Comment: This portion of Hummingbird Lane, lying south of Lower West

City during a subdivision process. The owner has provided a deed to the
City, and by approving this resolution, it will become public right-of-way.
Staff recommends accepting this dedication.

Comment: Staff recommends purchasing 1109 5th Ave. for $73,000. The
owner is in default on the mortgage, and the UICCU intends to proceed
with foreclosure. The City has a $30,000 junior lien because it loaned the
owner money to purchase the home. If the lender forecloses, the City's lien
will be extinguished. By purchasing the home, staff believes it can recover
some of the of the City's funding.

Comment: This resolution approves the proposed Lease Amendment No.
1 to extend the short-term lease for the ground floor commercial space in
the Library through February 29, 2016 in order to accommodate the
University of Iowa, who will continue to occupy the basement commercial
space until that time. A long-term lease for both spaces, commencing on
March 1, 2016, is set for Council consideration later on this agenda.

Comment: Since 2011 the City has contracted lobbying services with

from their services and staff wishes to enter another contract for 2016. No
significant changes to the previous contract are proposed and the fee
schedule remains unchanged.

and must commit funds to eligible projects. The FY16 Annual Action Plan
Amendment #2 proposes to allocate $699,998 in CDBG funds for three housing
projects. Prelude Behavioral Services withdrew their application from
consideration and it was removed from the proposed Amendment. This
amendment was approved unanimously by the Housing and Community
Development Commission (HCDC).

THE CITY MANAGER TO REQUEST AN EVALUATION OF THE MY
BROTHER'S KEEPER PROGRAM FROM THE CITY MANAGER'S
ROUNDTABLE
Comment: The MBK program urges communities to develop education
policies and workforce preparation programs targeting young males of
color. This resolution directs the City Manager to work with City
Manager's Roundtable participants to evaluate the program and reach a
consensus as to whether the City should participate.
ITEM 4d(10) POLICE TENTATIVE AGREEMENT - MOTION TO APPROVE A
TENTATIVE AGREEMENT BETWEEN THE CITY OF IOWA CITY AND
POLICE LABOR RELATIONS ORGANIZATION OF IOWA CITY.
Comment: This is a three-year agreement for Fiscal Years 2017, 2018,
and 2019 which provides for an across the board wage increase of 2.4%
at the beginning of FY2017, an across the board wage increase of 2.4%
at the beginning of FY2018, and an across the board wage increase of
2.6% at the beginning of FY2019. The agreement also provides for
changes to health insurance mirroring negotiated changes with the
AFSCME bargaining unit in FY2017 and FY2018 with additional
increases to employee contribution, deductible and out of pocket
maximum amounts in FY2019.

CEDAR RAPIDS, IOWA TO PROVIDE ENGINEERING CONSULTANT
SERVICES FOR THE 4 -LANE TO 3 -LANE STREET CONVERSIONS -
FIRST AVENUE (U.S. HIGHWAY 6 TO MALL DRIVE) AND MORMON
TREK BOULEVARD (U.S. HIGHWAY 1 TO MELROSE AVENUE)
PROJECT.
Comment: This agreement authorizes Snyder and Associates, Inc. to
provide design engineering services related to the 4 -lane to 3 -lane Street
Conversions — First Avenue (U.S. Highway 6 to Mall Drive) and Mormon
Trek Boulevard (U.S. Highway 1 to Melrose Avenue) Project. The project
generally includes 4 -lane to 3 -lane conversions on First Avenue and
Mormon Trek Boulevard, traffic signal replacement at three intersections
along Mormon Trek Boulevard, replacement of non -ADA compliant
sidewalk ramps, incorporation of on -street bike accommodations and the
addition of a right -turn lane on Mormon Trek Boulevard at Benton Street.
The total cost of the engineering services is $172,990 and will be funded
by General Obligation bonds.
SLOTHOWER ROAD / IWV ROAD WATER MAIN CONTRACT
AMENDMENT — RESOLUTION APPROVING, AUTHORIZING AND
DIRECTING THE MAYOR TO EXECUTE AND THE CITY CLERK TO
ATTEST AMENDMENT NUMBER 1 TO THE JUNE 17, 2014
AGREEMENT BY AND BETWEEN THE CITY OF IOWA CITY AND
MCCLURE ENGINEERING COMPANY TO PROVIDE ENGINEERING
CONSULTANT SERVICES FOR THE SLOTHOWER ROAD / IWV
ROAD WATER MAIN PROJECT.
Comment: This amendment authorizes McClure Engineering Company to
provide additional engineering services and project design modifications,
including a geotechnical study, tree removal plan and revisions to
construction documents. The amendment cost is $7,687.50 and will be
funded with Water revenues. Amendment #1 will bring the total
consultant services fees to $60,087.50. Construction cost for the
Slothower Road Water Main project is approximately $375,000.
IOWA CITY INTERIM MUNICIPAL DESIGN STANDARDS AND
CONSTRUCTION SPECIFICATIONS - RESOLUTION REVISING AND
ADOPTING THE IOWA CITY INTERIM MUNICIPAL DESIGN
STANDARDS PART 7 (WATER DISTRIBUTION SYSTEM) AND
CONSTRUCTION SPECIFICATIONS SECTION 02660 (WATER
DISTRIBUTION).
Comment: The Iowa City Interim Municipal Design Standards Part 7 -
Water Distribution System and Construction Specification Section 02660
Water Distribution have been revised to meet current standards and
regulations. These specifications are used for water main work within the
City.

BO JAMES CAFE PLANTER - RESOLUTION REVISING THE
SIDEWALK CAFE POLICY TO ALLOW FOR CONTINUED LIMITED
USE OF A PLANTER ON WASHINGTON STREET UNTIL THE
STREETSCAPE PROJECT BEGINS.
Comment: Under the Sidewalk Caf6 Policy, businesses may utilize
planters. Because of the cost to construct a caf6 in a planter, the business
is allowed to use the planter for 3 -years and the spaces are awarded by
lottery. BoJames has operated a cafe in the planter on Washington Street
for the last 3 years. In the spring of 2016, the planter will be permanently
removed as part of the streetscape project. BoJames has requested that it
be allowed to continue to operate the caf6 until the project begins. Staff
recommends amending the policy with respect to the 3 -year lottery process
to allow for this unique situation.

AUTHORIZING $7,908 IN FUNDING ASSISTANCE FOR LITTLE
VILLAGE MAGAZINE
Comment: Little Village magazine is relocating to an old office building in
the Riverfront Crossings area. The building owners and the business
have proposed a three way cost -share with the City for expenses to
upgrade energy efficiency and building aesthetics. The City Council
Economic Development Committee recommended approval of the
proposal at their meeting on December 1, 2015.

CREATIVE CORRIDOR FUNDING REQUEST - RESOLUTION
AUTHORIZING FUNDING OF $10,000 IN FY16, AND INTENT TO
BUDGET $10,000 IN FY17 AND FY18 FOR CREATIVE CORRIDOR
BRANDING EFFORT
Comment: The Creative Corridor branding is a regional effort led by the
Corridor Business Alliance. The Alliance includes a dozen municipal,
educational and quasi -governmental organizations that contribute to
these efforts to attract new employers and employees to the region.
Employers are attracted knowing the size of the greater area's workforce
in the "laborshed" that comes from the entire corridor, not just one
community. Potential employees need to know that the corridor is a place
they would find appealing to live. These branding efforts promote the
laborshed and the diversity of communities in which to live which helps to
meet both goals. The City Council Economic Development Committee
recommended approval of the proposal at their meeting on December 1,
2015.

Comment: This is a re -subdivision of Lot 4 and Lot 6 of Saddlebrook
Addition Part 2. Staff recommends approval of the final plat subject to
approval of legal papers and construction drawings by the City Attorney
and City Engineer. It is anticipated that legal papers and construction
drawings will be approved prior to the December 15 City Council
meeting. Approval will allow the development of Saddlebrook, Part 3, a 2 -
lot, 27.78 -acre residential subdivision on Shire Lane, west of Heinz Road
and South of Paddock Circle. The development includes four multi -family
buildings in accordance with a Planned Development Overlay zone
approved in February, 2015.

Comment: The Parks and Recreation Commission and staff review fees
and charges annually and increases are considered in order to support
the Department's operations. The Parks and Recreation Commission has
reviewed applicable fees and is recommending increases that are
articulated in the staff memo and fee chart.

ITEM 4e(1) CENTRAL BUSINESS SUPPORT (CB -5) CODE AMENDMENT —
MOTION SETTING A PUBLIC HEARING FOR JANUARY 5 ON AN
ORDINANCE AMENDING TITLE 14, ZONING CODE, SECTION 4B -4A-
7, TO ALLOW RESIDENTIAL USES ON THE GROUND -LEVEL FLOOR
IN THE CENTRAL BUSINESS SUPPORT (CB -5) ZONE IN THE AREA
BOUNDED BY GILBERT STREET, VAN BUREN STREET,
BURLINGTON STREET AND THE MID -BLOCK ALLEY SOUTH OF
JEFFERSON STREET, PROVIDED CERTAIN FORM -BASED ZONING
STANDARDS ARE MET.
Comment: At its December 3 meeting, by a vote of 7-0, the Planning and
Zoning Commission recommended approval of this zoning code
amendment. Approval will allow market demand to determine where
commercial space will be most successful by allowing urban residential
building types as an alternative to strictly requiring commercial uses on
the ground floor of mixed-use buildings in areas zoned CB -5 directly east
of the Central Business District. Form -based zoning standards will ensure
that buildings are appropriately scaled and designed to fit into an urban
setting in an area that transitions to lower -scale residential neighborhoods
in the Central Planning District further to the east.

Comment: At its December 3 meeting, by a vote of 6-1 (Eastham voting
no), the Planning and Zoning Commission recommended approval of this
rezoning subject to general conformance with massing and scale shown

Comment: The Developer's Agreement with The Chauncey for redevelopment of
the City -owned property located at the northeast corner of College and Gilbert
Streets contains many time -sensitive deadlines that must be met before the City

subject of two lawsuits currently pending on appeal: Iowa Coalition Against the
Shadow and Cole vs. City, Case No. CVCV075599, and Trinity Episcopal Church

Comment: In 2013, the City entered into a purchase agreement with Hieronymus AIL
Square Associates (k/n/a HSI, L.L.C.) for the City -owned parcel of undeveloped
land north of the Court Street Transportation Center. The developer intends to
develop the property as part of the site identified for the University of Iowa
Museum of Art, and, as such, administrative delays caused the contingency
deadline to pass without satisfaction of those contingencies. Thus, the 2013
purchase agreement is no longer in effect. HSI remains committed to this project,
however, and thus has submitted a new offer on this land. Because this property
is located within the city -University Project I Urban Renewal Area, the City sought
competing proposals. None were received, and therefore this resolution accepts
HSI's offer. The HSI offer contemplates a purchase price based upon an
appraisal obtained by the City and is contingent upon the City and HSI entering
into a developer's agreement and approval from the FTA.

Comment: The Human Rights Ordinance has been amended to align its
provisions with the federal Fair Housing Act (FHA). Because the Ordinance was
being updated, other provisions have also been amended to organize and clarify
the entire Ordinance. Substantive changes are: 1) Chapter 5 has been
incorporated into the general provisions of the Ordinance to avoid confusion
regarding applicable enforcement provisions, 2) the word 'citizen' has been
replaced with 'individual,' 3) the definition of 'person' has been updated; 4) the
definition 'housing accommodation' has been removed, as it served no present
purpose, and 5) the imperative 'shall' has been changed to 'may' in § 2-4-12 to
prevent the City from being forced to commence and maintain a civil suit that may
not be considered litigation worthy. The Human Rights Commission discussed this
at its October 201h meeting and recommends that the amendments be adopted.

Comment: Following a major overhaul of the taxicab ordinance last winter, it
was discovered that Section 5-2-6H of the City Code is contained verbatim in
Section 5-2-6F. Additionally, the U.S. Supreme Court issued an opinion in June
in City of Los Angeles v. Patel ruling that search warrants were required before
law enforcement could access hotel registrations. Currently the Code provides
that business offices are subject to inspection "upon notice," a requirement based
on the need for records during a police investigation. In practice, if the Police
Dept. had been denied voluntary access to an office, a warrant would have been
sought. With that said, Section 5-2-3B1 provides the taxicab business is subject
to inspection without notice, and it should be amended in light of the Supreme
Court case. This ordinance deletes both the duplicative provision andthe
