RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE A DEVELOPER'S AGREEMENT AND EASEMENT AGREEMENTS, AND ACCEPTING THE DEDICATION THEREOF, ASSOCIATED WITH THE FINAL PLANNED DEVELOPMENT OVERLAY (OPD) PLAN FOR PRAIRIE HILL, IOWA CITY, IOWA,. WHEREAS, the owner, Iowa City Co -Housing (ICCH), LLC, has filed an application for a final planned development overlay (OPD) plan for Prairie Hill development on the west side of Miller Avenue in Iowa City, Iowa, approval of which is done by administrative review; and WHEREAS, said planned development is located on the following -described real estate in Iowa City, Johnson County, Iowa, to wit: Lot 3 of Ruppert Hills Subdivision to Iowa City, IA, in accordance with the plat thereof recorded in Plat Book 46, at page 47, in the records of the Johnson County Recorder's Office, containing 7.88 acres and subject to easements and restrictions of record. WHEREAS, said OPD plan necessitates owner and City entering into a Developer's Agreement and easement agreements associated with Prairie Hill, to establish private street and open space maintenance obligations and ensure the provision of utilities and access to this development, which must be approved by Council before the OPD plan can be approved administratively; WHEREAS, the Department of Neighborhood and Development Services and the Public Works Department examined the proposed Developer's Agreement and easements, and recommend approval; and WHEREAS, the planned development has been made with the free consent and in accordance with the desires of the owners and proprietors. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF IOWA CITY, IOWA, THAT: 1. The Mayor and City Clerk of the City of Iowa City, Iowa, are hereby authorized and directed, upon approval by the City Attorney, to execute all legal documents relating to said final OPD plan for Prairie Hill, Iowa City, Iowa, and to certify a copy of this resolution. Washington St., Iowa City, IA 52240; (319) 356-5156 RESOLUTION NO. 16-2 RESOLUTION AUTHORIZING THE MAYOR TO SIGN AND CITY CLERK TO ATTEST AN AMENDMENT TO THE NOVEMBER 12, 2013 AGREEMENT BETWEEN THE CITY OF IOWA CITY AND BARKER LEMAR ENGINEERING CONSULTANTS TO PROVIDE ENGINEERING CONSULTANT SERVICES FOR THE IOWA CITY LANDFILL AND RECYLING CENTER WHEREAS, the City of Iowa City and Barker Lemar Engineering Consultants entered into a CONSULTANT AGREEMENT (AGREEMENT) on November 12, 2013, as a result of a competitive RFP process, whereby the CITY secured the services of the CONSULTANT to perform (a) Annual Landfill Volumetrics, (b) Annual Landfill Site Topographic Survey with Site Map Datum Conversion, (c) Annual Water Quality Report (AWQR), (d) Leachate Control System Performance Evaluation Report (LCSPER), (e) Methane Monitoring Report (MMR), (f) Title V Air Emissions Report and Permitting, (g) Hourly General Engineering Consulting, (h) Greenhouse Gas Reporting, and (i) Semi -Annual Water Quality Notification for the subject facility; and WHEREAS, the AGREEMENT was intended to cover CONSULTANT'S services as generally defined above for a defined period of three (3) calendar years, to include 2014, 2015, and 2016; and WHEREAS, the CITY had previously amended the scope of services in said AGREEMENT to add additional services required under the Iowa Administrative Code Section 567 Chapter 113 and under Title V of the 1990 Federal Clean Air Act Amendments via Iowa City Council Resolution 14-166; and WHEREAS, the City desires to further amend the scope of services in said AGREEMENT to address additional compliance items that arise requiring consulting and engineering services, including Evaluation of the Landfill Gas Wellfield, Design and Construction Administration Services for Expansion of the Landfill Gas Collection System, Training Services and updates to the Landfill Gas Collection and Control System Plan, Surface Emissions Monitoring Plan, Start-up, Shut -down and Malfunction Plan; and WHEREAS, an Amendment to the November 12, 2013 Agreement, as amended, for professional engineering services has been negotiated with and executed by Barker Lemar Engineering Consultants of West Des Moines, Iowa; and WHEREAS, funds for this amendment, not to exceed $281,000, will be paid from Landfill Operations; and WHEREAS, it would be in the best interest of the City of Iowa City to enter into said Amendment to the November 12, 2013 Agreement with Barker Lemar Engineering Consultants. NOW THEREFORE, it is agreed by and between the parties hereto that the AGREEMENT is hereby amended as follows: 1. SCOPE OF SERVICES The CONSULTANT agrees to perform the following additional services for the CITY, and to do so in a timely and satisfactory manner. A. Verifv and Potentially Amend Desion Cauacity Report Consultant will review the Iowa City Landfill's existing Design Capacity Report and determine if the report adequately documents the potential capacity of the facility based on the results of the Title V audit previously conducted. If any modification to the existing Design Capacity Report is deemed necessary, the noted changes will be submitted to the Iowa Department of Natural Resources (IDNR). It should be noted that during the 2014 audit, only the original Design Capacity Report was available for review, which did not match the design capacity noted in the Landfill Title V permit. However, in review of IDNR documents, an Amended Design Capacity Report dated February 17, 2012 was noted. Consultant proposes to review the Landfill's existing Design Capacity Report and determine if the report adequately documents the potential capacity of the facility as currently designed. B. Undate Landfill Gas Collectlon and Control System Design Plan Consultant will update the Landfill Gas Collection and Control System Design Plan (Design Plan). The existing Design Plan has not been updated since it was originally developed in November 1999. As noted in the audit finding, the Design Plan is outdated and needs to be updated to comply with general rule requirements as well as to reflect current operations, permitted airspace, facility design, and existing collection and control equipment. The updated Design Plan will include revised modelling of both the collection and control systems, as well as a revised calculation on the radius of influence of individual wells utilizing updated site design criteria. The wellfield design calculations will then be reworked utilizing this revised information. In addition, approved variance requests from the EPA database will be reviewed to determine applicability at the facility. Based on these revised calculations and research, an overall system plan will be developed, which will serve as a guidance document for system construction and operation going forward. C. Surface Emission Monitoring Plan Update Consultant will update the Surface Emission Monitoring Plan. As noted during the 2014 Title V audit, while the existing Surface Emission Monitoring Plan was approved by the IDNR, it does not comply with current NSPS and Title V regulations, and therefore should be updated. Consultant will review and evaluate the current plan and revise and update the plan to correspond with rule requirements. The updated plan will outline the required procedures currently not included in the existing plan, such as including a serpentine path developed for the Iowa City Landfill, which monitoring technicians will follow while conducting the required surface monitoring. Reporting forms will be speck to the Iowa City Landfill and provide meaningful direction with specific procedures for use by operations personnel. D. Start -Up Shut -Down and Malfunction Plan Update Consultant will update the Start -Up Shut -Down and Malfunction Plan. A Start-up, Shutdown, and Malfunction (SSM) Plan is required to establish procedures for recording start-up, shut- down, and malfunctions of the landfill gas collection and control system (GCCS) and documenting that the GCCS has remained in compliance with rule and permit requirements. The Iowa City Landfill's current SSM Plan was prepared only for the existing flare, not including any other equipment, and has not been updated. Consultant will review and evaluate the current SSM Plan and revise and update the SSM Plan to correspond with the current requirements and reporting, as well as incorporate existing equipment (such as the newly installed flare). Reporting forms will be specific to the Iowa City Landfill's operations so as to provide an accurate and meaningful plan with appropriate contingency procedures. E. Phase 11 Evaluation of LFG Wellfie/d Consultant will complete a Phase 11 Evaluation of the Landfill Gas (LFG) Wellfield. The findings of the Phase 1 Evaluation of the LFG system, the Greenhouse Gas (GHG) and Title V audits, and general discussions with Iowa City Landfill staff indicate that a Phase 11 Evaluation of the facility's GCCS would be beneficial prior to development of 2016 gas construction documents. The Phase II Evaluation will assist In determining the need for the following: well decommissioning, well abandonments, and application for variances from specific rule requirements for individual wells. Consultant will complete the evaluation prior to design development for the 2016 gas system expansion project. F. Develop and Perform Trainina for Landfill Staff Consultant will develop and perform training for Iowa City Landfill staff. Due to the complex nature of air regulations, training is important to ensure staff has an understanding of the rule requirements. Results of the initial weilfield balancing initiative and Phase I LFG evaluation completed in 2014, as well as follow-up discussions, have uncovered several areas where a lack of training and general understanding of the rule requirements is a central component to the compliance issues experienced at the facility. Thus, Consultant proposes to develop a site specific training program that will include the following: • General NSPS rules and regulations ("101" type training) • Wellfield monitoring (including monitoring requirements, regulatory timeframes, as well as implementation and tracking of corrective actions) • In -field welifield tuning and troubleshooting • Surface emission monitoring (including monitoring requirements, regulatory timeframes, as well as implementation and tracking of corrective actions) • Start-up, shut -down and malfunction plan (including associated forms and documentation) The annual training program developed will include both classroom style and in the field, hands-on training. Costs include a one-time development cost to adapt training into a form to be used for landfill operations and monitoring personnel. Following completion of development, annual training costs would be dependent on the needs of the facility. Two days of training are included in the estimated costs, with one day being classroom style training and the second day being hands-on training in the field. G. Development of GCCS Standard Operatina Procedures Consultant will develop GCCS Standard Operating Procedures formalizing communication and reporting responsibilities related to the GCCS. This document will outline the goals and objectives of the landfill gas collection system, the flare, landfill operations, and Title V monitoring, compliance and reporting requirements. This pre -planning document will then provide direction to operations personnel and assist with facilitating operations and maintenances needs with GCCS monitoring and compliance requirements. H. GCCS Annual Phaslna Plan Consultant will prepare an annual five year GCCS phasing plan to address integration of current and projected landfilling operations with GCCS operational issues and recommendations for system repairs, modifications, upgrades, etc. The annually updated plan will also be coordinated with any major landfill cell construction or GCCS system expansion construction scopes. The Iowa City Landfill and Consultant will discuss current fill sequencing plans and the GCCS sequencing plans will be incorporated into those drawings. L 2016 LFG Construction Related Services Consultant will perform services related to the 2016 LFG Construction Services as detailed below. Subtask l - GCCS Bid Documents Consultant proposes to prepare the bid documents for the anticipated 2016 LFG Construction Project, with general conformance with the following: • Prepare construction bid drawings to include contractor notes and additional information to assist the contractor in procuring materials and constructing the system. • Prepare project technical specifications as they pertain to the GCCS construction. Consultant will submit draft drawings and specifications to the Iowa City Landfill for review. A review meeting will also be set-up to go through the documents with Iowa City Landfill personnel. Following this meeting and receipt of comments, the drawings and specifications will be finalized, and Consultant will submit electronic copies of the drawings and specifications in Adobe Acrobat format for the City to use in the bid process. The final drawings and specifications will be prepared to a level of detail sufficient for an experienced, competent LFG construction contractor to construct the project. Subtask H — Construction Enaineerinst Assistance Consultant will provide technical and engineering assistance to the Iowa City Landfill in the following areas based on previous experience with the Client, during the bidding and construction process: • Bidding Services: o Participate in the pre-bid meeting and provide technical support during the facility tour. o Assist in the preparation of responses to contractors' request for additional information during the bidding process and provide to the landfill to incorporate into the official Client response. o Assist in evaluation of contractor bids and make recommendation to landfill staff. 0 Construction Engineering Services: o Attend the Pre -Construction Meeting with the selected contractor and Landfill personnel to go over the design intent and any aspects of the project that will require special attention. o Provide construction quality assurance (CQA) to document construction progress on a time and materials basis. o Work with Contractor and Landfill to address any field design changes that need to be made to accommodate unforeseen field conditions. o Attend construction progress meetings on a time and materials basis. o Be available during the construction period to address questions from the contractor or field personnel that may arise. o Prepare as -built construction documents. J. Resrulatory Coordination and Correspondence Consultant will, at the City request, prepare correspondence for submittal to state and federal regulatory agencies, such as requests to decommission wells, or for alternate procedures or alternate timelines for wellfield repairs or a required system expansion due to a monitoring issue. This may also include requests for operating variances and responses to requests for additional information such as that received in December from the EPA. Such requests would be at the request and direction of the City at the standard fee schedule rates included in the Agreement between the City and Consultant. il. Itemized pricing is subject to change without notice. 2 01-00-16 r 1 3d(2) =- CITY OF IOWA CITY MEMORANDUM Date: December 22, 2015 To: Tom Markus, City Manager From: Chris O'Brien, Director of Transportation and Resource Management Re: January 5, 2016 City Council Meeting Item Introduction: At the January 5, 2016 City Council meeting, consideration will be given to a resolution amending the agreement between the City of Iowa City and Barker Lemar Engineering Consultants for Landfill engineering services. History/background: In October of 2013, a Request for Proposal(RFP) was issued to engineering firms for landfill consulting services. Barker Lemar Engineering Consultants was determined to be the best choice based on a combination of cost and qualifications. An agreement with Barker Lemar to provide services for 2014 — 2016 at a cost of $117,486 was approved by City Council resolution #13-321. In June of 2014, an amendment to the agreement with Barker Lemar was approved by City Council. This amendment included services for calculation of our annual financial assurance obligation, greenhouse gas reporting, design of the project to replace the landfill gas flare and to assist with additional compliance and reporting obligations. This amendment was passed by City Council resolution 14-166 for a cost not to exceed $252,000. As a result of the original agreement and the first amendment, the Iowa City Landfill and Recycling Center has seen great improvement in training provided, performance of our gas collection system, response to issues that arise and overall operation efficiencies. At this time we require additional engineering services to address additional compliance items including evaluation of the landfill gas well field, design and construction administration services for expansion of the landfill gas collection system, training services and updates to several landfill operational plans. Discussion of Solution: Barker Lemar was selected as the Iowa City Landfill and Recycling Center engineering consultant through a competitive RFP process based on the hourly rates and qualifications of the firm. Since partnering with Barker Lemar on Landfill projects, their performance has been excellent and has resulted in several improvements in our operations. We believe that we are at a critical point in making improvements to our landfill gas collection system and operational plans and that amending the agreement to complete these projects with Barker Lemar as our engineering consultant will offer the most integrated, cost effective and efficient approach to this work. Financial Impact: The cost of additional engineering services will be billed on an hourly basis not to exceed $281,000 and at the same rates as the original contract amount with funds to be provided from landfill operations. History/Background: The Asphalt Resurfacing Project is a recurring maintenance project that concentrates on asphalt resurfacing and chipsealing at various street locations. Work on this project also includes repair of curb and gutter as needed and replacement of curb ramps to current ADA standards. Discussion of Solutions: As part of the project, a number of change orders were needed to address issues that arose during construction. Among these issues were changes necessary to accommodate actual utility materials, sizes and locations in the field, additional public utility repairs, a need for temporary pavement markings and charging of liquidated damages. In addition, as a result of the better than expected conditions observed in the field during construction, it was determined some of the sidewalk and street patching work was not needed. This resulted in reduced project quantities for these items, and lowered the actual project costs. Financial Impact: The project was awarded to L.L. Pelling Company of North Liberty, Iowa with a contract price of $799,910.75. Including project change orders and the reduction in project quantities, the final contract price is $701,646.36. Recommendation: Staff recommends acceptance of this project. History/Background: The Water Department repaired the water main on an emergency basis. However, the necessary storm sewer and pavement repairs were significant enough to be bid as a separate project. Plans and specifications were assembled by City staff and the project was bid through a competitive quote process. WITNESSETH: It is hereby agreed as follows: For the sum of $1.00 plus other valuable consideration, the receipt of which is hereby acknowledged, Owner hereby grants and conveys to the City an easement for the purposes of excavating for and the installation, replacement, maintenance and use of such storm water lines, pipes, mains, conduits, and overland drainageways as the City shall from time to time elect for conveying storm water, with all necessary appliances and fittings for the use in connection with said pipe lines, together with adequate protection therefor, and also a right of way, with the right of ingress and egress thereto, over and across the areas as shown on Exhibit A "Storm Sewer and Drainage Easement" hereafter described as the "Easement Area". Owner further grants to the City: 1. The right of grading said Easement Areas for the full width thereof, and to extend the cuts and fills for such grading into and onto said lands along and outside of the said Easement Areas, to such extent as the City may find reasonably necessary. 2. The right from time to time to trim, to cut down and clear away any and all trees and brush on said Easement Areas, and also to trim, cut down and clear away any trees on either side of said strip which now or hereafter in the opinion of the City may be a hazard to said Easement Areas or which may interfere with the exercise of the City's rights hereunder in any manner. e 3. The City shall promptly backfill any trench made by it, and repair any damages caused by the City within the Easement Areas. The City shall indemnify Owner against unreasonable loss or damage which may occur in the negligent exercise of the easement rights by the City. Except as expressly provided herein, the City shall have no responsibility for maintaining the Easement Areas. 4. Owner reserves the right to use said Easement Areas for purposes which will not interfere with the City's full enjoyment of the rights hereby granted; provided that the Owner shall not erect or construct any building, fence, retaining wall, or other structure, plant any trees, drill or operate any well, or construct any reservoir or other obstruction on said areas, or diminish or substantially add to the ground cover over said Easement Areas. Any improvements installed within the easement area, with or without the approval of the City, may be removed by the City without compensation or replacement. 5. Owner does hereby covenant with the City that it is lawfully seized and possessed of the real estate above described, and that they have a good and lawful right to convey it, or any part thereof. 6. Nothing in this Agreement shall be construed to impose a requirement on the City to install the original public improvement (s) at issue herein. Nor shall Owner be deemed acting as the City's agent during the original construction and installation of said improvement. 7. Parties agree that the obligation to install the public improvement(s) herein shall be in accordance with City specifications, and the obligation shall remain on Owner until completion by Owner, and until acceptance by the City, as provided by law. The provisions hereof shall inure to the benefit of and bind the successors and assigns of the respective parties hereto, and all covenants shall apply to and run with the land and with the title to the land. Additionally, numerous further studies including an urban tree assessment and multimodal traffic modeling have been undertaken to better inform the design of larger streetscape projects called for in the plan. The first major project stemming from the plan is the reconstruction of Washington Street, from Clinton to Linn. This corridor was identified as the highest priority due to poor underground utility conditions and aging above ground infrastructure including deteriorating sidewalk conditions. Driving this project is the need to replace the water main, which has failed twice in the last twenty years causing significant property damage and business disruption. Most recently, the water main broke in 2013 which resulted in numerous properties being flooded and required the street to be closed for several days. Discussion of Solutions: For the past two years, staff and the consultant team from Genus Landscape Architects (Des Moines, Iowa) have been developing plans for the reconstruction of Washington Street. There are a number of factors that make this project incredibly complex. Some of those complicating factors include, older underground utilities with multiple penetrations into each property, below sidewalk vaults of varying conditions, and competing streetscape elements (e.g. cafes, lighting, planting areas, bike parking, etc.) in limited right-of-way. After two years of study and multiple public meetings, staff has developed a plan for the full reconstruction of Washington Street from Clinton to Linn. At the January 19th public hearing, Genus Landscape Architects will give an overview of the plans. Some of the highlights include: • A shift from diagonal parking on one side of the street to parallel parking on both sides. This creates eight additional parking spaces over the two block area, provides flexibility with loading zone placement and allows for the expansion of sidewalk areas. • Travel lanes are reduced from 13 feet to 11.5 feet. Further reduction was explored but heavy usage by buses and delivery vehicles limited the ability to shrink lanes further. • Sidewalk space on the west block increases by 2 feet on both sides. On the east block sidewalk space increases by 4.5 feet on the north side and 12.5 feet on the south side. • Bike parking is increased by 12 spaces and the increase in vehicular parking creates an opportunity to explore converting automobile parking spaces to bicycle parklets if needed in the future. • The number of trees across the two blocks will increase from 33 to 40. Due to poor health condition or conflicts with underground vaults, 19 trees will be removed while 26 new trees will be planted. Removals were guided by the urban tree health assessment study that was completed in 2014. December 28, 2015 Page 2 • Planting areas have been expanded increasing site permeability from 3.5% to 5.0%. • Existing vaults are being repaired or sealed. Property owners are paying for 100% of repair costs, while the City and property owners are splitting the cost of new vault doors and water repellant membranes. • Public and private utility upgrades are planned, providing property owners the ability to plan for future needs, including potential broadband service and additional water lines for fire suppression or other building needs. • All cafes along the two block corridor are planned to be disconnected from the building. This creates a stronger retail environment by keeping pedestrians close to storefront windows, and eliminates the shifting pedestrian flow currently experienced on these sidewalks. • All crosswalks are being upgraded to current ADA standards with new curb ramps. Similarly, non-compliant sidewalk slopes are being brought into ADA compliance. Unfortunately, the nature of the project will cause disruption to the downtown community in 2016. The project includes full pavement removal and replacement from storefront to storefront. The City has had multiple construction phasing meetings with the downtown community and has attempted to develop a phasing plan that best serves the interest of the entire downtown district. The current plan allows for major work to begin on April 11, immediately after the Olympic Wrestling Trials are completed. It is expected that work will flow from Clinton to Linn (west to east) with the west block being closed from April 11 through July 23`d, and the east block being closed from July 23`d to September 30th. After the block reopens, the contractor will have another three weeks to complete final activities, such as landscaping. It is important to note that these are milestone dates and not strict periods of time. The contractor could move more quickly or delays could force these targets to be missed. It is the City's intent to keep a minimum 8 foot pedestrian access through the project area at all times. However, some periods of closure to storefront access points will be inevitable as vault work, utility connections and repaving activities have to take place. We are working to eliminate, minimize or at least plan such closures to have minimal impact on the businesses and pedestrians. Other phasing plans were considered but were felt to have a larger detrimental impact to the entire downtown community. For example, the City could close the entire two block stretch for the full project duration and likely complete the project sooner. However, that would necessitate the closure of Dubuque Street at Iowa. Similarly, the project could be broken up over two years (one block at a time), but that approach will likely lead to higher costs and extend disruption over two seasons. While there is no doubt this project will be incredibly disruptive in 2016. Staff feels we have developed a strong phasing plan that best serves the community. We also believe the improvements will provide great benefit to the City for many years to come and will help create an enhanced space for the public to enjoy and for businesses to prosper. Financial Impact: The proposed Capital Improvement Plan (CIP) includes $5,282,000 for the completion of this project. The Current engineer's estimate is $5,275,000. This includes two project alternates valued at $150,000, and $382,000 that the City estimates it will be reimbursed by property owners for vault related work. Staff is recommending that we utilize an incentive / disincentive approach in order to facilitate timely completion of the project. This includes a $1,000 per day incentive for opening the west block prior to July 23`d and a similar disincentive for closures of this block past July 23`d. An incentive / disincentive of $3,000 per day on the east block is being proposed around the reopening date of September 30'h. The maximum incentive for those targets is $10,000 and $45,000, respectively. December 28, 2015 Page 3 Recommendation: am recommending that on January 5th, the City Council set a January 19th public hearing on the plans and specifications for the Washington Street reconstruction project. On January 19th, the City Council will be presented with a more detailed overview of the project. The area shown on the concept plan will require additional rezoning and subdivision approvals and is subject to change. Approval of Cardinal Pointe West — Part 1 does not include approval of the concept plan. This and the surrounding areas were annexed into the city between 1969 and 1972. Since 1983 the area has been zone Interim Development — Research Park (ID -RP) to reflect possible development of an office park along Highway 218. In May 2002, -the City Council signed a Memorandum of Understanding with the City of Coralville and Southgate Development Services, LLC to agree upon a concept that envisioned a "conservation -type" development including residential and commercial uses in the area surrounding Camp Cardinal Boulevard. The master plan also laid out the financial participation of the cities and Southgate for the reconstruction, realignment and extension of existing infrastructure including the construction of Camp Cardinal Boulevard to facilitate the development. Good Neighbor Policy: The application indicates that the applicant plans to follow the Good Neighbor Policy, but no details have been submitted. ANALYSIS: Current Zoning: Based on the previous Comprehensive Plan, the area is currently zoned as -Interim Development - Research Park (ID -RP). The text of the 1997 Comprehensive Plan, however, recognized that with the establishment of Oakdale Campus north of Interstate 80, the possibility of additional development of office and research park type uses in this area may not be realistic. The Plan also recognized the topographical and infrastructural limitations of the area, and therefore, supported the development with a mix of uses, such as low density residential and office commercial uses. The Plan also supported clustered development that would result in pedestrian friendly neighborhoods with minimal disturbance of the sensitive areas. The ID -RP zoning allows only agricultural uses by right so a rezoning is necessary to allow development of this property. Proposed Zoning: The RS -5 zone is primarily intended to provide housing opportunities for individual households. The regulations allow for some flexibility of dwelling types to provide housing opportunities for a variety of household types (duplexes and attached single family on comer lots). This zone also allows for some nonresidential uses that contribute to the livability of residential neighborhoods, such as parks, schools, religious institutions, and daycare facilities. The RS -5 zone allows for single family lots with a minimum lot area of 8,000 square feet, and a minimum lot width of 60 feet. All lots within the proposed subdivision meet the minimum requirements of the RS -5 zone. Comprehensive Plan: This property is located within the Northwest Planning District. The current Comprehensive Plan identifies this area as suitable for "Conservation Design" and refers to the Clear Creek Master Plan (a more detailed district plan has not been prepared for the Northwest District). The Clear Creek Master Plan lays out a general development concept with possible street layouts, and shows areas for residential, commercial and office development. In staffs view the requested rezoning and subdivision design conforms with the conservation design envisioned in the Comprehensive Plan for this area. 3 Subdivision/Planned Development Design: The applicant is proposing a residential development with a mix of typical RS -5 lots (approximately 9,000 to 12,000 square feet) and larger lots (approximately 13,000 to 20,000 square feet) Following the principles of the master plan, the subdivision has been designed to minimize the impact on the sensitive areas that exist on the land. As shown on the concept plan development is being clustered away from the wooded slopes. Although woodland clearing is being proposed for the extension of Kennedy Parkway, to allow grading to create the single family lots and to provide for a stormwater management basin on Outlot D, when considering the overall subdivision (lot 1-31 and Outlot D together) over 50% of the woodlands will be preserved. The subdivision code requires that block lengths range from 300 feet to 600 feet. Longer block lengths may be considered where topographic conditions, water features or existing development prevent shorter block lengths, although midblock pedestrian connections may be required. To avoid disturbing ravines located to the west and east, Ava Circle is designed as a loop street that will exceed the 600 maximum block length. A pedestrian access is being provided between lots 11 and 12 and along the south side of lot 5, to connect Ava Circle with Preston Lane. In staffs view the proposed design helps to minimize the disturbance of the wooded ravines located on the property and complies with the Comprehensive Plan's emphasis on conservation design for this area. Environmentally Sensitive Areas: The property contains steep and critical slopes and woodlands. The Sensitive Areas Site Plan indicates that approximately 46% of the woodlands will be removed and approximately 40°x6 of the steep slopes and 11 % of the critical slopes will be graded to allow the extension of Kennedy Parkway, grading residential lots and stormwater management. The disturbance is less than 35% of the critical slopes and 50% of the woodlands and therefore does not require Planning and Zoning review. Traffic implications and pedestrian facilities: Kennedy Parkway, a collector street, will be extended from its current terminus at Preston Lane (Vintage Parkway to the north in Coralville) to provide two access points to Ava Circle. In the future Kennedy Parkway will extend father to the west to intersect with the future Highway 965. Preston Lane will extend south from Kennedy Parkway to provide access to lots 1 to 8. The concept plan shows that in the future Preston Lane will extend further to the south and intersect with Kennedy Parkway. These streets will be adequate to serve the 31 single family dwellings proposed at this time. To provide a pedestrian connection to this development the preliminary plat notes that a sidewalk will be constructed (outside of this subdivision) along the south side of Kennedy Parkway to connect with Camp Cardinal Boulevard. Curb ramps will also need to be provided at the intersection of Kennedy Parkway and Camp Cardinal Boulevard. Neighborhood parkland: A subdivision of this size is required to dedicate .38 acres of neighborhood open space or pay fees in lieu of. The Parks and Recreation Department has indicated that fees should be collected in lieu of dedication of land. This requirement will need to be addressed in the legal papers at time of final plat approval. Storm water management: A stormwater management basin will be provided in Outlot D. The City Engineer has requested corrections and clarifications to the stormwater management plan. Staff is working with the applicant's engineer to resolve these concerns prior to the October 15 Planning and Zoning Commission meeting. Infrastructure fees: This subdivision is subject to the water main extension fee for $435 per acre and sanitary sewer tap on fee of $570.98 per acre. Payment towards the cost of constructing Camp Cardinal Boulevard will also need to be addressed at the time of final plat 4 approval. STAFF RECOMMENDATION: Staff recommends deferral of this application pending resolution of deficiencies and discrepancies noted below. DEFICIENCIES AND DISCREPANCIES: 1. There will need to be an easement to convey storm water from Preston lane to the detention basin and Outlot A and Outlot B should have easements for drainage and easements to cover the storm sewer or be blanket easements for drainage and storm sewer. 2. There needs to be a drainage swale or some other way to convey the storm water from the storm sewer outlet in Outlot B to the detention basin. There also appears to be a gap in the plans where the entire 30' storm water drainage easement between Outlot B and the detention basin is not shown. 3. The proposed drain tile in the detention basin should be extended north so that it is under all the 8' wide bottom area that is at a 1 % slope. 4. If the detention basin is filled with water, it would be hard to gain access to around the detention basin since the sides of the basin are not proposed to be cleared and graded. What would you propose as the best way to gain access if there was a problem and emergency maintenance was required and the detention basin was full? 5. The water lines should be designed to create a loop system for serving the property west of lots 18 to 22. 6. There will need to be easements for the off-site sanitary sewer and a plan is needed for the proposed off-site sanitary sewer alignment back to the where it connect to the existing sewer system. 7. The sanitary sewer and storm sewer in Ava Circle are very close and cross in multiple locations. The application is for the northern portion of the area, however if approved this evening, Preston Lane will continue to the south to connect to Camp Cardinal Boulevard, and the potential for of single-family, townhouse and mufti -family development to the south of the current proposal. Mlklo pointed out the concept plan for future phases, showing Preston Lane extending to the south and the possibility of multifamily or townhouses being clustered to transfer development away from the wooded ravines. The application is to rezone the property to RS -5 which Staff has determined does comply with the Comprehensive Plan. The plan is to do a residential subdivision with a loop street, Ava Circle and'a north/south street, Preston Lane. Parsons asked why the street was named Preston Lane to the left of Kennedy Parkway and Vintage Boulevard to the right. Miklo replied that area to the north of Kennedy Parkway is in Coralville where the street is named Vintage Drive. The street south of Kennedy Parkway will intersect with Preston Drive farther to the south in Iowa City. So to keep it consistent, the Iowa City portion of the street between Kennedy Parkway and Camp Cardinal Boulevard will be named Preston Lane. In this stage there will be some grading and tree clearing in the back of the RS -5 lots and some grading and tree clearing to allow for the stormwater management basin. But even with the grading and tree clearings, it is below the threshold for the sensitive area rezonings with less than 50% of the woodlands and less than 35% of the critical slopes on the site. The City Engineer has reviewed and is satisfied with the stormwater management plan and it will drain into a detention basin. Hench asked if there would be any connections to the existing Deer Creek Road. Miklo stated that Deer Creek Road runs parallel to Highway 218 and there will not be any connections to that road. There is a possibility Deer Creek Road may be vacated in the future. Miklo pointed out that the future alignment of Highway 965 is just to the west, but there are no plans to build it in the near-term. Parsons assumed that the quarry to the north will not be going away anytime soon. Miklo agreed and indicated that the quarry is not within Iowa City's jurisdiction. Hensch asked if the water structure to the south was connected to this development. Miklo said that was designed when Camp Cardinal Boulevard was built and it may have some capacity for this subdivision but the City Engineer determinedd the current proposal must provide its own stormwater management. Eastham asked if consideration was made to go ahead with the rezoning for the entire area so that it would clearly state future development in the area would be townhomes and multi -family. He said that it is close the elementary school. Miklo said the applicant only requested this parcel, they are responding to the market at this time. He said the concept plan shows the intention for the remainder of the property include multifamily and townhouses. He noted that there will need to be some changes to the concept plan to meet code requirements. Miklo noted that with this development the sidewalk will be constructed (outside of this subdivision) along the south side of Kennedy Parkway to connect with Camp Cardinal Boulevard. Freerks opened the public hearing. Josh Entler (Southgate Companies) addressed the walkability to the elementary school and noted they will install an 8 foot wide trail along the north side of Kennedy Parkway and will install the 5 foot sidewalk along the south side of Kennedy Parkway from Preston Lane to provide access to the elementary school. To address the question of rezoning the whole area: they did not want to commit to a master plan of the whole area and need to see how the market will drive future development. With regards to the stormwater management, the current pond to the south will be Impacted but in a quality and quantity controlled manner. The developments stormwater basin will overflow and drain to the pond and other stream ways in the area, but will be controlled. He explained that the ownership of the pond is broken up into a pond association which means anyone whose water (either through piping or hard surface) drains into the pond is part of the ownership, so it is just not Southgate's responsibility. Entler noted that they will be clearing as few trees as possible, they share a desire to preserve as much of the woodlands as possible. Hench asked what the density of the development will be when fully developed. Entler was not able to say exactly what the final number would be a this time, the plans for the whole area have undergone several revisions. Hensch noted his concern is the number of vehicles and pedestrians all relying on just one entrance onto Camp Cardinal Boulevard, and when might Highway 965 be extended. Entler did not have information on that highway extension. Miklo did point out that when Preston Lane is extended to intersect with Camp Cardinal Boulevard, it will provide two ways in and out of the area. Hensch asked what the price point for the single family dwellings in this development will be. Enstler could only give a guess on what the price point would be and thought maybe in the range of $250,000 to $325,000. Freerks close the public hearing. Hensch just noted his concern about water drainage as that is an ongoing concern with every application the Commission reviews. Theobald noted her concern about diversity of housing and that area is neighborhood after neighborhood of the same. She is concerned that there is not guarantee that there will be a mix of housing in the future phases. She would like to see some mix and sooner rather than later. Eastham agreed and feels future developments in that area will need to include more diverse housing types to meet the Comprehensive Plan and School District diversity goals throughout the community. Martin said there area east of Camp Cardinal Boulevard does have a good mix of houses and thinks they did a good job of providing a range. Miklo showed on the aerial photograph the area along Ryan Court which has a mix of office, single family, townhouses and duplexes. Parsons pointed out that when they first built Camp Cardinal Boulevard development was slow to start but with the construction of the new school there has been some good development in the area. Hensch said a more general concern is that this is on the far edge of the city and is only accessible by car. His hope is that not all developments are dependent on access by cars.
