LANDFILL CONSULTING SERVICES RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND CITY CLERK TO ATTEST AN AMENDMENT TO THE NOVEMBER 12, 2013 AGREEMENT BETWEEN THE CITY OF IOWA CITY AND BARKER LEMAR ENGINEERING CONSULTANTS TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE IOWA CITY LANDFILL AND RECYCLING CENTER. Comment: This is the second amendment to the November 12, 2013 agreement between Iowa City and Barker Lemar Engineering Consultants, which authorizes Barker Lemar to provide services related to landfill gas and groundwater monitoring and reporting in addition to various landfill services to assist in maintaining compliance with federal and state regulations. The primary services in this amendment relate to the evaluation and expansion of our gas collection system. This includes plan updates, reporting, training of staff, and design services. The cost of additional engineering services will be billed on an hourly basis, not to exceed $281,000 and will be funded by landfill revenues. That portion of the Parkway was installed with the public improvements associated with Crossing Commons, Part One Subdivision located in Coralville. The improvements themselves were previously accepted and declared open for public access and use, however the City has not formally accepted ownership. In addition to the right-of-way dedication, a storm sewer and drainage easement is necessary. The developer is in the process of selling the lots, so it is appropriate for the City to accept the dedication of these improvements at this time. AND SETTING A PUBLIC HEARING ON SAID PROPOSAL FOR JANUARY 19, 2016. Comment: City Council is considering the vacation of this remnant piece of alley. Kum & Go would like to acquire this property and incorporate it into its redevelopment of the property located at the northwest corner of the Riverside Drive and Benton Street intersection. State law requires that the City be paid fair market value for these property rights. Kum & Go has offered to pay $13 per square foot (total of $5,070). Staff recommends approval of this offer. The project improvements will include street and sidewalk paving, traffic signals, pedestrian signals, water main, storm sewer, vault repairs, electrical lines, conduit, roadway and pedestrian lighting, site furnishings, irrigation, and plantings. The estimated construction cost is $5,125,000 (base bid). There are two Add Alternates with a total estimated cost of $150,000. Vault owners will be responsible for reimbursing the City for the cost of the vault repairs. The total estimated construction cost of the vault repairs that will be reimbursed by the vault owners is $382,000. The project will be funded with General Obligation bond proceeds. Approval will allow market demand to determine where commercial space will be most successful by allowing urban residential building types as an alternative to strictly requiring commercial uses on the ground floor of mixed-use buildings in areas zoned CB -5 directly east of the Central Business District. Form -based zoning standards will ensure that buildings are appropriately scaled and designed to fit into an urban setting in an area that transitions to lower -scale residential neighborhoods in the Central Planning District further to the east. This remnant right of way was discovered during evaluation of the Kum and Go project at the corner of Benton St and Riverside Dr; the right of way is not used for pedestrian or vehicular circulation. (SUB15-00023) Comment: At its October 15 meeting by a vote of 7-0 the Planning and Zoning Commission recommended approval of the preliminary plat. Approval will allow the development of a Cardinal Pointe West — Part One, a 31 -lot, 16.3 acre residential subdivision located south of Kennedy Parkway, west of Camp Cardinal Boulevard. Action:�i G 7 ITEM 6. APPEAL OF REVOCATION OF MOBILE VENDING PERMIT — APPEA� OF REVOCATION FOR PERMIT TO OPERATE A MOBILE VENDING- CART. Comment: On December 4, 2015, the City revoked the obile vending permit for Pop's Italian Beef. The City's mobile vending per ordinance requires that the vendor have all necessary permits issued by Johnson County Dept. of Public Health. After the Johnson County Dept. ubIic Health informed City staff that the food permit for Pop's Italian Bee ad been revoked, the City revoked the mobile vending permit. In accor nce with the City Code, the vendor has appealed this decision to t ity Council. The revocation letter, the vendor's appeal, and the letter i rming the vendor of the appeal hearing are included in Council packet.
