Resolutions and Motions: ITEM 2c(1) HAZARD MITIGATION GRANT PROGRAM APPLICATION PROCESS - RESOLUTION APPROVING THE HAZARD MITIGATION GRANT PROGRAM (HMGP) ADMINISTRATIVE PLAN FOR PROJECT DR4187. Comment: Resolution No. 15-269 authorized the City Manager to apply for Hazard Mitigation Grant Program ("HMGP") funding to buy approximately six homes in the 100 -year flood plains of the Iowa River and Ralston Creek and to sign the grant agreement. The HMGP requires City Council to approve an administrative plan governing the acquisition and demolition process. The proposed plan, which has been approved by the State (the State is administering the federal funds), is attached to the resolution. November 30, 2015 City of Iowa City Page 2 ITEM 2c(2) ASHTON HOUSE PROJECT - RESOLUTION ACCEPTING THE WORK FOR THE ASHTON HOUSE RAMP AND SIDEWALK PROJECT. /5--36,42 Comment: On December 3, 2013 a contract was entered into with Iowa State Contractors of Ottumwa, Iowa, to construct a ramp and sidewalk at the Ned Ashton House located at 820 Park Road. The final contract amount is $147,621.97. A list of change orders incurred with the project is included with the resolution. All the work covered by the contract has been complete and is ready to be accepted by the City. ITEM 2c(3) WINTER EMERGENCY HOMELESS SHELTER - RESOLUTION AUTHORIZING FINANCIAL SUPPORT OF THE JOHNSON COUNTY LOCAL HOMELESS COORDINATING BOARD'S WINTER EMERGENCY TEMPORARY SHELTER PROJECT. /5 3 7 Comment: This resolution authorizes the City Manager to contribute $20,000 on a winter emergency temporary shelter for homeless individuals. If further authorizes the City Manager to expend up to an additional $10,000 if such contribution is needed to sustain operations through the proposed thirteen week period. Similar requests are being made to other local private and public entities. ITEM 2c(4) PURCHASE LANDFILL EQUIPMENT - RESOLUTION AUTHORIZING THE PROCUREMENT OF ONE (1) LANDFILL TRASH COMPACTOR AND ONE (1) LANDFILL TRACK TYPE TRACTOR i's -,34"? Comment: This resolution will approve the procurement of a new Caterpillar trash compactor and Caterpillar track type tractor for the Landfill Operations. The procurement is in accordance with the National Intergovernmental Purchasing Alliance (National IPA) contract #120377. The total purchase will be $1,180,871.00, which exceeds the $150,000.00 spending authority of the City Manager, and so requires Council approval. Funds for purchase of both the compactor and track type tractor are available in account # 81710520 and #75750121. ITEM 2d Setting Public Hearings: ITEM 2d(1) UNIVERCITY SALE, 628 NORTH JOHNSON - RESOLUTION SETTING PUBLIC HEARING FOR DECEMBER 15, 2015, ON A PROPOSAL TO CONVEY A SINGLE FAMILY HOME LOCATED AT 628 NORTH JOHNSON STREET. Comment: In the UniverCity Neighborhood Partnership Program, the City purchases rental units located in designated neighborhoods surrounding the University, rehabilitates them, and then sells them to income -eligible buyers. Under the UniverCity Neighborhood Partnership Program, the City proposes to sell 628 North Johnson Street. The amount of the sale will be $179,900 (this is what the City paid to purchase the home) plus the "carrying costs," which are which are all costs incurred by the City to acquire the home, maintain it and sell it, including abstracting and recording fees, interest on the loan to purchase the home, mowing and snow removal, utilities, real estate taxes, and any costs in excess of $50,000 to repair and rehabilitate the home. November 30, 2015 City of Iowa City Page 3 ITEM 2d(2) U IOWA CITY GATEWAY PROJECT — RESOLUTION SETTING A PUBLIC HEARING ON DECEMBER 15, 2015 ON PLANS, SPECIFICATIONS, FORM OF CONTRACT, AND ESTIMATE OF COST FOR THE CONSTRUCTION OF THE IOWA CITY GATEWAY PROJECT, DIRECTING CITY CLERK TO PUBLISH NOTICE OF SAID HEARING, AND DIRECTING THE CITY ENGINEER TO PLACE SAID PLANS ON FILE FOR PUBLIC INSPECTION. Comment: This project includes the elevation of Dubuque Street and the reconstruction of the Park Road Bridge over the Iowa River. The project will include roadway, intersection and utility improvements, new sidewalk, and a combined trunk sanitary sewer. The estimated cost of the project is $52,000,000.00. The project will be funded with Surface Transportation Program funds, THUD appropriation funds, Local Option Sales Tax Revenue and General Obligation bond proceeds. ITEM 2d(3) REMNANT RIGHT OF WAY VACATION - MOTION SETTING A HEARING FOR DECEMBER 15 FOR A VACATION OF APPROXIMATELY 390 SQUARE FEET OF RIGHT OF WAY RUNNING NORTH -SOUTH BETWEEN 124 BENTON ST AND 731 RIVERSIDE DRIVE (VAC15-00006). Comment: At its November 19 meeting, by a vote of 6-0 (Parsons absent) the Planning and Zoning Commission recommended approval of this right of way vacation. This remnant right of way was discovered during evaluation of the Kum and Go project at the corner of Benton St and Riverside Dr; the right of way is not used for pedestrian or vehicular circulation. Action:, ldG / /if k S November 30, 2015 City of Iowa City Page 4 ITEM 3. i5-371 CHAUNCEY AGREEMENT - RESOLUTION OF INTENT TO CONSIDER AN AMENDMENT TO AN AGREEMENT FOR PRIVATE REDEVELOPMENT, INCLUDING THE TRANSFER OF LAND, BY AND BETWEEN THE CITY OF IOWA CITY, IOWA, AND THE CHAUNCEY, L.L.C. AND SETTING A PUBLIC HEARING FOR DECEMBER 15 AND PROVIDING FOR PUBLICATION OF NOTICE THEREOF. Comment: The Developer's Agreement with The Chauncey for redevelopment of the City -owned property located at the northeast corner of College and Gilbert Streets contains many time -sensitive deadlines that must be met before the City and the Developer can close on the sale of the property. This property is the subject of two lawsuits currently pending on appeal: Iowa Coalition Against the Shadow vs. City and Cole, Case No. CVCV075599, and Trinity Episcopal Church vs. City, Case No. CVCV077386. Due to the on-going litigation, the Developer has been unable to make progress toward satisfaction of the contingencies. The proposed amendment extends the various deadlines based upon the final resolution of the Trinity lawsuit, be it by a cou ruling on the merits or by voluntary dismissal with prejudice by the plaintiffs.
