director

Mayor Hayek and Council Member Dickens stated they would be abstaining due to a
conflict of interest. Mayor Pro tem Mims now presiding Moved by Botchway, seconded
by Payne, to set a public hearing for November 10, 2015, on an ordinance to re-establish
the Iowa City Downtown Self -Supported Municipal Improvement District for a period of
ten years in accordance with Iowa Code Chapter 386. Individual Council Members

INSTALLATION OF SPEED HUMPS ON SANDUSKY DRIVE, BETWEEN KEOKUK
AND BROADWAY STREETS.

THE INSTALLATION OF SPEED HUMPS ON WESTBURY DRIVE, BETWEEN
GLASTONBURY STREET AND WESTBURY COURT.

"Building and Housing," Chapter 5, entitled "Housing Code," to support neighborhood
stabilization by prohibiting furniture on roofs, adding standards for exterior building and
fence surfaces, requiring screening of dumpsters on multi -family dwellings and under
certain decks/porches, limiting the storage of landscaping/construction material, and
requiring GFCI protected outlets and carbon monoxide detectors, be given first vote.

Councilmember Throgmorton reported on his ride on the Towncrest bus with Mary

Councilmember Dickens thanked Doug Alberhasky and all the volunteers for the
Brewfest event the previous week -end; and acknowledged the Chicago Cubs baseball
"fantasy" game Wednesday evening.
Council Member Payne encouraged people to visit the City's website for a list of
Boards and Commission vacancies, and apply for an open position.
Council Member Dobyns stated that the City's Gateway Project should not interfere
with the grand opening of the new Hancher building next year.
City Manager reported on the current search for Park Director and Water
Superintendent and the succession plan progress that has been made.
