Pursuant to Chapter 386 of the Code of Iowa, herein "Act", a Petition has been filed with the City Council requesting that the City establish a Self -Supported Municipal Improvement District (SSMID) as contemplated by Chapter 386 of the Code. This Petition requests that the current Self -Supported Municipal Improvement District established by ordinance of the City Council in 2011 be extended for a period of ten (10) years with an expanded area and sets forth maximum rates of tax to be imposed and levied on property within the District. The name of the proposed District shall be the 'Iowa City Downtown Self -Supported Municipal Improvement District". It is also known as the Iowa City Downtown District. The proposed levy is in addition to all other taxes and will be distributed to the operation fund established by the SSMID ordinance. KARR, CITY CLERK � r ,1pmftmath CITY OF IOWA CITY MEMORANDUM Date: November 4, 2015 To: Tom Markus, City Manager From: Geoff Fruin, Assistant City Manager Re: Council Items Related to ImOn Communications Over the last couple of years, a few telecommunication companies have evaluated the Iowa City market and considered buildout of private fiber to the premise infrastructure. Such infrastructure would be geared to serve businesses and homes with cable, phone, television and internet services. Staff has been receptive to working with prospective companies as we routinely field complaints related to the services and pricing of incumbent providers. Concerns with current service offerings have also been illustrated in community surveys, including the most recent community survey conducted by the Telecommunication Commission. Over the past year, staff has worked with ImOn Communications as they have conducted extensive market research and engineering analysis of our market. ImOn is based in Cedar Rapids, Iowa and serves that community and the surrounding suburbs with cable, television, phone and internet services. After conducting their review of our market, ImOn has decided to pursue buildout of their infrastructure over the next several years. During ImOn's due diligence phase, we explored several cooperative efforts, including shared facility arrangements that maximize use of limited right-of-way. Two such cooperative efforts were identified and are ready for presentation to the City Council. First, staff is recommending that we lease ImOn 120 square feet of our Tower Place (6 S. Linn Street) data center (Unit 1 H) for a private communication hub. This 120 square feet is currently unused by the City and not anticipated to be needed in the foreseeable future. By leasing this space to ImOn, the City can earn additional revenue of $1951 per year. The contemplated arrangements pose no security threat and eliminate the need for a private utility hub in the downtown Iowa City area where right-of-way is extremely limited. Second, staff is recommending that we lease ImOn excess capacity in our City owned fiber optic network. The City's fiber optic network occupies right-of-way throughout the community and serves various public buildings and other municipal functions such as traffic signals. In some cases the City has excess duct and/or fiber capacity. In these cases it makes sense for the City to lease this excess capacity instead of having ImOn build separate infrastructure in the right-of-way, which would limit future public and private utility needs in the limited right-of-way. In order to lease the excess capacity, the City has negotiated a shared use master agreement with ImOn. The scope of services agreements, which are part of the master agreement, spell out a cost for each location that the City currently proposes to lease to ImOn. Lease rates were determined by the actual construction buildout costs of those facilities with reasonable administrative fees added to account for planning, engineering and other soft costs associated with the management of our fiber network. Staff feels that the proposed shared facility arrangements make efficient use of right -of -row and provide new revenue to the City. We have no concerns about limitations to future needs of the City as the leases only utilize excess capacity beyond our most aggressive growth projections. A third item appears on the City Council agenda. This is a standard license agreement that permits ImOn to install and maintain a fiber optic network within City right-of-way and provides 7 N November 4, 2015 Page 2 for future expansion of said network within the right-of-way. The City requires such license agreements of all entities that wish to place fiber optic networks within our right-of-way. I believe that the three items will allow ImOn to begin their build -out of our market in a responsible and efficient manner. The presence of a new utility company should improve service offerings from all providers and also place a downward pressure on the price consumers are paying for these utilities. ImOn will be a welcome addition to our community and I recommend that the City Council approve the three resolutions on the November 10th agenda. Finally, I'd like to acknowledge the staff contributions from the Legal, Finance and Public Works Departments. Working with a new utility company entering the market poses several challenges, particularly when managing limited right-of-way. The actions being considered by the City Council are the result of creative thinking that I believe will yield significant long-term benefits to the community.
